Councilmen present; Adams, Curry, Fritz, Thatcher, Matthews. Council - absent: None. Moved by Curry, seconded by Thatcher, that.the reading of the minutes of the regular meeting of March 21, 1950, be dispensed with. Carried, all Councilmen present voting aye. ADMINISTRATIVE OFFICIALS present: Alston, Sullivan, Warner, Harkey, McClure, Gautereaux. RESOLUTION NO. 5180 was read, authorizing the payment of $432.42 from the Capital,Outlay Fund as follows: American Typewriter Company,, 149.17, Court; Motorola Inc., $283.25, Fire. Moved by Fritz, seconded by Thatcher, that the Resolution be adopted. Carried, by the,following vote to -wit: Ayes: Adams, Curry, Fritz, Thatcher, Matthews. Nays: None. CHARLES V. McGILL, 2328 °E" Avenue, was present, and stated 4/4 1 293 that James Roosevelt is to pay a visit to National City on April 18th at 10100 AmM, and they would like permission to hold this meeting on 9th Street between National Avenue and Roosevelt Avenue for about one half hour. Mr, McGill said they would like permission to use sound equipment. Moved by Adams, seconded by Curry, that the request be granted, subject to the approval of the Chief of Police, Carried, all Council- men present voting aye. APPLICATION FOR ALCOHOLIC BEVERAGE LICENSE for off sale beer and wineby Robert W. Harrison, 2840 National Avenue, was read. Application was approved by Chief of Police Bates. Mayor Matthews ordered the application filed. COMMUNICATION FROM SAN DIEOO-CALZFORNIA CLUB requesting, t,000.00 from National City, was read. Moved by Fritz, seconded by Adams, that this be referred to the budget commit- tee. Carried, all Councilmen present voting aye. COMMUNICATION FROM Co 0. DONAHUE regarding the disturbance at 7th and "A" Avenue, was read. Mr. Donahue stated that he had received the report by the Chief of Police in this regard, which states that the Film Transport Company are quite noisy due to the fact there is no loading platform at this location. Mr. Donahue stated that when the Company rented this location they knew there was no loading platform, so he believes that this is a poor excuse, and since the Police cannot stand guard over them it is the duty of the Council to take the necessary action to stop this disturbance, COUNCILMAN ADAMS asked if that district was zoned for business and ADMINISTRA- TIVE CONSULTANT SULLIVAN stated that it was. COUNCILMAN ADAMS 4/4 294 said that since it was a business district he did not think that the noise was illegal, MAYOR MATTHEWS asked that this be referred back to the Chief of Police to out the noise down as low as possible, REPORT FROM THE PLANNING C0M_'.ISSIGN was read, which recommended that the 20 foot alley in Block 272, City Plat, be closed, reserving to the City the necessary utility easements. Moved by Thatcher, seconded by Adams, that the report be filed, Carried, all Councilmen present voting aye, ORDINANCE NO. , an ordinance of intention to vacate and close a public alley, was presented for the first reading. Moved by Fritz? seconded by Adame,, that only the heading be, read,. Carried, by the following vote to -wit: Ayes: Adams, Curry, Fritz, Thatcher, Matthews. Nays: None, ORDINANCE NO. , AN ORDINANCE OF INTENTION TO VACATE AND CLOSE A PUBLIC ALLEY LOCATED IN BLOCK 272 CITY PLAT, CITY OF NATIONAL CITY, CALIFORNIA. Moved by Fritz, seconded by Thatcher, that the Ordinance be laid over until the next meeting for the second and final reading., Carried, by the following vote to -wit: Ayes: Adams, Curry, Fritz, Thatcher, Matthews. Nays: None, REPORT FROM THE PLANNING COMMISSION was read, recommending that the City Council accept the tentative subdivision map of Rancho Terrace No. 1 together with tentative map of sewers in the proposed subdivision, subject to the following conditions: (1) That the slcreets be curbed and oiled. (2) That the City be given a 3c.:d for 10 feet off the South side of Lot 16 for street purposes; said 10 feet need not be improved. The Plan- 414 295 ning Commission also recommended that the sewera,be constructed as requested. Moved by Fritz, seconded by Curry, that the map be accepted and that the subdivider proceed on the basis of the requests of the Planning Commission. Carried, all Council- men present voting aye. REPORT FROM THE PLANNING COI(ISSION recommending the granting of Petition No. 364 of Margaret R. Bell, was presented for second reading. The permit would give Mrs. Bell permission to continue her business in her present location, 1013 E. 18th Street, and also to