National City, California, August 17, 1965
The regular meeting of the City Council of National City was called to order by
Mayor Gautereaux at 7:30 p.m.
COUNCIL MEMBERS PRESENT: Allen, Colburn, Hogue, Gautereaux, Council Members
absent: Morgan.
ADMINISTRATIVE OFFICIALS PRESENT: Carstens, Deputy City Clerk Cornelius, Foster,
Gautereaux, Senior Account Clerk Olmsted, Osburn, Planning Aide Reeves.
The meeting was opened with salute to tie Flag led by City Manager Osburn,
followed with invocation by the Revernad. Dwight Gladieux, First Christian Church,
MAYOR GAUTEREAUX recognized James C. Bailey, Fire Chief, who has completed 40
years of service with the City of National City. Mr. Bailey was presented with a
award by Mayor Gautereaux.
MOVED BY ALLEN, seconded by Hogue, the minutes of the regular meeting of August
10th be approved with the following additions or corrections; Page 187, Resolution
No. 8985, add "(Appointing representative to San Diego County Water Authority)" after Resolution title; Page 190, last paragraph, fourth line "Mr, Gautereaux"
should be changed to "Director of Housing Gautereaux"; Page 191, first paragraph,
first line, "City Manager Osburn reported" should be changed to "City Manager
Osuurn read a report in regard to "; page 193, fourth paragraph, add opening
sentence: "THE DIRECTOR OP HOUSING'S REPORT for the month ended July 30th was
presented"; Page 193, first paragraph, after the motion on the driveway failed,
it should read "Councilman Colburn left the meeting at this time)"; Paige 194,
first paragraph, change "This was included in the motion and second" to "Moved
by Morgan, seconded by Allen. the Mayor's recommendation be included in the •
motion." Motion carried by unanimous vote. Absent: Morgan.
RESOLUTION NO. , resolution ordering notice of sealed bids and setting bid
opening date (Prospect Street Improvements, Assessment District No. 144), was
presented. Moved by Hogue, seconded by Alien, the reading of the Resolution
be waived and it be adopted by reading of the title only. Carried by unanimous
vote. Absent: Morgan.
RESOLUTION NO. 8986, "RESOLUTION ORDERING NOTICE OF SEALED BIDS AND SETTING BID
OPENING DATE (Prospect Street Improvements, Assessment District No. 144)." Moved
by Allen„ seconded by Hogue, the Resolution be adoptd. Carried, by the following
vote, to -wit: Ayes: Allen, Colburn, Hogue, Gautereaux, Nays: None. Abs<rt,
Morgan.
RESOLUTION NO. , resolution accepting work and authorizing filing notice, of
completion (Improvement of 30th Street Paving, Coolidge Avenue to Railroad),
was presented, City Manager Osburn stated the project has been completed by the
Daley Corporation, inspected by the Engineering Department and recommended the
work be accepted and notice of completion be filed. Moved by Allen, seconded by
Hogue, the City Manager's recommendation be approved and that the reading of the
Resolution be waived and it be adopted by reading of the title only. Carried by
unanimous vote, Absent: Morgan,
RESOLUTION NO, 8987, "RESOLUTION ACCEPTING WORK AND AUTHORIZING FILING NOTICE OF
COMPLETION (Improvement of 30th Street Paving, Coolidge Avenue to Railroad)",
Moved by Allen, seconded by Hogue, the Resolutionte adopted, Carried, by the
following vote, to -wit: Ayes: Allen, Colburn, Hogue, Gautereaux. Nays: None.
Absent: Morgan.
CITY ATTORNEY CARSTENS stated a Superior Court hearing was held this morning in
the case of the City of National City vs Capitol Lands Corporation; the court
granted our request to file an amended complaint which alleges three new causes c•
action in this matter; the defendants, Capitol Lands Corporation and the other
individuals, have fifteen days in which to answer. The City Attorney said the
contents of this amended complaint were derived from information he learned in
depositions.

