Regular meeting of the City Council was called to order by Mayor
Hodge at 1:30 P.M. o'clock. Council members present: Fessman,
Hart, Heck, Hollingsworth, Hodge. Council members absent: None.
ADMINISTRATIVE OFFICIALS present: Alston, Bird, Curran, Lill,
Wagner, Holgate.
The meeting was opened with pledge of allegiance to the Blag,
followed by invocation by Judge Harbison,
Moved by Hart, seconded by Fessman, that the minutes of the regul-
ar meeting of September 18, 1956, be approved. Carried, all the
Council present voting aye.
RESOLUTION NO. 6750 was read, granting a special zone variance
permit to Anna Davies for the purpose of permitting the build-
ing of two two bedroom houses on Lots 37 and 38, in a R-1 Zone.
Said property is described as Lots 35, 36, 37 and 38 Block 3 of
Winnetka Terrace Subdivision, (1846 0 Avenue), Loved by Hart
seconded by Heck, that the Resolution be adopted, Carried, all
the Council present voting aye.
RESOLUTION NO. 6751 was read, granting a special zone variance
permit to Norman C. Ursery for the purpose of permitting the
Easterly side yard set back to be twenty feet West of the said
Easterly line, (Southwest corner of 7th Street and "Q" Avenue),
Moved by Fessman, seconded by Hart, that the Resolution be
adopted. Carried, all the Council present voting aye.
RESOLUTION NO. 6752 v.mas read, "RESOLUTION ADOPTING PLANS AND
SPECIFICATIONS (THIRTEENTH STREET). Moved by Heck, seconded by
Fessman, that the Resolution be adopted. Carried, all the
Council present voting aye.
RESOLUTION NO. 6753 was read, "PRELIMINARY DETERMINATION OF LEGIS-
LATIVE BODY UNDER "SPECIAL ASSESSMENT INVESTIGATION, LIMITATION
AND MAJORITY PROTEST ACT OF 1931" (THIRTEENTH STREET)". Moved
by Heck, seconded by Hart, that the Resolution be adopted. Carr -
led, all the Council present voting aye.
RESOLUTION NO. 6754 was read,, "RESOLUTION APPROVING ENGINEER'S
REPORT AND FIXING HEARING DATE (THIRTEENTH STREET)". The hear.
ing on the report is to be held on the 12th day of November, 1956
at 8:00 o'clock P.M. in the City Council Chambers. Moved by Heck,
seconded by Fessman, that the hearing be changed to November 19th
at 8:00 o'clock P.M. Carried, all the Council present voting
aye. Moved by Heck, seconded by Fessman, that the Resolution be
adopted. Carried, all the Council present voting aye.
RESOLUTION NO. 6755 was read, approving and accepting the deed
from Charles F. Harbison dated August 27, 1956, conveying cert-
ain real property t' the City of National City for street
purposeai,„ Moved by }ial lirsworth, seconded or Mart* that, the
Resolution be adopted. Carried, all the Council present voting
aye.
RESOLUTION NO. 67r6 was read, "RESOLUTION DIRECTING WORK TO BE
DONE UNDER DIRECTION OF THE ENGINEER OF WORK (FIFTH STREET)".
Moved by Heck, seconded by Hollingsworth, that the Resolution b e
adopted. Carried, all the Council present voting aye.
RESOLUTION NO. 6757 was read, " RESJ LUTION DIRECTING PREPARATION
OF ASSESSMENT DIAGRAM: IN THE MATTER OF THE IMPROVEMENT OF FIFTH
STREET". Moved by Hollingsworth, seconded by Hart, that the
Resolution be adopted. Carried, all the Council present voting
aye.

ATTORNEY CURRAN reported that the Indemnity Insurance Company
of North America has issued a sidewalk license bond in favor of
Lyle R. Drager as Principal, and recommended it be approved and
filed. Moved by Hart, seconded by Heck, that the bond be anprov-
ed and filed. Carried, all the Council present voting aye.
