Matthews at 7:30 P.M. otclock., Councilman present: Adams, Curry, Fritz, Thatcher, Matthews. Council- men absent: None. Moved by Fritz, seconded by Curry, that the reading of the minutes of the, regular meeting of March 7, 1950, be dispensed with. Carried, all Councilmen present voting aye. ADMINISTRATIVE,OFFICIALS present: Alston, McClure, Sullivan, Warner, Harkey, Gautereaux. BILLS AUDITED by the Finance Committee presented: General Fund $ 2,448.26 Street Fund 1,098.19 Park M & I Fund 108.17 Capital Outlay Fund 951.33 Retirement Fund 2,179.35 Payroll Fund 12,710.07 TOTAL $19,495.37 Moved by Thatcher, seconded by Fritz, that the bills be allowed and warrants ordered drawn for same. Carried, by the following vote to -wit: Ayes: Adams, Curry, Fritz, Thatcher, Matthews. Nays: None. RESOLUTION NO. 5171 was read, authorizing the payment of $951.33 from the Capital Outlay Fund as follows: American Rubber Mfg. Co., $707.00, Fire; Lloyd P. Hudson, $100.00, Park; Edward Rohde Co., $8.76, Park; Underwood Corp., $135.57, Police. Moved by Thatoher,,seconded by Curry, that the Reso- lution be adopted. ,Carried, by the following vote to -wit: Ayes: Adams, Curry, Fritz, Thatcher, Matthews. Nays: None. 3/21 278 COMMUNICATION FROM NATIONAL CITY-CHULA VISTA REALTY BOARD, was read. The letter states that they would like to go on record as being opposed to "spot zoning variances". Mayor Matthews ordered the communication filed. COMMUNICATION FROM NATIONAL CITY-CHULA VISTA REALTY BOARD, was read. The letter stated that they would like to have one of their members serve on the Planning Commission. Mayor Matthews ordered the communication filed. REPORT FROM THE PLANNING COMMISSION was read, whichz, nalded that the Otty 8ounell grant Petition No. 364 of,Margaret R. Bell, without permit to build requested building, giving Mrs. Bell permission to continue her business in her present location, also to use it as headquarters for handling real estate and insurance. Business now located at 1013 E. 18th Street, being the W 100' of S 18' of Lot 8 and W 100' of Lots 9 and 10 in Block "C" of Beermaker's Subd., Quarter Section 133 of Rancho de la Nacion. Moved by Thatcher, seconded by Fritz, that the report be filed. Carried, all Councilmen present voting aye. REPORT FROM THE PLANNING COMMISSION, was read, which stated that the present plans of the State Division of Highways do not provide adequate access from Harbor Drive to 8th Street of South bound traffic. The present design would almost pre- vent South bound vehicles from visiting the business district of National City. The Planning Commission wrote a letter to the State Division of Highways concerning the grade separation and access at 8th Street and Harbor Drive, and requested that the City Council likewise protest the proposed construction and request that a grade separation be substituted. 3/21 279 RESOLUTION NO. 5172 was read, authorizing the ADMINISTRATIVE OFFICER to write a letter to the State Division of Highways requesting a grade separation ba made at 8th Street and Harbor Drive. Moved by Fritz, seconded by Thatcher, that the Reso- lution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO. 5173 was read, authorizing the appointment of Mrs. Burleigh Bagnall, Sr. to the Board of Trustees of the National City Public Library to fill the unexpired term of Mrs. Walter Flack, deceased; term to expire June 30, 1952. Moved by Adams. seconded by Thatcher, that the Resolution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO. 5174 was read, denying the claim of Lillian Becker, 1624 Hoover Avenue, filed with the City Clerk on. February 21, 1950. Moved by Fritz, seconded by Thatcher, that the Resolution be adopted. Carried, all Councilmen pres- ent voting aye. RESOLUTION NO. 5175 was read, accepting the following grant deed for street purposes only, and authorizing City Clerk Alston to have same recorded: M. FLOYD FINNERTY AND AGNES J. FINNERTY, The westerly 30 feet of that portion of 80 Acre Lot 2 in Quarter Section 130 of Rancho de la Naoion, in the City of National City, County of San Diego, State of California, according to the map thereof No. 166, filed in the Office of the Recorder of said San Diego County, described as follows: Commencing at a point on the southerly line of said Lot 2 distant thereon south 71° west 80 rode from the southeasterly corner of said Quarter section 130; thence North 19° west 60 rods to the true point of beginning; thence continuing north 3/21 280 south 19° west 20 rods; theme south 71° west 20 rods; thence/19° east 20 rods; thence north 71° east 20 rods to the true point of beginning. Moved by