Ayes: Allen, Hollings - CITY ATTORNEY CURRAN reported he recei d. from the escrow holder the grant deed which vests the title in the City to Lots 251 to 321 inclusive and Lots 337 to 347 inclusive of National Award Homes Unit No. 2; also the quitclaim deed from California Water & Telephone Company which returns to the City a portion of the easenert which the National City Development Company granted to the California Water & Telephone Company. Both of the deeds have been recorded, and it was the City Attorney°s recommendation each of them be given a document number and Piled. Approved by unanimous vote, ATTORNEY CURRAN stated at the request of the Chief oPolice relative to the controlling of commercial vehicles on Manchester Avenue, an ordinance was acted upon at the last meeting of the Council, a.nd Chief Cagle has asked the ordinance be changed so rather than ten tons gross weight being the limit for commercial vehicles, the weight limit be reduced to five tons gross limit. In the event the Council is desirous of making the change recommended by the Chief of Police, we should hold up the publi- cation of the ordinance so it can be changed before it is published,. Moved by Hollingsworth, seconded by Morgan, the recommendation of the Chief of Police be approved and the publication of the ordinance be held up until the ordinance is changed. MAYOR HART stated former Mayor Fred Thatcher is in Paradise Valley Hos- pital, Room 371, DOROTHY COVEY, 1911 "B" Avenue, was present, and read a communication stating she found effective anti -communistic and anti -subversive legis- lation is needed in the State of California to protect public parks and buildings from being used by groups advocating the ideology contrary to the American form of Government; and urged the Council of National City to follow the lead of San Diego City Council and endorse proposed initi- ative amendment by Louis Francis, WAYNE REID, Director of Mission of Hope, was present, and asked if he could speak when the report of the Planning Commission is presented. 3/13/62 a qI 1�4oyiili mull. a,9 MAYOR HART stated the report will be presented 1 he could be heard at that time, Moved by Allen, seconded by Morgan, the report presented by Mrs. Covey be referred to the City Attorney for a report on San Diego's ord'.nance and his recommendation as to whether he thinks it is something we should all enter into. The present location of the building is 1701 McKinley Avenue and is to be moved to 301 W. 24th Street, for temporary use as an office, REPORTS FROM THE PLANNING DEPT. AND BUILDING DEFT. were read, recommending the request be granted, subject to certain requirements as set forth in the reports. Moved by Allen, seconded by Reid, the recommendation of the Planning Dept. and the Building Dept. be approved, and Lester G. Street be granted permission to move the building. Carried by unanimous vote. PETITION from property owners on "F" Avenue between 16th Street and 17th Street, was read, requesting the Council initiate proceedings to have the street paved and curbs installed. CITY MANAGER BIRD stated the peti- tion was signed by all of the property owners on the street with the exception of the Sweetwater Union High School District, which neither opposes or supports the petition, and recommended it be referred to the City Engineer for processing, subject to the final action and recommen- dation of the Planning Commission and its concurrence by the City Council. Approved by unanimous vote. COMMUNICATION FROM BERT A. BETTS, State Treasurer, was read, relative to Federal Income Taxation of interest derived from public funds. A resolu- tion from the City Council of National City in opposition to a Federal tax on bonds would impress our National Leaders and Representatives in Congress and would do much to counter any move to impose such a pact. Club, was read, requesting a donation of $200.G be utilized for purchase of twenty-two trophies for the National C .ty Garden Clubs 1962 Flower Show; also the Council help provide publicity for the show. COMMUNICA- TION FROM DON R. NORMAN, Flower Show Chairman, was aead, stating the annual flower show will be held. June 23rd and 24th at Central School and request the City°s continuous €upport as cc-eponeor of this years show. A number of tables from the Community Bldg. will be needed and help in moving school furniture out prior to setting up the show. The assistance will be needed Friday, June 22, 1962. COMMUNICATION FROM