ATTORNEY CURRAN reported that Aetna Casualty and Surety Company
has issued its Bond No, 33 S 3790 in favor of Yorke H. Smith
Company as Principal, and recommended it be approved and filed,
Moved by Hollingsworth, seconded by Fessman, that the City Att-
orney's recommendation be approved. Carricd, all the Council
present voting aye,
ATTORNEY CURRAN reported that Ohio Farmers Indemnity Company
has issued a certificate of insurance which appears to satisfy
the requirements of the lease granted to National Lumber Company.
It was the Attorney's recommendation that it be approved and filed.
Moved by Heck, seconded by Fessman, that the Attorney's recom-
mendation be approved. Carricd, all the Council °resent voting
aye.
CITY ATTORNEY CURRAN stated in regard to the request of the
Division of Highways with reference to Lots 3 to 8 in Block 139,
that after conferring with the title company he is of the opin-
ion that the Division of Highways is under a misconception in
this matter. The letter indicates that the State feels that the
right of redemption has not been cut off on these lots, whereas
as far as can be ascertaincd from City records the City now has
an interest in these lots which is equal to that of the Ralph
Cook Company, therefore it is recommended that the District
Engineer be apprised of this, and it appears that the State should
be negotiating with the City for purchase of the City's interest
rather than simply having a payment of delinquent taxes, as sujg-
ested in their letter, Moved by Heck, seconded by Hart, that the
Attorney's recommendation be allowed, and the City Manager be
instructed to address a letter to the District Engineer. Carried,
all the Council present voting aye.
COUNCILWOMAN HOLLINGSWORTH reported that Mrs. Ruble. ;Miller, who
is a member of the Topoerette Club, stated they were having their
annual headdress ball and all of the money raised is for
muscular dystrophy, and asked if all the Council mers would
donate their salary for the month of November. The ouncil
members all agreed.
COMMUNICATION ICATION FROM L. W. Bi DDERS was read expressing his app-
reciation for the Courteous service shown him by the Council in
the recent request for the relocation of a house, located at
3180 National Avenue.
COMMUNICATION FROM'. JANE G. KIRKPATRICK was read regarding the
issuance of a business permit under classification of piano
instructor at her home at 1835 "J" Avenue. Mrs. Kirkpatrick
requests that she be granted a business permit for her 1057
license to be effective the first day of January, 1957, and
that no variance or opposition to issuance of such license be
be approved by the Mayor and City Council. Moved by Hart, that
Mrs. Kirkpatrick be granted the license. Motion died for lack of
a second. COUNCILMAN HECK asked if this required study by the
Planning Commission because of the zoning. COUNCILMAN FESS AN
stated they Mrs. Kirkpatrick does have a license a t the present
time and the 1957 licenses are not due as yet so there is no
application for a 1957 license required at the ?resent time.
CITY PLANNER WAGNER stated this was one of the cases where a letter
was sent by the Planning Commission to holders of business
licenses in residential zones last year in anticipation of the
proposed new zoning ordinance in which there was a provision for
the granting of home occupational use permits, and Mrs, Kirkpat-
rick wiched to have some ciarifir-tion as to whethcr or not she

seconded by Hollingsworth, that the City Treasurer answer
Mrs. Kirkpatrickts letter and say that there is no ordinance
on the books that requires her to apply for a license at this
time and when the regular times comes she can get the license as
heretofore. Carried, all the: Council present voting aye.
COMMUNICATION FROM COUNTY al RD OF SUPERVISORS was read stat-
ing that on September llth they ordered consolidation of the Spec-
ial Election of the City of National City with the General
Election to be held on November 6th, as requested in Resolutions
Nos. 6724 and 6728,. The Board also authorized the Registrar
of Voters to render certain specified services to the City of
N ational City relative to the conduct of a Special Municipal
Election to be held September 26th, as requested in Resolution
No. 6729.
