Regular meeting of the City Council was called to order by
Mayor Hodge at 1:30 P.M. o'clock. Council members present:
Fessman, Hart, Hodge, Council members absent: Heck,
Hollingsworth.
ADMINISTRATIVE OFFICIALS present: Aist n, Bird, Curran,
Hoigate, Lill, Wagner.
The meeting was opened with pledge of allegiance to the Flag,
followed by invocation by Rev. Faye Brice.
Moved by Fessman, secAnced by Hart; that the rzinutes of the
regular meeting of October 2, 1956, be appr.>v&:d. Carried,
all the Council ?resent voting aye.. Moved ::y Fessman,
seconded by Hart, that the minutes of the ajourned meeting
of October 3., 1956, be approved. Carried, all the Council
present voting aye.
RESOLUTION NO. 6763 was road, "RESOLUTION OVERRULING PROTESTS
(CLEVELAND AVENUE)", Moved by Hart, seconded by Fessman,
that the R;s',luti,n be adopted. Carried, by the following
vte to -wit: Ayes: Fessman, Hart, Hodge. Nays: None.
absent: Heck, Hollingsworth.

RESOLUTION NO, 6764 was read, RESOLUTION ORDERING THE WORK
(CLEVELAND .VENUE)". COUNCILMAN HECK present during partial
reading of the Resolution. Moved by Hart, seconded by Fessman,
that the Resolutimn be adopted. Carried, by the following
vote to -wit: Ayes: Fessman, Hart, Hollingsworth, Hodge.
Nays: Nne. Councilman Heck abstained from voting.
ORDINANCE NO. "AN ORDINANCE OF INTENTION TO VACATE AND
CLOSE rt PORTION OF A PUBLIC STREET, TO -WIT: i. PORTION OF
"J" AVENUE, 1N THE CITY OF NATIONAL CITY, CALI FORNIA" , was
presented for the first reading and read in full.
ATTORNEY CURR,'.N reported that he has notified Byri D. Phel-
ps, Engineer of Work, 18th Street 1911 Improvement Act,
that we would like to have a report of his investigation as
soon as possible. No further steps can be taken by the City
until we have that report.
ATTORNEY CURRAN stated that sometime ago there was referred
to him an easement form which was submitted to the City by
the San Diego Gas and Electric Company. That form was to
grant to the San Diego Gas and Electric Company an easement
in the event "O" Avenue were to be closed, as is contemp-
lated. Certain objections were noted to the right of way
form submitted, and accordingly the City Attorney has drawn
a different form of easement to accomplish the same purposes
but in a form which is satisfactory to the City. We are now
ready to adopt a resolution authorizing the granting of the
easement requested, which is within the twenty foot strip
adjacent to the pro1erty being closed,
REVILVTION NO, 065 was read, granting of the easement end
right of way hereinafter described for use in running
electric lines. The Mayor is hereby authDrized and directed
to execute a right of way, granting to the San Diego Gas and

Electric Company an easement within the westerly twenty feet
of "Q"' Avenue adjacent to Lot 22, Block 1 of Bach and Shaules
addition. Moved by Hollingsworth, seconded by Hart, that the
Resolution be adopted. Carried, all the Council present
voting aye.
APPLICATION FOR TRANSFER OF OFF SALE BEER AND WINE BEVERAGE
LICENSE by Lucas Marin, Marin Market, 1640 McKinley Avenue
was presented. REPORT FROM POLICE DEPARTMENT states that
investigatian fails to discl®se any grounds for protest.
Moved by Heck, seconded by Fessman, that the application be
filed. Carried, all the; Council present voting aye.
APPLICATION FOR TRANSFER OF OFF SALE GENERAL BEVERAGE LICENSE
of Texas Liquor House #7, was presented. CITY CLERK A';LSTON

COMMUNICATION FROM BORDER CITIES CONFERENCE Ws read stating
that the first working sections of the four:: _annual confer-
ence will take piece in the form of !reakfast eeetings. The
first meeting will b: held at 7:30 A.M,, Monday, October 15th.

California, was presented, inviting the Council to a demon-

CITY ENG1I'NEER LILL reported that the contract for the imrrove-
ment of Fifth Street was awarded to the Griffith Company in
September and it is expected the contract will be signed this
month and construction should start in the near future.

