Regular meeting of the City Council r,ras called to order by
Mayor Hodge at 1:30 R.H. 0tc1ock. Council member present:
Fessman, Heck, Hollingsworth, Jensen, Hodge. Council members
absent: None.
ADVINISTRATIVE'OFFICIALS present: Alston, Bird, Lill, Holgnte,
Curran, wagner, Bailey.
The meeting r,ras opened with pledge of allegiance to the Flag,
followed by invocation by Rev. T'ilburn Hall.
Moaned by Heck, seconded by .tensen, that the minutes of the re-
gular meeting of November 8, 1955, be an^roved. Carried, all
the Council present voting aye.
RESOL"'TION NO. 6515 was read, accenting and. an -roving Lease No.
GS-09B-(S)-80 dated October 20, 1955 with the Gener-.1 Services
Administration of the United States of America, and the_City
Manager is authorized and directed to accept the same and execute
any and all documents necessary for and in behalf of the City.
Moved by Heck, seconded by Fessman, that the Resolution be adopt-
ed. Carried, all the Council present voting aye.
RESOLUTION NO. 6510 was read, accenting and approving City 7n-
gineerts specifications No. 506 providing for a sewer extension
on 16th Street between "M" and Palm Avenue. Moved. by Jensen,
seconded by Heck, that the Resolution be adopted. Ca^ried.,
all the Council present voting aye.

1, 2, 3, 4f/ 8, 19, 20, 21 and 22 of Alock 119. Moved by Heck,
seconded by Fessman, that the Resolution be adopted. Carried,
all the Council present voting aye.
RESOLUTION NO. 6518 was read, appointing City Engineer to net
as Engineer of work and Superintendent of Streets for the nro-
nosed improvement of Highland Avenue in accordance with the /Im-
provement Act of 1911". Hovel by Heck, seconded by Fessman,
that the Resolution be ado-nted. Carried, by the following vote
to -wit: Ayes: Fessman, Heck, Hollingsworth, Hodge. Nays: Jen-
sen.
RESOLUTION NO. 6519 T.ras read, appointing Robert 0. Curra.n as
Attorney to prepare all proceedings for the improvement of High-
land Avenue, and setting forth the compensation he shall receive
for the doing and performance of said work. Moved by Hpc'k, se-
conded by Hollingsworth, that the Resolution be adopted. Car-
ried, by the following vote to -wit: Ayes: Fessman, Heck, Hol-
lings'.'orth, Hodge. Nays: Jensen.
RESOLUTION NO. 6520 was read, ordering rlat showing exterior
boundaries of assessment district for improvement of Highland
Avenue. Moved by Heck, seconded by Hollingsworth, that the Reso-
lution be adopted. Carried, by the following vote to -wit: Ayes:

National City. Moved by Hollingsworth, seconded by Heck, that

from the Dent. of Alcoholic Control regarding the protest filed
on behalf of the City against Pat Demangos for transfer of on
sale liquor license. CO''"UNICATION FROM DEPARTMENT OF ALCoYoLIC
CONTROL Trims read acknowledging the valid protest against "at De -
mangos, and a cony of the protest is being forwarded to the an-
rlicent. In the absence of further notifioatirn it may be as-
sumed that the license has not been issued, that a hearing on
this protest is not required, and no further action on the part
of the City will be necessa:-.y. ATmORY7Y CURRAm stated unless he
receives notice of a hearing the matter will be closed.
ATTORNEY CU"RAN reported that he reviewed the verified claim of
Everett Crockettend it is recommended that the Council authorize'
-n0 direct the City Clerk to notify the Attorney for the claimant,
Everett Crockett, that he should submit a vertified claim on the.
standara form which has been prenarad for this puri-ose. Moved
by Heck, seconded by Jensen, that the City Attorneys recommenda-
tion be allowed. Carried, by the following vote to -wit: Ayes:

RESOLUTION NO. 6522 was read, approving the payment of `{22.02
from Capital Outlay Fund to Rodney Stokes Conrany, for Fire
Station Drill Yard and Traffic Signals. Moved by Hollingsworth,
seconded by Heck, that the Resolution be a.dorted. Carried, all
the Council present voting aye.
ALRR7T 7. CLA7TE, 914 E. 8th Street, was present in regard to the
article which appeared in the Union this morning ?:rith_reference
to Pay improvement. The article stated the Committee of the four
communities is studying Bay improvement and Mr. Clarke stated he
is interested in how these nominations were presented a.nd•who they
represent. MAYOR HODG^ stated he appointed a committee of three,
namely, Mrs. Hollingsworth, Mr. Heck, and Mr. Fessrie,nwith Mr.
°Iagner, Mr. Bird and he as ex-officio members. Mr. Fessman is
chairman. MR. FESSMAN stated the last meeting was October 31st
and no action has been taken since to his knowledge. The next

meeting will be November 28th.

