National City, California, April 21, 1954
Adjourned meeting of April 20, 1954, of the City Council was
called to order by Mayor Hodge. Council members presents
Heck, Hollingsworth, Jensen, Parchen, Hodge, Council ri6tbrs
absent: None.

The meeting was opened with the _ledge of allegiance to the Flag,
and invocation by Heir. Floyd Pittman.
APPOINTMENT OF PLANNING COMMISSION MEMBERS was Presented.
COU=TCIT AN HECK stated the resignations of the members was not
accented at the lest meeting, and the resignation of one of the
members of the Commission was not offered last night, and un-
less that member is present to tender his resignation, the
City Clerk'should be instructed to inform Mr. Elmore, by regis-
tered mail, that the Council by majority action has requested
the resignation of the entire Planning Commission. Moved by
Heck, seconded by Hollingsworth, that a letter be written to
Mr. Elmore asking for his resignation. Carried, by the follo?•r-
ing vote to -wit: Ayes: Heck, Hollingsworth, Hodge. Nays:
Jensen, Parchen. Moved by Hollingsworth, seconded by Heck that
we accept the resignations of those who resigned from the Plan-
ning Commission. Carried, by the following vote to -wit: Ayes:
Heck, Hollingsworth, Hodge. Nays: Jensen, Parchen. COUNCIT-
'•TOMA? JENSEN stated she wished to go on record as opposing it
as she objects to the manner in which the Planning Commission
was asked for their resignation. COUNCILMAN HEC" stated he has
contacted four Peonle who have expressed their willingness to
serve on the Planning Commission, and nominated the following:

IMPROVEMENT OF 18TH STREET was presented. CITY CLERK ALSTON
asked City Engineer Marwick if he had any further information
in this regard. CITY ENGINEER WARMICK stated he. had nothing at
the present time. We are waiting for additional signatures to
the petition requesting the Improvement Act. Moved by Heck,
seconded by Hollingsworth, this be laid over until the next meet-
ing. Carried, all Council members present voting aye.
THE MATTER OF THE BANJO STREET OF ROBERT GILL, 305 E. 29th St.,
was presented. CITY CLERK ALSTON stated this Was laid over for
Mr. Gill to bring in deeds for street purposes, and asked the
City Engineer if any deeds have been Presented. CITY ENGINEER
WARWICK stated they have not. Mr. Gill is requesting an un-
balanced dedication and also the consideration of the Council
in allowing him to put in a Cul-de-sac with an 80 foot diameter.
ROBERT GILL, 305 E. 29th St., was present, and stated he looks
at it mainly as a change of a proposed street. It is a pro-
posed 80 foot street and we propose to change it to a 60 foot.
It is also a proposed through street and it is almost impossible
to have a through street so they wish to propose a 60 foot street
with a cul-de-sac. MAYOR HODGE stated it would be his recom-
mendation that it be referred back to the Planning Commission.
Moved by Parchen, seconded by Jensen, that this Matter be re-
ferred back to the Planning Commission, Carried, all the Council
present voting aye.
MAYOR HODGE appointed the following Council members to serve
on the Finance Committee: Hollingsworth, Heck and Hodge. Coun-
cilwoman Hollingsworth was appointed chairman of the committee.
COMMUNICATION FROM :SWELITWATER UNION HIGH SCHOOL DISTRICT was
read, relative to High School seniors participating in City
Government Day, Hay Lb, 1954. Moved by Parchen, seconded by
Jensen, that the City Clerk be instructed to send a letter to
the School District welcoming the students. Carried, all the
Council present voting aye.
COMUNICATION FROM THE SAN DIEGO COUNTY BUDGIE SOCIETY was read,
with reference to an ordinance proposed by the Planning Commis-
sion restricting the keeping of birds, chickens, etc. CITY
CLERK ALSTON stated it was her suggestion that it be laid over
as the report of the Planning Commission has not been Present-
ed as yet.
APPLICATION FOR OFF SAT,F' BEER & WINE BEVERAGE LICE T--7E to Cozine ° s
Grocery, LO2 W. 13th St, , was presented. REPORT F Rc : POLICE
CHIEF SMITH was read, stating the Record Division ofthe State
Bureau of Criminal Identification and Investigation fails to
disclose any criminal record of applicant. However, this loca-
tion is within one block of the First Christian Spiritualist
Church. COUNCIUTAN PARCHEN stated it has been the policy of the
past Council to protest any issuance of new licenses primarily
for the reason they felt there were too many in the County.
There are other reasons, such as being too close to schools
or churches. Moved by Heck, seconded by Hollingsworth that
the application be•approved, Carried, by the following vote
to -?grit: Ayes: Heck, Hollingsworth, Hodge. Nays: Jensen,
Parchent because it is too close to a church.
COMMUNICATION FROM CITY ATTORNEY OF CORONADO was read, relative
to San Diego Bay, stating he has been instructed to e_:nedite the
matter of granting a transfer of territory to the City of San
Diego to create a corridor in accordance with the discussions
and meetings which have been held in the past.. The last pro-