Fritz, seconded by Adams, that the Resolution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO, 5176 was read, authorizing.the following in- creases in salary: Jack C. Arbuckle, Jr., Paul L. Chambere, Wilfred C. Mead, salary $210,00 per month each, as recommended by SUPT. OF STREETS FINNERTY, all.effective March 16, 1950. Moved by Adams, seconded by Fritz, that the Resolution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO. 5177 was read, authorizing an increase in salary to Richard J. Harrold to $268.00 per month, effective April 1, 1950 as recommended by ACTING FIRE CHIEF BAILEY. Moved by Adams, seconded by Fritz, that the Resolution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO. 5178 was read, authorizing the appointments of Mrs. Mildred Gillespie and William J. Crossley, to the position of Recreation Leader, subject to six months probationary period, at a salary of $227.00 per month, effective April 1, 3/21 281 1950, as recommended by SUPT. CF PARK AND RECREATION GAUTEREAUX. Moved by Adams, seconded by Thatcher, that the Resolution be adopted. Carried, all Councilmen present voting aye. COMMUNICATION FROM C. O. DOVAI,U2 was read, regarding the disturbance at 7th and rA° Avenue, Mr. Donohue sent in a letter previously to this one which was referred to the Police Department for checking. The complaint is against the Film Transport Company. A letter from Chief of Police Bates was read stating that several checks have been made with the Company, and they are very dissatisfied with this location and are now looking for a place to move to. The company have added another man to their force to assist in loading and un- loading the films in order to lessen the noise, and the noise has decreased appreciably. Chief Bates said he believed they will cooperate to the fullest extent. Moved by Adams, seconded by Curry, that the communication be filed. Carried, all Coun- cilmen present voting aye. REQUEST OF A. J. CAMPBELL ON SUBDIVISION POLICY was read. Mr, Campbell states that he is contemplating the subdivision of a parcel of land near 16th Street and Lanoitan Avenue and would like to know the policy regarding improvements. ENGI- NEER MoCLUBE stated that if the curbs are shown on the plans you can be reasonably sure that the subdivider will put them in; and if the oiling of streets are shown on the improvement plan, it should be adequate.. Engineer McClure said that in regard to the sewer it was discussed by the Sewer Committee and he.thought that was a matter of policy the Council should decide, the Council should act on each individually as they come in. COUNCILiMAN FRITZ said that each subdivision should 3/21 282 stand on its own merits. COUNCILMAN ADAMS asked what guarantee does the City have that they will put in the curbs and oil the streets,. COUNCILMAN FRITZ stated that when we accept the map showing the curbs and oiled streets, the pressure could be brought to bear to put them in. ENGINEER MCCLURE stated that the Ordinance could be amended which would take care of this situation. Mr. MoClure sAid that the zoning ordinance requires a setback on the part of the street that is not dedicated, and that prohibits building on the other half street. The subdivider should only be held responsible Tor his portion of the Street. Moved by Adams, seconded by Thatcher that Attorney Warner be instructed to draw up an amendment to the Ordinance setting up the requirements for a subdivision. Carried, all Councilmen present voting aye. Councilman Adams made a motion, seconded by Fritz, that the,Administrative Office answer Mr. Campbell'A letter. Carried, all Councilmen present voting aye. MAYOR MATT} WS announced that it was 8:00 P.M. and time for the hearing on Petition No. 363 for zone variance of R. P. McCullough, requesting permit to construct six four unit dwellings on Lots 11 and 12 of Thelen'e Resubdivision of a portion of 10 Acre Lot 1, in Quarber Section 155 of Rancho de la Nectar:. Petition and appeal by residents and owners of real estate in Zone R 1, was read. The petition and appeal asked that the Council reverse action taken by the Planning Commission, which recommended the granting of Petition No. 363 of R. P. McCullough; that the adoption of Ordinance No. 750 was an assurance to property owners in this vicinity that buildings would be limited to one -family units. A change would cause a heavy lose to home owners. COUNCILMAN ADAMS 3/21 283 stated that he thought the Counoil should have more informa- tion presented to them than what they have now in order to get a clearer picture of the situation involved. Engineer McClure presented a map of