National City, California, July 24, 1951
Regular meeting of the City Council was called to order by
Mayor Maurice Carrigan at 7,:30 P.M. o'clock. Councilmen
present: Clarke, Curry, Hart, Carrigan. Councilmen absent:
Ingalls.
Moved by Hart, seconded by Curry,'that the reading of the
minutes of the regular meeting of July 17, 1951, be dispensed
with. Carried, all Councilmen, present voting aye.
ADMINISTRATIVE OFFICIALS present: Campbell, Grey, Wagner,
Bailey, Casey, Gautereaux.
A. W. STEPHENS, Chairman of the Community Redevelopment Agency
presented some correspondence from the Agency which had been
requested by the City Attorney.
COMMUNICATION FROM SUPERIC`TENDENT OF SANITATION MIKKELSON re-
commending the appointment of J. A. Hargis as Dispatcher, was
referred to. This would be, a temporary appointment, pending a
Civil Service examination. There would be an increase of $$7.00
a month, effective July 1, 1951. Moved by Clarke, seconded by
Hart, that the recommendation of Supt. of Sanitation Mikkelson
be accepted. Carried, by the following vote to -wit: Ayes:
Clarke, Curry, Hart, Carrigan. Nays: None.
FETTER OF THANKS FROM MEW SISTERS fOr the bazaars pieced oa
National Avenue and 8th Street in honor of the Pythien Sunshine
Girls' Grand Council #1, was read. MAYOR CARRIGAN ordered the
communication filed.
LETTER FROM CHIEF SMITH on investigation of transfer of liquor
license of i766 Cafei7, was read. The transfer of this license
on July 9, 1951 is in the name of "Club 66", Newart, Inc.,
730 National Avenue. This is the same corporation that is

holding licenses on the Tahiti Cafe and Club Melody. There
has not been any unusual activity at either the Club Melody
or Tahiti Cafe which would tend to create any additional police
problems. MAYOR CARRIGAN requested that the communication be
filed.
COMMUNICATION FROM NATIONAL CITY CITIZENS' COMMITTEE was read,
urging the City to proclaim October 24, 1951, as United Nations
Day. They request that the Mayor form a Committee for U. N.
Day, representative of the City's varied groups and interests.
COUNCILMAN CLARKE said he thought we should at least be in
sympathy with this, and after the Council has had time to
consider what would be appropriate we should do something in
this regard. MAYOR CARRIGAN requested this be held over for
a week in order to give it some thought.
COMMUNICATION FROM NATIONAL CITY BASEBALL MANAGERS' LEAGUE was
read, thanking the City of National City, the Park Department,
the Public Works Department and the Recreation Department for
the splendid baseball facilities provided for the children and
adults of National City and vicinity. The new baseball field
at 21st and Palm Avenue is one of the finest diamonds in San
Diego County. The managers participating in the adult'league
have expressed tasir appreciation for the 00pp®ratleA they have
received from James Casey, Recreation Director, and his staff.
COMMUNICATION FROM NATIONAL CONFERENCE OF COUNCILMEN AND ALDER-
MEN was -read. This was a follow up letter to the one previous-
ly sent inviting the Council to attend the annual convention
in Cleveland , Ohio, July 18, 19, 20 and 21, 1951. MAYOR
CARRIGAN stated no action was necessary.
RESOLUTION NO. 5497 was read, authorizing the transfer of
$2,038.08 from the General Fund to the Traffic Safity Fund,

as a loan. Moved by Curry, seconded by Clarke, that the
Resolution be adopted. Carried, all Councilmen present voting
aye.