posed corridor which as acceptable to the cities, is known to
all parties concerned and the proceedings may be started when
the cities of Chula Vista, Coronado,• National City and San
Diego have expressed agreement in regard to this corridor. It
was suggested that a written description of the corridor be pre-
pared, and as the City of Coronado has no regular engineer it
would be appreciated if the City Engineers of National City and
Chula Vista prepare the description. The City of San Diego and
the City of Coronado desire to proceed immediately and would ap-
preciate a letter from National City stating their agreement with
the proposed sfforridor. When this letter has been received the
City Attorneys of the various cities should be authorized to
meet and draft the necessary proceedings for submission to the
various City Councils. If this corridor is not acceptable to
any of the cities concerned, they would appreciate having this
knowledge as it will have a direct effect upon the course of
action which will be taken by the City of Coronado in an at-
tempt to solve this problem. CITY MANAGER GAUTEREAUX stated
it seems as though the City of Coronado is asking for coopera-
tion as well as asking that a job be done from a municipal gov-
ernment that is not bidding for e corridor. We do not need one
at the present time we have area in front of us. There are
cities that are in accord and no doubt the City of San Diego is
far better equipped as far as time, and number of engineers who
can present a detailed description of a corridor such es they
might be interested in. MAYOR HODGE requested this be laid ov-
er.
GRANT DEED FROM JOSEPH FRANK & AMY E. BOCHNIAK for the Southerly
20 feet of Lot 318 of Lincoln Acres Annex No. 2, was presented.
CITY ENGINEER WA~WICK stated this is for a part of a street
which the City has been trying to develop. When the area what
would be 19th Street between Rachael and Granger was laid out
in the original subdivision it was only laid out as a 20 foot
street with lots 290 feet in depth. Moved by Heck, seconded
by Parchen, that the deed be accepted end referred to the City
Attorney for the preparation of a resolution to be presented at
the next meeting. Carried, by the following vote to -wit: Ayes:
Heck, Hollingsworth, Jensen, Parchen, Hodge. Nays; None.
REPORT OF THE CITY TREASURER for the month of March, 1954, was
presented. Moved by Heck, seconded by Parchen, that the report
be accented and ordered filed. Carried, all the Council present
voting aye.
APPT.ICATION FOR TAX SALE on Lot 13, Block 174, National City, by
Metropolitan Securities Company, was presented. The sum of
4.00.00 has been deposited as the opening bid, CITY CLERK ALSTON
stated it has been the policy of the Council in the past to re-
fer this to the City'NIanager to obtain an appraisal of the prop-
erty. BERNARD BANKE, representing the Metropolitan Securities
Company, was present and stated this lot is located on the
Northwest corner of 19th and ?'Filson. MAYOR HODGE requested this
be referred to the City Manager for an appraisal,
CCbIl UNICATIOI. FROM CENTRAL BAPTIST CHURCH, was read, requesting
Permission to erect a small tent on the Southwest corner of
Delta and Highland for the purpose of holding a one -week revival
Monday through Friday, the first week in June. MAYOR HODGE re-
quested this be referred to the City Manager for e recommendation
.at the ne7t meeting.
COM_TNICATIOI' FROM THE COUNTY OF SAN DIEGO was read in regard to
the proposed signal installation at 30th & Highland Avenue. This

