National City, California, November 26, 1963
Regular meeting of the City Council was called to order at 7:30 p.m.
by Mayor Gautereaux. Council members present: Allen, Colburn, Hart,
Morgan, Gautereaux. Council members absent: None.
ADMINISTRATIVE OFFICIALS present: Cagle, Carstens, Foster, Gautereaux,
Hergert, Osburn, Stockman, Stratton.
The meeting was opened with salute to the flag by City Manager Hess,
followed with invocation by the Rev. Harrison Thompson, First Methodist
Church.
MAYOR GAUTEREAUX spoke briefly on the death of President Kennedy and
stated programs which he instituted will live on.
MAYOR GAUTEREAUX presented the first MYRA (Municipal Youth Recognition
Award) awards to Thelma Camacho who represented California in the Miss
Teen Ager Contest and was second runner up in the United States, and is
Vice President of the sophomore class at Sweetwater Union High School;
and to Marjorie Kim, a junior at the same school who has had an entry
submitted to the Freedom Foundations Awards.
MAYOR GAUTEREAUX presented a certificate to Police Chief Cagle in
recognition of his completion of training at the F.B.I. Academy in
Washington, D. C.
MAYOR GAUTEREAUX presented a certificate and a key to the City to
Albert G. Felling, Captain, U.S.N., Commander U. S. Naval Station, San
Diego, for his participation in the development of harmonious rela-
tionship between the U.S. Naval Station and the community. Captain
Felling spoke briefly on National City's tribute to the Navy: Salute
to Navy Week.
Moved by Colburn, seconded by Allen, the minutes of the regular meeting
of November 19, 1963, be approved. Carried by unanimous vote.
Resolution No. , resolution giving notice of proposed annexation
to the City of National City of uninhabited territory described herein
and designated ''Wright Annexation" and giving notice of time and place
for hearing of protests thereto, was presented. Moved by Allen, sec-
onded by Colburn, the reading of the resolution be waived and the
resolution be adopted by reading of the title only. Carried, by the
following vote to -wit: Ayes: Allen, Colburn, Hart, Morgan, Gautereaux.
Nays: None,
RESOLUTION NO. 8516,. "RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION
TO THE CITY OF NATIONAL CITY OF UNINHABITED TERRITORY DESCRIBED HEREIN
AND DESIGNATED 'WRIGHT ANNEXATION' AND GIVING NOTICE OF TIME AND PLACE
FOR HEARING OF PROTESTS THERETO". Moved by Morgan, seconded by Allen,

the Resolution be adopted. Carried, by the following vote to -wit: Ayes:
Allen, Colburn, Hart, Morgan, Gautereaux. Nays: None.
Ordinance No. , "an ordinance amending Ordinance No. 1067, incorpor-
ating amendments to San Diego County Ordinance No. 3443", was presented
for the first reading and read in full.
Ordinance No. , "an ordinance amending Ordinance No. 743 to provide
for the care, restitution, sale or destruction of unclaimed property in
possession of Police Department of the City of National City", was pre-
sented for the first reading and read in full.
CITY ATTORNEY CARSTENS stated the next two ordinances to be presented
for the second reading pertain to annexations of uninhabited territories
known as the "Wise" and "'Conner" annexations. Moved by Allen, seconded
by Colburn, the reading of the ordinances be waived and they be adopted
by reading of the title only. Carried, by the following vote to -wit:
Ayes: Allen, Colburn, Hart, Morgan, Gautereaux. Nays: None.
ORDINANCE NO. 1079, "AN ORDINANCE A PROVING THE ANNEXATION OF CERTAIN
UNINHABITED TERRITORY DESIGNATED 'WISE ANNEXATION' TO THE CITY OF
NATIONAL CITY". Moved by Allen, seconded by Morgan, the Ordinance be
adopted. Carried, by the following vote to -wit: Ayes: Allen, Colburn,
Hart, Morgan, Gautereaux. Nays: None.
ORDINANCE NO. 1080, "AN ORDINANCE AT ROVING THE ANNEXATION OF CERTAIN
UNINHABITED TERRITORY DESIGNATED 'CONNER ANNEXATION' TO THE CITY OF
NATIONAL CITY". Moved by Hart, seconded by Alien, the Ordinance be
adopted. Carried by the following vote to -wit: Ayes: Allen, Colburn,
Hart, Morgan, Gautereaux. Nays: None.
Ordinance No. , "an ordinance amending Ordinance No. 962, Zoning
Ordinance of the City of National City, California" was presented for
the second reading. Moved by Colburn, seconded by Allen, the reading
of the ordinance be waived and it be adopted by reading of the title
only. Carried, by the following vote to -wit: Ayes: Allen, Colburn,
Hart, Morgan, Gautereaux. Nays: None.
ORDINANCE NO. 1081, "AN ORDINANCE AMENDING ORDINANCE NO. 962, ZONING
ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA (Between 30th and
32nd Streets and "D" Avenue and location of what would be southerly
extension of "E" Avenue)". Moved by Colburn, seconded by Alien, the
ordinance be adopted. Carried, by the following vote to -wit: Ayes:
Allen, Colburn, Hart, Morgan, Gautereaux. Nays: None.
HEARING ON PROSPECT STREET ANNEXATION was held at this time. City Clerk
Stratton stated there were no written protests and asked if anyone was
present in this regard. Thomas A. Stollenwerk, 4995 Auburn Drive, San
Diego 5, was present and stated his protest. Director of Planning Stock-
man stated it was not a majority protest. Moved by Allen, seconded by
Colburn, as no one else approached the microphone, the hearing be closed
and the procedure of the annexation be referred to the City Attorney.
Carried by unanimous vote.