the Planning Commission were trying to find. P. through street
running east and west other than 8th Street and it was nronosed
that 10th Street be the most logical one. There was never any
thought of the South Pay Plaza and when they did come to National

the City demanded that South -ay 41n2a nay for the im-,rovements
a.nd they were willing to do so. The Council had no intentions
of throwing business towards any one grou» or taking away for
others. ^veryone on the Council is very ;+nxious to helm anyone
in the City, and in their recommendations, not only from the .
traffic angle, they were thinking about 8th Street 'hen they

nrorosed Freeway, and that the Council should consider the
petitioners in making their recommendations. 'ARGA.ET SIMKIN,
420 E. let Street, was present and stated that the people on
National Avenue & 8th Street who signed the petition are against-
10th Street interchange as they feel it would hurt their business.
ALBERT E. CLAR'KE stated the State has decided that there is too
much traffic on the present freeways and they need -relief so they
decided to nut it through a certain part of our City with an on _
and off ramn at Division Street and one at 8th Street. Mr.
Clarke stated it is his belief that one off and on ramp will take
care of all the people who will want to use the Freeway. The
Council should consider this problem and obtain engineering ad-
vise as to the most feasible thing for the City as a whole.
CITY MANAGER BIRD stated he will not be able to write the letter
to Mr. Dekema for at least a week because of the other additional
data, which the State Engineers require.
THE MATmE7 OF THE r'IRE ALARM'' SYSTEM was nresented. CITY MANAGER
BIRD asked Fire Chief Bailey if his report made a recommendation.
The CHIEF said not, and thought it might be well to withhold any
decision at this time. COUNCILMAN HECK said he did not think at
the present time our budget is set up to handle a fire alarm
system and that it should be tabled until next year_and be con
sidered`in the next budget. Moved by Hollingsworth, seconded by
Fessman, that the matter of the fire alarm system be delayed un-
til next spring. Carried, all the Council rresent voting aye.
FIRE CHIEF BAILEY asked that the Council scrutinize the points
on rage three of his report which he has checker'.
REQUEST FOR REFUND on business license by John F. Shaver, was
presented. The refund due is 12.50 and the request was anrrovee
by the City Treasurer and _License Clerk. Moved by E_ollings7orth,
seconded by Heck, that the request be granted. Carried, by the
following tote to -wit: Ayes: Fessman, Heck, Hollingsworth,
Jensen, Hodge. Nays: None.
RESIGNATION OF E. T. G"UHCT from Civil Service Corzrmission was
read. Moved by Hollingsworth, seconded by Jensen, that the resig-
nation be accented and a letter be written thanking him for his
services. Carried, all the Council present voting aye.
COI.?MUNICATICN FROM NATIONAL SCHOOL DISTRICT making an offer for
the purchase of nrorerty, was presented. Moved by Jensen, se-
conded by Fessman, that the offer be turned down. COUNCILMAN
HECT stated he thought the Council and School Board should have
an informal discussion to see if the School Board has clans
where other logical sites could be utilized or whether this to -
the necessary site, and see if this matter cannot be solved.. -
Motion lost, by the following vote to -wit: Ayes: Fessman, Jen-
sen. Nays: Heck, Hollingsworth, Hodge. Moved by_ueck, second-
ed by Hollingsworth, that e letter be written to the National
School District in reply to their letter dated. November 9th
stating that the Council is giving due consideration to the matter
for denial or acceptance of their offer and that an informal
meeting be arranged between the membere of the National School
District and the Council for further exnlcring all possibilities
in relation to this nroerty. Carried,by the following vote to -
wit: Ayes: Fessman, Heck, Hollingsworth, Hodge. Nays: Jensen.
COMMUNICATION FROM TH7 SAN DIEGO COUNTY rrATro AT'TH.ORTTY was read,
Inclosed was a cony of Resolution No. 366; cony of the Engineers
report to the Metrorolitan grater District of Southern California
urging further study by the Metropolitan water District of the
problems indicated therein. It is suggested that member agenciae

of the Authority might adopt similar resolutions a.nd forward
them to the "a -ter District, CITY CL7PY ALSTON requested this
be referred to the City Attorney. Moved by Hollingsworth, se-
conded by Jensen, that the City Clerk's request be ennroved.

