National City, California, January 9, 1951,
Regular meeting of the City Council was called to order by
Mayor Clinton D. Matthews, at 7:30 P.M. o'clock. Councilmen
presents Carrigan, Clarke, Curry. Hart, Matthews.

Moved by Curry, seconded by Hart, that the reading of the
minutes of the regular meeting of January 2, 1951, be dis-
pensed with. Carried, all Councilmen present voting aye.

Moved by Clarke, seconded by Hart, that the bills be allowed
and warrants ordered drawn for same. Carried, by the follow-
ing vote to -wit: Ayes: Carrigan, Clarke, Curry, Hart,
Matthews. Nays: None.
RESOLUTION NO. 5380 was road, authorizing the payment of
$6,345.17 from the Capital Reservo Fund as follows: Herluf
Brydegaard, $2,400.00, Professional Services Fire Station;
P. E. May & Sons, $3,945.17, Street Equipment. Moved by
Clarke, seconded by Curry, that tho Resolution be adopted.
Carried, all Councilmen present voting aye,

R$2WBR'f A. BARNES was present and stated that he hes tried
a great many times to have the questions answered that ho
has asked regarding the fire insurance for the City, but
that he has been suppressed or sidetracked. MAYOR MATTHEWS
askod Mr. Barnes what he would like to have the Council
do, as they have answorod his questions for six months, had
private meetings with him end gone over this matter many
times. MAYOR MATTHEWS said he finds it almost impossible
to find out just what Mr. Bernos is trying to prove, end
he would bo glad to have a special mooting after the Council
is adjourned and take up the fire insurance question.
ATTORNEY WARNER stated that he was in touch with Mr.
Campbell in regard to the closing of the alloy to Block 19,
and that Mr. Campbell and Mr. McCune have withdrawn their
objections.
RESOLUTION NO. 5381 was road, vacating and closing tho Alley
in Block 19, City Plat, National City. Moved by Clarke,
seconded by Curry, that tho Resolution be adopted. Carried,
all Councilmen present voting aye.
PLANNING COMMISSION PETITION NO. 377 was presented. CITY
MANAGER SULLIVAN stated thet tho proponents of this zone
variance have not presented a petition in support of their
case which the Planning Commission denied. MRS. SULLIVAN
stated because this hed been laid ovor she notified by post
card all of the signers of tho petition that was presented
previously, tho people who wished the Planning Commission's
recommendation upheld. VIRGIL 0. CAMPBELL was present and
stated ho widadd tc, thank Mrs. Sulliven for notifying the

signers of tho petition. Moved by Clarke, seconded by
Carrigan, that tho docision of the Planning Commission be
upheld, that Petition No. 377 bo doniod. Carried, by the
following vote to -wit: Ayos: Carrigan, 4larko, Curry, Hart,
Matthews. Nays: Nona.
THE SALARY SCHEDULE was presented. COUNCILMEN FART and
CLARKE exprossod themselves in favor of adopting the Salary
Schedule presentoa by tho City Manager. MAYOR MATTHEWS felt
that a lot of thought should bo given to this matter before
adopting this schedule as the matter of tho forty hour week
will be brought up again at the end of the fiscal ysar.
COUNCILMAN CARRIGAN said ho did not think that this is the
time for a complete reschoduling of all salaries, that ho
thought an equitable agreoment should be workod out and that
the employees are entitlod to a cost of living wage increase,
but that ho cannot roconcilo this schedule with a cost of
living wage Incroaso, MR. CARRIGAN said he did not favor
tho salary schedulo as tho oxpondituros would have to bo
carried on through the next fiscal year and he wondered
whether there would bo revenue to take care of it. CITY
MANAGER SULLIVAN said it was her conviction that in public
omploymont employees should bo paid the going wage and if
you cannot afford to carry on as many projects as you would
like to do that you should curtail the activity but not
curtail the salaries, and that she would novor reeommend
other than the going wago rate for employees. COUNCILMAN
CURRY favored the adoption of tho salary schedule as present.

Schedule es presented by City Manager Sullivan be adopted.

COUNCILMAN CARRIGAN said he was -happy to go along on a wage
increase but he coull not go along on this one as he thought
it was out of line. Carried, by the following vote to -wit:
Ayes: Clarke, Curry, Hart, Matthews. Nays: Carrigan.
RESOLUTION NO. 5382 was road, repealing Resolutions No.
5226, 5280. 5325, 5337 and 5363 and adopting the following
salary schedule for City Employees, effective January 1, 1951:

BS IT FURTHER RESOLVED that employees shall progress
from one rate to the noxt succeeding rate at intervals of
six (6) months until the highest step is obtained.

