MEMBERS OF THE NATIONAL CITY COUNCIL:
A special meeting of the City Council has been called by the
Mayor of National City to give and accept deeds in the
matter of the Alley at 16th Street and "D" Avenue; also
there is a request for authorization to the merchants of
National City to use sound trucks to advertise dollar day.
The time and place of said meeting is 7:00 P. M. o'clock in
the Council Chamber, City Hall, National City.

I HEREBY CERTIFY that on July 12, 1950, prior to the hour
of kj:00 P. M., I personally served each member of the City
Council to -wit: Carrigan, Curry, Hart, Matthews, with a
copy ofuthe notice of the Special Council Meeting. 'A copy
of said notice is attached here -to. (Councilman Clarke is
out of the City).

Special meeting of the City Council was called to order
by Mayor Clinton D. Ve thews et 7:00 P.M. o'clock.
Councilmen present: Ce:rigen, Curry, Hart, Matthews.
Councilmen absent: Clarke.
ADMINISTRATIVE OFFICIALS present: Alston, Sullivan, Werner.
MAYOR MATTHEWS stated that the special meeting was called
to give and accept deeds for elley purposes, also to set
on a request from the Chamber of Commerce to use a sound
truck to advertise "Dollar Days".
LETTER FROM THE CHAMBER OF COMMERCE reads: "For the purpose
of promoting "National City Duller Days", July 13, 14, 15,
the Bard of Directors in regular session yesterday in-
structed the undersigned to apply for permit for use of a
sound truck in National City Community during said "Do11:,r
Days". -It is believed that ell business houses In the
community will derive benefit from this event, end, likewise
shoppers will, no doubt, appreciate a reminder concerning
this money -saving event. For the purpose of staging future
events for the benefit of local business firms es a whole,
it would else be appreciated if the Honorable City Council
would grant permission to the Chamber of Commerce for use
of sound trucks in promotional events when such events have been officially approved by the Board in advance. It
is suggested that this permission be granted for the
balance cf the year 1950 or e greeter period, if it is
the pleasure of the Council. We will instruct said sound
trucks to ect without committing nuisance of any kind,"

MAYOR MATTH:WS stated thet there Is an Ordinance on the
books et present aicn forbids the UR3 cf sound trucks in
National City except spe':iel permission of the Council.
COUNCILMAN H/RT atLte3 that he thought permission should
be granted for the one day, but this request is fcr the
balance of the year, and that the Council should consider
whether we should have such en Ordinance on the -books,
and he would like to heve e ruling from.the Attorney whether
it is legal. MAYOR MLTTHEWS stated that the request is for
three days, not Just quoATTO?NB Y WARNER stated that
he believes the Ordinance is constitutional, but special
permission can be granted by the Council. MAYOR WI THEWS
said he wondered if it is the pleasure of the Council to
retain this'type of Ordinance. He said he would like to
take it up et the Zdayors' meeting and see what the other
cities ere doing ea it. ATTORNEY WARNER stated that the
San Diego Ordinance is Almost identical with ours except
the section which eliows the Council to grant special
permission. MR. WIFNEER said he sent a copy of our ordinence
and also of San Diego's Ordinance to the Chula Vista
Attorney because he had been directed to draw up an
Ordinance. ATTORNEY WARNER also stated thet the Ordinance
prohibits "unreasonable loud or disturbing unnecessary
noises". COUNCILMAN CURRY made a notion that the request
from the Chamber of Commerce for the use of a sound truck
July 13, 14, 15, be granted. COUNCILMAN-CARRIOAN stated'
that he did not believe the request from the Chamber of
Commerce could be called a civic function. National City
Dollar Deys is definitely a business building scheme; just
es 1f he wanted to use a sound truck simply because -he was

e business man and a member of the Chamber of Commerce.
ATTORNEY WARNER stated he thought "we were kicking over
the traces a little bit". COUNCILMAN HART said he thought
if we grant it to one we must grent it to others. CITY
MANAGER SULLIVAN stated they asked her what would happen
if they did use the sound truck and she stated that they
would be arrested. COUNCILMAN CARRIGAN said as fer es the
City of Netional City is concerned it would draw an addition-
al sales tax this month. Ma. CARRIGAN said: "1 want all
the business I can get, what would prevent me two or three
weeks leter using a sound truck. What right would you have
to turn me down?" ATTORNEY WARNER stated there was a
decided difference between a private individual and e
civic function. COUNCILMAN HART said that there ere sound
trucks on the streets every week. He said he thought the
business men can put their ads in the paper for do11Ar days.
MAYOR MATTHEWS said he knows that the Lions Club is going
to request the use of a sound truck one of these days and
that he thought the Cougcil should grant permission for it,
end also grant permission for the use of it for "Dollar
Days". MAYOR If TTHEWS also stated that we may be setting
e precedent which some merchants might take advantage of,
however if it happens, et least we do have some control,
if the Ordinance is still on the books. COUNCILMAN CURRY
said a sound truck does not make any more noise then whet
we have here in the perk with the model planes, end there
have been no objection to that. COUNCILMAN HART asked if
anybody had any complaints en the truck that advertises
movies for the children. MJYO3 ML'TTH:!"S said he had a
complaint on it about two months ego. COUNCILMAN HART

seconded the motion granting the use of the sound truck.
Carried, all Councilmen present votin; eye,
RESOLUTION NO. 52C6 was reed, accepting e grant deed for
alley purposes from H,NtY J. TGINONI and LEONA ADKISSON
TOONONI described as: The roost half of the closed alley
adjoining Lots 9 and 10, on the East, of Block 3, Sub-
division of 10 Acre Lot 8, Quarter Section 154, according
to map thereof No. 552 filed in the office of the County
Recorder. The City Clerk is authorized to have same re-
corded, Moved by Carrigan, seconded by Hart, that the
Resolution be adopted. Carried, all Councilmen present
voting aye.
RESOLUTION NO. 5267 was read, authorizing Mayor Matthews
to sign a grant deed to HENRY J. TOGNONI and LEONA ADKISSON
TOGNONI from the City of National City for the following
described property: The East 10 feet of Lets 9 and 10 of
Block 3, Subdivision of 10 Acre Lot 8, Quarter Section 154,
according to map thereof No. 552 filed in the office of the
County Recorder. Moved by Hart, seconded by Curry, that
the Resolution be adopted. Carried, ell Councilmen present
voting eye.
Moved by Curry, seconded by Carrigan, that the meeting be
closed. Carried, all Councilmen present voting aye.