is included in the Road Department Preliminary Budget, The
bud5et'envisions that the County's share of the estimated cost
of ?12,000.00 would be j9,000.00. CITY CLERK ALSTON stated that
would leave the sum of 13,000.00 to be paid by the City. CITY
MANAGER GAUTEREATTX said he would recommend that this be refer-
red back to the Traffic Committee for further study and recom-
mendation in connection with the letter as recommended by the
County. COUNCILMAN PARCHEN stated it might he well to ascer-
tain what type of signal they have in mind as that is about
17,000.00 more than the signal at 24th St. & National Avenue.
MAYOR HODGE requested it be referred to the Traffic Safety
Committee for recommendation and then to the Council through
the City Manager.
REQUEST OF iMIRS. LULU DEVITT for refund of 144.85 which was paid
for paving of "I" Avenue, was read. The paving job was never
started as not sufficient people deposited their share of the
money to have the work done. COUNCILMAN PARCHEN asked the City
Attorney if this was legally refundable. ATTORNEY CURRAN stated
it would be necessary to obtain more facts; whether or not the
City had been put to any expense, whether there have been any
steps taken with reference to the petition. It was his recom-
mendation this be referred to the City Manager to ascertain the
facts before any action is taken.
COUNCIL''OI/IAPT JENSEN stated there are two bills for the Daytime
Band Review, one in the amount of 1100.00 for a rain bond and
it was her understanding that the City was to be made beneficiary,
and the papers in the possession of the City before the bill is
paid. The other is in the amount of 127.81 for rental of an ad-
ding machine, and it was to be ascertained whether it was being
purchased or rented. It had been ruled previously if it was be-
ing rented then the City could pay but if the payment was part
Payment for the purchase of the machine, the City was not to pay
for it, It was requested these bills be withheld for the present.
COIfMUNICATION FROM TOM LEONARD, Chairman, Maytime Band Review,
was read, requesting permission to use twenty-four bleacher sec-
tions•set u-, at intervals along 8th Street and National Avenue on
May 8, 1954. Since there has not been time to get the exact
locations for these bleachers, they requested permission, sub-
ject to the o,k. of the City departments that have jurisdiction
over thee; items. They will submit contracts and other pertin-
ent data to the City officials concerned before action is made
final. Moved by Hollingsworth, seconded by Heck, that the re-
quest be. granted. Carried, by the following vote to -wit: Ayes:
Heck, Hollingsworth, Jensen, Hodge. Nays: Parchen.
REPORT FROM CHIEF SMITH wa.s read, regarding the application for
off sale beer and wine license in name of Samuel Daniel Bauert,
137 7. 8th Street. The report was favorable. Moved by Parchen,
seconded by Jensen, that the application be filed. Carried, by
the following vote to -wit: Ayes: Hollingsworth, Jensen, Parchen,
Hodge. Councilman Heck abstained from voting.
CITY CLERK ALSTON stated we have the second reading of an ord-
inance of intention to vacate and'close portions of public sts,,
to -wit: 29rd St., Harding Avenue, Coolidge Avenue and alley in
Blocks 151, 152, 105, 106, 87 and 88, in the City of National
City, and asked if the Council wished it read at this time, CITY
ETTGINEE^ T,TART•TICK stated that the description in the ordinance
states: "that portion of Coolidge Avenue Tying between the So-
utherly line of 22nd Street and the Northerly line of 24th St.".,
it so happens that the City is supposed to have a 100 foot right

