National City, California, October 3, 1950.
Regular meeting of the City Council was celled to order by
Mayor Clinton D. Matthews et 7:30 F.M. o'clock. Council-
men present: Carrigan, Clarke, Curry. Hart, Matthews.
Councilmen absent: None.
Moved by Carrigan, seconded by Curry, that the reading of
the minutes of the adjourned meeting of September 26, 1950,
be dispensed with. Carried. ell Councilmen present voting
aye.
ADMINISTRATIVE OFFICIALS present: Alston, Sullivan. W^rner,
McClure, Vensant.
HERBERT A. BARNES was precept and asked why he could not
see the group insurance contract. MAYOR MATTHEWS stated
that the contract has not es yet been received. CITY MAN/GER
SULLIVAN stated thet the procedure is, the employees have
to make en application by signing an authorization for pay-
roll deduction, this is the method by which the insurance
company secures enough aignctures to enter into a contract,
and they have secured the signatures of 95 employees and
will submit a master contrect, which has not yet been re-
ceived. MR. BARNES said that there never has been any real
meeting of the employees or any advertising done. The
matter of the fire insurance policies was egein referred
to and Mr. Barnes stated that he could not understand why
he personally wes eliminated end not given en opportunity
as the other twelve people were given on the fire insurance.
CITY M9NAGER SULLIVAN said that Mr. Barnes wes not

eliminated, and thet he received the same letter that each,
of the other insurance agents received. He,sPid that he
could not understand why a Canadian Company was chosen,
why we sent our business to another country. MRS. SULLIVAN
said that she would be glad to explain this insurance plan
to Mr. Barnes in her office in the morning, et which time
she would have the records aveilabie and could better
answer Mr. Bernes questions. COUNCILMAN CLERKS stated that
the files and the records of this City ere open to the
inspection of the people of this community et any time,
and it is unreasoneble to expect the Council to listen to
ell this detail pertaining to one individual when we have
so much community business before us, and he would suggest
tc Mr. Barnes that he would get greater setisfection if he
sew the records himself. MR. BARNES stated that he would
take this up with Mrs. Sullivan in the morning and also have
Mrs. Alston show him the records end policies on file in her
office.
S. D. LOUCKS was present end reed some quotations from a
letter that he received and his replies to the letter.
COMMUNICATION FROM CITY ENGINEER McCLU?iE submitting a summary
of bids received on Project 31, Eighteenth Street Resurfac-
ing, Highland Avenue to Wilson ."_venue, was road. The low
bid, that of the Daley Corp. is substantially below the
cost set up for this portion of the project, end it is the
recommendation of the City Engineer that they be awarded
the contract.
RESOLUTION NO. 5339 wes reed, accepting the bid by the

Daley Corp. of $15,160.00 for Project 31, Eighteenth Street
Resurfacing, Highland Avenue to Wilson !venue, and author-
izing the Mayor to sign e contract on behalf of the City
with the Daley Corp. Moved by Carrigan, seconded by Hart,
that the Resolution be adopted. Carried, all Councilmen
present voting eye.
ORDINANCE NO. ^T_ , an ordinance approving the annexation
to National City of "Millerton Annex" wts presented for the
second and final reading. Moved by Hert, seconded by
Clarke, that only the heading be reed. Carried, by the
following vote to -wit: Ayes: Carrigan, Clarke, Curry,
Hart, Matthews. Nays: None.
ORDINANCE NO. 795, AN ORDINANCE APPROVING THE ANNEXATION
To THE CITY OF NATIONAL CITY, CALIFORNIA, OF CERTAIN UN-
INHABITQD TERRITORY, IN THE COUNTY OF SAN DIRGO, STATE OF
CALIFORNIA, DESIGNITED AS "MILLsRTON ANNEX". Moved by
Clarke, seconded by Hert, thet the Ordinance be adopted,
Carried, all Councilmen present voting eye.
CITY MANAGER SULLIVAN stated the cerds have not ell been
received from the property owners in "Sunny Knolls" and it
is her recommendation that it be laid over until the next
meeting. Moved by Hart, seconded by Curry, that the second
reading of the Ordinance on "Sunny Knolls Annexation" be
laid over until the next mooting. Carried, all Councilmen
present voting aye.
A. J. CRACOLICI was present end stated that he did not
understand why the Council was trying to annex Sunny Knolls

when the majority of the proporty owners were not in favor
of It. MAYOR MATTHEWS steted that if the people there were
opposed to the annexation the Council would not go ahead
with it. MR. CRACOLICI steted thet they were definitely
opposed to it at this time, that it be put ovor for e year
as quite a few of the property owners are now being called
into the service and would not be getting enough money to
pay higher taxes.
CITY MANAGER SULLIVAN stated thet letters end cards were
sent Jac ell the property owners in "Logan" and a reply has
been received in writing or in person to the Manager's
Office from all except one proporty owner who lives in
Los Angeles and the Manager's Office tried to reach herby
phone in order to complete that contact. Mayor Matthews
discussed it with Mr. Knox and all favor the annexation.

CITY MANAGER SULLIVAN stated that cards have been sent to
all of the property owners in "Fisher" end the returns
ere incomplete and she recommended tnet it be laid over
until the next meeting. Moved oy Hart, seconded by Clarke,
that the second reeding of the Ordinance on "Fisher Annex-
ation" be laid over until the next meeting. Carried, ell
Councilmen present voting aye.
CITY MANAGER SULLIVAN stated there is one owner of "Euclid
Rancho" and he has signified in writing that he wishes to
be annexed to National City.

CITY MANAGER SULLIVAN stated that the annexation rf "Palm
Valley" is incomplete and recommended that it be laid over.

