Council members present: Fessman, Heck, Hollingsworth, Jensen, Hodge. Council members absent: None. ADMINISTRATIVR' OFFICIALS present: Alston, Bird, Curran, Holgate, Lill, Wagner, Gautereaux. The meeting was opened with pledge of allegia.n.pe to the Flag, followed by invocation by yer- gedge. ,,, -=/d- CITY PLANNER'7AGNER asked that the minutes of the last meeting be corrected, as follows: in the third and. ninth lines from the bottom on Page 161 the word"•revert" be changed to "refer", and on nage 162 the date of February 9th be changed to February 13th. Moved by Hollingsworth,.seconded by Jensen, that the minutes of December 20th as amended, be approved. Carried., all the Council present voting aye. RESOLUTION NO. 6513.0 was'read, approving assessment' diagram Z""" Avenue). Moved by Heck, seconded by Hollingsworth, that the Resolution be adopted. Carried, all the Council -,resent voting aye. ORDINANCE NO. , "AN ORDINANCE OF TH7 CITY OF NA'I0'TAL CITY REGULATING THE' INSTALLATION AND 'T,IOVAL OF �'ACILITITES I'T ''U;LIC STREETS AND OTHER ',mac PLACES", was 'resented for the first reading and read in full. ATTORNEY CUPRAN reported that the Certificate of Insurance issued by the State Compensation Insurance Fund certifies that Pace Construction Company has a policy an'roved by the Insurance Commissioner for Workmen's Compensation. The Certificate is in order and recommended it be approved and filed. TToved,by Heck, seconded by Jensen, that the Attorney's recommendation be allowed. Carried, by the following vote to --wit: Ayes: Fessman, Heck, Hollingsworth, Jensen, Hodge. Nays: None. ATTORNEY CURRAN reported that the Metropolitan water District has officially advised the City of National City that the Decla-' ration of Intentions which the Council adopted has been accepted, as required by law, by the Controller of the Ietronolitar_ 'eater District. ATTORNEY CURRAN stated on December 22nd an informal hearing called by the Public Utilities Commission was held with refer- ence to the application of the San Diego Gas & Electric Company for an increase in electric rates. It annears that the Gas '. Electric Company are no longer attempting to innose a foul' zone system, and their position now is to stand on a two zone system and it will be uD to whoever proposes a system different to the present two zones to bear the burden of proof of showing why _ more than two zones are necessary. There is someone who is advocating many more than two zones so we will still have to be very alert to make certain that our rights as to zoning are not put in jeopardy. CITY ATTORNEY CURRAN reported that the Argonaut Insurance Ex- change has issued a Certificate of Insurance certifying that Electrical Products Corporation &/or Electrial Products Stu_oay Company has a valid Workmen's Compensation Insurance Policy in a form anrroved by the Insurance Commissioner of California, 12/27 164 that it appears to be in order, and recommended it be approved and filed. Moved by Hollingsworth, seconded by deck, that the Insurance Policy be aprroved and filed. Carried, all the Council present voting aye. COMMUNICATION FRO"" KENNETH L. HELSIE was read requesting consid-' eration'of installation of street lights in National Vista Homes, at Beta, Mesa and Lanoitan, North of Division and East of Euclidz also pedestrian cross walks, especially across Euclid at ^,eta. Moved by Hollingsworth, seconded by Heck, this be referred to the Traffic Safety Committee. Carried, all the Council present voting aye. COMMUNICATION FRO''' SAN DIE'GO COUNTY PLANNING CONGRESS regarding subdivision standards was _presented and laid over until the next meeting, COMMUNICATION FROM SAN DIEGO CHAP ER OF COM74ERCE was rear_ stating that the Board of Directors passed. a resolution urging integra- tion of City and'County nark acc_uisition and development. Moved by Hollingsworth, seconded by Heck, that the City Planner for- ward to the County, City of San Diego and the San Diego Chamber of Commerce a letter regarding our proposed plans for narks in National City, and also giving the amount of area and the type of park, including the proposed parks. Carried, all the Council present voting