HEARING ON SWEETWATER ROAD ANNEXATION was held at this time. City Clerk
Stratton stated there were no written protests. There was no one pres-
ent in this regard. Moved by Morgan, seconded by Allen, as no one
approached the mike, the hearing be closed and the annexation be refer-
red to the City Attorney. Carried by unanimous vote.
HEARING ON 24TH STREET ANNEXATION was held at this time. City Clerk
Stratton stated there were no written protests. There was no one ?res-
ent in this regard. Moved by Morgan, seconded by Hart, as no one
approached the mike, the hearing be closed and the annexation referred
to the City Attorney. Carried by unanimous vote.
Moved by Allen, seconded by Hart, the reading of the resolution finding
a majority protest has not been made in regard to the three annexations
be waived and they be adopted by reading of the title only. Carried, by
the following vote to -wit: Ayes: Allen, Colburn, Hart, Morgan, Gautereau:
Nays: None. Councilman Morgan inquired if all three resolutions could
be adopted by a single vote. City Attorney Carstens said it is legal to
adopt more than one Resolution with a single vote.
RFSOLUTION NO. 8517, "FINDING AND DETERMINYNG THAT A MAJORITY PROTEST
HAS NOT BEEN MADE (PROSPECT STREET ANNEXATION)".
RESOLUTION NO. 8518, "FINDING AND DETERMINING THAT A MAJORITY PROTEST
HAS NOT BEEN MADE (SWEETWATER ROAD ANNEXATION)".
RESOLUTION NO. 8519, "FINDING AND DETERMINING THAT A MAJORITY PROTEST
HAS NOT BEEN MADE (24TH STREET ANNEXATION)".
Moved by Morgan, seconded by Colburn, the Resolutions be adopted. Car-
ried, by the following vote to -wit: Ayes: Allen, Colburn, Hart, Morgan,
Gautereaux. Nays: None.
CITY ATTORNEY CARSTENS reported the federal tax exemption certificate
referred to him by the Council last week appears to be a form required
by federal law to be certified by a representative of the City, and
recommended the Council authorize the City Clerk to sign the exemption.
Moved by Allen, seconded by Morgan, the City Attorney's recommendation
be approved. Carried by unanimous vote.
CITY ATTORNEY CARSTENS reported he has reviewed the specifications for
the City's comprehensive insurance policy and feels all necessary cov-
erage is included and recommended going to bid, advertising to be pub-
lished December 5th and December 12th and the bid opening be scheduled
for December 16th at 10:00 a.m.; the contract to be awarded on Decem-
ber 17th. Moved by Allen, seconded by Colburn, the City Attorney's
recommendation be approved. Carried by unanimous vote.
CITY ATTORNEY CARSTENS stated he has reviewed the certificate of insur-
ance for M. Arrieta, and has contacted the carrier in regard to changes.
MRS. ELIZABETH AMES, 1927 Granger Avenue, was present and stated she
had recorded on tape some of the proceedings of the past weekend in