BE IT FURTHER RESOLVED tho effective date of this
Resolution shall be January 1, 1951, that each encumbont
employee shall bo assigned to tho sand stop in tho salary
schedule as such enpolyoo was receiving December 31, 1950.
BE IT FURTHER RESOLVED that employees who shall begin
employment with the City shall receive the lowest rate in
the range unless the department heed and the City Manager
shall recommend a higher step and such recommendation shall
have the consent of the City Council, and
BE IT FURTHER RESOLVED that now employees and promoted
employees shall receive such 6 month step increase in rate
to which thoy may become eligible upon tho first of the
month nearest t, the sent -annual anniversary dote of their
employment or advancement. Moved by Hart, seconded by Clarke,
that the Resolution be adopted. Carried, by the following
vote to -wit: dyes: Clarke, Curry, Hart, Matthews. Nays:
Carrigan.
RESOLUTION NO. 5383 was read, appropriating tho sun of
$3.995.50 for the operation of the National City Civilian
Defense Council from January 1, 1951 through June 30, 1951.
Moved by Sta*o, seeonded by Hart, that the Resolution be
adopted. Carried, all Councilmen present voting ayo.
RESOLUTION NO, 5384 was road, approving the Supplemental
Easement Agreement, dated October 3, 1950, betwoen the
San Diego and Arizona Eastern Railway Company and the City
of National City, by which the railroad grants certain
additional parcels of right of way adjacent to the 18th Street

underpass.

Resolution No. 5376 is hereby rescinded. Movod
by Clarke, seconded by Curry, that tho Resolution bo adopted.

REQUEST FOR REFUND ON BUSINESS LICENSE by Frod C. Peterzan,
was read. The License Dopartrsnt reconnondod that $2.50
be rofundod. Moved by Curry, seconded by Hart, that the
refund be granted. Carriod, all Councilmen prosont voting
ayo.
THE MITER OF THE APPOINTMENT OF L THIRD MEMBER ON THE WATER
POLLUTION CONTROL BOARD was prosonted. MAYOR MATTHEWS stated
ho would like to recommend that Mr. Henke be appointed on
the Board. Moved by Hart, seconded by Curry, that Bernard
Henke bo appointed as a nonbor of the Water Pollution Control
Board. Carried, all Councilman present voting ayo.
CITY CLERK ALSTON stated sho had received a communication
from the Leaguo cf California Citios which stated a mooting
was to be hold Monday, Tcnuc,y 15; 1951 in Los A.*ngola>
reletive to the State Rotironont for onployees. MRS. ALSTON
said thet with the Ccuncil's permission sho would liko to
attend the meeting. Movod by Hart, seccndod by Clarke, that
CITY CLERK I.LSTON bo authorizod to attond tho Hooting.
Carriod, all Councilmen present voting ayo.
CITY CLERK ALSTON stated thet sho would like the permission
of the Council to attond a mooting at Palm Springs, January
27, 1951. The new election laws will bo discussed at this
mooting. Moved by Hert, socondod by Clarke, that CITY CLERK
ALSTON be authorized to attond the mooting in Palm Springs.

ATTORNEY WARNER stated there are soveral items of litigation
which ho would like to presont to the Council. Tho Unitad
States of Anorica has a suit in which National City is the
dofondent, to condone the new Post Offico site at 9th and
"Bn. MR. WARNER said he had boon in communication with Mr.
Hurley cf the Lands Division cf tho United Status Lttorrmgsg
Office and ho believes thoy aro of the opinion that the
City has very littlo intorost, if any, except the possible
revorsionary interest in tho stroots and tho current taxes,
and Mr. Warner stated ho took the position in the law suit
that the City will stipulate the judgment for whatever the
City's interest is in order to facilitate their suit so that
they can build as soon as possiblo. The second litigation
pending is tho suit in which Mr. Ko11y is tho attorney and
he has made an offer of sono $400.00 in settlement of Lots
3 and 7, Block 215, and Lots 20 Ind 23, Block 235, which is
tho back taxos plus the penalties. tt. WARNER said he would
like to have the Councilmen lock at thoso four lots before
the next mooting in order that this matter can be settlod..
ATTORNEY wLRNER stated that ho would liko to discuss the
lettor from tho Library Board, which Councilman Clarke men-
tioned he had receivod. MR. WARNER said the Library Board
wrote a letter to tho Council sometime in Doconhor and it
cane to Mrs. Sullivan and it was referred to him booauso
thore was n ]a gal quostion involvod. Tho nattor of the
Library and whether they are governed by tho Education Code
or not, is not a now ono, and has faced City Attorneys many