ERNESTINE ADAMS was read, requesting the Council not be hasty in tearing down the Olivewood Housing. COMMUNICATION FROM JEANNETTE J. KELLER was read, registering a protest in regard to the Olivewood Housing Project. RESOLUTIDN FROM IV TIONAL CITY CHAMBER OF COM- MERCE was read, commending the City Council and City Manager for the progress made so far in the gradual phasing out program of the public housing. Also the Charberr of Commerce pledges its support to the City Council to get the land on the West side sold or leased and occupied by the proper type of substantial tenants. It was the recommendation of the City Manager the two communications and the resolution be filed. Approved by unanimous vote. COMMUNICATION FROM JOSEPH E. HAV= NER, General Manager, Automobile Club of Southern California, was read, relative to a program for development of county roads and city streets. CITY MANAGER BIRD stated two documents ware enclosed; one which went before the Interim Committee on Highways and the other a proposal relative to the many projections which have been placed before the Council as to the increase in one cent gas tax, the criteria of apportionment, the road deficiencies in the State, and working toward a 1963 legislative program to grant to counties and cities some monies from the State of California to aid cities in taking care of our road deficiencies. CITY MANAGER BIRD reported he received a proposal made by a realtor rela- tive to an agreement for exchange; a manufacturing concern located in National City on Lots 1, 2, and 3, Block Wee National City Plat, South- east corner of 21st Street and Hoover Avenue, Hewitt gyros. Manufacturing Company. They are proposing to exchange the property for one and one- half acres of property in the City owned Behia Vista Industrial Tract. It was the recommendation of the City Manner the matter be referred to the Real Estate Committee, and the Chairman of said Committee call a - meeting to consider the proposal within a very reasonable time. Moved by Morgan, seconded by Reid, the recommendation of the City Manager be approved, and a meeting of the Real Estate Committee be set up for tomor- row at 10:30 e.anc in the Manager as office Carried by unanimous vote. COMMUNICATION FROM CITY MANAGER FLETCHER, CITY OF SAN DIEGO, addressed to City Clerk Alston, was read; acknowledging and thanking her for the com- munication sent to the City Council of San Diego concerning the tax infor mation pamphlet put out with the county tax bills. They were pleased to have the suggestions of the City Council of National City regarding the information to be included in next year's brochure, and will give them consideration. CITY CLERK ALSTON reported she received a resolution from the City of Imperial Beach regarding tax statements© CITY CLERK ALSTON announced the meeting of the County Division of the League of California Cities, Friday evening at the Sands Hotel, Highway 395. COMMUNICATION FROM ASSEMBLYMAN SHERIDAN HEGLAND was read, stating ha requested the Governor to include a special call on civil protection so he could introduce again his own legislation including tax incentives on behalf of fallout shelters The Governor has not yet agreed to such a special call. The communication was ordered filed. 3/13/62 COMMUNICATION FROM ASSEMBLYMAN JI CK SCHRADE was read: than 298 City Clerk Alston for her letters regarding the 1% tag on intra-state telephone receipts, liquor license revenues and the community fallout shelters. The City Council°s opinions are very much appreciated, and he will con- tact the other nembers of the San Diego delegation so they may work together in helping solve these problems. The communication was ordered filed. CITY ENGINEER FOSTER requested he be excused. MAYOR HeRT granted the request, REPORT FROM THE PLANNING COMMISSION was reed, relative to application for zone variance No. 2-20 signed by H. Le and Sylvia Wilson in regard to the property located at the northeast corner of 24th Street and Lanoitan Avenue. Petitioners ire requesting permission to split the property into three parcels; two parcels to maintain a 90 foot frontage upon a dedicated street with the third parcel to maintain a 36.77 foot frontage upon a dedicated street in lieu of the required 50 foot frontage. It eas the recommendation of the Planning Commission the request be granted. Moved by Allen, seconded by Reid, the recommendation of the Planning Commission be approved, and referred to the City