HomeMy WebLinkAbout1950 12-12 CC MIN371 National City, California, December 12, 1950. Regular meeting of the City Council was called to order by Mayor Clinton D. Matthews at 7:30 P.M. o'clock. Councilmen present: Carrigan, Clarke, Curry, Hart, Matthews. Council- men absent: None. Moved by Clarke, seconded by Hart, that the reading of the minutes of the regular meeting of December 5,, 1950, be dispensed with. Curried, all Councilmen present voting aye. - ADMINISTRATIVE OFFICIALS present: Alston, Sullivan, Warner, Gauteroaux. BILLS AUDITED by the Finance Committee presented: General Fund $7,677.40 Comm. Redevelop. Fund 258.58 Library Fund 143.41 Park M & I Fund 276.76 Street Fund 2,043.11 Harbor Fund 1,423.51 Light. Distr. #1 32.65 Capital Reserve Fund 45.00 Payroll Fund 17 837.39 TOTAL $29;737.81 Moved by Curry, seconded by Hart, that tho bills be allowed and warrants orderod drown (or same. Carried, by the follow- ing vote to -wit: Ayes: Carrigan, Clarke, Curry, Hart, Matthews. Nays: None, RESOLUTION NO. 5377 was rord, authorizing the payment of $8,940.77 from the Capital Reserve Fund, as follows: Charles Bruning Co., Inc., S2,147.85, Equipment; Lloyd Hudson, $234.90, City Hell Remodeling; Crook Company, $$6,513.02, Equipment; Wayne W. Smith, $45.00, Surveying Fire Station Sito. Moved by Clarke, seconded by Curry, that 12/12 372 the Resolution be adopted. Carried, all Councilmen present voting aye. HERBERT A. BARNES was present and requested that he be allow• ed to see the binder policy on the fire insurance. MAYOR MATTHEWS asked that it be laid over until tho next meeting. COUNCILMAN CLARKE stated that tho amount of space allotted to the taxi stand on 8th Street is insufficient, that it is difficult for the taxi driver to got out of his position when a bus is behind him and a car is parked in front. CITY MANAGER SULLIVAN stated a request had been received from tho Taxi Cab Company requesting that they be moved to Notional Avenue instead of 8th Strect. Moved by Clarke, seconded by Curry, thet this matter bo referred to tho Traffic Commission. Carried, all Councilmen present voting aye. THOMAS LEONARD was present, favoring the card rooms, and that to close them would be imposing upon the rights of the individual. REV. ERNY wes present, favoring tho ebolishment of the card rooms. Rev. Erny stated that it is a known fact thet gambling goes on in these places. COUNCILMAN CARRIGAN suggested that tho Ordinance be read. COUNCILMAN CLARKE made a motion, seconded by Carrigan, that the Ordinance mentioned on the Agenda be removed from the Agenda, ATTORNEY WARNER stated that tho second rending of the card room ordin- is ance/mentioned on the :_genda, and in order to clarify it he would like to state th^t on November 28, 1950, wo had a first reading of en ordinance which had been hastily prepared and which would have had to be amended. When it came up at the last meeting for a second reading, Attorney Warner stated 12/12 373 that ho had prepared a now ordinanco, and that ono was rend, but no action was taken on the other one, and it would be proper that the matter of the second re?ding of this part- icular ordinance bo tekon off the Agenda. Carried, all Councilman present voting aye, MAYOR MATTHEWS eskod that the now ordinance be read. ORDINANCE NO., AN ORDINANCE FOR POLICE REGULATION, RELATING TO CARD ROOMS AND PLACES WrRE CARD TLBLES aB KEPT FOR HIRE 0R PUBLIC USE IN THE CITY OF NATIONAL CITY, CALIFORNIA: REPELLING SECTION 34 of ORDINANCE 708; REPEAL- ING SECTIONS 2, 3, 4, and 5 OF ORDINANCE 760, AND REPEALING ALL ORDINANCES OR PARTS OF OIDIN! CES IN CONFLICT HEREWITH; was read in full. E, J. CHRISTMAN, S. D. LOUCKS, REV. THOMPSON and MRS. JOHN HARGRAVE word present and all expressed their desire to have the eard rooms banned from National City. WALTER McCREARYb FRANK PADGETT, SAM bAVIS and WM. J. KUNK€L were present and felt that tho card rooms should be allowed to remain in National City. J. R. HLRVEY wes present and stated ho felt the matter of the card rooms should bo placed on tho ballot and give everyone a chance to veto on it without placing the responsibility on the Council or any ono individual group to make so important a decision. Moved by Carrigan, second- ed by Curry, that the Ordinance be laid over until the next meeting for the second and final reading. COUNCILMAN CLARKE stated we have heard a lot of pro anc' con regarding tho eontrovorsery in respect to the card room ordinance, and what he is interested in more than anything else is that 12/12 374 there is such a thing as liberty and human rightsq and he is not going to do anything to interfere with tho liberty of other people providing they do not violate the law and cause discomfort to the