, 260 National City, California, April 19, 1955 Regular meetingaof the City Council was called to order by P?ayor Hodge et 7:30 P.M. Council members present: Hollingsworth, Jensen, Parchen, Hodge. Council members absent: Heck., ADIINISTHATI?TE OFFICIALS present: Alston, Bird, Curran, Lill, Wagner, Gautereaux, Bailey. The meeting was opened with ,ledge of allegiance to the Flag, " followed by invocation by Rev. Knight. Moved by Jensen, seconded by Hollingsworth, that the minutes of - the regular meeting of April. 5, 1955, be annrove. Carried, by the following vote to -wit: Ayes: Hollingsworth, Jensen. Coun- cilmen Parchen and Hodge abstained from voting. Mays: None. Absent: Heck. RESOLUTION N0. 6384 was read, a.,nroving the application of Joser"_ Damico for a remit to construct an over -sized driveway at 1LL06 National Avenue, and it is,hereby ordered that a nernit be issued as per the sketch attached to said Resolution. Moved by Hollings- worth, seconded by Parchen, that the 'resolution be adopted. Car- ried, all the Council present voting aye. RESOLUTION NO. 6386 was read, adopting scale of prevailing wage rates in connection with the 'ronosed_ im,rorement of Harbison Avenue between the centerline of Fourth Street and the center- line of Division Street. COUNCIIPTOr_AN HOLLINGS''a0-TH stated there is a bill in Sacramento which would do away with the advertising of wage scales, so that when a notice to bid is advertised the wage scale will be in the specifications. ATTORNEY CURD.AN stated at the present time National City has over a year to go on its contract for the collection of garbage. rILLIAH NOESER was present and stated there have been two test cases in Los Angeles and in San Diego T:hich Fives the right to the individual that garbage is their own private prop- erty, and it has been defeated where there has been any_means of trying to keen a man from disposing of his own garbage, if he - has a permit. M'S, KODISH was present and asked if tree trim- mings, shrubbery, etc.,. is excluded under the definition of rub- bish. ATTORNEY CURRAN'stated the answer is "yes".. REPORT FROM THE PLArrirG' CO"T''ISSIOr was read, arr-'oving the re- quest of Robert T. Ingle, 2537 E, 13th Street for an�nroval to establish a thirty-six foot travelway within a fifty-five foot right of way in front of his property at the intersection of 13th Streit arid Harbison Avenue, subject to the approval of the City Engineer, COUNCILMAN PARCHEI`T asked the City Engineer if there were some circumstances present which prohibit a 6o foot right of way. CITY ENGINEER LILL stated Mr, Ingle's house is very close to the street and-•-e_do have a twenty-five foot right of way in the centerline of 13th Street, and on the South there is a thirty foot right of way. Thirteenth Street is in process for 1911 Act improvement and we are working on the nlans. It is only two blocks long, and it appeared that under the circumstan- ces it would be feasible to put in a thirty-six foot street, Moved by Hollingsworth, seconded by Jensen, that the Planning Commission's recommendation and the City Engineer's recommenda- tion be sustained. Car-ied, all the Council present voting aye., REPORT FROM THE PLANNING COMMISSION was read regarding F,T, llia.ms Manor No, 3 revised Tentative Map. The revised man showed dele- tion of the northerly 200 feet and the southerly 350 feet which includes the drainage ditch and proposed eighty foot Twelfth Street from the originally annrowed elan. H. L. 'Till.iams, OT•Tn- er and subdivider, explained that he hada.n offer for the Nor- therly 200 feet for a commercial development and_ that he real- ized he would either have to obtain a zone change or variance for the property. SHATTUCK was read asking that the Council give consideration to the deletion of sidewa.l'- -s on that portion of Richardo Terrace Subdivision described as follows: Along the south side of Ricardo Street between "" and "S" Avenue, the east side of "R" Avenue and the west side of "S" Avenue lying south of T-iccardo Street. The aren. described lies outside the subdivision and the existing hous- es within it front on Division Street. Any such sidewalks would be at the rear or side of these houses and of tittle or no use to them. On both "R" and "S" Avenues- 1r.