use it as headquarters for handling real estate and insurance. COUNCIL1MAN ADAMS stated that he thought the Council was going to have to decide whether they are going to grant "spot" zone variances. COUNCILMAN CURRY said there is very little R-1 Zoning on 18th Street. COUNCILMAN ADAMS said he thought it would be well to go ahead and re -zone the whole street. COUNCILMAN CURRY said we had a petition from the people on 18th Street asking that it be zoned for ENGINEER McCLURE said that the petition was irregular it did not define any limits and it was referred back people. COUNCILMAN FRITZ said he thought Mrs. Bell's should be held up until the whole street is re -zoned. CILMAN CURRY said he saw no reason for holding it up. CILMAN FRITZ thought that it wasn't fair to go out in business. because to the request COUN- COUN- resident - ial districts and start a business. MAYOR MATTHEWS stated that he is not in favor of granting a zone variance without a hearing. COUNCILMAN CURRY said that it has been posted and. gone through a hearing. Moved by Adams, seconded by Thatcher, that the Planning Commission be requested to review the zoning of 18th Street from Highland Avenue to Palm Avenue. Carried, 4/4 296 all Councilmen present voting a;'e, ORDINANCE NO. , an ordinance of intention to vacate and close a public alley was presented for the final reading. Moved by Fritz,,seoonded by Adams. that only the heading be read., Carried, by the following vote to -wit: Ayes: Adams, Curry, Fritz, Thatcher, Matthews, Nays: None. ORDINANCE NO. 780, AN ORDINANCE OF INTENTION TO VACATE AND CLOSE A PUBLIC ALLEY LOCATED IN BLOCK 212 CITY PLAT, CITY OF NATIONAL CITY,,CALIFORNIA. The hearing was set for 8:00.o'clock P.M., April 18, 1950. Moved by Adams, seconded by Fritz, that the ordinance be adopted. Carried, by the following vote to - wit: Ayes: Adams, Curry. Fritz, Thatcher, Matthews. Nays: None. RESOLUTION NO. 5181 was read, authorizing,Aeseesor Alston to add to the 1949-50 tax roll, Addition #32, assessed value $750.00 for improvements on the N 50' of Lot,23, Block 242, City Plat; amount of $12.38. Moved by Adams, seconded by Fritz, that the Resolution be adopted. Carried, all Council- men present voting aye. RESOLUTION NO. 5182 was read, authorizing an increase in salary to Charles A. Neuman to $220.00 per month, effective April 1, 1950, as recommended by SUPT. PARK & RECREATION cAUTEREAUX. Moved by Adams, seconded by Curry, that the Resolution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO, 5183 was read, authorizing the appointment of Emilio Lucero, as Maintenance Man,, in the Street Department, beginning salary $199.00 per month, effective April 3, 1950; 4/4 29? probationary period to begin on said date. Also authorizing the employment of two additional men on a temporary basis at a salary of 1180.00 per month, until such time as the Civil Service Commission can supply an eligibility list; as recom- mended by STREET SUPERINTENDENT FINNERTY. Moved by Adams. , seconded by Fritz, that the Resolution be adopted. Carried. all Councilmen present voting aye. COMMUNICATION FROM MRS. BURLEIGH BAGNALL, SR, was read. The letter stated that Mrs. Bagnall wished to express her sincere appreciation of the action of the City Council in appointing her to fill the unexpired term of office of Mrs. Walter Flack on the Library Board. Mayor Matthews ordered the communication filed. CITY CLERK ALSTON stated that she had received a letter from the Department of Public Works and one from the Secretary of State, which stated that a certification had been filed by Roy V. Peel, Director of the Census, which shows that National City has a population of 21,058 as of February 23, 1950. The communications were ordered filed. ENGINEER MCCLURE reported that he had checked the matter of the stop sign at 20th and Rachel Avenue with the Captain of Police and they found this to be a dangerous corner. Mr. Mc Clure recommended that the Chief of Police take the necessary steps to install a stop sign at that intersection. ENGINEER MCCLURE reported that he had investigated the matter of a street light at 20th and °E° Avenue; and since this is a part of the master plan it is his recommendation that it be installed. Moved by Thatcher, seconded by Curry, that the 4/4 298 street light be installed. Carried, all Councilmen present voting aye. ENGINEER MCCLURE stated that he had received a letter from the State Division of Highways in reply to the Resolution by the City Council requesting a