APPLICATION TO MOVE A BUILDING by Floyd H. Johnson was read.
The building which Is a frame house, is to be moved from:

ATTORNEY CAMPBELL reportod that ho had prepared an amendment
to tho agreement entered into between the City and Mr. Charlos
Stein for the operation of tho concession• in the Park. Tho
change that has boon mado is that Soction 3 of tho original
agroemEnt is amended to road: ;Tat tho oporator horeby agroos
to oporate and conduct said concession seven days oach'wook
botwoen the hours of 10:00 A.M. and 6:00 P.M. and at all othor
hours that may be now or horoaftor designated by the City.
That all other sections of said agreement aro horoby'roaffirmod.
RESOLUTION NO. 5498 was road, approving an amendment to tho

City and Charles Stein, a copy of which amondmont of agroomont

ATTORNEY CAMPBELL statod ho had proparod al earoomont for tho
City and tho Associated Construction Compaay C:ich ui aid permit

tho sowor linos would bo borno by Beverly Glon Subd. and they
would have tho right to connoct all tho lots in tho subdivision

subdivider will pay tho connection foo and permit foe, which is

sowers will bo installed in accordance to the ordinances of txa
City, Stato rnd County. It will enable them to go ahead much
more quickly as they aro rowdy to start tomorrow or Thursday.
RESOLUTION NO. 5499 was road, approving tho agreement between
the Associated Construction Company end the City of National
City, datod July 24, 1951. Maurice Carrigan, Mayor of the City
of National City is hereby authorized and directed to execute
same for and upon bohalf of said City. Movod by Hart, seconded

MAYOR CARRIGAN announced that it was 8:00 P.M. and time for
tho opening of the bids on Lateral Sower Job No. 10. The
following bids wero receivod: Pace Construction Company,
$1,888.00; Schafer and Stowers, $2,797.00; Carroll & Fostcr,
$2,135.02; L. B. Buttorfiold, $2,590.70; H. R. Broedon,
$2,615.00. MAYOR CARRIGAN requested the bids bo referrod to
tho City Engineer for chocking and bring in a report at tho
next meeting.

ATTORNEY CAMPBELL roportod on tho Robinson proporty which was
laid over. This is tho proporty on which tho Bank of Amorica
has a trust deed and thoro is tho question as to tho dedicat-
ion of a stroot and giving tho City 30 foot. Tho Bank claims
thoy aro going to tako it away from tho City and from Mr.
Robinson and Mrs. Mitcholl. Thoy havo also roquostod tho City
roturn tho 30 foot. A Notice of Intontion to Vaceto would bo
tho procoduro to start, and thoy in turn would grant tho City
thoir oesomont or rights -of -way on 9th Stroot, Attornoy Campboll

From 4th Stroet to 8th Stroot tho terrain is quito rough with
hills and valloys. Fortunatoly tho proposod stroot area runs
just botwoon tho hills and offors but little difficulty in
comploting a roadbod. Tho drainago channols aro sovoral in
numbor but can bo containod within tho wost sidJ of tho proposed
rights of way, Tho ground from 8th St. to llth St. is quito
flat and offors no obstaclo. From llth St. to 12 St. is high
ground which would havo to bo oxcavatod. Howovor, all of tho
matorial could bo usod botwoon 12th St. and 16th St., obviating
any wasto, Thore is no othor stroot botwoon Highland and Palm
Avonuo which lends itsolf to boing mado into a north -south
through stroot without tromondous cost. Thoroforo, it looms
that 1f it is possiblo to do so, without too much difficulty,
it might bo vory advantagoous to tho City to obtain all tho
rights of way nocossary now whoroby tho City could, at somo
future time, construct a through stroot from 4th St. to 16th
St. without having to pay an oxorbitant prieo for tho right.

on their property for a poriod of ono yoer. COUNCILMAN HART
said he felt that if wo cannot grant tho samq privilogo to
ovorybody ho was not in favor of granting this roquost to the
Paradiso Valloy Sanitarium. Wo havo othor poop?o just as

RESOLUTION NO. 5501 was road, granting a spocial zono varianco

ordor from tho National City Eloctric Works somo purchaso
orders woro mado in tho oerly part of May and dolivorios mado