Attorney. Car- ried, by the following vote to -wit: Ayes: Allen, Hollingsworth, Reid, Hart, Nays: Morgan, CITY PLANNER STOCKMAN stated the :sage of the property in the 2800 Block on the East side of Highland Avenue was referred to the Planning Commis- sion by the Council at the meeting of March 6th, Mrs. Stockman stated she invited Mr. Reid, the Director of the Mission of Hope to attend the Planning Commission meeting and after listening to Mr. Reid's comments on the usage of the property, it was moved and passed by a three to one vote, the Planning Commission interpret with the information they had, the chapel is strictly for private use of the residents of the property and not open to the public; it would be a chapel rather than a church and it is an allowable use in the area which it is located. WAYNE REID, Direc- tor of Mission of Hope, 2821i Highland Avenue, was present and stated they use the chapel as their place of worship for those persons who are beneficiaries of the Mission of Hope program. Moved by Hollingsworth, seconded by Morgan, the City Clerk write to the Ministerial Association and ask them if they consider thie a chapel or a church. REV. REID stated he felt the motion was entirely out of order. VICE MAYOR HOLLINGSWORTH stated her motion was purely for information only; this is a question of the terminology. REV. REID said he would much rather see it decided in a Court of Law than to ask individuals. FLOYD E. PITTMAN, Pastor of the Highland Avenue Baptist Church, and President of the National City 3/13/62 '�C IFTJ M 9 Ministerial Association; was pesent and stated he= would like for Mr. Reid, and anybody else here with him, to understand the City of National City has never tried to block the churches from having religious services; the ordinance was not for that purpose. The Ministerial Association was taken into consideration with three separate meetings with the Planning Commission before the ordinance was ever voted on; we studied it from every angle and agreed to abide by it and cooperate with the City. The Ministerial Association does not feel the ordinance is out of line; we feel commercial zoned property is valuable taxable property, and the second reason for the ordinance is to better facilitate the parking for churches. The Ministerial Association does not belie' , and does not feel this ordinance is infringing on our rights at all; we are happy to cooperate with the City and live by it. Rev. Pittman said he,;personally does not appreciate Mr. Reid, if his influence has caused it, for the Council to he harassed by the radio yesterday, and he would like Mr. Reid to know this is not the way he is going to get the baking of the National City Ministerial Association. The Ministerial Association does not, ae this time, endorse him or his program. REV. REID stated it is unconsti-yu tional to apply the ordinance to a private chapel, and he feels in delay- ing it and if you refute the Planning Commissions recommendation you are pushing us all into a very controversial issue. MAYOR HART stated it was not a question about the church, or religion, it was a question of being in the proper zone. REV. H. C. ADAMS, 452 - 5th Avenue, Chula Vista, Pas- tor of the Community Church of God, was present and stated he has not known Rev. Reid too long, he met him through their local Ministerial Association. Rev. Adams stated he was invited to speak in Rev. Reid"s chapel to the gentlemen who are in his establishment; and he can testify it is not a church, and he would not like to support another church, other in the than his own, and they have placed the Mission of Hope/budget of their church. Rev. Adams said he hated to see the Mission of Hope leave Chula Vista and did not know all the entailments why it left. We plan to con- tinue our support, because Rev, Adams said he has referred several cases to the Mission of Hope as they were unable to handle them and Rev. Reid was qualified and able to take the referrals. Motion carried by unani- mous vote. MAYOR HART stated it was necessary for him to leave the meeting and asked Vice Mayor Hollingsworth to take the chair© CITY MANAGER BIRD announced there will be a meeting of the Traffic Safety Committee tomorrow at 1:30 p.m. in the Police squad room. ODWCILNMAN MORGAN asked if the matter of the green curb at 10th and National was on the agenda and stated if it was not, it was O.K. to go ahead without it, but would like to see it on the agenda if it was possible to do so.
