Council members present: Fessman, Heck, Hollingsworthi Jensen,_Hodge. Council members absent: None., ADMINISTRATIVE OFFICIALS present: Alston, 81t4d, Curran, Gautereaux, Wagner. The meeting was opened with pledge of allegiance to the Flag, followed by invocation by Mayor_ Hodge. George Thompson instead of Mayor Hodge, Moved by_,oliings- wor:th, seconded by Jensen, that the minutes be annroved, as corrected. Carried, all the,Council present voting aye. RESOLUTION NO. 654.1 was read, ap.00inting Engineer and fixing com+Densation for proposed improvement of 18th Street_between Palm and Rachael. Moved by Heck, seconded by Jensen, that the Resolution be adopted. Carried, all the ,Council present voting Aye. R^SOLUTION NO. 654.2 was read, appointing_person to nrepa're 411 proceedings for proposed improvement of 1.8th Street between _ Palm and Rachael. Moved by Heck, seconded by Hollingsworth, that the Resolution be adopted. Carried, by the following vote to -wit: Ayes: Fessman, Heck, Hollingsworth, Hodge. Pays: Jensen. ATTORNEY CURRAN reported that the Home Indemnity Comrany_has is- sued a Certificate of Insurance certifying that Ci S. Johnson - and 'rallace GI Johnson, a Co -Partnership, and C. S. Johnson as an individual have automobile and general comprehensive liabil- ity insurance, in accordance with the terms of their contract, and it is recommended the Certificate be approved and filed. - Moved by Jensen, seconded by Hollingsworth, the the Attorney's. recommendation be adopted. COMMUNICATION FROM STATE BOARD OF PUBLIC H7ALTH regarding seT.rage disposal to San Diego Bay relaters, was read. A resolution was adopted calling for prompt action in correcting the existing hazardous and offensive condition in Sari Diego Bay ?•raters dine to discharge of sewage and sewage effiuents; and suggesting that each agency review its problems with the San Diego Reginal r:Tater Pol- lution Control Board and the San Diego County Department of Public Health to determine if temporary measures such as chlorination or other treatment will minimize_the existing publfe healthhaz-_. aids and offensive conditions in San Diego Bay pending_completion of new sewage collection and treatmentworks. Moved_ by Hollings- tworth, seconded by Fessman, that the City manager answer the lett- er and state that 7e are helpless, as it would denend entirely on San Diego about how soon we could do anything about_ sewage disposal. COT_NCILMAN F7SSITAN stated it is his understanding there is to be a meeting" in San Diego on January llth in regard to a sewer bond and asked if the Council had been invited to attend that meeting. MAYOR _ HODGE stated he had been asked to attend, also the City Manager and City Attorney. There will be minutes of the meeting avail- able and copies will be given to each,Council member. R'DOrT OF CITY TREASURER for November, 1955, was presented, Moved by Hollingsworth, seconded by Heck, that the report be filed. Carried, all the Council present voting Aye. COi7UNICATION FRO" SAN DIEGO OBER OF COMMERCE was read stating in cooperation with the Internal Revenue Department they will present a special forum to aid firms in compiling and filing their annual report of income tax deductions. Hoescr was presented wishing the Council a Prosperous and Happy New Year. 1/3 169 REPORT FROM CITY ENGINEER LILL was read stating that Ets-Ho'-,:in G-alvan have completed installation of the traffic light at- lOth and Highland. This installation has been inspected and approved and it is recommened that 'the Council accept the pro- ject and authorize payment as.setforth in the contact', as'follows: 905 of contract price upon acceptance, total } 3,969.90, 10 of contract price 3-5 days after acceptance of the project; total__ contract price 14,411.00. Moved by Heck, seconded by Jensen, that the City Engineer's report be accepted. Carried, all the Council present voting aye. CHAMBERLIN, was read stating careful consideration has been given to the proposed disposition and its effect on present and anticipated Navy housing requirements in the_ area. ?'Thile the importance of adequate school facilities is fully_recognized,. the acute need for this housing_precludes reiinquishrient at this time._ It is therefore recommended that the units be continued in operation until the present situation is relieved. Moved by Fessman, seconded by Jensen, that the National School District - be notified of the answer -we have received from the Navy, and for the reason given by the Navy, that the schooloffer not be acc- epted. COUNCILMAN FESSMAN questioned T*hether it would hot be w=ae for the City to make some two and three.bedroom units from -she single units in the Olivewood Housing. MAYOR HODGE requested this be referred to the Housing Director. COMMUNICATION FROM LFGAUT OF CALIFORNIA CIT'I?'S was read stating that on April 27, 1955, Governor Knight wrote to all of the Cities in Calblprnia asking each to holda town hall meeting for the purpose /discussing juvenile delinquency problems. The Governor's letter also mentioned that a Governor's Conference would be hell in Sacramento in early 1956 to determine the progress made_ and to consolidate the recommendations of the variouj individual town hall meetings into one report. This conference is now scheduled for the first part of April, 1956. In line with the Governor's suggestions, the cities of,Contra Costa County and the County of- Contra Costa organizedt )ToT..•rn Hall_Meeting of Youth, which was held in Richmond on November 10, 1955. A summary report of thib meet- ing, which was compiled by the host city, Richmond, is enclosed.. The Richmond report suggests an interesting approach to the organization ofa meeting on juvenile delinquency and also suggests a number of recommendations which might well be considered by similar meetings in other cities. COUIWILTIOMAN JENSEN stated she thought this should be referred to the Coordinating Council as they are taking up the problems of junvenile delinquency. 