people of this community.. COUNCILMAN CARRIGAN stated that the card rooms are a detriment to the community and other legitimate businesses and hones, and they add tc the general dlseoloretion of whatever area they happen to be in. They are a mdral hazard both mentally and physically, and are a disgrace,and a blight on any City. They are an adjunct to, and probebly the beginning of most "skid rods". COUNCILMAN HART stated that he is not follow- ing Councilman Clarke, but is voting as he actually feels is right on any vote that comes beforo the Council, to which he is untitled. Motion carried, by the following vote to -wit: Ayes: Carrigan, Curry, Matthews. Nays: Clarke, Hart* CITY MANAGER SULLIVAN stated that it was time, for tho heav- ing on the Ordinance of closing the alley in Block 19. MRS. SULLIVAN stated that at the t$me the petitioner, Mr. McCune presented the request to us, it was our understanding that ho had acquired all except two lets in the Block and those were under negotiations. Mr. McCune is out of the City, and the two lots are still in a different ownership and face on 18th Street which would make it necessary for those lots to have access from the alley. MRS. SULLIVAN said she thought the hearing should proceed but it is not necessary for tho Council to pass a Resolution to close the alloy at this meeting. MAYOR MATTHEWS asked if anyone wished to speak on the closing of this alley. BERNARD BANKS was present and stated that the avnpr of the two lots expressed 12/le 375 1 a desire to know which streets and alleys were closed in that vicinity. CITY MANAGER SULLIVAN said she would send him a map showing the closed streets and alleys. Moved by Curry, secondod by Hprt, that this be laid over until the next mooting. Ceri'ikd, ell Councilmen presont voting aye. THE A$CHITECTS CONTRACT was presented and CITY MANAGER SULLIVAN requested that this be laid over until the Council had a copy of the plans. MAYOR MATTHEWS asked that this be laid over until some future date. CITY MANAGER SULLIVAN recommen4pd that the Council accept the proposal of F. San Martin to collect the garbage, end that tho City Attorney be authorized to drew up the agree- ment for the Mayor to sign. Moved by Carrigan, secondod by Hart, that the bid of F. San Martin to collect the garbage be accepted, and authorizing Attorney Warner prepare the agreement betweon F. San Martin and the City of National City. Carried, all Councilmen presont voting ayo. COMMUNICATION FROM EMPLOYEES' ASSOCIATION requesting a pay- roll deduction for purpose of membership dues for the Employees' Association, was read. The request was for the City Clerk to be authorized to make a deduction once a year, said deduction to be made from the payroll period ending January 15, 1951 and each year thereafter. ATTORNEY WARNER .stated that he did not believe this could legally be done, but he would be glad to check into the matter and see if it is permissible. Moved by Curry, seconded by Carrigan, that the request be referred to tho City Attorney. Carried. all Councilmen present voting aye. 12/12 376 ATTORNEY WARNER presontod oach member of tho Council with a copy of the County's Auction Ordinance. MR. WLRNER said tho Ordinance was recently adoptod by tho Board of Suporvisors, and if the Council profors this typo of ordinance, ho will draft a similar ordinance. CITY MANAGER SULLIVAN stated that tho Court Clerk is leaving the employ of the City tho first of Sonuary and the beginning salary of tho Clerk is $171.00. MRS. SULLIVAN seice they have had some' difficulty attompting to rocruit a roplecor_ont. Tho Civil Sorvico Commission advertised for an examination and only two applicants apreared and ono had a broken arm end could not do the practical test on the typewriter, and the othor cno Sot another job. MRS. SULLIVAN said there is a Clerk who has substituted in the- Ccurt end Police Dopt, and she received more salary then the boginning salary. MRS. SULLIVAN recommended that the salary bcgin at tho second stop cf $184.00 in order to obtain tho services of this Clerk for the Court. MRS. SULLIVAN stated that this young lady will have to teke a Civil Sorvico examination letor, but in the meantime she would work on a temporary basis. Moved by Clarke, seconded by Carrigan, that Mary Louise Sides be appointed temporary Clerk in tho Court, salary rato to be $18400. Nays: None, CITY MANAGER SULLIVAN statod thet in considering the Netional Hotel sito as a redevelopment project, that after a tour with the Ccuncil Bhp dons not fool that we are at a point 377 to describe a redevelopment district, as it is a very serious matter and should be continued until wo can make a reason- able definition of blight. M':S. SULLIVAN said wo