aye. COMMUNICATION FROM CHIEF OF POLICE SMITH was read regarding resig- nation from Officer Richard Donovan, and recommending,the a.ccent- anee of same. COMMUNICATION FROM RICHARD J. DONOVAN was read submitting his resignation from the Police Department, effective December 31, 1955 and requested that his name be kept on the Civil Service list for a •period of one year after his resignation. Roved by Fessman, seconded by Jensen, the resignation be accented with regrets and suitable appreciation for his services, and that his name be kent on the Civil Service list for one year. Carried, by the 'following vote to -wit: Ayes: Fessman, Heck, Hollingsworth, Jensen, Hodge. Nays: None. ?FARING ON ESTABLISHMENT OF R-2 ZONE FOR MILLERS AN"EJLATION was held at this time. No written protests were received, and no one was nresent objecting to same. Moved by Heck, seconded by Hollingsworth, that since there are no protests, the hearing be declared closed, and the Attorney be instructed to nrenare the necessary ordinance to zone the property R-'L. Carried, by the following vote to -wit: Ayes: Fessman, Heck, Hollingsworth, Jensen, Hodge. Nays: None. HEARING ON APPAL OF ZONE VARIANCE OF JACINTO T)IAZ, JR. was held - at this time. The Planning Commission denied his request for a zone variance. The petitioner requested variance in square foot- age requirement and side yard requirement to remodel rear unit, which is considered no -conforming according to the present ordi- nance. MRS: '~ALODY, 6186 Cumberland Street, San Diego, was pres- ent and stated they rented an apartment at 1615 Orange Avenue from June 7, 1946 until Nov. 1, 1955, and from what she has been able to learn it has been a two family residence for 15 years. CITY MANAGER BIRD stated that Ordinance 622 shows that the nron- erty in question was as of 1948 or prior thereto an R.-2 zone. MAYOR HODGE stated he thought permission should be given to_ preserve the present property but not to increase it. Moved by Hollingsworth, seconded by Fessman, that the Planning Commission's recommendation be sustained. and since this was built before Ordinance 750 was in effect Pr. Diaz should have the use of the 12/27 165 rental, however it should not be added to and the Building In— snector should go out'and make a survey to see whether the build— ing is un to standard, and if it cannot be brought up to stand- and it is un to the Building Inspector to rule that it is impos— sible to bring it un to standard and it would revert to garage usage. Under no conditions should he be allowed to add a room or violate any regulations. Carried, by the following vote to — wit: Ayes: Fessman, Heck, Hollingsworth, Jensen, Hodge. Nays: None. A:SRLICATIOTT FOR TRANSFER OF ON SALE :SEER AND tTINF LIC"NSE to Dominick1e, 2533 National Avenue,'was presented. Moved by. Jensen, seconded by Hollingsworth, that the application be filed. Carried, all the Council present voting aye. APrLICATION FOR OFF SALE BEER AND '"INF LICF'NSE to Otiiia I'Iarin, 164.0 McKinley Avenue; was presented, Moved b^ Jensen, seconded by Hollingsworth, that the anrlication be filed. Carried, all the Council present voting aye. CITY MANAGER BIRD asked whether the Council wishes to_give the service award pin and certificate to resigned Richard Donovan as he has five years of service with the City. It was the concensus of opinion of the Council that he should be given the pin and certificate. CO'TMUNICATION FRO:T SAN DIEGO COUNTY '?LANT'TING COr'TNISSION was read stating it seems probable that State funds will be available for the acquisition, development, inrrovement and oreration of small crafthancors, Tho County Board of Supervisors has recognized_ the need for dtate—financed small craft harbors at apnronriate places along the coast of San Diego County. The Board also has recognized the need for a San Diego County Master Plan for Small Craft Harbors which includes both incorporated and unincornorated territory and has directed the County Planning Commission to prepare such a plan with full cooperation of the various cities concerned. A reply to questions as setforth in the communication was requested. Moved by Hollingsworth, that the City Manager