1/3 170 CITY MANAGER BIRD stated we established standby and overtime nay in the Sewer and Street Denartments,_and have. been working on a _nrorsition whereby we could give better service more adequately during the time of off hours.. Carried, all the Council present voting aye. _ _ CITY MANAGER 'IRD re-^orted that he his a request from a_gentleman who lives at 625 "T° Avenue, because of necessity, due_ -to the lack of water mains, wishes permission to extend a private -line on City property, 80 feet on the east side of UT" Avenue. The ''ater Company will not give him service. Since this requeat cam:; in another gentleman has purchased property near there and _ is in the same category. w• Tould it be correct. procedure to grant to a private individual the right of extending a water line in the parkway of City property if he would sign a waiver of all damage and claim tb the City? COUNCILMAN FESSMAN stated striae' this is a dedicated street he thought it would be the City's duty to notify the ;'rater Company that they expect to have a main on that street. 1/3 '171 If these men nut a private line_ on City property it will even- tually have to be torn up and it would cause double expense. CITY MANAGER BIRD stated he was informed by the anolicant who made the request that he applied to the Water Company and they want 11500.00. Moved by Fessman, seconded by Jensen, that the City ask the Water Company to nut in the line, and if the City Manager cannot get any cooperation from the Water Cornnany,_he be emmowered to allow this man to extend a private line. C0'TNCIL-- MAN HECK stated he thought the Water Company should be able to provide services requested by our,_citizens. COUNCIL;AN F'-'S9ItAN, with permission of Councilwoman Jensen, amended_the motion, mak- ing a condition on it so that at such time that either the street is improved or a main is laid there, this man be connected to the main, and the City Manager?s recommendation in regard to liability be allowed. REPORT OF HOUSING DIRECTOR GAUTEREAUX'was presented_, showing_a net revenue for November, 1955 of 123,291.53; total number of vacant units as of December 30, 1955 was 13 studio apartments and 14 one bedroom apartments. REPORT OF THE PLANNING COMMIgBION was read regarding application for Conditional Exception No. 540 signed by Curtis W. Lee rela- tive to property at 704 E. 3rd_Street. Petitioner is requesting C--3 usage, in an R1.4 Zone, side yard setback variance from four _ feet to zero feet, front yard setback variance from ten feet to five feet, distance between buildings from eight feet to six feet, variance in signs to allow signs on front windows giving business name and a neon sign approximately two by seven feet_to be erected on ton front of building. It was the recommendation of the Plan- ning Commission that this zone variance be granted, provided_there_ is off street parking of a minimum of three cars. 1roved by. Fessman, seconded by Hollingsworth, that the, Planning Commissionts recommendation be allowed, and a resolution prepared. CITY PLANNER WAGNER'reminded the Council that the Planning -Com- mission will hold a public hearing on the proposed new zoning ordinance on January 9th. RESOLUTION ^T0. 6544 was read, accepting the work done by Ets- Ho'_cin and Ga1van for the installation of traffic lights at loth and Highland? and authorizes the filing of a notice of completion and orders that nayment__for said work be made in accordance with the contract. C`OLTATCILwOI:AN J'"NS.N asked hoer the report on the Fire Department is progressing. CITY MANAGER BIRD stated that the inquiry, as ordered, is proceAd.ing in an orderly fashion, but that it will possibly be two more meetings before a report can be_made in this regard. COUNCIL'TOMAN JENSEN said she would like a report as soon as possible as she has made_ many interviews herself. COUNCILMAN FESSMAN stated two weeks ago narking on_Highlanc1 Avenue between 8th and 10th Streets was discussed and he asked that "no narking" signs be placed on the opposite side of the street from a dead end street and was told, that it was covered by Ordinance No. 827. Mr, Vessman said he would like_to ':now why there has not been something done about it, and he would like to see that ordinance enforced. COUNCIL7AN FTIVAI\T asked about the specifications on sub base material for our subdivision ordinance requirements.. CITY MANAGER BIRD stated we have submitted to the i/3 172 San Diego Testing Laborator t a draft of the'ordinanoe requesting of their reputable engineers their opinions, and as yet we have not received their comments. On the matter of Ordinance 827, immediately following the Council meeting in which that directive was brought forth, we finished the alignment, the marking_, the tow away zone, etc.'on Highland Avenue from 8th to 10th,Streetl on the west side. The other matter becomes_a controversial _ situation as to the technical language of the ordinance, there fore it has been referred by the.City Manager and Chief of_Police for a conncurrence with the Traffic Safety Committee. The question of adjacent to sDhools is a matter of painting that portion of the travelway adjacent_to a school site, particularly the Sweetwater Union High School. It is our opinion that we would like to see the night school in operation so thaf we_are on solid ground before we go ahead promiscuously, even though the Ordinance does allow Traffic Engineer to order certain things__done. .,t.re believe.it is good parctice to view the situation so that we are in possession of substantiating facts to back up whatever action we take. ALBERT CLARKE, 914 E: §th Street, was present and stated he wished to commend the mayor, ity Council and City Manager in their Prompt action in.having the traffic lights installed at 10th and Highland. He also expressed his thanks for replacing the flag at the City Hall. Moved by Fessman, Seconded by Jensen, that the meeting be closed. Carried, all the Council present voting aye.
