Council members present: Allen, Fessman, Hart, Hollingsworth. Council members absent: Hodge. ADMINISTRATIVE OFFICIALS present: Alston, Bird, Curran, Gautereaux, Lill, Stockman, Holgate. The meeting was opened with pledge of allegiance to the Flag by City Manager Bird, followed with invocation by Rev. Warriner. Moved by Hart, seconded by Fessman, the minutes of the regular meet- ing of March 3, 1959, be approved. COUNCILMAN ALLEN stated on the last page of the minutes, in the second line,of the third paragraph it reads: "Council Allen" and should be corrected to read: "Coun- cilman Allen". Moved by Allen, seconded by Hart, the minutes be ap- proved as mailed with the correction as noted: Carried, all the Council present voting aye. RESOLUTION NO. 7441 was read, "HrlSOLUTION DETERMINING THAT PROJECT SHOULD PROCEED (A Avenue Between 24th Street & 26th Street)." Moved by Hart, seconded by Fessman, the Resolution be adopted. Carried, by the following vote to -wit: Ayes: Allen, Fessman, Hart, Hollings- worth. Nays: None. Absent: Hodge. RESOLUTION NO. 7442 was read, "RESOLUTION ADOPTING WAGE SCALE (A Ave- nue Between 24th Street & 26th Street)." Moved by Allen, seconded by Hart, the Resolution be adopted. Carried, by the following vote to -wit: Ayes: Allen, Fessman, Hart, Hollingsworth. Nays: None. Absent: Hodge. RESOLUTION NO. 7443 was read, "RESOLUTION OF INTENTION NO. 7443 (A Avenue Between 24th Street & 26th Street)." Moved by Fessman, se- conded by Hart, the Resolution be adopted. Carried, by the follow- ing vote to -wit: .eyes: Allen, Fessman, Hart, Hollingsworth. Nays: None. Absent: Hodge. REPORT FROM THE CIVIL SERVICE COMMISSION was read, recommending for the approval of the Council the added requirement of "ability to type thirty-five words per minute" for the job specification of Li- brary Clerk and Senior Library Clerk. This recommendation is made to concur with the request of the Library Board of Trustees. Moved by Allen, seconded by Hart, the recommendation of the Civil Service Com- mission be accepted. Carried, all the Council present voting aye. REPORT FROM CZVIIr`SL"RVTCE COMMISSION was read, recommending Freida Palhegyi, Janitress in the City Library, be blanketed into competi- tive service. Moved by Hart, seconded by Fessman, the recommendation of the Civil Service Commission be approved. Carried, all the Coun- 3/10/59 319 oil present voting aye. ATTORNEY CURRAN stated due to the difficulty encountered in the pub- lication of the required notice with reference to the public auction of tax deeded land authorized to be sold by Resolution Nov 7426 which was adopted on February 24th, 1959, it is his recommendation the City Clerk be authorized and directed to amend Resolution No. 7426 by in- terlineation to provide the public auction be held on April 20th at 10:00 A.M. Moved by Hart, seconded by Fessman, the recommendation of the City Attorney be approved. Carried, voting aye. ATTORNEY CURRAN reported The Manhattan Fire pany has served a notice of cancellation of San Martin & Son. The contract the company all the Council present and the has Marine Insurance Com- policy issued to F. with National City requires insurance be maintained, and recommended the City Clerk be authorized and directed that a new policy, pursuant to the provisions of the contract with the City, be filed on or before the effective date of this notice of cancellation. Moved by Allen, seconded by Hart, the recommendation of the City Attorney be followed. Carried, all the Council present voting aye. ATTORNEY CURRAN reported there has been an amended amendment filed by Aztec Bus Lines to its application for authorization to commence ser- vice to Brown Field. This amendment has been noted by the City At- torney, and pursuant to the authorization of the City Council, has filed an appearance with the Public Utilities Commission in this case requesting the matter be set down for a hearing. ATTORNEY CURRAN stated the communication from the San Diego County Water Authority dated February 20, 1959, enclosed a copy of a letter to Governor Brown that was authorized. by the Authority, which com- mends him in taking a forceful position on the important problem of conserving and distributing California's now wasting water surpluses. The letter stated the policy of the Directors of the Water Authority; there is also a letter to the members of the legislative delegation from San Diego County which indicated in general the Board of Direc- tors will go along with the budget item for the Department of Water Resources. It was the recommendation of the City Attorney the com- munication be filed. Moved by Fessman, seconded by Hart, the recom- mendation of the City Attorney be approved. Carried, all the Council present voting aye. ATTORNEY CURRAN referred to the communication from Teyssier & Teyssier, Inc., dated February 10, 1959, requesting payment for the.sum of $2,413.40; and an additional statement for $1,073.28. The two items in question have never been agreed upon, therefore it is his recom- mendation Teyseler & Teyssier be notified in writing that neither of 3/10/59 320 these statements can be