COUNCILMAN COLBURN reported briefly on his trap to Washington August llth where
he represented the Mayor; the Conference was opened with the Vice President's
remarks as to why the meeting was being held; the meetings are being held because
there is a large gap between citizens and the Federal government; where citizens
come in contact daily with City government and seldom with Federal Government;
also, communication with City government and Federal government regarding Federal
subsidized grants. Councilman Colburn stated these meetings are going to be
very Tseful in the future; that the Department of Urban Affairs had created a
new cabinet post as of the loth of this month and all of the Urban renewal proj-
ects that we know of are probably outdated and will be updated with the informs"•
tion brought back from the Conference. Councilman Colburn stated the Vice Presi-
dent encouraged that any forms normally filled out and sent back include a letter
explaining the City's personal problem and that he was slightly upset over the
encouragement for cities to participate in Federal aid programs. Councilman
Colburn said all of the information brought back was turned over to the City
Manager to be distributed to the proper Department Heads. Mayor Gautereaux
thanked Councilman Colburn for representing him at the Conference and he asked
questions regarding housing, Councilman Colburn stated it was indicated in the
new ccncept of urban renewal or government subsidies to the unemployed or low
income bracket the trend was not to build new developments and wipe out the
blighted areas; it was to relocate these people into a variety of areas not con-
centrated in one new development; the idea was to get the people out of urban
areas, encourage them to get into homes; the program is a subsidy; they estimate
that 25% of a person's income should go for home rental and if 25% would not put
them in a decent home, then the: government could subsidize this portion until
their income increased and they could also have an opportunity to lease with an
option to buy which would encourage them to improve their property. Councilman
Colburn..said he asked, with these things in mind, if these things were possible
and if this was the goal of the Federal government, would it be possible the
Navy or the other services would soon be out of the apartment rental business,
such as the Bayview housing east of the National City city limits. Councilman
Colburn stated it was his opinion this has nothing to do with the City of Nationa!
City but it is a concern of ours, Councilman Colburn said it was asked if the
Navy would get out of this type of business and turn it over to private enter-
prise to create better living conditions, a more diversified living area; the
answer was they had no intention of going into that field.
VICE MAYOR ALLEN reported that afeieed, Jack Reed, who had just reterned from a
fishing trip in the northern part of the state, informed the Vice Mayor he was
very much surprised to see on the television screen, at the Lodge where he stayed.r
the newscaster advertising National City as the team that just won the series of
gamed played in Fullerton, that they were heading for Santa Clara and that Nationa
City was going to have the Little World Series in National City August 26th, Vies
Mayor Alien said this is soya igf interest to everyone to know that not only
*sere but this is being passed on almost everywhere. Mayor Gautereaux stated the
National City Pony League Team, having just won this peat tournament, which was
the regional tournament, is certainly to be congratulated and it looks as though
there is a very good chance as they go into the Santa Clara tournament, which :is
tie divisional tournament representing all of the Western st ates, if they are =
successful, they will be horse here in National City representing the western part
of the United States in the world Series Pony League here, Mayor Gautcrcemx cadd

Mayor stated it would be impossible for him to attend the Saute Clara tournament
and asked permission of the Council to have Councilman Morgan and Mr. B,J,
Gautereaux represent him and the Council as official delegates of the City of
National City at Santa Clara; with the Council's permission and the approval of
the City Manager, he would so delegate Councilman Morgan and Mr, B,J. Gautereaux
to represent us at Santa Clara, Moved by Allen, seconded ny Hogue, the Mayor's
recommendation be approved. Carried by unanimous vote. Absent: Morgan.
THE HEARING ON THE RL{SOLUTION GIVING NOTICE OF INTENTION to vacate and close
portions of 'W' Avenue from 8th to 9th Streets was held at this time, Senior.
A6et,Clerk Olmsted reported one protest was received from Mrs. Flora Knight, 1431
"L" Avenue. C.R, Ball, 1127 "A" Avenue, was present and submitted a check for
$50,00 from the First Assembly of God Church to cover legal advertising and
printing in this matter, E.H. Alsdorf, 2105 "J" Avenue, was present and stated