regard to President Kennedy's assassination as a historical gift to
children of the future so they might know what ignorance can do. She
presented the tapes to Mayor Gautereaux for use in the National City
Public Library.
VICE MAYOR ALLEN stated he was sorry what had happened in the United
States but his son was home briefly for the first time in six years.
COUNCILMAN MORGAN stated when the amendment to the health ordinance was
discussed last week there was discussion of having someone from the
County to talk to the Council. City Manager Hess stated this was the
case but in viewing the ordinance it was found it concerned only phy-
sical examination.
COUNCILMAN COLBURN stated the Evening Tribune featured a story about a
National City couple, Guy and Exuma Russell, Valley View Sanitarium and
Rest Home, who celebrated their 70th wedding anniversary. Moved by
Colburn, seconded by Hart, the City Manager write to them on behalf of
the City. Carried by unanimous vote.
COUNCILMAN HART stated Second Avenue is much improved since the scraper
and sweeper cleaned it.
COUNCILMAN COLBURN inquired if a motion is made simultaneously by two
Councilmen, can one be counted as a second. Mayor Gautereaux said the
Chair should identify the maker of the motion and it would then require
a second.
MAYOR GAUrEREAUX stated he had neglected to thank the three judges who
selected the MYRA winners: Lee Chilson, Miss Annetta James, and Father
Rosell.
CITY ENGINEER FOSTER reported in regard to the synchronization of traf-
fic signals on Highland Avenue, stating traffic moving to the south is
heavier than that moving north; at a 25 mph speed it is possible moving
south to make the traffic lights at 4th and loth Streets, possibly
having to stop at the light at Montgomery Ward, and then make the
lights at 16th and lath Street. Other departments have been requested
to notify the Engineering Department if it is necessary for them to
stop at any signal so they may be put back on synchronization. Moved
by Allen, at the earliest possible time when funds are available, signs
stating signals are set for 25 mph be erected. Motion died for lack of
a second. Moved by Gautereaux, seconded by Colburn, the report be
accepted and filed. Carried by unanimous vote.
CITY MANAGER HESS reported in regard to left turns on Highland Avenue
he has received many letters of protest to painting curbs red to allow
refuge lanes from business men who would suffer loss of parking spaces.

City Manager Hess stated each member of the Council was given copies of
the City Engineer's report on feasibility of painted left turn refuge
lanes last week to enable them to study the areas. Moved by Alien, sec-
onded by Hart, the traffic on Highland Avenue between Fourth and Eigh-
teenth Streets be left as it is. Motion carried by the following vote
to -wit: Ayes: Allen, Hart, Morgan. Nays: Colburn, Gautereaux.
Moved by Morgan, seconded by Allen, the letters of protest be filed with
the City Clerk. Carried by unanimous vote.
DIRECTOR OF PLANNING STOCKMAN requested the Resolution ordering the
closing of a portion of Taft Avenue be laid over until all the neces-
sary easements are obtained. Moved by Hart, seconded by Colburn, the
Director of Planning's recommendation be approved and the Resolution be
placed on the agenda when all the easements are received. Carried by
unanimous vote.
CITY ENGINEER FOSTER requested the report on streets on which federal
government has requested the City to file a disclaimer is not complete
and requested it be laid over. Moved by Allen, seconded by Morgan, this
item be taken off the agenda until such time as the City Engineer or
City Attorney make the recommendation. Carried by unanimous vote.
COMMUNICATION from Police Chief Cagle in regard to the F.E.I. National
Academy and recommending another officer be allowed to attend next year
was presented. Moved by Allen, seconded by Colburn, the communication
be accepted and the recommendation be approved. City Manager Hess
stated a copy of the communication was placed in the budget file for
next year. Motion carried by unanimous vote.
COMMUNICATION from Delton Reopelle, Chairman of the Chamber of Commerce's
Committee on Salute to Navy, in thanks for the City's support of the
activities and for financing the event was presented and ordered filed
by unanimous vote.
COMMUNICATION from Ed. T. Maloney in regard to left turn lanes on High-
land Avenue was presented and ordered filed by unanimous vote.
MINUTES of the Civil Service Commission meeting of November 20th were
presented and ordered filed by unanimous vote.
COMMUNICATION from the Civil Service Commission attaching specifications
for Public Works Director, Director of Planning, and City Engineer for
approval was presented. Moved by Allen, seconded by Colburn, the com-
munication be accepted and filed. Carried, by the following vote to -wit:
Ayes: Allen, Colburn, Gautereaux. Nays: Hart, Morgan.
CITY MANAGER HESS reported receipt of a certificate of insurance for
the G-M-U•Corporation covering operation of the golf course and recom-
mended it be filed with the City Clerk. Moved by Morgan, seconded by