honored for payment. Moved by Fessman, se- conded by Hart, the City Attorney's xecommendation be approved in regard to Teyssier & Teyssier's payments. Carried, all the Council present voting aye. ATTORNEY CURRAN reported the City of National City has been named as a defendant and served with process in San Diego County Superior Court Action No. 232001. There are numerous other defendants in this matter which involves the acceptance by the City of National City of an easement. The complaint raises numerous problems of law amd also possibly some factual questions. It appears clear the City Attorney should be given authority to appear and defend this action on behalf of the City of National City. Moved by Allen, seconded by Fessman, the City Attorney be authorized to appear and defend this action. Carried, all the Council present voting aye. NORRIS M6ITHEWSON, 1936 "C" Avenue, was present and stated they have been trying for about six years to get their street improved but there is one property owner who owns about sixty percent of the prop- erty and he is not willing to sign a petition for the improvement. There is no street light here which createsa bad situation, also there is a lot of traffic and speeding w.ich makes it hazardous for the school children who use this street. Mr. Mathewson said:,he would like to know if there is any way they could combine "0" Ave- nue from 18th Street down to the Housing; "F" Avenue and "E" Avenue. CITY MANAGER BIRD stated we have attempted through the media of some of the residents in the area to circulate petitions but they come up against the problem of the property owner on the west side of "0" Avenue. There is the possibility of combining them; and re- commended it be referred to the Engineering Department to make a study as to whether or not we can get a sufficient amount of signers to get this very much needed improvement. Moved by Hart, seconded by Allen, the recommendation of the City Manager be approved. Coun- cilman Fessman said he would like to amend the motion that the mat- ter of excess speed and traffic be referred to the City Manager for proper delegation to the department heads involved. Councilman Hart seconded the amendment. Carried, all the Council present voting aye. MARTHA CLA.RK, 2133 National Avenue, was present and stated she thought there should be a "slow" sign on the highway at 21st and National Avenue. There are a number of accidents at this location and thought possibly a sign of this nature would alleviate the situation. CON.. OILMAN FES8MAN stated he believed the 25 mile zone should be extend- ed southward along National Avenue further than it is at the present time; we have outgrown our 35 mile speed limit on National Avenue down at least to 30th Street; it should be 25 miles the full length 3/10/59 321 if it qualifies within the 25 mile restriction of the Motor Vehi- cle Code, Moved by Fessman, seconded by Allen, the matter be re- ferred to the City Manager for appropriate investigation and a re- port. Carried, all the Council present viting aye. COUNCILMAN ALIEN stated he had been requested by Mayor Hodge to re- present him at the opening ceremonies of the new Robert Hall Stores and they were very pleased we had a representative. The Mexican Chamber of Commerce and the Vice Mayor of Tijuana gave some insight on what happened in Mexico in regard to the gambling incident a few months ago; and this particular group were unhappy it happened. COUNCILMAN ALLEN stated on February 28th we had a patrolman resign and as yet we have not had a man to replace him. The Chief of Police has made a selection, but the man now has to be fingerprinted, and the finger prints have to be sent to three different organiza- tions for clearance as to whether or not he has even been in jail, or ever arrested. Mr. Allen said he thought the Council should re- commend to the Civil Service Commission to consider changing their rules that when they post an examination, at the time the applicant turns in his or her application for the position in question they should be sent immediately to the Police Department and his finger prints be taken and sent out for the reports and this may save a lot of time; there will not then be any question as to whether the person is eligible to take the position. Moved by Allen, seconded by Hart, this recommendation be sent to the Civil Service Commis- sion. COUNCILMAN r'BSSMAN stated there may be a hundred applicants for one position, and he thought it would be better to send the finger prints in for the man that was to be hired rather than the hundred that applied. Carried, by the following vote to -wit: Ayes: Allen, Hart, Hollingsworth. Nays: Fessman. Absent: Hodge, COUNCILMAN HART stated he saw on television boys and girls carrying banners which stated "unfair to sponsored bands." Mr. Hart said he did not think that was good advertising for National City. They should be allowed to march in the Maytime Band Review the same as any others. VICE MAYOR HOLLINGSWORTH stated the last two or three years there have been repeated complaints because the Band Review is getting too long. Ozzie's Band