as far as the city is concerned more money would be spent on the first flood in
that area than would be gained from any taxes, and that he was still against the
closing of any street in National City, Moved by Allen, seconded by Colburn, the
hearing be closed, Planning Aide Reeves read the Planning Commission's recom-
mendation of July 12th that the Westerly half of "M" Avenue between 8th and 9th
Street be vacated subject to certain conditions. Vice Mayor Alien stated he did
not approve of closing the street; he knew the drainage problem. and what ef.11
happen if this street is closed. Moved by Allen, seconded by Hogue, we reverse
the recommendation of the Planning Commission and leave this street open,
Councilman Colburn said this is only half a street; there is a building on the
other half and it could never be a through ttreet and as far as the drainage is
concerned, the Planning Commission's recommendation was that proper drainage
would be necessary, Mayor Gautereaux stated the drainage has been accomplished;
the street couldn't be closed; it is not a safe travel way and he didn't see
any value in the street being left open. Councilman Hogue stated this street
is in the area of the shopping center and there might be high level apartments
built in the area or the shopping area way increase in size and because of the
nearness to the shopping area at the pr.:sent time we do not know enough about
future developments there to be closing the street, Councilman Colburn asked if
there was a map available to observe the buildings where "M" Avenue would go
through if it was open. Vice Mayor Alien stated "N" Avenue could possibly go
all the way through; it depends on whether the Plaza wishes to go in there or we
want to condemn the land to go through. Mayor Gautereaux stated he would support
the closing of the street providing there was some concrete plan for improving
"N" Avenue, opening "N" Avenue through, but until such time as we are guaranteed
that "N" Avenue will be put to grade and we control the property giving access
to functional type traffic, both vehicular and foot, he would not consider the
closing of "M" Avenue. The Mayor stated if there was a concrete proposal on
"N" Avenue, he would be in favor of closing this half street and at this point
he would support the motion, Councilman Colburn asked if it would be proper
to have the City Manager call a meeting with the property owners involved to
see if the church might be able to encourage the Plaza to dedicate "N" Avenue.
Mayor Gautereaux skid such a meeting would be very much in order, Motion
carried by the following vote, to -wit: Ayes: Allen, Colburn, Hogue, Gautereaux
Nays: None, Absent: Morgan. Mayor Gautereaux stated the street will not be
vacated and the planning Commission's recommendation will be overruled. Moved
by Allen, seconded by Hogue, Mr. colburn's suggestion for a meeting of the City
Manager with the property owners involved be considered to see if it could be
worked out, Carried by unanimous vote, Absent: Morgan.

COUNCILMAN COLBURN stated his daughter, Teel Sue, was present and wearing the
uniform of the Pom Pom Corps for the Pop Warner Football Team,
CITY MANAGER OSBURN reported receipt of a letter from John W, Kirby, 115 East
18th Street, questioning a decision to allow a residential unit to be built in
an industrial area on West 9th Street in the vicinity of the end of 9th Street,
and requesting legal opinion as to whether or not the decision to allow this
building is in compliance with the Ordinance, Moved by Allan, seconded by Colbur.

this matter be referred to the City Attorney for a report.. Carried by unanimous
vote. Absent: Morgan.,
CITY MANAGER CS3URN prevenbed a map showing the areas requiring street improvemner,4
in regard to a 1911 Act Improvement for Coolidge Avenue, 24th Street South, and
another map indicating where sewer, drainage, and rights -of -way were required.
City Manager Osburn said he would like to get the people interested in this 1911
Act and suggested a meeting be called of the people owning property in the
area so there would be agreement on the necessary improvements„ Moved by Alien,
seconded by Hogue, the recommendation of the City Manager be approved and that
he be instructed to continue with this 1911 Act until we get some kind of an
answer. Mayor Gautereaux asked what the possibility of adding Hoover Avenue
from 24th Street through to what would be 25th to this 1911 Act and obtaining
the cooperation of those property owners in order to have a full circulation
in that area, City Manager Osburn stated there was a good possibility. Motion

A COMMUNICATION FROM SENATOR THOMAS H, KUCHEL in regard to established policy
relative to the expansion of the Fort Rosecrans National Cemetery was presented.
Vice Mayor Alien asked that the communication be read, The letter was read by
Senior Account Clerk Olmsted, Ordered filed by unanimous vote, Absent: Morgan.,