grade separation be made at 8th Street and Harbor Drive. The letter stated that it was de- cided that this could not be financed at the present time as there is only a limited amount of funds available, and that it will be at least five years before the projeot can be com- pleted to the Border. Mr. McClure said that he would suggest that the Assemblyman from this District be contacted in order to make certain that the necessary funds be allowed far, this grade separation. Moved by Adams, seconded by Thatcher, that the Administrative Office write to the Assemblyman from this District and to the Highway Department at Sacramento; sending a file of the correspondence along with the letter. Carried, all Councilmen present voting aye. ENGINEER MCCLURE presented the plane and specifications for curbs in the center portion of 12th Street between National , Avenue and "D" Avenue. Moved by Adams, seconded by Thatcher. that the plans be accepted. Carried, all Councilmen present voting aye. ADMINISTRATIVE CONSULTANT SULLIVAN presented a report on tideland leases. There is one $ year lease at the present time between the City of National City and the Atohison,Topeka & Santa Fe Railway Company, for 5.44 acres of tidelands, for which they pay the City.3338.33 per month. E. A. Hudson entered into a lease in January, 1949, at the rate of 2 cents per 4/4 299 square foot per annum. Mr. Hudson has been paying the City $35.00 per, month through January of 1950. The lease expired in January, and the bond indemnifying the City against damage by Mr. Hudson expired in April of 1949. For the fiscal year the City has received 0245.00 from Mr. Hudson, There is an oral agreement in effect with M. E. Staffen for 7,500 square feet at the rate of 3 cents per square foot per year. He pays at the rate of $18.75 per month. Mr. Bollinger entered into an agreement with the City to use a portion of the tide- lands for wrecking boats. He deposited $1,000 with the City against future rent and any damage to property. He terminated his lease as of the 15th of March 1950, and was charged for 5i months for 42,000 square feet. at a rate of 3 cents per square foot per annum, or a total of $577.50. Mrs. Sullivan made the following recommendations: (1) That the future rate of rent for tidelands leases be 4 cents per square foot. per annum, inasmuch as this is the going rate for leaseholds in San Diego County. (2) That funds be appropriated from the Harbor Fund to make a survey of the tidelands for the purpose of plotting the area into 5 acre parcels. (3) That E. A. Hudson be notified to vacate hie present lease or enter into a new lease at the rate of $166.00 per month, until his sal- vage is completed, and further that he be required to indemnify the City by bond or deposit. (4) That the City initiate proceedings to annex the uninhabited territory between the tidelands on the South side of Paradise Creek and National Avenue, in order to permit access for use of the tidelands South of Paradise Creek. (5) That plans be drawn preparatory to requesting a disposal area for future filling of tidelands in the dredging of the channel immediately West of the tide- 4/4 300 lands and the dredging of Paradise Creek to a minus six feet. This general plan to provide for the mooring of small boats at the mouth of Paradise Creek to be described as "Paradise Cove, small boat harbor". MRS, SULLIVAN stated that the reason for the recommendations was that we have had inquiries concerning new leases. MPS. SULLIVAN stated that about 160 to 200 cars parked daily by employees of the Navy on City property and should be notified that they are trespassing as National City could be held liable if any accidents occurred on the City's property. ADMINISTRATIVE CONSULTANT SULLIVAN said that the recommendations need not be taken care of to- night but should be taken up soon, with the exception of the second and third recommendation which should be taken care of now. Moved by Adams, seconded by Thatcher, that recom- mendation No. 3 be carried out. Carried, all Councilmen pres- ent voting aye. COUNCILMAN ADAMS stated that he did not see any objections to any of the recommendations. MAYOR MATTHEWS said they should be studied and taken up in the very near future. Moved by Adams, seconded by Fritz, that the second recommendation also be approved. Carried, all Councilmen present voting aye. ADMINISTRATIVE CONSULTANT SULLIVAN stated that the Recreation Department requested $335.00 from the Capital Outlay Fund to