have a letter addressed to the Building Inspector, which stated that at the roquost of tho owners of tho National Hotol thoy are proceodirig to assist tho architect in socuring data for working drawings necessary for donolition and repairs. It is estimated that they will be able to start construction on or about April let. This has reference to tho application of Mr. Kunkel. Mr. Brooks and Mr. Procopio to remove the top two stories of the building and to remodel the ground floor and to reinforce the back and the undor pinning, in com- pliance with the findings of the structural ongineers. CITY MANAGER SULLIVAN stated she would like to ask the policy of the Council as to the paving of streets in sub- divisions. MRS. SULLIVAN stated wo have a subdividor who has put up the nonoy for the oil on the assumption that it is still tho practice of the Council to use City equipment and labor on tho paving of stroots in subdivisions, provid- ing the subdivider graded the stroot and put up the Honey for the oil. MRS. SULLIVAN said wo have subsequent subdividers who have presented tentative plan and final plans. NATO MATTHE'NS said he would not approve of using City equipment in a new subdivision. Moved by Carrigan, seconded by Curry, that the 1m revenont plans of subdividers under tho Sub- division Ordinance includo the full payment of stroot pavingc Carriod, by tho following vote to -wit: Ayos: Carrigan, Curry, Hart, Matthews. Nays: Clarke. 12/12 378 CITY CLERK ALSTON stated that at tho last meeting the Resolution was rescinded which sot tho opening bid of $210.00 on Lots 16 to 20 in Block 119, and she wished to know if the Council wished to sot a now opening bid. COUNCIL- MAN CARRIGAN said ho thought a letter should be sent to Mr. Anderson explaining the situation and ask him to make another bid. CITY MANAGER SULLIVAN said that Mr. Anderson know about the amount and that wo originally had his chock for $367.00, the amount of the back taxes, and that he will be glad to submit his check for that amount again. MAYOR MATTHEV"S asked that this be hid over until tho noxt request, CITY MANAGER SULLIVAN stated that we have the problem before us of elcsine a partion cf 14th Street and Harrison Avenue. This was involved in a condemnation action of the Defense Plant Corv.at the time Concrete Ship located. Subsequently the Navy exceeded to the right of the Defense Plant Corp. and after that happened the Navy excluded this parcel from the condemnation action that was still pending in tho Federal Court. There is no record as far as the City Is concerned showing that those two parcels of land are vacates, but they were in the original condemnation action and subsequent- ly excluded, and in order to clarify the ownorship on 14th Street, which is a street on paper and not in actual exist- ence, it is Mrs, Sullivan's recommendation that wo vacate these two portions officially. An Ordinance of Intention to Vecate has been prepared. Moved by Curry, seconded by Hart, that only the hooding be read. Carried, by the follow- ing vote to -wit: Ayes: Carrigan, Clarke, Curry, Hart, Matthews. Nays: None. I2/12 1 379 ORDINANCE NO. , AN ORDINANCE OF INTENTION TO VACATE AND CLOSE A PORTION OF A PUBLIC STREET, TO -WIT: A PORTION OF 14TH STREET AND HARRISON AVENUE, IN TH7 CITY OF NATIONAL CITY, CALIFORNIA. Moved by Carrigan, seconded by Hert, that the Ordinance be laid Ivor until the next meeting for the second and final reading. Carried, &11 Councilmen present voting aye. COUNCILMAN CURRY said that he favors nico white traffic lines this tine of the year and that he would like to havo the linos painted again in cortoin parts of the City. MAYOR' MATTHEWS said ho was in accord with Councilman Curry. COUNCILMAN C URKE asked if there has been any further develop- ment on the sidewalk survey. CITY MANAGER SULLIVAN stated that the survey is progressing and that she hes adopted ono policy pending the time of any further chance legally, and that is the mettor of sidewalks whore troos havo been removed. We have trees that are causing groat damage in different pests of the City, and whore tho trees are re- moved the City has boon ropairing the sidewalks. COUNCILMAN CURRY inquired as to how we stand regarding the sidewalks on 24th Streot. MRS. SULLIVAN said thet it is a very difficult rrcblom because the petitioners havo asked for an Improvement District and the Federal Government owns sufficient amount of land tc prevent the District from formation. MRS. SULLIVAN said it would be easier to do it by private contract in those areas thet are not Federally owned. ATTORNEY WARNER said that Engineer McClure has been trying to arrange an agreement with the petitioners without let 380 the Federal Govornnent.