A COMMUNICATION FROM THE METROPOLITAN WATER DISTRICT of Southern California
relative to the controversy between California and Arizona over the Colorado
River was presented, Moved by Alien, seconded by Colburn, the mattes be referred
to the City Attorney and if the City can_be adjusted to it, the request for a
resolution be granted, Mayor Gautereaux stated it was extremly important we
adopt such a resolution supporting their position in the forthcoming hearings,
Moved by Hogue, seconded by Alien, the last motion be amended and we adopt
a resolution favoring this project and forward the resolution to the Metropolitan
Water District. Carried by unanimous vote, Absent: Morgan.
AN APPLICATION FOR PERSON TO PERSON TRANSFER OF AN ON -SALE BEER license by Elmer
A. and Jaunetha J, Lazin, dba Al's Cafe, 2100 National Avenue, was presented.
Moved by Allen , seconded by Colburn, the application be filed, Councilman
Hogue said the last paragraph of the communication from the Acting Chief of
Police states their investigation reveals an acquisition to revoke Mr„ Lazin's
present -on. -sale beer license is being personally filed immediately by the
Alcoholic Beverage Control Office, and Councilman Hogue suggested the application
be left alone. Mayor Gautereaux asked if there was any reason why the acquisitio:
to revoke this license is being filed at this time, Moved by Hogue, seconded
by Gautereaux, the item,be tabled until we receive? information from the Chief
of Police as to why this license is being challenged. Vice Mayor Alien stated
he felt they were getting out of their field, Motion to table this item
failed by the following vote, to -wit: Ayes: Hogue, Gautereaux. Nays: Allen,
Colburn, Absent: Morgan. Moved bb Allen, seconded by Gautereauxs this item
-be placed on the.,Ac enda for next week. Motion amended by Hogue, seconded by
Gautereaux, we have a report from the cajef of Police as to why this license
is being challenged,
Mayor Gautereaux stated, as he recalled, this involved an arrest of a person
on suspicion of possession of narcotics or something to that extent; there was
a criminal action and, if this was the case, he personally would be in a position
to see that this type of license is not issued. Councilman Hogue stated he felt
this party is putting this license in another title so he can hang onto it,
Councilman Colburn stated the action of the Council to file this application has
no bearing on the case; we have no valid reason for questioning matters of the
ABC; they can close an establishment without our permission, Mayor Gautereaux
stated we do have ,the right and if the Alcoholic Beverage Control is going to
revoke a license under mitigating circumstances and it involves morals or
any other type of illicit activity, we have the right to protest it and support
the revocation of the ABC and, even if ABC does not revoke the license and we
still feel we ought to protest it, we have that right. Mayor Gautereaux stated

it was incumbent upon the Council to re',iew Such matters and to know the reason
they are considering this revocation* E,H, Aledorf, 2105 ,ran Avenues, was
present and stated he thought the Governor had signed a Bill doing away with
the field authority of the ABC and giving the authority back to us as a city
where we may object to any license that is applied for, Amended motion carried
by the following vote, to -wit: Ayes: Allen, Colburn, Hogue, Gautereaux. Nays:
None, Absent: Morgan,
A COMMUNICATION FROM THE U.S. ARMY ENGINEER DISTRICT, LosAngeles, relative to
application for a permit to dredge an entrance channel, construct two stone
jetties, and an offshore breakwater at San Elijo Lagoon, midway between Cardiff -
By -The -Sea and Salona Beach, was prsented. Ordered filed by unanimeu vote,
Absent: Morgan.
THE MINUTES OF THE PARK AND RECREATION ADVISORY BOARD'S meeting of August 4th
were presented. Moved by Alien, seconded by Hogue, the City Manager investigate
and determine the cost for the 3-day AAU meeting at the National City Pool,
Mayor Gautereaux stated he hoped in view of the facilities we have and the
efforts being made in the area of competitive swimming, an area that peoperly
promoted and capiteeleed upon could do as much as any other major activity in
the commun.ty in perpetuating the image of our City, the Council would adopt
the policy of giving full seeeeet_ to any AAU activities competitivewise,
that could be promoted and we go into an all out program of supporting the
efforts of our Recreation Department, Moved by Colburn„ seconded by Allen,

A COMMUNICATION FROM THE SANTA SOPHIA CHURCH, SPRING VALLEY, requesting permiss-
ion for their Altar Society to hold a rummage sale August 26, 27, and 28, at 659
National Avenue, was presented. City Manager Osburn stated this is a local
church or practically local it is in Spring Valley, Moved by Hogue, seconded
by Allen, the City Manager's recommendation be approved. ;.arried, by the follow-
ing vote, to -wit: Ayes: Alien, Colburn, Hogue, Gautereaux, Nays: None.