copy of theirttesolution 2762 unanimously adopted by the
Coronado City Council on October 2, 1956 is enclosed. CITY
MANAGER BIRD recommended t his be referred to the City
Attorney and the Harbor Committee. Moved by Heck, seconded
by Hart, that the City Manager's recommendation be allowed.
Carried, all the Council present voting aye.
REPORT OF CITY MANAGER BIRD WAS read regarding the bids opened
for one heavy duty type truck, cab and chassis. Two bids
were received, one from Acme Chevrolet Company and one from
the International Harvester Company, as follows: ACME
CHEVROLET COMP/NY, net price $26?1.15; INTERNATIONAL HARVEST-
ER COMPANY, net price, $2460.17. It was the City Manager's
recommendation that the bid of the International Harvester
Company be accepted and the City Attorney be authorized to
prepare the necessary resolution. Moved by Heck, seconded by
Hart, that the City Maanager's recommendation be allowed,
and that the low bid of the International Harvester Company
be accepted. Carried, by the following vote to -wit: Ayes:
Fessman, Hart, Heck, Hollingsworth, Hodge. Nays: None.
CITY MANAGER BIRD stated in furtherance of our drainage
operation a letter and map was sent to the District of Public
Works, Eleventh Naval District, requesting that the City of
National City be granted en a a.sement for drainage purposes
westerly from 19th Street through Navy Property to the exist-
ing bulkhead as shown on the enclosed drawing, plus permiss-
ion for temporary use of adjoining area for construction
purposes. The City proposes to install on such easement a
concrete drainage pipe and will conform to all necessary
specifications concerning such installation.
CITY MANAGER BIRD reported that he is in recei;at of a letter
from the Division of Highways, which is in reply to a letter
which he sent to them with the purpose in mind of speeding
up construction of Project 32, which is 2t.th Street. The
letter stated it is satisfactory to construct Project 32 in
two stages, the first stage should be designated Project 32,
Unit 1, 24th Street from Hoover Avenue to Highland Avenue,
the remainder of the project may be constructed as the
second stage. CITY Ml.NAGFR BIRD stated the second phase is
the bridge crossing a►t the channel.
APPLICATION OF CLIFF REED to move a building from 323 E 16th
Street to 1604 "Ds Avenue, to be used as a garage, was
presented. REPORT OF CITY PLANNER WAGNER and report from the
BUILDING DEPARTMENT were read. One of the recommendations
setforth in the report of the Building Department was that
the interior be painted. Moved by Hart, seconded by Heck,
that the request be granted in accordance with the require-
ments of the Planning Department and Building Department,
and that the Building Department's records be changed to
include painting of the exterior. Carried, all the Council
present voting aye.
APPLICATION OF ARVEL TRUEBLOOD to move a building from 1610
National Avenue to 1807 National Avenue for use as a used
car office building, was presented. REPORTS FRJii THE BUILDING
DEPARTMENT and CITY PLANNER WAGNER were read. Moved by Heck,
seconded by Hart, that the application be approved with the
recommendations from the Building Department and City Planner.
Carried, all the Council present voting aye.
CITY MANAGER B1 D stated that sometime ago there was sub-
division known as F.A. Richards Subdivision, and that sub-
division was accepted by a previous Council wherein there was
stipulated certain actions to be taken. In the minutes of
Febo 4, 1946.the subdivision was accepted subject to filing

an adequate bond; there was never any bend filed. That bond
was to cover curbs and oiling of streets. There were also
no improvement plans filed. On Feb. 17, 1948 there was an
acceptance by the City Council of the subdivision. We have
had recent owners in the subdivision who were promised by
the subdivider certain things, such as curbs, necessary
street appurtenances, etc, Mr. Bird read a copy of a letter
from F.A. Richards which stated: "To whom it may concern, I,
the undersigned, guarantee to pave street and install curbs
to City's specifications on Lot 5, Block "A" of F.A. Richards
Subdivision when buildings are completed". The other owners
did not havo such a statement, and they are asking National
City to consider what legal steps or remedy there is so
they might proceed against the subdivider, who promised that
he would put in certain improvements when they purchased their
property. CITY MANAGER B1kD said he had some affidavits or
statements from various property owners. It is the City
Manager's recommendation this be referred to the City Attorney
to see what action, if any, the City might have to give relief
to these property owners. Moved by Hart, seconded by Fessman,
that it be referred to the City Attorney. Carried, all the
Council present voting aye.
CITY PLANNER WAGNER reported he had been unable until today
to contact Mr. Haelsig to arrange a meeting to consider the
renaming of portions of S. 43rd Street. The meeting is
tentatively set up for 2:00 P.M. on Monday afternoon, Oct.
15. The problem is that one half of the street has one name
and the other half another name; there have been suggestions
made that the entire route which is Fairmount Avenue in the
north part of San Diego and is to be extended through to S.
43rd Street might be renamed entirely as Fairmount Avenue, or
Fairmount Avenue Extension. However, there is nothing c.)ncrote,
it was merely a discussion. As soon as we receive more in-
formation he will make a report.
ALBERT GIORDANO, 1715 S. 43rd Street, was present and stated
he wished to withdraw his protest in regard to the dairy.
Moved by Hart, seconded by Hollingsworth, that the meeting be
closed. Carried, all the Council present voting aye. Meet-
ing closed at 2:24 P.M.