REPORT OF THE CITY TRESURER for the month of August was presented,
and ordered filed,
COMMUNICATION FROM S,Adi DIEGO COUNT -WATER AUTHORITY was rea*
advising of a meeting Septc`.. • 26th at o A,;,,4 in the Council
Chambers at the Civic Center, regarding the conservation of
water. 'COUNCILWOMAN HOLLINGSWORTH asked if the City Manager
planned to have any representative a t the meeting. CITY ?ANW ER
BIRD said he intends to attend the meeting. We have a water
conserving ordinance on the books if it becomes necessary for
enforcement. This is merely outlining a plan on a voluntary
basis at the present time.
COMMUNICATION FROM SAINT D1'7GO GAS AND ELECTRIC COMPANY was read
which refers to Ordinance No. 907, an brdinance.of intention to
vacate snot close 20 feet of "C Avenue between 15th and 16th
Streets. On July 25t.h they entered a protest, by letter, becuase
of existing electric power pole line facilities within that
portion of "C Avenue proposed to be vacated. Easements provid-
ing for their existing facilities have now been secured, and,
therefore, the Company wishes at this time to withdraw its
protest to the proposed closing. Moved by Hollingsworth, second-
ed by Heck, that the communication and Ordinance No. 907 be referr•
ed to the City Attorney. Carried, all the Council present
voting aye.
CITY ENGINEER LILL reported that we received a letter fromt he
Public Utilities Commission approving the Cleveland Avenue pro-
ject. COUNCILMAN FESS,P.iti asked if it will be possible to get
the job started and completed before the rainy season. CITY
ENGINEER LILL stated he believed it woulb be possible to let the
contract sometime the later part of November, if everything goes
along satisfactorily.
CITY MANAGER BIRD stated that sometime ago the Council ordered
Management in cooperation with t he Building Dept. to prepare an
electrical ordinance, an amendment to the existing electrical
ordinance, or a recommendation of a new ordinance. Subject
to that order' there was a meeting et led by the Building Dept.
of the Board of Appeals and Electrical Contractors and the
ordinance was reviewed and several worthy suggested changes were
proposed. During the discussion that followed it was pointed
out that the main objective for amending the present code was to
gain uniformity with the requirements of other municipalities in
the arca, and with this in mind most of the changes were abandoned.
It was the unanimous opinion of the Board and all present that
the proposed electrical ordinance is a good workable code and
and should be presented to the proper City officials for adoption
immediately. REPORT FROM THE B' ILDING DEPARTMENT to the City

Manager was read stating their office has made a comprehensive
study of the codes of all the other municipalities in this area
as compared to the existing Ordinance No. 534. As a result of
this survey it has been determined that Ordinance No., 534
is totally obsolete. The original draft of this proposed
ordinance has been presented to the Board of Appeals and to
representatives of licensed contracting electricians of this
area for discussion and suggestions and a few changes were
recommended and included in the final draft. It was agreed
by all present that the ordinance as proposed would be fair
and workable, CITY MANAGER BIRD said he has completely.ch4cxi-
ed this proposed ordinance and it is designed to take care of
Ordinance No. 53s and recommended it be referred to the City
Attorney for preparation and brought before the Council at a
hearing. Moved by Fessman, seconded by Hart, that the City
Manager's recommendation be approved. Carried, all the Council
present voting aye.
REPORT FROM THE ENGINEERING DEPARTMENT was read regarding
plans and specifications for traffic signals at 8th and
Roosevelt and 16th and Highland. It Ys_nroposed that the bids
be opened on Ootoher 15, 1956. CITY MANACItn $TRD stated these
are two budgeted items. COUNCILMAN HECK said he bastioned
whether it would not be advisable to put in a signal at Gt-hand
Palm Instead of 16th and Highland. Moved b y Hart, that it be
referred back to the Traffic Safety Committee for their opinion
as to where the light is needed the most. Motion died for lack
of a second. COUNCILMAAN FESSMAN asked if the contemplated sig-
nal at 16th and Highland will be located in such a manner that
it will not have to be moved. CITY ENGINEER LILL stated the
installation is made so that the standards can be relocated,

ation of the traffic lights at 8th and Roosevelt and 16th and
Highland be approved. Carried, all the Council present voting
aye.