put a roof over the Shuffle Board Court, but in estimating the amount necessary for this according to Supt. of Recreation Gautereaux, it will cost $455.00. MR. GAUTEREAUX stated that this takes care of the North end of the Court, and would also act as a wind break in the winter. It also includes an eight foot fence which will take care of the dust situation, and a 4/4 301 set up for night lighting which takes care of the steel poles, wiring and lights, so that the Court may be used during the summertime in the evenings. COUNCILMAN FRITZ asked if Mr. Gautereaux,thought the people want the Court covered in the wintertime, and,Mr. Gautereaux said they would not cover over the entire area, only the north end, as in the wintertime it would ordinarily throw a shadow if the Court was entirely covered and it would make it damp. Moved by Fritz, seconded by Thatcher, that Supt. of Recreation Gautereaux be authorized to make the requested additions to the Shuffle Soard.Court., Carried, by the,following vote to -wit: Ayes: Adams, Curry, Fritz, Thatcher, Matthews. Nays; None. ADMINISTRATIVE CONSULTANT SULLIVAN reported that the budget forms will go out as soon as completed. ADMINISTRATIVE CONSULTANT SULLIVAN stated that Mayor Matthews suggested that it might be a good idea to publish a man of the. precincts of National City. Moved by Adams, seconded by Fritz, that the map be printed. Carried, all Councilmen present voting aye. COUNCILMAN CURRY reported that the Lighting Committee made a survey of the requests for a.street light at 21st & "C" Avenue and one at 21st & "A" Avenue, and recommended that the two, lights be installed. Moved by Thatcher, seconded by Adams, that the lights be installed as recommended. Carried, all Councilmen present voting aye. RESOLUTION NO. 5184, was read, declaring 16th Street from Roosevelt Avenue to East City Limits, a street of major im— portance; and that Resolution No. 4729 is hereby amended as 4/4 302 it refers to 16;11 Street, Also that a copy of this Resolution be submitted to the Di -vision of Highways, Department of Public Works,,for their approval to include that section of 16th Street, described as, from the East line of °L" Avenue to the West line,of Harbison Avenue, as a part of the National City system of major City streets. Moved by Thatcher, seconded by Adams, that the Resolution be adopted. Carried, all Council- men present voting aye. RESOLUTION NO, 5185 was read,.aocepting the following grant deed for street purposes only, and authorizing City Clerk Alston to have sazte recorded: MEDFORD R. and NEAVILIE H. COURTNEY, the Westerly 30 feet of the northerly one-third of the southwesterly quarter of the easterly half of the westerly half of 10 Acre Lot 12 in Quarter Section 153 of the Rancho de la Nacion, according to the Map thereof No. 166 by Morrill, in the office of the Recorder of said San Diego County. Moved by Adams, seconded by Thatcher, that the Resolution be adopted. Carried. all Councilmen present voting aye. ATTORNEY WARNER stated that a claim had been filed against the City of National City by William,H. McAlister for damages to his motor vehicle on February 24, 1950, at 1929 "L" Avenue. The City was oiling "L° Avenue and some of the oil splashed on his car. The amount of the calm is $8.25. Attorney Warner stated that he had received a letter from Percy H. Goodwin requesting that the claim be denied. RESOLUTION N0. 5186 was read,,denying the claim of William H.,McAlister, 1929 "L" Avenue, National City, filed on March 28, 1950• Moved by Adams, seconded by Fritz, that the 4/4 303 Resolution be adopted. Carried, all Councilmen present voting aye. ATTORNEY DARNER stated that the natter of the exchange of property with Mr. and Mrs. Greenberg was turned over to him, and that he studied this at some lengths. The legal aspects were discussed as to the relative values of the property concerned. Attorney Warner said he had received a letter from Mr. Greenberg stating that certain lots have been con- demned by the State Division of Highways and he is asking an exchange of different lots. Mr. Warner asked that he be granted an additional two weeks so that he can make a study of the matter and check on the back taxes involved. Moved by Thatcher, seconded by Adams, that the Attorney be granted an additional two weeks to complete the study. Carried, all Councilmen present voting aye. ATTORNEY WARNER reported that the building at 9th Street and Roosevelt Avenue has been removed. RESOLUTION NO. 5187 was