Allen, the City Manager's recommendation be approved. Carried by unani-
mous vote.
CITY MANAGER HESS reported the Chamber of Commerce will hold the offi-
cial Christmas Lights ceremoney in front of the Library at 6:00 p.m.
Friday, November 29th.
CITY MANAGER HESS reported five Sweetwater Union High School students
met with him and the Mayor from 3:00 to 5:00 p.m. last Friday and aho*ed
a"deep interest in city government. He will continue to meet with small
groups of students each Friday afternoon and invited any interested
Councilmen to attend.
CITY MANAGER HESS stated he has received a communication from the
H.H.F.A. stating they have completed the audit of the Seventh Street,
Storm Drain and the federal government owes the City $351.12. The City
Manager stated it will be necessary to prepare a resolution indicating
the account isDracl 1nag sed• be recommended monies in the account be trans-
ferred to the 6ansexaa Fund from which it emanated and the City Attorney
be authorized to prepare a resolution. Moved by Morgan, seconded by
Allen, the City Manager's recommendation be approved. Carried by
unanimous vote.
CITY MANAGER HESS stated the Junior Chamber of Commerce is giving a
Thanksgiving Dance for teen agers at the armory and requested use of a
portable stage and
folding chairs. City Manager Hess recommended their request be granted
and they be charged a fee of $1.00 for the use of the chairs. Moved by
Allen, seconded by Hart, the City Manager's recommendation be approved.
Carried, by the following vote to -wit: Ayes: Alien, Colburn, Hart,
Morgan, Gautereaux. Nays: None.
CITY MANAGER HESS stated a notice of sale from the State Division of
Highways for 60,000 yards of fill was received. The City has no need
for fill at this time and the City Manager recommended the notice be
filed with the City Clerk. Ordered filed by unanimous vote.
CITY MANAGER HESS reported the Junior Baton Corps won first place in
competition at Anaheim State Championship for the second year. The
older girls missed first place by two points. The teams are a credit
to the Recreation Department. The City Manager stated on such occa-
sions it is his custom to direct letters of thanks for cooperation and
interest to the parents and sponsors, etc. Moved by Allen, seconded
by Morgan, the City Manager continue to send such letters. Carried by
unanimous vote.
CITY MANAGER HESS reported under the rules of the Comprehensive Clas-
sification Survey, effective December 1st the following employees are
eligible for step increases: Fred Baker, Engineering Dept., to Step D;

Robert Montijo, Park Dept., to Step E; Merrill Stamper, Fire Dept., to
Step E; and Ione Minogue, City Clerk's Dept., to Step E. All step
increases have been approved by their department heads and the •City
Manager recommended the step increases be granted. Moved by Allen,
seconded by Hart, the recommendation be approved. Carried, by the fol-
lowing vote to -wit: Ayes: Allen, Colburn, Hart, Morgan, Gautereaux.
Nays: None.
CITY MANAGER HESS reported in regard to the Navy Fire Fighting School,
because of financial circumstances, there are no immediate plans under
consideration to move to another area.
CITY MANAGER HESS stated in regard to the Drainage Priority Lists pre-
viously given to the Council, they should be returned to him with nota-
tions of changes in priorities so they can be set up in proper order;
three responses have been received. Moved by Allen, seconded by Colburn,
the list be approved as presented. Councilman Morgan stated the Duck
Pond should not be last on the list. Carried, by the following vote
to -wit: Ayes: Allen, Colburn, Hart, Gautereaux. Nays: Morgan.
CITY C'LFRK STRATTON reported receipt of a claim for money damages from
International Metals, Inc. The claim was referred to the City Attorney
and to the insurance carrier and the City Clerk requested ratification
of her action. Moved by Morgan, seconded by Allen, the action be
ratified. Carried by unanimous vote.
CITY CLERK STRATTON presented two communications from the County Boun-
dary Commission: (1) to Mr. and Mrs. George Carstanoff approving the
"Shelby Drive No. 2 Annexation" subject to corrections listed and to
com•Aetion of proposed "Slepko Annexation"; and (2) to Gilbert E. Fritz
approving "Fritz Annexation" subject to corrections listed. Moved by
Alien, seconded by Colburn, they be referred to the Director of Plan-
ning. Carried by unanimous vote.
CITY CLERK STRATTON read a petition received at 3:19 p.m., November 26th,
protesting the decision of the City Council to proceed with the 1911
Act Improvement of 12th Street, "D" Avenue to "E" Avenue, and "E" Ave-
nue from 12th Street northerly and requesting a re -hearing, signed by
C. J. Newsom, Manager, Montgomery Ward and Co., Robert Stein, Mario
Silva, Rt. Rev. Msgr. Thomas Egan for Diocese of San Diego, C. J.
Melillo (the other two owners involved already have written protests
on file), which makes 100% protest. Moved by Allen, seconded by Colburn,
it be referred to the City Attorney for recommendation. Carried, by the
following vote to -wit: Ayes: Alien, Colburn, Hart, Gautereaux. Nays:
Morgan. Moved by Morgan, seconded by Hart, the spending of money for
advertising for bids be held up until we find out and report next week

and the City Attorney draw uo a Resolution to stop the advertising.
Carried, by the following vote to -.wit: Ayes: Colburn, Hart, Morgan.
Nays: Allen, Gautereaux. Moved by Hart, seconded by Morgan, the Reso-
lution be drawn up tonight. City Attorney Carstens stated if the Reso-
lution were adopted tonight we could not verify whether or not we have
a valid 1911 Act. Motion failed to carry by the following vote: Ayes:
