Council members absent: Heck„ 4 INISTR.ATIvE OFFICIALS present: Alston, Bird, Curran, Lill, Gautereaux, Whgner, Bailey, The meeting opened with pledge of allegiance to the Flag, followed by invocation by Rev. 'Faye Brice. Moved by Jensen, seconded by Fessman, that the minutes of the meeting of December 6, 1955 be approved Carried, all the Council present voting aye. , RESOLUTION NO. 6530 was read, Ordering the'issuance of,a permit to Wurster Construction Corporation to construct and maintain a driveway on Roosevelt Avenue, north of Second Street, Moved by Hollingsworth, seconded by Jensen, that the Resolution be adopted. Carried, all the Council present voting aye. _ RESOLUTION NO. 6531 was read, ordering the issuance of a permit to Standard Oil Company of California to construct and maintain two driveways at 12th Street,_and highland Avenue. Moved by Jensen, seconded by Hollingsworth, that the Resolution be adopted. Carried, all the Council present voting_aye. RESOLUTION NO. 6532 was read, granting a special zone variance permit to H. L. Williams for the purpose of reducing_the__front_ yard setback line from twenty_feet to ten feet on property described as follows: Lots 3,_4, 5, 6, 7, 8, and,9_ o.f Williams Manor No. 3 Subdivision. Moved by Hollingsworth, seconded by Fessman, that the Resolution be adopted. Carried, all the Council present voting aye. RESOLUTION NO. 6533 was read, granting a special zone variance permit to "P'ant-ago Tamayo for the purpose of constructing a vegetable stand, on property located at 1829 E. 18th Street. Said permit is granted upon certain conditions as setforth in the Resolution. COUNCILMAN HECK,presenta Moved by Jensen, seconded by,Feseman, that the Resolution be adopted. Carried, by the following vote to --wit: Fessman, Hollingsworth, Jensen, Hodge. Councilman Heck refrained from voting. RESOLUTION NO. 65,4 was read, directing preparation of assess— ment— "I<'r Avenue between 18th Street and 21st Streett_Wayne P. Lill, Engineer of Work and Supt. of Streets of the City__ of National City, is_hereby_directed to prepare an assessment diagram covering and showing the real property described in the assessment district setforth in Resolution of Intention No,,6454. Caizzie4, ail the Council present voting aye, TDORT FRONT THE TRAFFIC SAFETY COAU TTEE stated a request for 30 minute parking limit on Highland Avenue between 28th�and 30th Streets is being held for further study. A discussion was held on a request from the City Council asking for a -report on the advisability of putting a wire fence down the center of Highland Avenue in the vicinity of the Kiddie PlaylE.nd to prevent pedestrians from jaywalking. It was felt that such a fence would constitute a greater hazard to the flow of traffic ✓ than the pedestrian probem. It was recommended that some means be found to relocate the Playland_to some less dangerous location. ATTORNEY CURRAN reported on the _case of Frank Hynum, dba Chula Vista Sanitary Service which came urn for trial!. December- 2nd. After taking of the direct testimony of Mr, Hyrum during the time he was under cross exarnin_ation_by the City Attorney,..it_„ appears that according to the testimony of Mr, Hynum that co-- Partnerchip had eeased to exist sometime in At.gust of 1952, only one month after the making of the cont.-act. Accordingly the matter was put off the calender by the Y•t in order that the niaintii'f can comrjy with the fictit- oLz._, r:aine statues and then perfect his °lea -dings; until that time there is nothing to be done by the City ATTORNEY CURRAN reported on the action in the United States District Court, United States of America vs 130 acres,_of land, and the trial has been set for February 28, 1956, This is the matter reported on several times before which involves Mr. 'Thibodo., In order there will be no question as to the position of the City, it is requested that the City .Attornav be given specific 149 authorization to advise the Council tor the ob*ernment, that the figure shown in the recommendation is the atnoUnt of delinquent taxes due the City, and are the figures on ishich thisinatter proceeds trial. Moved by Heck, seconded by Jensen, that the City Attorney's action be appro ed by the City Councils Carried, all the Council present voting aye ATTORNEY CURRAN stated he had ro rapproval certificates of insurance submitted by C. S. Johnson, and upon examinatign__,it appears that these certificates are not correct in two respects; they,_do not name'the City ofNational City as co-insured, and the contract requires certificate of insurance regarding Work- men's Compensation, therefore it was referred back to the City Clerk -so that Mr. Johnson could be advised as to the discrepancies in his certificates. ATTORNEY CURRAN Stated, the City Council has had the request made by the San'Diego County Water Authority that the City pass_,a resolution, which was referred to the Attorney for study, Along with the resolution was a report which is a very, complicated volume that was prepared by the Engineers. We do not_have suf- ficient information to go on record at this time, and thereeom- mendation of the City Attorney is that rather than passing a resolution, that by letter the San Diego CountyWater Authority be advised that the City believes that the matter is ofsuch overwhelming importance and there are so many possibly conflic- ing_views that we prefer at the present time not to_go on record regarding_the matters which are contained in their resolution. Moved by Hollingsworth, seconded by Jensen, that the City Attorneys recommendation in regard to theresolutio be approved, and that a letter be sent to the San Diego_County Water Authority. Carried, by the following vote to -wit: Ayes: Fessman, Heck, _ Hollingsworth, Jensen, Hodge. *aye: None. HEARING ON SALE OF LOTS 1 to 10, BLOCK 48 was held at this time. No written protests were received„ Moved by Heck, seconded by Jensen, that the matter be referred to the City Manager' for the necessary steps to follow for the sale of this property, as there were no protests. Carried, all the Council present voting aye. CITY ATTORNEY CURRAN stated with reference to Ordinance 827_and the recommendation of_the Traffic Safety Committee as to the place that bheTraffic Safety Committee plays in the formula- tion of policy, that after examining the ordinance and the communication from the Traffic Safety Committee he is not clear as to what is being recommended or what is to be decided, Mr. Curran stated he needs further clarification and would like to refer the matter back_to the City Council for whatever_action O they desire; or it could be referred back to the Traffic Safety N. Committee with the request that they,make,specific recommendations to the Council as to what they,_desire with reference to any . possibility of amending Ordinance No. 827. Moved by H_ollings- worth, seconded by Jensen, this be referred back to the Traffic Safety Committee for specific recommendations. Carried, all the Council present voting aye. • J. R. SHATTUCK, 3909 El Cajon Blvd., -San Diego, was_nresent in regard to paving in Ricardo Terrace_Subdivision. kr. Shattuck stated that within two weeks they_ will. be ready for paving and requested he be permitted to pave the streets in a different manner than required by the Ordinance.. The request was denied at; the last meeting. In reading the ordinance over carefully and discussing it with the City Manager and Mr. Finney, 12/13 150 Mr. Shattuck stated he came to the conclusion that'the ordin— ance does not require paving inexoees Of 14" of asphalt_ concrete surface and 5;" of cement treated base. It is his understanding this ordinance had. been referred to the City Attorney for an opinion on the wording. CITY ATTORNEY CtURRAN stated this matter was discussed with him, by the City Manager last Friday and as yet he has not come to any conclusion as_to the_ proper interpretation of the ordinance, but will try to have it by the next meeting. P. W. Helsley, owner of the San Diego "Testing Laboratory was present and stated he was here to answer_ any questions that he could in regard to soil tests, paving, etc. COUNCILrOMEN HOLLINGSWORTH asked Mr. Helsley if he makes tests on soil for the various subdivisions in San Diego County and do they recommend the type of treatment for certain types of soils. PR. HELSLEY said to a very small extent, as it is., covered by ordinances of.the Citieg. _ COtNNCILWOIAN HOLLINGS'— WORTH stated she still feels that if this particular paving tha t is suggested by Mr. Shattuck, if in the opinion of the City Engineer it is adequate to give_ a street that will last twenty years, the request should be granted. COLWILMAN HECK__ stated the City Engineer's reports states this would be an adequate pavement. Mr. Heck stated he does not like to work a hardship but that he does_not like_to see any deviation from our ordinance, but there are times when strict adherence to the he ordinance would work undue hardships. Mr. Shattuck stated he had_discussed this whole -matter again with_the City Engineer and he would like to use 2" asphalt concrete and 6" cement__ treated base instead of 2" asphalt concrete and 7" cement treated base. _CITY ENGINEER LILL stated he would not onnose the 2" asphalt concrete and 64 cement treated base but would prefer the 2" asphalt concrete and 7" cement treated base. COTJNCILWOMEN JENSEN said we made our ordinances to live u' to them. COUNCILMAN FESSMAN said he had a lot of respect for Mr. Lill's judgment but we are making_a mistake by deviating from_ the ordinance, and that he is opposed to any deviation of the ordinance, Moved by Heck, seconded by Hollingsworth, that last week's action taken by the Council be rescinded and that the City Engineer's recommendation be followed which allom..rs the subdivider to install a pavement.gonsisting of 7" of cement - treated base and 2" of asphalt concrete surface for a total__ pavement thickness of 9". Carried,__br the following vote to —wit: Ayes: Heck, Hollingsworth, Hodge. Nays: Fessman, Jensen. Moved by,Fessman, seconded by Jensen, that the ordinance be amended to provide more stringent restrictions for the sub base material, and that it be referred to the City Engineer for a_ recommendation to the Council. Carried, by the following vote to —wit: Ayes: Fessman, Heck, Hollingsworth, Jensen, Hodge. Nays: None. MAYOR HODGE recommended that the Council send Seasonts Greetings to the various Councils of the County and to the Board'of Supervisors. Moved by Heck, seconded by Hollingsworth, that the Mayor's recommendation be followed. Carried, all the Council present voting aye. COMMUNICATION FROM MAYOR VERI'riLLION OF LONG BEACH was read__in regard to the Allen Bill nertaining to tidelands. CITY CLERK ALSTOIT recommended this be referred to the City Attorney,_as the Alien Bill could vitally__effect any Coastal City._ Moved by Hollingsworth, seconded by Jensen, this be referred to the City Attorney for a report. Carried, all the Council present voting Aye. 12/13 151 APPL?CATION TO MOVE A BUILDING BY Scott'S. Graves was presented. It is to be moved from 4262 39th Street, .San: Diego to 2335 Lanoitan Avenue. RE''ORT FROM THE BUIL13!NG tRSDECTOR recommended "i Y the granting of this request subject to tfollowing: 90 dayt'ime" limit; performance bond in the amount of 'ti,000.00; foundation, new electrical service and plumbing_ in accordance with National City ordinances. REPORT OF CITY PLANNER recommended that the ordinance requirements be followed and that the exterior lines of the structure be modernized with repainting and landscaping. REPORT OF THE BUILDING INSPECTOR AND RE?'ORT OF CITY PLANNER were read, recorlmending the application to approved subject to the restrictions_set- forth in the reports. Moved by Heck, seconded by Hollingsworth, that the moving be permitted, subject to the City Planner's recommendation and the recommendations of the_Building_Insnector, and that off street parking be_provided. Nays: None. 1!INUTES OF MEETING OF NOVEMBER' 28, 1955 OF PLANNING COMflITTEE FOR DEVELOPMENT OF SAY DIEGO BAY were presented. There is to be an important meeting December 19th, 9:30 A.M. in the San Diego Council Chambers of the entire San Diego Bay Development Committee. COM UNICATION FROM DIVISION OF HIGHWAYS was read concerning _ proposed traffic interchanges for the freeway through National City. The City's proposal to provide interchanges et 10th Street and at 4-th Street in place of thepronosals of the Division of Highways for interchanges at 8th Street and Division Street will receive further study. The City will be advised when the studies have been completed. CITY MANAGER BIRD stated in regard to the call for bids on the liability insurence called for the 19th, a letter was received as_ follows: COMMM?UNICATION FR01 ' . GX" H.` GO0Dt+.TIN CO TPAPTY was read stating_in accordance with your request we attach three copies of the policy experience under the captioned contract. The Great American Indemnity Company_is umwilling to write Bodily Injury Liability on a deductible basis as provided in the specificaions. The final paragraph on page two of the specifications voids any bids submitted as an alternate. Unless there can be some modification, it would appear that the specifications prohibit us from entering a bid, CITY MANAGER BIRD 12/13 152 stated this is in reebonee to our asking our present carrier for loss ratio for the last twoyears_and nine months which they have supplied us. Mr.Bird stated in regard to the deductible basis the specifications are not on a deductible basis. , COIUNICrTION FROM IRS. PAUL E. BRUCE, Long Beach, was read,- expressing appreciation for the wonderful job the instructors did at the National City plunge. CITY MANAGER BIRD reported in regard to the request for a,_traffic signal at 13th Street and Harbor Drive, the Division of High- ways have agreed to conduct a study and if the study shows favorable and meets the Division of Highway's standards we will go ahead with the installation on•a fifty-fifty basis, RE?ORT FROM FRANK B. FINNEY, Asst. to. the City Engineer, isas read in regard to proposed street lights at the intersection of 8th Street and Palm Avenue, the minutes of the Traffic Safety Committee dated January 12,.1955, stated: "Proposed fights at Sth Street and Palm Avenue were also deemed not advisable at this time since the presence of the signal standards themselves would constitute a road✓hazardin the absence of curbs at.this intersection." The curbd on the north side of 8th Street would have to await the improvement of the drainage channel which in turn would have to await solution of the overall nroblem_of drainage in Paradise Valley. A plan of channelization for this intersection is currently_under study by the Traffic�� Safety Committee, a final plan of which should be presented he "Council in the near future. CITY MANAGER BIRD stated in regard to_ a traffic signal at-18th- and Palm is being considered, if and when the proposed improve- ment of 18th Street is carried to its conclusion. CITY MANAGER BIRD stated in going into the seat bench folder he discovered there was in existence a contract, and there still__ is a contract with the San Diego Seat Advertising Company. They have changed ownership and the new owner has proved ea.tis- factory to him and his office. The,new owner, E. 0. Hillman would like to have the contract reassigned to San Diego Seat _Advertising Company, E. 0. Hillman, owner, instead of the San Diego Seat Advertising Company, B. J. Primmer. COUNCILWOMEN HOLLINGSWORTH inquired about any monies which might be_ -owing the City under the contract. CITY MANAGER BIRD stated that the contract was entered into in 1947 and subsequently added to in 1952, running to and including August, 1957. This contract' sets forth certain stipulations, and they are to pay n1.00 per bench per month. Mr. Hillman took over this business from r. Primmer in March 1954, and he has been paying the City of San Diego for these benches in National City. This contract _ is not an exclusive contract, and in order to straighten this matter out the first step necessary would be to allow a,transfer on assignment fro Satn Diego Seat _Advertising Company, B. J. Primmer to San DiW Advertising Company, E. 0. Hillman, owner, and it is Mr. Bird's recommendation that this be'done. Moved by Heck, seconded by Jensen, that the assignment, as recommened by the City Manager, be allowed. Carried, all the Council present voting aye. CITY MANAGER BIRD stated we will continue to collect the back money and bring the insurence policy_lar to date as required by the contract. COTJNCIrJMAPT TICK stated in the event this company does not wish to r,lace more benches in the City we might contact other companies. CITY MANAGE_B BI'D_ stated_we have a proposal from the California Bench Company, _ also a concern in El Cajon, but they feel that they should pay no money. A proposal from the California Bench Company.�_riil be forthcoming. 12/13 1,53 CITY -MANAGER BIRD reported in regard to the paving of'Ricardo Terrace Subdivision which was. approved by the Council, it will be necessary that a resolution--be^prepared, and he would so recommend. CITY MANAGER BIRD stated on December 6th an informal meeting between the Board of the National.School District and the Council was held and it was the understanding of the School Beard that action by the Council would be taken in this meeting. Moved by Hollingsworth, seconded by Reck) that the City Manager_ write to the Commandant of the Navy asking, the position of the Navy on releasing any property. Carried, by the following vote to —wit: Ayes: Fessman, Heck, Hollingsworth, Jensen, Hodge. Nays: None. COIFTUNICATION FROM UNIVERSITY OF CALIFORNIA., DEDARTMENr OF ENGINEERING was read regarding the eighth annual conference on Streets and Highways to be held January 25th to 27th at the University of Southern California in Los Angeles. CITY MANAGER BIRD stated it is his recommendation that two members oL the Engineering staff be allowed to attend this conference., 7Ioved by Hollingsworth, seconded by Heck, that the request be granted. CITY MANAGER BIRD stated we received a Memorandum of Agreement from the State Division of Highways providing for expenditure of the gas tax allocation to cities,_and recommended the Mayor and City Clerk be authorized to execute the contract and a resolution be prepared. -Moved by_Fessman, seconded by Jensen, 'hat the City Manager's recommendation be allowed, Carried,, by the following vote to -wit: Ayes: Fessman, Heck, Hollings— worth, Jensen, Hodge. Nays: None. RESOLUTION NO. 6535 was read, adopting_and approving memorandum of agreement for expenditure of funds allocated under Section 2107.5 of the Streets and Highways_Code, and the Mayor and City Clerk are directed to sign the same on__ behalf of said City. Moved by Fessman, seconded by Jensen, that the Resolution be adopted. Carried, all the Council present_voting aye. COMMUNICATION FROM CITY MANAGER BIRD ?.ras read stating that _ because of multitudinous activities and the pressing need of applying his entire time to the office of City Management, he is tendering his resignation as Fire Marshal of the City__of National City effective December 15,,1955. Moved by Jensen, seconded by Hollingsworth, that the resignation of Mr, Bird as Fire Marshal be accepted with regret. Carried, all the Council present voting aye. COMMUNICATION FROM P. M. MAHAFFEY was read stating that having checked the map of the proposed rezoning of the section of_ National City west of National Avenue he discovered that_two small island —like sections have been excepted from what appears to be an otherwise industrial zoning of this area. It is his understanding that these exceptions were made with the idea of satisfying a tew people who objected to the abatement clause in the ordinance, and now that the abatement clause has ceased to be an issue is convinced that the people in these sections would be agreeable and grateful for an M-1 zoning for the -whole area. 4 12/13 154 If these two small areas continue to be in -residential zoning it will mean that they are surrounded by industrial zoning_ana a freeway on alb. sides, which wouiddiscourage any residential _ _ building or improvement_ and also eliminate the possitility_of ._ using the property for commercial purpose, Mr. Mahaffey_states he owns Lots 1, 21 31.and L, Block,_26, which are located on_ the Southeast corner of llth and Coolidge, with commercial buildings on each side. Th.is_proposed zoning will leave this property in a residential zone, but within one half b_l9Qck_on the North and one block on the West, an M--1 zone.__ It is his desire to have the above lets included in the M 1 zone, so that he can remote an :old house and erect another commercial building. COUNCILWOMAN HOLLINGSW3RTH stated the Pianning_Commission felt that the initiative should come from those people in the two_ zones, and that a letter be sent to Mr. Mahaffey asking him to get a petition signed by the people in these two islands,t reques- ing the_Planning Commission and Council to include them in the M-1 zone, in the zoning ordinance. CITY PLANNER_WAGNER stated the property owners should indicate their willingness to have this property rezoned. A copy of.this letter was brought to the attention of :.he Planning_Commission last night and they -.ve set January 23rd for an official discussion on the proposed o:d.inance. Also to be discussed is the rezoning of the__North- aast and Southeast corner of 8th and Palm which is being consid- e''ed for commercial zoning. The Commission will set up_a public hearing date for the revised ordinance and :.one .clan before sending it back to the Council. Moved by_Hollingsworth, seconded by Heck, that_a letter be sent to Mr. Mahaffey by the Planning Commission notifying him of the action lest evening and reiterating again_ the advisability of presenting a petition from other property owners in that area. Carried,_ all_ the Council Present_voting_aye. CITY PLANNER WAGNER asked fora clarification in regard to -the zoning ordinance being referred back to the Planning Commission for the purpose of defining_hardship cases. COUNCILMAN FESSMSN stated it is his understanding that_in zoning as__far as zone variances are concerned we should consider the land use only and - not the people living on the land; people do not enter into hardship cases, it is the land use inself. __COUNCIL?'rOiAN HOLLINOA SWOI1TH concurred. CITY PLANK ER_wAGNER_ said he cannot say that he is qualified to determine as to how to properly handle that particular matter. It should be pet.up as policy by both_the Planning Commission and the Council to instruct the staff not to accept applications for zone variances unless the hardship can be proven. COUNCILMAN FESSMAN said he thought it should be _ in the ordinance for the reason it_comes back to the matter of principles, if it is simply a matter of policy it can be deviated from but if set up in the ordinance it cannot be so easily_done. CITY PLANNER WAGNER stated he will endeavor to work something out in the ordinance, and suggested a revision of the present applications for zone variances. COUNCILWOMAN HOLLINGSWORTH said she thought an application blank as suggested should be set up. MAYOR HODGE stated according -to reports it appears there are four Planning Commissioners whose terms expire on January 21, 1956 and questioned if this was correct.