read, giving notioe,of the proposal to annex a portion of Florence Resubdivision, an uninhabited territory, the boundaries of which are specifically described as follows: All of Resubdivision of Florence, First Sub- division according to Map 1687, on file in the office of the County Reoorder, County of San Diego, California, except that portion lying easterly of the following described line; beginning at the Southeasterly corner of the land described by Map 1687 thence South 71°48t West 400 feet to the true point of beginning; thence N 18°12' West and continuing to an intersection with the norfurly boundary of 4/4 304 the land described by Map 1687. Hearing will be held at 8:00 o'clock P.M. May 2, 1950. Moved by Thatcher, seconded by Curry, that the Resolution be adopted. Carried, all Counc76 men present voting aye. ATTORNEY WARNER stated that he had received a letter from Holbrook & Tarr, Attorneys in Los Angeles in regard to two suits by the Merchants National Realty Corporation against National City. They ask that the City sign a stipulation, but Attorney Warner said that he would like to take a little time to look into the case and see if we should sign the stip- ulation. PURCHASING AGENT HARKEY reported that the Air Compressor arrived last week, and the painter and he looked it over, also Councilman Curry. Mr. Harkey said the price of the compressor is 1875.50 inoluding tax and we can get $150.00 trade in allowance. This compressor is adequate for the operation of painting, digging holes for posts; and a number of other uses. Mr. Harkey said that he would recommend the purchase of this piece of equipnent. COUNCILMAN CURRY stated that he thought it was a nice piece of equipment and had a Model B Motor. COUNCILMAN FRITZ asked if the City had need for the old compresaor. MR. HARKEY said we did not, and if we put it up for bids we might get $75.00 or $100.00 and we would have to pay the cost of the advertising, and recommended that it be traded in on the new equipment. Moved by Curry, seconded by Adams, that Purchasing Agent Harkey be authorized to purchase the compressor. ,Carried, by the following vote to -wit: Ayes: Adams, Curry, Fritz, Thatcher,"Matthewe. Mays: None, 4/4 305 COUNCILMAN CURRY stated that he thinks we have a very hazardous condition on "A" Avenue near the swings in the Park, and recom- mended that this area be marked. SUPERINTENDENT OF PARKS GAUTEREAUX said that sometime ago he cane in with a recom- mendation, and at that time it was referred by the Council to the Traffic Committee for study. Mr. Gautereaux said that he recommended that "A" Avenue be posted as a Park and Re- creation zone; posting sign for traffic to caution and slow down; this should be done on "A" Avenue to 14th Street. Moved by Adams, seconded by Thatcher, that this be referred to the Chief of Police, and that he be authorized to act nccord. ingiy. Carried, all Councilmen present voting aye. COUNCILMAN FRITZ said he would like to have the Traffic Com- mission reconsider the location of the "stop" sign at 24th Street and "L" Avenue. COUNCILMAN ADAMS stated that four years ago the Council passed a so-called anti -noise ordinance, which he states is uncon- stitutional, COUNCILMAN ADAMS,stated that this ordinance is being violated by a great many, and he would like to see this particular ordinance referred to the City Attorney for review and study, to see if some of the kinks cannot be taken out of 1St Moved by Adams, seconded by Curry, that this ordinance be referred to the City Attorney for study and recommendation. Carried, all Councilmen present voting aye. E. H. ALSDOBP was present and said he wondered,why 20th and Highland Avenua is not painted as a cross walk, Mayor Matthews �nkea that this be referred to the Traffic Committee, also 25th and Highland Avenue in front of the Highland Avenue 4/4 306 Baptist Church. COUNCII1(AN THATCHER said that he had reoeived complaints from motorists that Wan Street from 34th Street to our City limits is being used by San Diego polioe to trap motorists, many of which are tourists. THOMAS FORBES was. present and stated that he got two tickets in this section, and he said he understands that a number of the merchants in National City are going to ask the Council in San Diego to change the speed law to 33 miles an hour. Moved by Thatcher, seconded by Adams, that we send a letter to the San Diego City Council asking that action be taken to change the speed limit. Carried, all Councilmen present voting aye.