A COMMUNICATION from City Manager Osburn relative to participation by the City
of Natinni1 City in the fall Neighborhood Youth Program starting October 1st

CITY MANAGER OSBURN stated he was requested to check into the driveway situation
on Mrs, Cusack's property; he was still working on it, The City Manager read
a letter from Councilman Morgan who stated he was concerned about the interest
in Mi:s. Cusack's property and hoped the Council would see fit to work out
something as she needs a way in for doctors, nurses, Jcin her late years of life;
that she is now 81 years of age and has ueed this entry to her property for
some 40 years,
CITY MANAGER OSBURN reported receipt of a request from the Dunphy Construct-
ion Company for an overwidth driveway on 30th Street and Harding Avenue; they
are requesting 120' on Harding and 95' on 30th Street to accommodate trucking
concern* City Manager Osburn stated a map will be available before :he next

CITY MAP'.AGSR OSITJPN reported receipt of the niautes of the San Diego County
Water Authority's regular meeting of July St i, Moved by Allen,, seconded by
Colburn, the minutes be fixed with the City Manayee, Carried by unanimous

CITY MANAGER OSEURN stated in regard to the request presented last week for an
inspection of Granger Hall the Altrusa Club advised a previous inspection showed
Granger Hall to be safe for compliance with Fire Department requirements, and
withdrew their request of August 3rd for an inspection. Moved by Allen, second-
ed by Colburn,, Vas letter be accepted with thanks. Carried by unanimous vote.

CITY MANAGER OSBURN stated a contract was redrawn with Koebig and Koebig re1.ati.ne
to our Federal drainage project planning and recommended it be referred to the
City Attorney and if approved by the City Attorney, a resolution be presented
next week. Moved by Allen, seconded by Hogue, the City Manaier's recommendation
be approved. Carried by unanimous vote. Absent: Morgan,
SENIOR ACCOUNT CLERK OLMSTED reported the Annual ;Street Report to the State
Controller had been completed and copies filed with the State Controller and
the State Division of Highways,
CITY ENGINEER FOSTER reported the two 1911 Act jobs on Euclid Avenue, from 4th
to 8th and 8th to Plaza Boulevard; are substantially complete and the Engineerine;
Department is in the process of getting the final estimates ready; the 16tft
Street job from Lanoitan to Harbison Avenue Is eeteing underway,
THE CITY TREASURER'S REPORT for the month of July was presented, Moved by Allenr
seconded by Colburn, the report be accepted* Carried by unanimous vote. Absent
Morgan,
MAYOR GAUTSREAUX informed City Attorney Carstens that during the City Attorney's
abnew) laat week there • as an item before the Council of a driveway for Mrs.
Laubmayer at the covxier of 8th Street and "K" Avenue; it was reported that
because of the 1911 Act the Engineering Department changed the radius on the
street, thereby placing the exist±r9 position of the driveway differently in
respect to the radius; it was reported it was impossible to give this driveway
and recommended against giving her the driveway she requested at the location
of the existing driveway as it would be violating the City Ordinance, Mayor
Gautereaux asked the City Attorney for .a .reprt The Mayor stated this property
owner has done nothing to her property; she is in the position of having existed
fye the number of years that she has occupied this property and, in his opinion,
has done nothing to break the Ordinance of the City. Mayor Gautereaux
stated he would like a ruling on whether o:• not this person in effect did
violate the City Ordinance by the action the Council took relative to this
project being accomplished as it has been, if it actually put her in a position
of violating the Ordinance. The Mayor stated this is one situation and the firet
tin since he had been in office that he had seen the City run roughshod over
a citizen .of our community,