tins. It was a recent issue in Coronado. MR. WARNER said
ho talked with the City Attorney cf Coronado and ho had
obtained a ruling from tho Longue of California Cities.
Mr. Werner wroto tho Loaguo of California Cities and told
thou our problem and thoy subsoquontly gave a roply.
Tho only question concernod is as to who signs tho warratits,
and Lttornoy Warnor said ho did not boliovo that it really
mado ouch difference. Tho League's opinion is that if wo
do not organizo the Library strictly undor the Education
Code that we can disrogard it. . Mr. Wrrnor stated thorn
is a peculiar sotup horn, whilo we do not actually tax thou
as a separate fund under tho Education Ccdo, wo do set up
in the tax rate a Library Fund, and thet he felt we should
follow the Education Code. MAYOR MLTTHE'tS said he would
suggest thet when Lttorney Darner has the information pre-
pared thet a meeting bo called with the Library Board and
discuss the natter.
CITY MLNAGER SULLIVAN roportcd on tho sidewalks on 24th
Street. Mrs. Sullivan statod that sho invostigatod tho
natter of the participation cf the Government, and because
the donountablo projoct has boon reclassified to temporary,
they are legally unablc to participate in any sidowaik con-
struction. It also moans that tho 1911 Improvonont Act is
impossible, so tho procedure to porsuado tho property owner
is the only alternativo.
COMMUNICATION FROM THE COMMUNITY REDEVELOPMENT AGENCY was
read. The letter statod thet during tho process of re-
development there will be a number of houses that aro not

sufficiently dilapidated to bo dostroyed and will require
moving to another area. Tho Lgeney suggests that the Plann-
ing Commission and tho City Council consider some form of
architoctural control in ordor that the houses moved from the
redevelopment area will not bo mevod to neighborhoods where
the property ownors will find them unacceptable. The Commun-
ity Redevelopment Agency, at its last meeting, adopted e
motion offering to cooperato with the Planning Commission and
tho City Council to the and that blight would not be dis-
tributed City-wide as a result of redovelopnont. MAYOR
MATTHEWS recommended that this bo roforred to the Planning
Commission, and to report to the Council.
CITY MANAGER SULLIVAN stated that while in Sacramento she
will contact the State Allocation Board for plans and spec-
ifications in ordor to negotiate with then as to tho
procedure to get the money transferred to Nrtional City. In
addition sho plans to discuss the plans and specifications
et four ttot , as money has been approprPeted by the !Mate
and it is available for a Grunt of throo portent of the
construction test. One is the drainage system in tho City,
a sewage disposal plant, tho piors for tho Harbor develop-
ment and the City Hall. Moved by Clarko, seconded by Curry,
thst City Manager Sullivan be authorized to discuss the four
items mentioned with the State Allocation Bc^rd as to what
money is available to the City for plans and specifications.

CITY MANAGER SULLIVAN stated thet if the plans for the
fire station meet with tho approval of the Council it will

be necessary to have authorization from the Council to ad-
vertise for bids en the sr_ecificetions. Moved by Hart,
seconded by Clarke, that tho City Manager be authorized to
advertise for bids for the fire station. Carried, all
Councilmen present voting aye.
COUNCILMAN CLARKE said that City Manager Sullivan in her
nenorendun to the Council nentionod the financing of several
hundred multiple dwellings for tho Navy, and that it is his
understanding that this housing is becoming quite a vital
thing as far as tho Eleventh Naval District is concernod,
and he wondered if the City could not in sono way encourago
somebody who night be intorestod in building housos to
accommodate this nood. By so doing it would increaso our
community, which would be of bonofit. CITY MANAGER SULLIVAN
said she discussed with the Planning Commission Monday night
a petition that has been aignod for the zono variance of
sono R-1-A which is an agricultural zone on Sth Street to
an R-2 or R-4 in crdor to build permanent multiple drsll-
ings. MRS. SULLIVAN stated that this afternoon she brought
two groups together who want to build houses and poople who
hove land, and they are apparently about to Hake a joint

SULLIVAN said that it appears there will be ono project, not
in the sense cf public housing but a group of houses.
COUNCILMLN CLARKE asked If a report will be given by the
coordinator at the meatinr; tomorrow evening in the Community
Building on Civilian Defense. CITY MANAGER SULLIVAN said
that Mr. Reed will report on tho Sacramento nootinc. MRS.
SULLIVAN said that Mr. Reed and Mr. Butler who attended the
nesting from San Diego found that San Diego and National
City are far ahead in their planning than the rust of the
cities in the State.