is being eliminated this year, and the difference is the parents pay the band instructors of Ozzie's Band for instructing their children, while in our high schools do not, so a sponsor's band is a paid instructor's band and they felt by eliminating the sponsored band it would shorten the review. We still have as many high school bands participating as previously. ERNEST STANLEY, President of the Chamber of Commerce, was present and stated it was felt it was unfair to the school 3/10/5 9 322 children to compete for awards with a commercial organization, and that is one of the things that was taken into consideration when they decided there would be no sponsored bands. COUNCILMAN HART stated he believed everyone would agree to need a new City Hall and he would like to see the matter of selling the property between 12th and 14th Street, from "A" to National .i..venue put before the people. CITY CLERK ALSTON stated new petitions relative to lunch trucks were submitted to her office yesterday and she chocked them and found there were 357 signatures; 256 with out of town addresses; 45 with business addresses; 53 with National City addresses; 3 with no ad- dresses. COMMUNICATION FROM PRUDENTIAL OVERALL SUPPLY and COMMUNI- CATION FROM JOHN HANCOCK FURNITURE MANUF:.CTURING CO. were read ask- ing the Council to reconsider allowing trucks in National City. Moved by Hart, seconded by Allen, this be held over until the next meeting when we have a full Council. Carried, all the Council pre- sent voting aye. CITY CLERK ALSTON stated she received a proclamation requesting the May or be authorized to proclaim March 16th to 21st as DeMolay Week in National atty. Moved by Allen, seconded by Fessman, the Mayor be authorized to sign the prgclamation. Carried, all the Council pre- sent voting aye. MINUTES OF SMALL CRAFT HARBORS COMMISSION meeting held in Sacramento February 16th was presented, and City Clerk ftlston recommended they be referred to the City Attorney. Moved by .Alen, seconded: by Hart„ the City Clerk's recommendation be approved. Carried, all the Coun- cil present voting aye. COMMUNICATION FROM CHULA VISTA CHAMBER OF COMMERCE was read relative to the establishment of a series of programs on water by the Chula Vista Chamber of Commerce Water Committee. The programs for the first two meetings are: noon luncheon, Tuesday, March 10th in the Chamber of Commerce office; noon luncheon, Tuesday, April 14th in the Chamber of Commerce office. Moved by Fessman, seconded by Allen, the communication be filed. Carried, all the Council present voting aye. COMMUNICATION FROM NA9TIONAL CITY LIONS CLUB was read stating they would like to rent Kimball Park Bowl for their annual Fourth of July Celebration July 3rd and 4th. They wish to have a fireworks display on the night of the 4th and invite the City to help pay the cost of the fireworks, on a fifty fifty basis up to $1,000,00 limit. Moved by Fessman, seconded by Hart, the City notify the Lions Club we will give them permission to use the par]c on the 3rd and 4th of July, and that we will again participate on th.e same terms and conditions as last year. Carried, all the Council present voting aye. Moved by Fessman, seconded by Allen, the City Attorney prepare an agreement 3/10/59 323 with the Lions Club. Carried, all the Council present voting aye. FIYANCIAL REPORT OF CITY TREASURER for the period ending February 28th,was presented. Moved by Hart, seconded by Fessman, the re- port be filed. Carried, all the Council present voting aye. CITY CLERK LLSTON stated she received a notice from the Corps of .Lrmy Engineers of dredging in San Diego Bay which she referred to the City Engineer. REPORT FROM CITY ENGIN.;,ER LILL stated this not- ice concerns the dredging proposed by the San. Diego Gas and Electric Company in National City tidelands area, outside of pier head line; and believes the City has already approved such dredging and no ac- tion is necessary. Moved by Fessman, seconded by Hart, the communi- cation be filed. Carried, all the Council present voting aye. CITY CLERK ALS'TON stated she has the suit which was filed with her on March 6th by Raymond C. and Mabeli. Koch; Donald John and Irene H. Sullivan against the City of National City, et al, and she re- ferred it immediately to the CityA.ttorney, and he reported on it earlier in the meeting. Moved by :Alen, seconded by Hart, this be referred to the City Attorney. Carried, all the Council present voting aye. CITY CLERK ALSTON stated she has the addenda to the application of the Aztec Bus Lines which she referred to the City Attorney. Moved by Fessman, seconded by Allen, this be referred to the City lttorney. Carried, all the Council present voting aye. CITY CLERK 1LLSTON stated on December 2, 1958, a warrant was issued to Edward F. :Lrregui in the amount of $245.00 and apparently the warrant was lost. Mrs. Liston recommended the Council authorize the Ilttorney to have payment stopped and a new warrant issued. Moved by Ellen, seconded by Hart, the recommendation of the City Clerk be ap- proved. SECOND i.NNOUNCEMENT OF FIRST INTERNi,.TIONAL CONFERENCE ON WASTE DIS- P4SisL IN THE