City Clerk We the duly elected and qualified Councilmen of the City of National City, California, do hereby consent to the holding of a Special Council Meeting on November 17, 1961, at the hour of 2:00 p.m. o'clock, at the City Hall, City Council Chambers, National City, California, for the purpose of presentation of a resolution regarding the Sewage Disposal Agreement of 1960 and Supplement. Dated this 17th day of November, 1961. i p MAYOR COUNCILMAN 11/17/61 160 National City, California, November 17, 1961 Special meeting of the City Council was called to order by Mayor Hatt at 10:00 a.m. o'clock for the purpose of discussing and taking action upon a necessary resolution to approve the contract between the City of National City and the City of San Diego in reference to the Metro- politan Sewage Disposal System. Council members presents Allen, morgan,. Reid, Hart. Council members absent: Hollingsworth. ADMINISTRATIVE OFFICIALS present: Bird, Poster, Osburn. Moved by Allen, seconded by Morgan, we waive the usual procedure of having salute to the Flag and invocation. Carried by unanimous vote. CITY MANAGER BIRD stated due to the fact Vice Mayor Hollingsworth did not sign the waiver calling the meeting and was not sent or served a written notice, the holding of the meeting :lould not be in conformity with the statutes of the Government Code pertaining to Sixth Class Cities; therefore, no official action can be taken. Moved by Morgan, seconded by Allen, the meeting be adjourned, and a special meeting called for 2:00 p.m., November 17, 1961. Carried by unanimous vote. ATTEST: 111�vt C -741 C xa, - n Cif CIE RK .ze,0420 MAYOR, `CITY OF NATIONAL CITY, CALIFORNIA 11-17-61 161 National City, California, November 17, 1961 Special mueting of the City Council was called to order by Mayor Hart at 2:00 p.m. o'clock for the purpose of discussing and taking action upon a resolution necessary to approve the contract between the City of National City and the City of San Diego in reference to the Metro- politan Sewage Disposal System. Council members present: Allen, Morgan, Reid, Hart. Council members absent: Hollingsworth. ADMINISTRATIVE OFFICIALS present: Bird, Osburn. Moved by Allen, seconded by Morgan, salute to the Flag and invocation to dispensed with for this meeting. Carried by unanimous vote. CITY MANAGER BIRD reported a written notice was served personally on Vice Mayor Hollingsworth, City Council member at 10:20 a.m., November 17, 1961. Moved by Allen, seconded by Reid, the document presented in evidence that Vice Mayor Hollingsworth was served notice of the meeting three hours prior to the meeting be placed on filed. Carried by unani- mous vote. CITY MANAGER BIRD recommended the document showing the Mayor and three Councilmen signed the waiver calling the meeting be placed on file. Moved by Allen, seconded by Reid, the recommendation of the City Mana- ger be approved. Carried by unanimous vote. CITY MANAGER BIRD read a Resolution of the City of San Diego, authoriz- ing the City Manager of City of San Diego to execute that certain Sewage Disposal Agreement of 1960 with the City of National City and that cer- tain Supplement to Sewage Disposal Agreement of 1960 with the City of National City. CITY MANAGER BIRD recommended the Resolution of the City of San Diego be placed on file by the City Clerk. Approved by unanimous vote. COMMUNICATION FROM PAUL BEERMANN, DIRECTOR OF OPERATIONS, THE CITY OF SAN DIEGO, was read, relative to construction of Metropolitan Intercep- tor Sewer through National City. The communication sets forth what the City of San Diego is agreeable to doing in connection therewith. Com- munication ordered filed by unanimous vote. RESOLUTION NO. 8026 was read, granting the City of San Diego authority to construct, maintain and operate the interceptor sewer of the Metro- politan Sewer System in the streets of National City under the same terms and conditions as the City of National City constructs, maintains and operates its own sewer facilities therein. Moved by Morgan, sec- onded by Allen, the Resolution be adopted. CITY MANAGER BIRD stated the resolution was drawn by his office, it has not been reviewed by the City Attorney, and it is verbatim the resolution as requested of us by 11-17-61 162 the City of San Diego. Carried, by the following vote to -wit: Ayes: Alien, Morgan, Reid, Hart. Nays: None. Absent: Hollingsworth. Moved by Morgan, seconded by Reid, the meeting be closed. Carried by unanimous vote.