of way for a floodway channel on the westerly side of Coolidge
Avenue through that area. Mr. Warwick stated when this item
came before the Planning Commission it was his recommendation
that the City retain title to the Westerly 25 feet of Coolidge
Avenue in order to give us a means of access to the flood chan-
nel so we can maintain it. CITY MANAGER GAUTEREAUK stated it
is his recommendation this be referred to the City Engineer and
Manager for further checking. MAYOR HODGE so ordered.
COMMUNICATION FROM SAN DIEGO COUNTY BOUNDARY coif isSION was read,
regarding the special meeting held on January 26, 1954, approv-
ing the boundaries of tidelands and portion of San Diego Bay
proposed to be annexed to the City of National City. CITY CLERK
ALSTON stated the Council referred this to Attorney Campbell and
he returned it so that it couly again be referred to our new
Attorney. MAYOR HODGE so requested.
CITY CLERK ALSTON stated we have a communication from the San
Diego Chamber of Commerce regarding the wheel tax which was
referred to Attorney Campbell and returned by him, and asked
that it be referred to City Attorney Curran. MAYOR HODGE re-
quested this be referred to the Attorney.
CITY CLERK ALSTON stated she had the written resignations of
George James, Thelma N. Hollingsworth, and Cecil F. Allen, from
the Planning Commission, which will be filed as action was
previously taken.
COMMUNICATION FROM THE DIVISION OF HIGHWAYS was read regarding
proposed narking prohibition. On the easterly side of South
Harbor Drive between the north line of 8th Street and the
South end of the 7th Street Channel. Bridge vehicles have been
observed to be parked off the shoulder area. The narking
practice is hazardous to vehicles using South Harbor Drive and
should be prohibited. It is requested that a resolution be en-
acted which will effect the prohibition of parking at all times
on the easterly side of South Harbor Drive between the north
line of 8th Street and the south end of the Seventh Street
Channel'Bridge, a distance of approximately 350 feet. Moved by
Paschen, seconded by Jensen, this be referred to the Traffic
Safety Committee. Carried, all the Council present voting aye.
REPORT FROM THE DIVISION OF HIGHWAYS was read, showing the es-
timated apportionment of gas tax revenue allocated to Cities
for the fiscal year ending June 30, 1955. The amount for
National City is $78,350.00.
COMMUNICATION FROM CITY MANAGE? GAUTEREAUX was read, regard-
ing the disposition of trash at the Mayfair market. Due to the
fact that the quantity of trash accumulated is such that to
place same in containers as specified and required by Ordin-
ance 836 is impractical and beyond reason, and it is also im-
possible for containers to be placed near or at the curb of any
street, due to the location of the market. Permission was given
the market management at the opening of the market to disnose of
rubbish by means of a contractor other than the one under con-
tract with the City. The City contractor was not properly eq-
quired to handle such quantities and was claiming he was not
bound by contract and agreement. A temporary permit was given
a Mr. Frank Rasmussen for the hauling and disposition of the
trash from Mayfair Market for a period of two weeks. It is the
Manager's recommendation that this permit be extended for a per-
iod of 60 days thereby enabling the City to enact necessary ..
changes in the ordinance and work out suitable agreements with

all parties concerned. Moved by Hollingsworth, seconded by
Jensen, that the City Manager's recommendation be approged.