CITY MANAGER BIRD reported that Application 37353 to the Public
Utilities Commission by the Telephone Company has been forwarded
to him, which was information the City Attorney recueted.
CITY MANAGER BIRD stated he has an application to excavate P.r-
proximately 30,000 cubic yards of dirt, material from property
owned and located at the ^outh Bay Plaza. The filing fee of
x10.00 as required has been deposited. Accompaning the aprlica-
tion is a check for the one dollar per thousand yards for in-
spection, or a total of 30.00. It is the Engineer Depa.rtment's
recommendation that some provision be made to prevent persons or
objects from rolling down the steep cut bank that will be left,
this can be accomplished by a wire a fence of chain link variety
being installed at the to of the bank, the recommended height
would be 6 feet, COMMUNICATION FROM CITY MANAG7R. BI-.D eras read
recommending that the application of John J. Moore Company for
excavation Hermit be granted subject to conditions as setforth
on the application and in conformity with the recommendations of
the Engineering and. Street Departments. CITY MATAG`P,'BT'?D stated
he would recommend that a bond in the amount of '150,000.00 for
the completion of work be recuired and that a liability bond in.,
the amount of 0300,000.00 be required. Moved. by Heck, seconded
by Hollingsworth, that the City Manager's recommend'tions be al-
lowed, together with the required amount of bonds. Carried, by
the following vote to -wit: Ayes: Fessran, Heck, Hollingsworth,
Jensen, Hodge. Nays: None.
COYmUNICATION FROM ITATIONAL CITY KIWAIS CLIP T,ra.s reae-reouesting'
that the kitchen in the Community Building be enlarged, remodeled,
and refurnished. COUNCILAN FESS?TAN stated he thought the facil-
ities are inadequate end the kitchen should be remodeled, etc.
COUNCILMAN HFCK inquires' as to available money for doing this _
work. CITY VAnTAGF ' 'PIRD stated there has not been set un any
such amount, however the amount is indefinite end suggested this
be referred to Maintenance & Improvement for a cost renort.

quest be allowed to have 'taintena.nce & Improvement to prepare a
feasibility report and cost report for the council's benefit.

years ago was set uo on a 30 day basis, subsequently to that it
was set uo on a 40 hour week basis. It is the Manager's recom-
mendation that for the 'purposes of determining the hourly rate
to be raid, based on a 40 hour week established by the City _
Council, the following formula -shall be used in all comrmtations:
monthly salary divided by 173.33. Moved by Hollingsworth, se-
conded by Jensen, that the elan submitted by the City Manager in
establishing the hourly rate for City employees be e,,proved.

CITY MANAGER BIRD stated in regard to the question of our ser-
vices at the Community Building it is his recommendation that
for the extra, janitorial services, outside of regular employee
activity, the rate be established at 11.70 oer hour. Moved by
Hollingsworth, seconded by Heck, that the recommendation of the
City Manager be annroved. Carried, by the following vote to. wit :
Ayes: Fessman, Heck, Hollingsworth, Jensen, Hodge. Nays: None.
CITY MANAGER BIRD presented the cost report of lighting National
Avenue. This is a monthly cost break down for the continuation
of the mercury va.00r street lighting on National Avenue from 30th
Street to 13th Street. This.Trill be similar to the present -in-
stallation on National Avenue north of Pith Street. From 13th
Street to the south side of 24th Street, the cost Will be '198.85
per month• from 24-th Street to 30th Street, '120.90 per month, a _
total of 1319.75 per month. Moved by Heck, seconded by Hollings-
worth, that the mercury vapor lights be instelled_ on National Ave-
nue from 13th to 30th Street, at a total cost of 1319.�5 per month.

CITY MANAGER BIRD stated that due to the overtime work by our En-
gineering Dept, and because of the,method 9f calculation there is
due to the following meeeers of the Engineering force for hours
of work, as follows: F. S. Dudley, 5,days, 130.55; F. B. Finney,
5 days, 135.85; Edward C. Latham, 5 days, 122.75; Donald Newberry,
1 day, 15.54; Judson T. Naiman, 1' daay, 15.54; willa-rd G. Barrett,