CO.MUNICATION FROM CIVIL SERVICE COMMISSION was read recommend-
ing the reappointment of Luther Reif*. whose term as Civil Service
Commissioner expires September 30, 1956,. COMMUNICATION FROM
NATIONAL CITY POLICE RELIEF ASSOCIATION was read stating they
would appreciate any consideration the Council might give to
the reappointment of Luther G. Reid. Moved by Hollingsworth,
seconded by Hart, that these recommendations be referred to
Mayor Hodge for appointment. Carried, all the Council present
voting aye.
REPORT FROM THE FINANCE COMMITTEE addressed to the Planning
Commission was read regarding the 1911 Act Improvement - 20th
Street, "A" 8 "B" Avenue. The Finance Committee meeting on
September 18th reviewed this proposal and it was the opinion
of this committee that the area slated for improvement should
he reviewed by the Planning Commission. In the committee's
opinion they felt thitt the matter shouid be reviewed with the
purpose in mind of narrowing these residential streets to a
sixty foot dedication, with a forty foot travelway. They
further believe that a study should be made, particularly of
20th Street with the view in mind of studying all of th5 ram-
ifications apparent and hidden of opening 20th Street from
National Avenue to Highland Avenue. This will necessitate
acquisition of rights of way, either by negotiation or condem-
nation. PETITION FROM PROPERTY owners was read stating they
request the Council to consider rededicating "A" Avenue between
QOth and 21st Streets from an 80 foot street to a 60 foot street
to conform with "A" Avenue south of 21st Street which is a

was read stating they are enclosing a petition for rededicat-
ing "A" Avenue between 20th and 21st Streets. Only one person
refused to eign the petition, Mrs. Jennie 'ivrner who owns the
properLv at 207.6 ani 2020 "A" Avenue. It is understood that
there will t'e approximately $60,00 expense for advertising,
etc for which Jr.ey will be personally responsible. CITY

REPORT FROM TN7... PLAITING CO.;MISSION regarding Application
for Conditional Exception No. 568 signed by- C;iar les L. Stanley
relative to the property at 527 "E" Avenue, was read. Petit-
ioner requested elimination of the four foot sideyard ' requir-
ed in order to gain sufficient space to construct two 3-bed-
room or 2-bedroom and den apartments over a five car garage.
Petition was received with 21 signatures of residents in the
area affected by the variance, representing 14 parcels of
property, protesting the granting of the request. It was the
recommendation of the Commission that the Zone Variance be
denied. APPEAL filed by David A Neal, Attorney for Mr. Stanley
was read, asking that the Council overrule the Planning
Commission and order the zone variance requested. Moved by
Heck, seconded by Hart, that the hearing be set for 2:00 P.M.,
October 16, 1956, in the City Council Chambers. Carried,
all the Council present voting aye.
RESOLUTION NO, 6758 was read, approving n d accepting Engineer-
ing Department Specifications No. 605 for the Installation of
Traffic Lights at Eighth Street and Roosevelt Avenue and
Sixteenth Street and Highland Avenue, and the City Clerk is
authorized and directed to advertise for bids for the same,
to be publicly opened at 3:00 P.M., October 15, 1956. Moved
by Hart, seconded by Fessman, that the Resolution be adopted.
Carried, all the Council present voting aye.
MAYOR HODGE appointed Luther Reid as a member of the Civil
Service Commission.
Moved by Heck, seconded by Hart, that the meeting be closed.
Carried, all the Council present voting aye. Meeting closed
at 2:31 P.M.