COMIUNICATION FROM STATE CONTROLTFR was read, stating the City
of National City will receive 123,800.00 for motor vehicle
license fees for the fiscal year 1954-55.
COMMMUNICATION FROM SAN DIEGO NUMISMATIC SOCIETY was read, re-
questing that the Mayor of National City proclaim the week
from Agri) 26 to May 2, 1954, as Coin Week In National City.
It is honed and e7petted that a proclamation will give added
recognition to the science of numismatics. Moved by Jensen,
seconded by ?archon, that the proclamation be adopted. Car-
ried, all the Council present voting aye.
CITY MANAGED GAUTEREAUX asked that the City Attorney and Man-
ager be instructed to work on an ordinance regulating the col-
lection of trash, MAYOR HODGE so ordered.
COMMUNICATION FROM DEPART iEI T OF 7UBLI HEALTH huh �l ^.TT
, was read, regard-
ing the dumping of trash in the area of the "Duck Pond". On
April 1st "no dumping" signs were posted, and the area will be
inspected at regular intervals to see if the dumping of trash
can be controlled. The problem of two leases, one that the
owners of the private property must work out as the County can-
not assign County crews to clear private property.
COMMMIUNICATIOPN FROM SAN DIEGO TRANSIT SYSTEM was read, regard-
ing their service in National City, They are retaining the
existing routing of the "W" line pending further consideration.
Their company is eager to provide service where service is need-
ed and used.. Unfortunately the "?•J" Route which serves the great-
er tart of the National City area has been poorly patronized and they are anxious to make adjustments on this route if by
t such adjustments patronage can be improved. They state they
will be glad to give careful consideration to any suggestions
that the Council or City Manager wish to make. CITY MANAGER. .GAUTEREUX stated he has in connection with this letter an ap-
plication which has been filed with the Public Utilities Com-
mission requesting authority to increase certain bus fares.

�Inc. and Highland Shopting Center, was read,
ding South ay Plaza. In line with the development of
South Bay Plaza there are certain matters which might properly
be discussed in a formal meeting with the Council. The ques-tions about which the discussion is Proposed are as follows:
Clarification of easements rights for the sewer mains now lo-
cated on the property; the opening of loth Street from High -
lend venue to "L" Avenue and the actions necessary to be taken
both
by the City and the developers of South Bay Plaza in or-
der to accomplish same; the construction of the pronos;ed drain
culvert under Highland Avenue; a final decision as to the course
and character of the drain channel to be constructed easterly
of the Proposed culvert; the location and design of street to
be extended or improved easterly of the property with particu-
lar reference to the extension of 10th Street to the intersec-
tion with Palm Avenue. The purpose of the meeting

to get the questions before the Council. Since furthernolansis
call for the immediate construction of two large buildings with
completion and occupancy scheduled for October 1st it is quite
important that we avoid any unnecessary delays. It is request-
ed that the meeting be held at an early date. CITY MANAGER
GAUTEREAUX stated Mr. Wilson was in his office several days ago

and laid these matters before the City Engineer and himself.
It is quite important that certain matters be taken care of
in a short time. The meeting in itself will require quite some
time. COUNCILMAN PARCHEN stated he would like to request that
the meeting with Mr. Wilson be held in the evening and that the
proceedings be recorded„ CITY ENGINEER ttrARtrICI stated the first
item is the question of the sewer easements and should be taken
care of as soon as possible4 Due to the way they were originally
laid out years ago the Title Company found out when they made a
search of title that the easements did not come quite together
and there is some question regarding our own property and it is
causing Mr. Wilson some trouble with his leases. Mr. Warwick
said he expected to be able to finish these things un this week
and present them at the earliest possible date, regardless when
the meeting is held. He will need time to prepare the descrint-
ions, and they Will then present them to the Attorney, and he
will prepare the necessary documents for relinquishment of the
existing easements and give Mr. Wilson the other description so
he can make his document and have them nroner_l_y processed. If
the regular meeting on May Loth takes place before the special
meeting with Mr. Wilson he would like the Council to take action
on the sewer easements. CITY MANAGER GAUTEREAUX stated it would
be his suggestion that when the City Engineer has prepared what
he has that possibly arrangements can be made with Mr. ?lilson
for a meeting and the Manager's Office would notify the Mayor
as to the date.
COMMUNICATION FROM CITY MANAGER GAUTEREAUX wasregarding
the lease of propertyat 1 th and Tidelands read bi
9 nds Avenue now being op-
erated by the City as a parking lot for Navy personnel, mainly
to the Navy, The Manager recommends a lease to the Government
of certain property described in the lease under conditions as
submitted in the lease agreement. It is recommended the Council
accept this lease and authorize the Mayor to sign same. CITY
MANAGER GAUTEREAUX stated at this time he would like Attorney
Curran to check the lease before acceptance.
COMmU?ICATIOLT FROM' Co .A, LaRSEN CONSTRUCTION COMPANY addressed
to Robert A. Bradt, was read, in regard to National City Library.
They submitted'a cost breakdown for adding the following items:
Dressing table, clothes closet and bulletin board, at P. total
cost of S,427.98. CITY MANAGER GAUTEREAUX stated he is asking
that this be allowed. Moved by Hollingsworth, seconded by Heck,
that the bill be allowed. Carried, by the following vote to -wit:
Ayes: Heck, Hollingsworth, Jensen;. Parchen, Hodge. Nays: None.
COMM-MUNICATIOI`I FROM FIRE CHIEF BAIT,FY was read,stating he wouldlike to send Fireman Engineer Lee Bacon to an education class
conducted at Santa, Monica the first of May for specialized train-
ing in drill tower and other evolutions of simulated fire practice
by the State Fire Training Institute. Housing, meals and trans-
portation will be necessary as well as some class room text books
and paper. Provisions were not made in the 1953-5L budget for
such activities but with a transfer of ' 100.00 from the salaries
fund, where there is a surplus, this could be accomplished.
COMMU-?ICATIOI'T FROM -CITY MANAGER GAUTEREAUX was read, recommending
the transfer of S100.00 from the Salary Fund to the In -Service
Training Account of the Fire Denartment, for the purpose of al-
lowing one fireman engineer to participate in this special train-
ing. It is recommended that Lee Bacon be allowed to attend the
classes as specified by Chief Bailey, with expenses up to >100.00
being paid by the City. Moved by Heck, seconded by Parchen, that
the City Manager's recommendation be approved, if it is legal and
so ruled by the Attorney. Carried, by the following vote to -wit:

COMMUNICATION FROM CITY MANAGER GAUTEREAUX was read, regarding the
condition left existing after the recent completion of sidewalks,
curbs and gutters on 28th Street between Highland Avenue and "F"
Avenue. This street was formerly an oil mix prepared and laid
at the time the subdivision was constructed, which was several
years ago. There was no established grade but the general con-
tour was prepared merely to care for water conditions and oil
mix was laid with just a rolled gutter edge. The people on this
street claim that they had not been previously informed as to
possible conditions that might arise from the change of grade,
and if they had known in all probabilities they would not have
had the work donee At the -present time the surface material has
been cut back away from the gutter line approximately 5 feet
paralleling the gutter on both sides, with the anticipation that
the City might replace this area with oil mix at the City°s ex-
pense. The property owners have registered ,,rotest With the
'Tanager's office and feel that the City in the major part is
responsible. In checking this matter with the Engineer and the
Street Suit., Mr. Gautereaux said he is convinced there is only
one feasible manner in which to handle this problem, and that is
to put the existing street to a grade suitable. The approximate
cost of materials, labor, equipment rental, etc. is 71,121.00.
He would like to ask permission of the Council to negotiate a

WOMAN HOLLINGSWOR'TH stated the City has a responsibility to de-
fray some of this expense by some compromise that T'ir. Gautereaux
could make, because the _proper grade level was never established
on that street, and that the Council should try to remedy the
situation. COUNCILMAN PARC_HEN asked -if Mrs. Hollingsworth
thought the City was financially able to match this on every
case that might arise. We are setting a precedent if we do
this. CITY ENGINEER TiARWICK said in the future before any de-
velopments are made on any of the streets that they all be tak-
en to grade. Moved by Hollingsworth, seconded by Jensen, that
the City Manager be instructed to see what he can do about ne-
gotiating and remedying this problem on 28th Street, Carried,

in reading the ordinance it does. not state whether or not he
has the right to tell_aeorle they cannot build curbs, and it is
apParently set up with the idea of allowing them to do it. If
he had a. statement of policy from the Council it would make his
job much easier. If the Council thinks that no curbs should be
built until the street is brought to a reasonable grade where
such a thing cannot occur then we could refuse the construction.