CITY PLANNER WAGNER stated. on December 1st at 6:30 P.M. in the
Club House at the rear of the Town & Country Hotel in Mission
Valley the annual fall meeting of the San Diego County Planning
Congress will be held. All of the Planning Commissioners, City
Council members, City Staff are invited to attend, Installation
of new officers will be held, and our Chairman of the Planning
Commission, Sigbert 0. Granger has been nominated for President

of the Congress for 1956.
CITY PLANNER T}TAGN'R reported that the Planning dommission last
night received conies of the first draft of a. news subdivision
ordinance which will be ready for general distribution at the
command of the Commission. There are -conies available in the
Planning Office. The Commission may wish to go over some sections
of the ordinance in detail before they release it for general -
distribution. The proposed ordinance will set un higher stondarde
of subdivisions within the City, new methods of processing sub-
division maps, and would rdauire that the subdivider be resronsi-
ble for the location, not only of the street improvement but
normal tree planning program, the installation of street name
signs and be responsible for installation of street lights. The
proposal are subject to change after the review. One of the sub-
jects of this ordinance that may be somewhpt controversial le the
suggestion that from now on the split of any single parcel of
ground in National City into two or More parcels would reauire
the filing of some form of official man.
CITY'PLANT'TER WAGNER reported in regard to the discussion on high-
ways, that a tentative man.ha.s been prepared showing a. network
of major east -west streets. This map has not had official sanctiol
by the "lanning Commission.
CITY CLERK ALSTON announced the League of California Cities meet-
ing in Oceanside November 18th.
COUrTCTLIAN HECK asked if the subdivision ordinance previously dis-
cussed provided for putting in improvements, such,Rs sidewalks
and curbs. MR. WAGNER stated if the Commission and the Council
ihsist upon a tentative and final subdivision map, even for the
split of two parcels then the improvements required by the section
for subdivision maps would be_mandatory.
COUNCILMAN FESSMAN stated some time ago there Tens a, -recommendation
from the Planning Commission relative to closing an alley between
19th and 20th Streets on the west side of National Avenue request-
ed by Mr. Hamilton. The Commis^ion recommended the closing be 01-
lowed. Mr. Fessman stated he has since inspected the alley and_
sees no way for that alley ever being used as an alley, and_a.sk-
ed that the matter be opened un again for whatever procedure is
necessary.. Mr. Fessman stated he would like referred to the
Planning Commission for study a pronosa.l to wherever possible
where ownership is in blocks in that part of town, from one street
to the other than instead of the lots, going to the alley that they
be resubdivided and opened to the next street. National Avenue
could then be used for a front street, Roosevelt behind it would
be the service street or an alley, and than the same street would
be the service street for the alley for the block further west
and then the next street would be a front street. It is going
to be necessary to have off street narking for the warehouses in
that area. The blocks should be longer and front on two streets.
Either the City or some individuals own entire blocks in the area.

Hamilton to close the a11eyfrom 19th to 20th Street on the ?,rest -
side of National Avenue, es recommended by the Planning Commissior
be allowed. Carried, by the following vote to -wit: Ayes: Fess-
man, Heck, Hollingsworth, Hodge. Nays: Jensen. Moved by Fess-
man, seconded by Hollings/ rth, this be referred to the City,
Attorney for the preparation of an ordinance. Carried, by the

COUNCILAN HECK brought up the matter of'the sale of City owned
property between Division and Lth Street, Rnd asked the oresent-
sta.tua of the property, and when it would be possible to adver- ,
tise for bids and sale of the property. CITY MANAGER R/Rn stat-
ed it is up to the Council to determine how they wish to sell it,
whether in one piece or small pieces, what valuation you wish to
nut upon it, and other factors. COUNCILMAN Hra stated he
thought the property should be sold in one parcel. The question -
also arises whether we wish to sell it with'a proposed plot nlen
or sell it as raw ground. ALBERT E. CLARKE, was present and stat-
ed he thought the sale of this property should be put on the
April ballot. That the Council in 1950 out it to_the vote of the
people whether they wanted the land to be used as a golf course
and it was turned down. Then he And the Council sold the water
well that had been developed as the City had no further use of it.
COUNCILMAN FESSMA*T stated there are R number of people who wish
to build their own houses according to their own plans and not
purchase a home built by a subdivider, and that he would like to
see the subdivision plan Mr. Wagner has drafted carried out And
the subdividing And improving done by the City; not by City help
but contracted out to private contractors, under the supervision
of the City Engineer and the lots made reedy for suitable build-
ing sites. Mr. Fessma.n said he would like to see any citizen
have en opportunity to buy..a lot there if they so wish. COY CTL-
HAN HICK stated the sketches submitted provide for 308 lots,
more or less,.and the present subdivision costs for improvement
of vacant property is approximately 't1,500.00 a lot which'ould
amount to 4.62,000.00, which is too costly for the City.
COUNCIL70MAN HOLLINGST-►ORTH stated at a previous Council meeting
some time ago the real estate people disapproved of the City go-
ing into the real estate business. COU! CIwAN FESS3TAN a.skPd whether the City could form a corporation for the purpose of -
subdividing that property. ATTORNEY CURRAN stated the City has
only limited powers which the State Legislature grants, and as -
far as he knows at the present time there is not any provision
that would authorize the City to form any such semi public corr-
oretion. COUNCILMAN FESI AN asked if it would be possible in
the next Legislature to have such an action introduced for that
purpose. ATTORNEY CURRAN stated it is always possible for any
Legislator to introduce any proposal on any given subject as
long as it is not unconstitutional. COMNCILHAP' FTSSITAN said he
would like to see the sane general idea followed in regard to
0livewood Housing when it is released for sale to the nubile.
COUNCI1210?AN JENSEN said she was in agreement with Ir. Fessman
but wondered how we could finance it. MAYOR HODGE said he
thought if the City went into the business of subdividing it
might as well go into any other business, it is entirely out of
our jurisdiction to invest the dity's money in anything that
could possibly be a speculation, and would suggest that this
pronerty be nut up for sale to the highest bidder, with no string
attached other than the zoning ordinance. Moved by Heck, second-
ed by Hollingswerrth, that the City owned property_located east
of El Toyon,School between Division and Lth Streets be Advertised
for sale as a single parcel in accordance with the Title Company'•
description, with the sale of the lots to be zoned for a minimum
of 6500 square feet. In the advertisement of the bids that A.11
bidders be advised the proposed sketch is on file with the t'la.n-
nin, Dept. for the proposed development of the homes. Carried,

COUNCILM!,RA! HOLLINGS'*ORTH stated that recently lie- hi?d a zone
change come to the Council and due to it being a zone change
and somewhat different than ordi!ar31q"comes before the Rlanning

Commission there were no required improvements end sometimes
when those things come before the Countil it is possible, if _
we do not have sufficient time on it, there would be certain
things that should be required, would "slip by",_therefore she
would like to recommend that from now on where a. zone variance
or zone change is asked, that the City Engineer should have
those proposals before him before it comes before the Council
so we will not "slip up" on any proposed improvements that are
needed. CITY PLANNER WAGNER stated he Agreed with Mrs. Hollings-
worth in the respect that under normal circulst.nces and until
recent information was made available to him he was under the
assumption that there was little you could do except judge the
property on the change of land use, However, Mr. T'ragner said he
has now found out and the Planning Commission were advised last
evening of a method whereby any rezoning, especially for com-
mercial and perhaps for other land use, the state law requires _
two public hearings by the Planning Commission a.nd at least one
by the Council, It is the City Planners understanding that the
ordinance ?mending the zone ordinance, to make note of the change
of the zoning, may have a provision in it to the effect that such
rezoning does not take effect until R. subdivision map has been fil
ed on a parcel of land so involved in rezoning which has been
heretofore unsubdivided, that was discussed in the rroposed
zoning of Millers Annexation, A request for commercial prop-
erties along 47th Street was submitted to the Commission and was
protested vigorously by some. It had been proposed to the Plan-
ning Commission if this were to be considered favorably that a
recommendation from the Commission to the Council would contain
that provision, that said rezoning or zoning to commercial not
to bn effective until the filing of a tentative and final sub-
division ma» of the a.rea.. In the case of 8th and Harbison had
we knowledge of that particular instrument v all of those things
would have been accomplished. Mr. Hesseltine made public the
information that he would agree to apply with the City1s wishes_
forimprovement. This new approach will give us an opportunity
to get the needed improvements where commercial rezonings of un-
subdivided property, but where the property has been officially
recognized as subdivided property Mr. Wagner is not sure what
the legal effect would be in requiring improvements. COUTCIL—
rTOMAN HOLLITTGSwORTH asked if a niece of land that has never been -
occuoied, but is asking for a zone change, is classified as a
subdivision. CITY PLANNER WAGNER stated it it has never been giv-
en en official men number and a lot and block number and filed, it
would be considered as unsubdivided nronerty. M77. HOLLINGSWORTH
stated she thought the Engineering Department should also work
on this so all departments will be working together, and we will
not do one thing,in one case and something else in another.
Moved by Fessman, seconded by Jensen, that the meeting be closed.
Carried, all the Council present voting aye. Meeting closed at