$676,55. Mr. Wagner said if tho Council will approvo ho will

ACTING ADMINISTRATIVE OFFICER WAGNER statod tho City Enginoor
has purchased a new survoyor's instrument, a transit, and has
insured it. On tho bill it shows a possiblo allowaneo of $50.00
trado in on the old traiSit, It is assumed that in oxcass of
$50.00 may bo rocoivod by offoring this up for salo. J. P.
McCLURE was present and offnrod $60.00 cash for tho transit.
COUNCILMAN HART said ho thought tho Council should sell it to
Mr. McClure for $60.00. MAYOR CARRIGAN statod the Attornoy will
draw up a Resolution accepting tho offer. MR. GREY said the
trans it is in Los Angolos and askod Mr. McCluro if ho could got
it. MAYOR CARRIGAN askod if it would bo satisfactory with
Mr. McClure if tho trans it was plckod up at the oarliost poss-

ACTING ADMINISTRATIVE OFFICER WAGNER statod in rogard to tho
roquost of Mr. Fossman asking tho City Council to writo a
lottor to tho Navy Dopt. stating thoy will not object to tho
Navy allowing the use of a 60' x 90' parcel in Block 307,
north of Mr. Fossman's portal of land; wo havo socurod a copy
of tho oesomonts that stand for Tidelands 4vonuo, end for
this particular parcol, a revocable permit. It is rather
involved. It would seom that -the City can, if it sees no
particular use for that portion, write a letter to the Navy,
if tho Council desires, stating they had no objection. MAYOR
CARRIGLN requested that the Acting Ldministrotivo Officer
write the lettor to the Navy Dept. stating tho Council has no
objections.
ACTING LDMINISTRATIVE OFFICER WAGNER stated that the bid of

the National City Electric Works for tho electrical oquipment
for the Firo Station seems to bo in ordor and it is his ro-
commondation that tho Council approve the paymont of tho
$1,176,45.
RESOLUTION NO. 5502 was road, accepting tho bid datod June 27,
1951, of tho National City Electric Works in the sum of
$1,176045, Maurice Carrigan, Mryor of the City of National
City is authorizod and dirocted to exeouto tho contract there-
for on behalf of tho City. Movod by Clarke, seconded by Hart,
that tho Rosolution bo adoptod. Carriod, all Councilmen prosont
voting aye.
RESOLUTION NO. 5503 was road, accepting the sum of $60,00 from
J. P. McClure for transit #5305, box and tripod. That the
Acting City Administrator, Fred Wagnor, is heroby authorized
to sign the necessary documont to carry out the terms of the
Rosolution. In the evont the City is not ablo to dolivor said
transit, box and tripod to J. P, McCluro within 45 days from
the dote horoof this Rosolution shall bocomo null and void.

ACTING ADMINISTRATIVE OFFICER WAGNER statod that Mr. Gordon
Cloator, coordinator for tho Fiesta asked what could bo dono
to spood up and faeilitato tho purcheso of supplios end also
assigning of work stations and othor dutios that might havo to
wait for Council action, •As a result of tho convorsation Mr,
Cloator has writton a lottor to tho Council asking if tho Act-
ing City Administrator could bo ompoworod to mako docisions
pertaining to tho Fiesta rathor than having to wait for Council
action. MAYOR CARRIGAN said that porhaps a contract was nocoss-
ary to make this logal. ATTORNEY CAMPBELL said it was his

undorstanding that Mr. Cloator was to call or see if thoy
could arrnngo somotimo to got togothor end find out tho torts
to placo in tho contract. Thoro is a flat payment for certain
typos of sorvico and tho Council should have that and somo of
tho gonoral plans sot forth in tho contract. Thoro hes boon no
formal hiring es of this time. Tho Council mast hiro Mr.
Cloator. MAYOR CARRIGAN askod if Mr. Cloator would work with
tho Attornoy tomorrow and got this mattor straightonod out.
Mr. Cloator said ho would. MR. WAGNER askod if Mr. Cl ator's
lottor could bo roforrod to tho Attorney so that tho contonts
can bo incorporatod in tho contract. MAYOR CARRIGAN said ho
thought it would bo well to withhold tho lottor and do thoro
particular itoms in with tho contract. Anothor communication
from Mr. Cloator stntod thoro is a momorandum which ho would
liko to havo sont to all dopertmonts stating th^t the Fioste
will bo prosontod this yoar August 24th and 25th. Tho Fiosta