have no night lighted ball fields, Some of the electric poles
have been purchased from the City of San Diego, and in order to
finish those poles so that they are usable for setting up in
the park it will take poles fabricated to a height of L9' 6",
We have received prices for the fabrication of the poles,
as
follows.: Standard Iron ':corks, $1,620..00; Otto Stang, 11,68.11.
That is for all materiels other than the Poles. Mir. Gaut<reaux
recommended this particular expenditure. It was not in bud-
get for 1953-54, and will he an outlay from Qenera.l Fund. outlay
and will have to be transferred for this project. This trans-

fer of funds can be taken care of at another meeting if it is
the Council's desire that we proceed with this particular por-
tion of the recreational project. After these poles have been
completed there will be an expenditure approximately ` 3,000.00
or 13,200.00 to complete the entire project. COUNCILMAN PAR-
CHEN asked if the City Manager thought we could afford to pur-
cha.se the Housing Project and spend this amount for recreation,
CITY MANAGER GAUTEREAUX stated to purchase the housing and pay
for it outright is going to deplete the outlay but we would
have enoughto take care of an item such as this, Moved -my
Hollingsworth, seconded by Heck, approving the expenditure of
1l,468,11 to Otto Stang, and that the City Manager be authoriz-
ed to proceed with the project. Carried, by the following vote

COMMUNICATION FROM CITY MANAGER GAUTEREAUX was read requesting
Permission to employ the services of Harry Bonnell & Associate,
the present auditors for the City, in setting up the new budget
for the fiscal year 1954-55. It is anticipated the time requir-
ed will be five to six days at approximately 150.00 a day. This
would include Air. Bonnell and his assistant, Moved by Parchen,
seconded by Jensen, that the City Manager be authorized to employ
Mr. Bonnell, as requested by the City Manager, Carried, by the
following vote to -wit: Ayes: Heck, Jensen, Parchen, Hodge.

CITY CLERK AL TON stated she had several items which had been
referred to Attorney Campbell which she would like to have ref-
ferred to Attorney Curran, One is a contract with the Retire-
ment System. MAYOR HODGE requested this referred to thi. City
Attorney. The other item is a refund to the Paradise Valley
Sanitarium for taxes paid from 1946 through T950, Also a claim
against G. C. Trotochau by the City, and asked that these be
referred to our City Attorney, MAYOR HODGE ordered these docu-
ments referred to Attorney Curran for recommendation,
COUNCILWOMAN HOLLI'iGSWORTH asked that the City Manager bring to
the Council the contract and report of the existing condition
of the dump on the tidelands, so that an effort can be made to
have that completely removed and eliminate any more burning.

COUNCILC:OIMIAN HOLLINGSWORTH stated that two bills for the Maytime
Band Review were taken out es there was some question in regard
to them, and asked if llr. Leonard, Chairman of the Band Reviews
could straighten it out for them so all could be approved at
this time, One bill is for two months rental on an adding machine
and asked if it was towards purchase of the machine or just for
rental, MR. LEONARD stated it is for rental but if either the
ileytime Band Review or the Chamber of Commerce wants to purchase

and asked if the City has been made the beneficiary and turned
over to the City. MR. LE0NARD said he thought it was made out

sit Company in regard to the possible re-routing of the ":!"
route, and he will check the actual outcome of the meeting.

COUNCI7MAN PARCH`.N stated that the City Attorney is to be paid
fees for going to court, and asked if the Council is to o.k. it
before making court a.p-erances. Is he to give the Council_ the
approximate cost before going to court? COUNCILWOMAN JENSEN
stated if there are going to be any court fees or fees for 1911
Act that they should be presented to the Council before and not
after the Pork is done. COUNCILw0ii AN HOLLINGSUCRTH stated she
thought the base salary is very small for someone qualified and
if it is going to take a great deal of court appearances in the
higher courts, he should be recompensed for it. ATTORNEY CURRAN
stated the City Attorney only takes action when authorized by
the Council, and when each individual case comes up it will be
possible to give an estimate.