the immediate vicinity; on the North there is a R-4 zone just outside National City, there is a multiple dwelling,300 feet from the property concerned in the zone variance, and a number of other multiple family dwellings. E, L. SULLEN, 407 E. lst Street, was present and protested ,the action taken by the Planning Commission. COUNCILMAN ADAMS said that he noticed at least one or two members of the Plan- ning Commission in the audience, and he would like to know some of the reasons the Planning,Commission took into consideration when they recommended the.granting of Mr. M&Oullough's petition. MRS. THELMA HOLLINGSWORTH, was present and stated that she,has been on the Planning Commission for approximately one year, and she said that she felt it was necessary to keep personal- ities out and consider only what was the best for National City, Mrs. Hollingsworth said that some of the residents in the district concerned felt that it would devalue, their property if the apartment houses were allowed to be built, but several realtors thought it would increase the value of the property. However it would mean an increased assessed valuation for National City and help business in general by bringing a number more families to National City. Mrs, Hollingworth said that three members voted for the variance, two against it, but thought we should look to the future. E. J. CHRISTMAN Was present and stated that he was acting. Chairman of the Planning Commission so was unable to vote, but that he brought out all the facts he could. He said he lived in this district and that he thought eventually the whole area would beoome a 3/21 284 multiple dwelli:g di30rict. He thought thatthey were over developing the arse fit.. any objections should be given con- sideration. MB. SULLEN asked Mr. Christman if he as a member of the Planning Ccmmtseion would repeal this Ordinance and Mr. Christman said "no". MR. and MRS. R. M. GUMT2, 502 E. 1st Street, RAYMOND HILL, 618 E. let Street, REUBEN ROSAND, 337 E. 2nd Street, PERRY 0. FRALICK, 408 E. let Street, ROBERT SIMKIN, JR., 420 E. 1st Street, ROBERT SIMPKIN, SR., 448 E. 1st Street, and MRS. HUITT, 404 E 2nd Street, were all present and protested the action of the Planning Commission. JAMES B. ABBEY, Attorney for Mr. McCQllough said that the plans that were filed with the Planning Commission were just rough ones and. approximately what they wanted to build on this property, but if the Council would care to have them furnish a more complete set of plans, they would be glad to do so. He said if they were not wanted in this area they would not form it down the people's throats, but he would like to see this matter laid over for thirty days and then come baok with some detailed plans. COUNCILMAN ADAMS said he would like to see this matter laid over until the Council gets more informa- tion on it. COUNCILMAN CURRY said that the City went to con- siderable expense to rezone the City, a zoning engineer was hired and he felt that this portion of the City should be left 4s it is until some later date, ten or fifteen years from now. COUNCILMAN THATCHER asked how many members of the Planning Commission were present when they had their hearing, Mr. Christman said there were six present with the Chairman, there were 19 protests against it and 11 were in favor of it. MAYOR MATTHEWS said t'iat -:e have to try and legislate the people's wishes and i- there had not been such a showing of 3/21 285 people protesting, he would think that it was very good to have buildings of this type as anytime that we can bring twenty-four families to National City, it creates more spending power and raises the assessed valuation, but that the people elected the Councilmen to go along with their wishes. Moved by Curry, seconded by Thatcher, that the permit of R. P. McCullough be denied. Carried, by the following vote to -wit: Ayes: Curry, Fritz, Thatcher, Matthews. Nays: Adams. CITY CLERK ALSTON reported she had received a 0heok in the amount of $1,310.81 from the State Compensation Insurance Fund. This represents a savings of 37% in the cost of our workman's compensation insurance. This savings is a result of on-the- job accident prevention activities of the City's employees. Moved by Adams, seconded by Thatcher, that the check be accepted. Carried, all Councilmen present voting aye. ENGINEER McCLDRE stated that the Sewer Committee reoommended an addition to, the sewer on 4th Street between Harbison and Rachel Avenues, at a cost of $238.00, and an addition to the newer system on Paradise Drive between 8th and loth Street, at a cost of $150.00. Moved by Adams, seconded by Curry, that these additions to the sewer system be•allowed. Carried, by the following vote to -wit: Ayes: Adams, Curry, Fritz, Thatcher, Matthews. Nays: None. ADMINISTRATIVE CONSULTANT SULLIVAN reported there is a matter of an exchange of property with 8. 