answer this communication and state that we are still planning on the small craft harbor and will furnish the available infor— mation and that City Planner rwragner will be the rerson who Trill - work with the County Planning Department. After some discussion the motion was seconded by Heck, Carried, all the Council pres— ent voting aye, COfl t)NICATION FROM ARTHUR HENDFI SHOT, President, Municipal Employees' Association was read, requesting that consideration be given at this time to the proposed salary survey and wage adjust— ment which has been planned under the current budget schedule. CITY MANAGER BIRD stated there was an amount of money setup in the budget for the Civil Service Commission to rrenare a study of job classifications, and that in his letter to the Council at the adoption of the budget he recommended that a study at the end of six months be made of the budget in its entirety with the view in mind of examining those nossibie inequities which might appear or exist after our first six months In onera.tion. Moved by Hollingsworth, seconded by Jensen, that the City. tanager be empowered to have a survey or classification of salaries and it be left to his discretion whether he needs to hire someone from the outside. CITY MANAGER BIRD stated the City Manager is charged by ordinance of preparing a salary schedule. The plan class— ification is the province of the Civil Service Commission, and 12/27 166 they should follow through. '.'s in Management will attemnt,to supply them, and have been sunnlying them with all the recent surveys we have in our possession. Moved by Hollingsworth, seconded by Jensen, that the last motion instructing the City Manager to conduct a salary survey and job classification analysis be rescinded. Carried, all the Council present voting aye. Moved by Hollingsworth, seconded by Heck, that the City Manager prepare a salary schedule analysis. Carried, all the Council present voting aye. Moved by Hollingsworth, seconded by Heck, that the City Manager. ascertain, and repor to the Council the statis of the Civil Service Comriission,/ ob,analysis survey, and whether they need any_. outside help to complete it. Carried, by the following vote to --grit: Ayes' Fessman, Heck, Hollingsworth, Jensen, Hodge. Nays: None. REPORT FROM THE n:LANNIN'G COMMISSION regarding communication from Howard S. Colburn, Jr., 126 F. 5th Street, which was laid over from the last meeting pending a report from the City Engineer's office, was nresen'tied, and o:'r1ered continued, REPORT FRGY THE PLANNING CcM7rr:SSICN was read, which stated that January 23, 1956 eras set aside for final oisogssions on the ordinance and a public hearing be held on Monday, February 13, 1956 after 7:30 Palk and requested that City Attorney Curran be permitted to attend the January 23r. d meeting. COTTNCILMAN HECK asi_ed if Attorney Curran felt it would be necessary and pro.,er to attend this meeting. CITY ATTORNEY CtJRRAN stated he made it clear at the time he was sworn in as City Attorney that he did not feel that any part of his duty involved the question of policy. COUNCILMAN hFCX stated the A.t o:oney might be considered in a policy making category if he atpea�^ed at the meeting, and that he did not think it would be necessary to have the Attorney in attendance at 'that meeting. CITY PLANNER TTA.GNE'R stated in regard to the request of the_Com— mission for tiie Cit�r Attorney to atten3 the hea.ring_on the pro— lposed zoning ordinance, C.rd;nance 729 which established the Planning Commission has 'nit the statement that the Planning Commission whe.il have the services of the City. Engineer and the City Attorney, and that was the reason for this request, The Commission would not wish at any time to place the City Attorney in an unfavorable rosition in any of tnese matters, but they. feel that some of the 'Jechrica_i -?nase:s of the 'next itself could be clarified at such an informal discussion, ix. order to have a minimum of corrections and changes on the final draft. CITY PLANNER wAGNER stated a reouest had been made that the - Council be furnished T-rith the data discussed at the recent San _ Diego County Planning Congress dinner mcPting.
