MINUTES OF THE ADJOURNED MEETING OF OCTOBER 22nd
OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA
October 30, 1968
The adjourned meeting of the City Council of the City of National City was
called to order at 4:30 p.m. by Mayor Morgan. Council members present:
Camacho, Colburn, Hogue, Reid, Morgan. Absent: None.
AD4INISTRATIVE OFFICIALS present: Foster, McLean, Minogue, Osburn, Parks,
Stockman.
CITY ATTORNEY McLEAN read the City Engineer's report of the result of the
opening of sealed bids for the improvement of I, J, L, 20th, 22nd, 24th
Street Assessment District No. 153; three bids were received: T. B. Penick
& Sons was the low bidder in the amount of $74,293.15; Griffith Company's
bid was $87,711.51; V. R. Dennis Construction Company's bid was $97,746.23;
the City Engineer recommended the low bid of T. B. Penick & Sons in the
amount of $74,293.15 be accepted. The City Attorney stated this was also his
recommendation. City Engineer Foster said their estimate was $78,149.27 and
the low bid was 4.93% below their estimate.
RESOLUTION NO. 9691, "RESOLUTION OF AWARD OF CONTRACT ('I', 'J', 'L', 20th,
22nd, 24th Streets, Assessment District No. 153)," was presented. Moved by
Hogue, seconded by Reid, the resolution be read by title. City Clerk Minogue
stated she had the Certificate of Publication and Affidavit of Posting Notice
to Bidders on file. Councilman Colburn inquired if there was a reason for
the urgency in awarding the contract. City Attorney McLean replied the state-
wide ballot carried Sta.t xProposition 9, the effect of which is to place a
limitation on property/levies; the firm of O'Melveny and Myers, municipal
bond specialists, expressed some concern that if Proposition 9 passes, it
might affect 1911 Act bonds; it was their opinion that if an assessment pro-
ceeding had gone so far as awarding the contract prior to November 5th even
though Proposition 9 were approved, that particular project could go ahead;
inquiries have been received from contractors asking if the contract would
be awarded prior to November 5th as they had been told by the bond house they
wouldn't bid the bonds unless this was done. Motion to read the resolution
by title carried by unanimous vote. The title was read. Moved by Hogue,
seconded by Camacho, the resolution be adopted. Councilman Reid inquired if
he should abstain from voting as he has property within the district. City
Attorney McLean said Councilman Reid did not have any legal obligation to
abstain from awarding the contract. Carried by unanimous vote.
CITY MANAGER OSBURN stated a report had been given to each of the councilman
regarding a Citizens' Committee in relation to a workable program; by
appointing these people they would come back with a resolution at the next
Council meeting authorizing these people to appoint ad hoc committees to
study any certain problems or conditions that they wish to study during the
coming year in relation to the workable program; it was his recommendation
th-se people be appointed. Moved by Hogue, seconded by Reid, the City Mana-
ger's recommendation be approved. Upon advice of the City Attorney, the City
Manager read the list of names recommended for the Citizens' Committee as
follows: Lorenz _I; Ruehle, Vice President and Manager of South Bay Savings
and Loan Association of Chula Vista whose residence is 836 Ethel Place,
National City; Melvin Chester, Assistant Manager of Streicher's Shoe Stores,
San Diego, Chairman of Baha'i World Faith, 2915 E. llth Street, National
City, whose residence is 1531 E. 7th Street, National City; John Menard,
Judge, Judicial Court, National City, whose residence is 1041 B Avenue,
National City; Ernest H. Azhocar, half owner of Bay Front Battery Manufactur-
ing Company, 1408 McKinley Avenue, whose residence is 1615 Lanoitan Avenue,
National City; James Bird, Architect and Engineer, Bird, Fujimoto & Fish,
AIA, San Diego, whose residence is 2529 K Avenue, National City. Director of
Planning Stockman stated they would work on a housing element of the General
Plan which is required by the Federal Government, working with development of

t e parks, etc. Motion to approve the City Manager's recommendation carried
b unanimous vote.
T e Mayor's proposed proclamation of "COMMUNITY DEVELOPMENT MONTH" (November,
1.68) was read. Moved by Camacho, seconded by Colburn, the proclamation be
a roved. Carried by unanimous vote.
CE MAYOR HOGUE stated he was disappointed because he wa.s unable to go to
t e 24th Street Terminal opening; he suggested in the future when such plans
w=re made, they try to have them held on Saturdays. Mayor Morgan requested
h be reminded of this when such plans were being made.
Moved by Camacho, seconded by Colburn, the meeting be closed. Carried by
u animous vote. The meeting closed at 4:45 p.m.