COMMUNICATION FROM RECREATION DIRECTOR CASEY was road, stating
that in compliance with tho trond of recroation ho has onrollod
at Stato Collogo to obtain a better coordinated recreation

program botwoon the local schools and the City. Mr. Casey is
attending State Collogo on a part timo basis for a teacher's
cortificato. This projoct will not interforo with his sorvicos
in the Recreation Dept. MR, CASEY was presont end statod this

but aftor this wook it will bo in the mornings only. It will
bo during his froo timo as his working hours aro from 1:00 to
10:00 P.M,
ACTING ADMINISTRATIVE'ORFICER'WAGNER stated Mr. Gautoreaux
informed him that ho was contacted by a roprosontativo of tho
Mission Pipo & Supply Company in regard to Ordor A 7441. Somo-
timo ago we ordored numorous longths of lin and lie galvanized
pipe, 1. back order allotmont is still duo us on that purchaso
order of 100 lengths of lh" and 85 longths of 1i" galvanized
pipo, and is aveilrble if wo wish to purchaso same. It is
nocossery that tho Mission Pipo & Supply Company know by to-
morrow if wo wish tho pipo. MR. GAUTEREAUX statod that tho
ordor is a portion of a back order, end is roady for dolivory.
Thoy havo not dolivorod it duo to tho fact that it has boon so
long sinco tho ordor was plocod and so lato in dolivory. This
was all contomplatod in tho former projocts, namoly Palm Valloy,

COUNCILMAN CURRY statod that sometime ago ho asked that an
analysis be made of tho soil that is being usod on the streets
in subdivisions, to see if it was suitable for nixing the oil.
Mr. Curry said ho did not think a street should bo put in and
thou in the very near future havo to do the job over again, at
tho expense of the City, and that this analysis should bo made
as soon as possible and before the streets in the subdivisions
are put in. MAYOR CARRIGAN ordered this referred to the City
Engineer and City Attorney for study and recommendation.
COUNCILMAN CLARKE stated he would like to ask Fire Chief Bailey
regarding the tent where various services aro held, situated
north of Division and east of Highland Avenue, whether or not
that has been passed officially and whether it passes inspect-
ion as far as the Electrical Code is concerned and of the Fire
Underwriters. CHIEF BLILEY stated that in company with the
Deputy State Fire Marshal they made an inspection from the
Fire and Panic Safety angle and found the tont was of a flame
proof nature and it had the required amount of exits . There
was some electric wiring that was suggested be cleared up.
There were oil heating stoves and there were suggested changes
in that since there was sawdust on the floor. As an overall
picture it is in fairly good shape. It got a clearance through
the Fire Marshal's office with the minor suggested changes.
Chief Bailey said it was his understanding that the Building
Dept, was to follow up on the electrical installation. COUNCIL-
MAN CLhRKE said he personally is worried about the existing
eeadlf+leva there. CRISP BAILER said they will make a follow
Imp Inspeetien very ehcrtly.
OEORGE W. THOMPSON was present and stated that maintenance of
ahyr Gorerhnent is a treneadolls expons°, and if the roads are

turned over to the City after the subdivisions ere through with
them and the proper mix has not been used, it will be a great
expense to the City. It is, his belief that an analysis should
be made of all the materials and a certain standard be adopted
before any roads are permitted to be put tn. MAYOR CARRIGAN
said this has been of Some concern to the City Council for
quite some time,. and hope Sat it can bo taken care of now.
