HomeMy WebLinkAbout1953 12-30 CC ADJ MIN132 National City; California, December 30, 1953 Adjourned meeting of December 29, 1953, of the City Council was called to order by Mayor Sarn at 5:15 P.M. o'clock. Councilmen present: Campbell; Carrigan; Moeser, Sarn. Councilmen absent: Parchen. ADMINISTRATIVE OFFICIALS present: Campbell, Gautereaux; Warwick. COMMUNICATION FROM CITY MANAGER GAUTEREAUX was read, recommend- ing that all bids received for the purchase of one truck be rejected, and that authorization be granted to readvertise. J. G. GAHN, General Truck & Engine Company representative, was present and stated he will be glad to furnish the City Manager with the specifications of every truck that is built whereby you can judge exactly what you want according to gross vehicle weight, horsepower; etc. It would be a detailed specification of all trucks built in that classificat- ion. COUNCILMAN CARRIGAN said he thought that would be helpful in drawing up requirements for specifications. Moved b.y Carrigan, seconded by Moeser; that the bids be rejected, as recommended by the City Manager, with the stipulated con- dition that the specifications be broadened to the extent that Dodge, International and GMC and other well known makes of trucks be not eliminated by specifications and be allowed to bid, and that authorization be granted to readvertise for bids. Carried, all Councilmen present voting aye. ATTORNEY CAMPBELL stated in regard to the bids for garbage pickup the bid of Ramirez Brothers was not considered as it was received too late, and in checking the bid of the Chula Vista Sanitary Service it was found that it was not a complete bid, therefore both bids are irregular. The ordinance provides that all bids shall contain the following provision: "That no charge shall be made to the City of National City for the collection and disposal of garbage from any property owned and operated by the City of National City." The Council has the privilege of waiving any irregularities, but it would be his recommendation that no irregularities be waived. City Manager Gautereaux has been contacting various possible haulers today and Mr. Hynum was informed that his bid was irregular and at that time he submitted a proposal on the theory of negotiation, and if the Council wishes to consider any other offer it might be fair to Mr. Ramirez to see whether or not he wants to make an offer. COUNCILMAN CARRIGAN stated he thought Mr. Ramirez should be given the opportunity to make an offer and at the same time Mr. Hynum should certainly be given consideration. ATTORNEY CAMPBELL stated he had two offers and thought it would be fair for Mr. Ramirez to submit his offer before the other offers are read. Moved by Carrigan, seconded by Campbell, that the bids be rejected. Carried, all Councilmen present voting aye. MR. RAMIREZ was present and stated he would pick up the garbage in National City for $775.00 per month from January 1, 1954 to December 31, 1954. COUNCILMAN CARRIGAN asked if his verbal bid is legal and binding. ATTORNEY CAMPBELL stated if his offer is accepted he can be held to it, and he asked Mr. Ramirez if he would comply with all the ordinances and laws of the City, County and State and all applicable laws that we have and provide service as is now in existence both as to the amount, time and procedure. MR. RAMIREZ stated he would. MR. HYNUM'S offer is for a period of 12 months at the rate of $950.00 12/30 133 per month. F. SAN MARTIN'S offer is for a period of six months for no payment whatsoever by the City. CITY ATTORNEY CAMPBELL stated he would suggest that if either Mr, Hynum's or Mr. Ramirez's bid is accepted that the Council advertise or negotiate in October or some such date, if the ordinance is so changed, and if Mr. San Martin's offer is accepted that you start negotiations in May, COUNCILMAN CARRIGAN stated it would be his recommendation that the San Martin offer be accepted providing the City Attorney makes certain that it comply with all the rules and regulations and that he will continue to do the job as efficiently as he is now doing. COUNCILMAN MOESER stated he did not think the Council could do anything else but accept the bid of F. San Martin, and that we go along on this basis for six months and then the City Attorney and City Manager work out the details and possible change in the ordinances so that at the end of six months we can come up with a negotiated contract or new bid. RESOLUTION NO. 6094 was read, accepting the offer of F. San Martin & Sons to collect all garbage within the City of National City for a period of six months commencing January 1, 1954, for which they shall receive and be entitled to all garbage collected as full compensation for said collections. The City Attorney is hereby directed to prepare the contract therefor, and the Mayor is hereby authorized and directed to execute the same on behalf of the City. Moved by Carrigan, seconded by Moeser, that the Resolution be adopted. Carried; all Councilmen present voting aye. Moved by Carrigan, seconded by Moeser, that the meeting be closed.