2. Greenberg. Mrs. Sullivan said that she had talked with members of the Council about this but would like to recommend that this matter be referred officially to the City Attorney. Moved by Fritz, seconded by 3/21 286 Thatcher, that the matter be referred to the Attorney. Carried, all Councilmen present voting aye. ADMINISTRATIVE CONSULTANT SULLIVAN stated that she had a petition having to do with a request for street lighting, and she would like to recommend that this be referred to Engineer McClure and the Street Lighting Committee. Moved by Adams, seconded by Thatcher, that the petition be referred to Engineer McClure and the Street Lighting Committee. Carried, all Coun- cilmen present voting aye. ADMINISTRATIVE CONSULTANT SULLIVAN stated that she had a re- quest for annexation of some unhabitated territory to the City. Moved by Adams, seconded by Thatcher, that this be referred to the Attorney for checking. men present voting aye. Carried, all Counoil- ADMINISTRATIVE CONSULTANT SULLIVAN stated that the Trailer survey has been prepared. Mre. Sullivan said that of the number of trailers which are now in National City, 130 are occupied and 56 of these the permit fee of 32.00. information which may be are on private property, 39 have paid MRS. SULLIVAN said the survey contains valuable for amending the Trailer Ordinance. MAYOR MATTHEWS presented a petition against being moved into a Trailer Court, and against having to pay a $2.00 monthly fee to the City for parking on private property. The petition contained 13 signatures. B. B. Walker, 2112 Rachel Avenue, was present. Mr. Walker said he circulated the petition. He said he and his wife and child live in a trailer. He said they have to pay State License and Liability insurance and that costs about $121.00 a year. He said he was told that the $2.00 3/21 287 a month fee was fcr £ re and theft protection, which he thinks is a poor excuse, Mr. Walker said when he moved in his trailer he put in sewage, watch was approved by the Health Department. MAYOR MATTHEWS Stated that the Trailer Park Association has requested an amendment to the Trailer Park Ordinance and sug- gested that this be referred to the Planning Commission. Moved by Curry, seconded by Thatcher, that this petition be referred to the Planning Commission. Carried, all Councilmen present voting aye. ADMINISTRATIVE CONSULTANT SULLIVAN stated that she had pre- pared a short digest of the measures on the ballot. COUNCIL► MAN FRITZ asked if this was accepted if it would be possible to send these out with the sample ballots. ATTORNEY WARNER stated that he had checked on this matter, and he is not in favor of sending it out with the ballots; however if the Council wishes to send out such information it should be separate from the sample ballot. MRS. SULLIVAN said she would recommend that it go out only for release to those persons interested, and not sent out separately. MAYOR MATTHEWS said he thought it would be quite satisfactory to give to those interested if we cannot send it out with the sample ballots. COUNCILMAN ADAMS said he would suggest that members of the Council use it for what it is worth, if the newspaper cares to publish it it is the newepaper's business. MAYOR MATTHEWS said he personally would like to have one sent to every voter. ATTORNEY,WARNER said he does not think it advisable. Moved by Fritz, seconder. by Thatcher, that ADMINISTRATIVE CONSULTANT SULLIVAN have a supply of these "Comments on Ballot Measures" mimeographed to htiae available to those persons interested. 3/21 288 Carried,,by the following vote to -wit: Ayes: Curry, Fritz, Thatcher, Matthews. Nays: Adams. ADMINISTRATIVE CONSULTANT SULLIVAN stated that in regard to the Fire Insurance, the insurance on the buildings and equipment was not written for the full amount of the value the last time. The fourteen agents have now gotten together as a committee to prepare a recommendation for two policies instead of fourteen as previously.. This insurance can be taken out on a five year budget plan, the rate is fixed by the Rating Bureau. Mrs. Sullivan said that she could not make any recom- mendations tonight. ADMINISTRATIVE CONSULTANT SULLIVAN stated that the Second Annual Institute on Government would be held at Balboa Park, April 21 and 22, 1950. RESOLUTION NO. 5179 was read, petitioning the San Diego County Board of Supervisors to