MARINE ENVIRONMENT July 22-25, 1959 at the University of California, Berkeley, was read, and ordered filed. NOTICE OF MEETING OF SM:.LL CR«FT IL.RBCRS COMMISSION to be held March 16, 1959 from 1:00 P.M. to 5:00 P.M. in the County Board of Super- visors Chambers was read. CITY CLERK LLSTON recommended the notice be referred to the City .Ittorney. Moved by ialen, seconded by Hart, the recommendation of the City Clerk be approved. Carried, all the Council present voting aye. CITY CLERK 1,LSTON reported shy: had the notice from The Manhattan Fire and Marine Insurance Company for the cancellation of the insur- ance to F. Carried, all the Council present vot- ing aye NOTICE FROM CORPS OF ARMY ENGINEERS relative to dredging was pre- sented. CITY CLERK JLSTON stated it was referred to the City Eng- ineer and he reported this restricted area is offshore at Camp Pendleton and does not concern the City of National City. Moved by Hart, seconded by Allen, the notice be filed. Carried, all the Council present voting aye. REbOLUTION FROM COUNTY BO1.RD OP SUPERVISORS relating to cancellation of taxes on property acquired by the City from Alfred R. & Antonia C. Welker, was presented. Moved by Fessman, seconded by Hart, the resolution be filed. Carried, all the Council present voting aye. COMMUNICATION FROM SENATOR HUGO FISHER was read relative to the City's resolution protesting proposed library legislation. He stated he will watch closely any legislation having to do with pub- lic libraries and will consider any such legislation carefully be- fore he votes. Moved by Allen, seconded by Hart, the communication be filed. Carried, all the Council present voting aye. CITY ENC-INEER LILL reported the notices of hearing on Resolution of Intention for the improvement of "0" Avenue from 15th to 16th Street have been posted. R. E. Hazard Contracting Company today are paving the east half of Highland Avenue from 8th Street to 10 th Street. REPORT FROM CHIEF OF POLICE SMITH was read stating Officers Duane Gagnon and William Curtis have been assigned to the Traffic Division as Motorcycle Officers, effective March 6th. At the present time they will use the new motorcycle equipment jointly which was placed in service March 6th. With this change in assignment the Officers will automatically be placed in rate 24E plus $15.00 per month haz- ard compensation. Moved by Zalen, seconded by Hart, the report be accepted. Carried, all the Council present voting aye. CITY MANAGER BIRD stated because of the increasing potential lia- bility on the part of the City, it is recommended for consideration by the Council that they approve certain rules as enumerated by Mr. Bird, pending an action of the appropriate ordinance of an amendment to the present building ordinance. It was recommended the Council seriously consider the rules and the matter then be referred to the City Attorney to bring about a change in the ordinance or the enact- ment of a new ordinance controlling the situation. Moved by Fessman, seconded by Hart, a copy of the Tules the City Manager has just read be distributed to each member of the Council so they can read it and study it, and possibly at the next meeting we could conform with the request for an iterim rule until we could get an amendment adopted. 3/10/59 325 Carried, all the Council present voting aye. CITY MANAGER BIRD stated sometime ago at the request if the Grand Jury of 1958 and the Jury of 1957 in relation to Civilian Defense, The City Managers of the County of San Diego worked out a descrip- tion of the proposed creation of a Civilian. Defense Disaster Organ- ization for the entire County of San Diego. There has been a con- siderable amount of study put in this program. The purpose behind the entire matter was to create an organization which disregarded imaginary city limits and which truly set up a chain of command and control whereby Civilian Defense could be made ®perative in the event of a disaster. This was done and taken before the Mayors Association of the County of San Diego, and at the meeting of the Mayors, it was their recommendation and acceptance that a resolution to request the County Board of Supervisors to create such an organ- ization. The basis of the organization is voluntary on the part of the cities; but the first thing that must be done is a resolution to request the Board of Supervisors to create such an organization. CITY MANAGER BIRD recommended the Council authorize the Attorney to prepare such a resolution for the next meeting. Moved by Allen, seconded by Fessman, the recommendation of the City Manager be ap- proved. Carried, all the Council present voting aye. COUNCILMAN ALLEN asked the City Manager when we could anticipate the siren and radio on our own unit. CITY MANAGER BIRD said the bill has just been paid for the siren but did not know just when it would be installed. Mr. Bird said he did not know a radio was to be installed on the unit. ACTING MAYOR HOLLINGSWORTH stated she knew it was something Mr. Allen wanted to know but felt the question should be taken up with the City Manager or Department Head, rather than in Council Meeting.
