National City, California, January 16, 1957
Adjourned meeting of January 15, 1957, of the City Council was
called to order by Mayor nodge at 2:v0 P.M. o!clock. Council
members present: Fessman, Hart, Heck, Hollingsworth, Hodge.
Council members absent: None.
ADJIINISTRATIVE OFFICIALS present: Bird, Curran, Ho1gate.
The meeting was opened with pledge of allegiance to the Flag,
followed by invocation by Mayor Hodge.
CITY MANA•iER BIRD stated there was nothing on the agenda other
than the meeting with the South Bay Irrigati ln District Board
members, and Mr. Jewett of Leeds, Hill and Jewcit.
MAYCR HODGE declared a recess.
AYOR HODGE called the meeting to order. Council members ores•:nt:
Fessman, Hart, Heck, Hollingsworth, Hodge. Council members absent:
None.
Moved by Fessman, seconded by Heck, that the plan be continued
on the basis that National City will operate its own municipal
distribution system and the South Bay Irrigation District or
another entity will operate theirs, the impounding facilities
and a oossible filtration plant to be operated jointly or a
method pursued as to how it could be best done, in order to
bring this thing to a point where we can present it to the people
for their decision, whether they want it or not. Carried, by
the following vote to -wit: Ayes: Fessman, Hart, Heck, Hollings-
worth, Hodge. Nays: None.
COUNCILMAN HECK stated he thought the most business like manner
to proceed in the matter would be for each group to authorize
their Attorney to proceed either on a negotiated basis or on
condemnation proceedings to determine the actual value, and what-
ever the value may be we would still put the matter before the
people to vote on. ATTORNEY CURRAN stated he thought the manner
that Mr. Heck. suggested is what Atty. Engstrand and he would
think would be necessary except that we have a definite pre-
liminary and that is with the declaration of policy we now have
the problem of implementing that policy, and the first step is to
authorize the retainieg of O'MIelveny & Myers, and Leeds, Hill &
Jewett to work up an agr ement so that we have something specific
to go on, that is together with the cooperation of the Attorney
for the South Bay Irrigation District and the City Attorney,
and with thgt authorization then the agreement will go hand in
land with a proposal to be worked out by the Attorneys and the
Engineers as to a bond proposition to be submitted to the people,
so that those two things go together; the agreement first of all,
together with a proposal for a bond issue to be presented to the
people of National City, and at the same time, a proposal for a
bond issue to be presented to the people of the South Bay Ir-
rigation District. Moved by Heck, seconded by Fessman, that the
Council authorize the retaining of O/Melveny & Ters, and Leeds,
Hill & Jewett to work up an agreement, togethe_ with the cooper-
ation of the Attorney for the South Bay Irrigation District and
the City Attorney, as recommended by Attorney Curran. Carried,
by the following vote to -sit: Ayes: Fessman, Hart, Heck, Hol-
lingsworth, Hodge. Nays: None.