cancel the taxes on Lots 75, 16, 7?, Blook 5, Paradena Park, 40 Acre Lot 1, Quarter Section 131, Rancho de la Nacion. Moved by Fritz, seconded by Adams, that the Resolution be adopted. Carried, all Councilmen present voting aye. ATTORNEY WARNER stated that he had prepared an ordinanoe of intention to vacate and close sn alley in Block 212, City Plat. ORDINANCE NO. , an ordinance.of intention of vacate and close a portion of a public alley, was presented. Moved by Adams, seconded by Fritz, that only the heading be read., Carried, by the, following vote to -wit: Ayes: Adams, Curry, Fritz, Thatcher, Matthews. Nays: None. 3/21 289 ORDINANCE NO. , AN ORDINANCE OF INTENTION TO VACATE AND CLOSE A PUBLIC ALLEY LOCATED IN BLOCK 212 CITY PLAT, CITY OF NATIONAL CITY, CALIFORNIA. Moved by Adams, seconded by Fritz, that the Ordinance be laid over until the next meeting ftsr the second and final reading. Carried, by the,following vote to -wit: Ayes: Adams, Curry, Fritz, Thatcher, Matthews. Nays: None. ATTORNEY WARNER stated that in regard to the moving of the building at 9th & Roosevelt, he had talked with,two attorneys, one represented the party who owns the building, and the other a attorney represented the owner of the land, and they promised that the building would be moved within the next two days. Attorney Warner said that he had talked with them again yes- terday and they said they had started to move some of the building and it should be moved within the next day or two. B. B. WALKER said that a Mrs. Hunter was threatened by the Police that she would have to move out of her trailer by the 9th of next month if she did not pay the $2.00 license Pee. She went to the Police Department, and Mr. Walker said they took her last $2.00 away from her, she had no money with which to buy food. MRS. FLORENCE CLARKE, 2638 National Avenue, said she thought if the lady was old and had no money at all, she should not be living in a trailer, the County of State should take care of her. BERNARD BANKE was present, and asked about the tidelands that the State was going to give to the City of National City. MRS, SULLIVAN said it is part of the Bay and it is before the State Lands Commission. 3/21 290 ADMINISTRATIVE CONSULTANT SULLIVAN stated that she and PURCHASING AGENT HARMY would like permission to prorate the rental oharge on some tidelands that the City leased. The man who leased the property thought that our rental was high. Mrs. Sullivan said they would like to accept five and a half months rental instead of six months. Moved by Adams, seconded by Fritz, thatADIINISTRATIVE.CONSULTANT SULK VAN be authorized to prorate the rental charge, as requested. Carried, all Councilmen present voting aye. J. E. WATERS, 3126 E. 20th Street, was present, and stated that in regard to the City's collection of garbage and rubbish, he lived on the other aide of Lincoln Acres and that he needed all the garbage he had. He said the City did not collect any garbage from his place and therefore he did not feel that he should have to pay; he said he did not see where that is a law because it was never voted on by the people. COUNCILMAN FRITZ said he widhed to compliment the people who got up the report on "Trailer Parks". PURCHASING AGENT HARI{EY said he is still txging to locate a compressor. Mr. Harkey said there is a new type of compressor but none have been delivered in San Diego County, Mr. Harkey said we could get twice the value from this compressor than we could from the others at about one-third more, but before he recommended the purchase of it he would like to see it in operation. COUNCILMAN CURRY said that he thought we should take some action in the near future to take care of the white lines on our streets. Mr. Harkey said the compressor could be used for the marking of the lines. MAYOR MATTHEWS said he 3/21 291 saw no objection-1 t3 illJwing Mr. Harkey another two weeks to check on the co-nprescor, MR. WATERS state. t'zat down on 20th Street at the bottom of the hill from hi6 house, which is 3126 E. 20th Street, some- thing should be done making this safe. MR. H. H. WALKER said he has Been a couple of wrecks at this corner. Moved by Fritz, seconded by Curry, that this be referred to the Police Department for checking. Carried, all Councilmen present voting aye. COUNCILMAN CURRY asked that ADMINISTRATIVE CONSULTANT SULLIVAN and ENGINEER McCLURE make a survey of the tidelands owned by the City that are leased. MRS. SULLIVAN stated that she will have the report at the next meeting. Moved by Thatcher, seconded by Adams, that the meeting be closed. Carried, all Councilmen present voting aye.