CITY CLERK ALSTON stated that the next item is the first
reading of the Subdivision Ordinance. ATTORNEY WARNER
stated thvt it was the second reading, however it has been
mended since the first reading and when there is an amend-
ment it must have another first reading end be laid over et
leant five days.

SAFETY COMMISSION was presented. Councilman Curry said
that he would like to stggest tnet Jerry Harris be appoint-
ed to the Commission. COU CIL.LAA CARRIGAN stated that
before the appointment is made, and in order to avoid a lot

of these resignations, he would recommend that any man
suggested, be written a letter informing them of the duties
involved and the approximate time it would take and give
them en opportunity to accept or object the offer./ MAYOR
MATTHEwS said he was in accord with Councilman Carrigan's
suggestion unless the men had already been contacted. Mr.
Harris caked for a job and said that he would give the
-time to It. COUNCILMAN CLARKE stated that Mr. Harris asked
him -that he be considered if any vacancy oecured on any
commission, and Mr. Clarke said that he would heartily en-
dorse Jerry Harris. Mr. Clarke said that he too would like
to see a letter written to anyone that might be considered
es a member of any Commission, it would give them an
opportunity to give it some study. COUNCILMAN CARlIGAN said
that he would also suggest that in the letter the names of
the ether members of the Commission be included so that they
would know with whom they would be working. CITY M1NAGFR
SULLIVLN stated that her offiee would take care of the matter.
RESOLUTION NO. 5340 was reed, authorizing the appointment of
Jerry Harris to the National City Traffic Safety Commission,
effective October 1, 1950. Moved by Clarke, seconded by
Curry, that the Resolution be adopted. Carried, all Council-
men present voting eye.
FETITICN OF CITY EMPLOYEES for 40 hour week was presented,,
COUNCILMAN HART said that it was his understanding that if
the 40 hour week was adopted that it would not necessarily
mean any additional help, end asked City Manager Sullivan
if that was true. CITY MANAGER SULLIVAN stated that she has

gone over it with each department carefully and she thought
it would be very difficult in the police Department without
having additionel help. in the Fire Dera rtment we heve a
problem of allowing firemen time off because of the differ-
ent kind of schedule. The other departments could, if the
employees sew fit to adjust themselves to some different
working arrangement, probably work'e 40 hour week without
edditilnal help. CCUNCILMAN HART said it was his suggestion
thet this be laid over and studied and thet the actuel cost
of putting it into effect be broucht back to the Council
so that we will have something to work on. CCUNCILMAN CURRY
stated that the City Council agreed on the 40 hour week, it
was a matter of the City Manager bringing in a schedule show-
ing the cost and additionel men necessary, end we have not
received it up to this time. COUNCILMAN CARZIGAN stated
that that was the old Council, not this one. CCUNCILMAN
CURRY said it was the City Council et that time. COUNCILMAN
CLGRKE said he received a communication which stated that
the City Council of National City has previously passed by
majority vote a resolution to establish a 40 hour work week
for the civil employees of Netionel City, which resolution
was given wide publicity in the National City News. Mr.
Clarke said he would like to know what the status of thet is
et the moment. ATTCRNEY WARNER stated that when this matter
was raised in January of this year, there was a motion made
that the employees be put on a 40 hour week, which was
seconded and passed. However, that was not the proper way
to proceed, it has to go to the Civil Service Commission
and then come beck to the Council with a recommendation.

It went to the Civil Service Commission, and Mr. Warner
stated that as far as he knows they have not come up with
e recommendation as yet, C1TY MANAGER SULLIVAN said that
the Civil Service Commission wrote a letter stating that
they had a hearing on the 40 hour week but that they felt
that it was a budget utter rather than a Civil Service
matter and therefore did not make any recommendation. The
Council referred this back to the Civil Service Commission
for the second time. Moved by Clarke, seconded by Bert, that
the Civil Service Commission furnish the Council with the
details concerning the 40 hour week. Carried, all Council-
men present voting aye. COUNCILMAN CARRIGAN suggested that
a representative group of employees and the Civil Service
Commission and the Council get together in en informal meet-
ing end work out en amicable agreement. MAYOR NA TTHEWS said
he thought it a very good ides to have such a meeting, and
he would like to have the departmmnt heads also attend.
COUNCILMAN CURRY said that he thought -we should consider
having a skeleton crew on Saturday mornings. MAYOR MATTHEWS
asked that the meeting be called for Tuesday, October 10,
1950 at 8:30 P.M.
NOTICE from the Public Utilities Commission, in the matter
of the San Diego Transit System which is making application
for authority to increase rates, was read. The hearing is
to be held October 11, 1950 et 2:00 r,M. in the Board of
Supervisor's Chamber, Room 310, Civic Center Building, San
D1ago. Moved by Clarke, seconded by Curry, that Attorney
'Verner be authorized to attend this meeting on behalf of
the City Council. Carried, ell Councilmen present voting eye.

to annex to the City of National City the uninhabited
territory designated ea "Pritchards°, located in the County
of San Diego. The hearing was set for 8:00 o'clock P.M.
November 8, 1950. Moved by Curry, seconded by Clarke, that
the Resolution be adopted. Carried, all Councilmen present

many of the Mayors attend as possible. Moved by Carrigan,
seconded by Hart, that Mayor Matthews be authorized to attend
this Congress. Carried, all Councilmen present voting aye.
REQUEST from City Treasurer Vensant for a refund of S1.00
for advance payment for "Garbage and Trsah" removal paid by
Mrs. L. Paperella, 817 Celt Wood Avenue, Schenectady, N. Y.,
was reed. Moved by Hart, seconded by Clarke, that the
refund be made. Carried, all Councilmen present voting aye.
CCUNCILMAN CU/RY stated that now that we are starting on
this program of annexation, tree planting and various other
things that most of these should go through the Planning
Commission for their approval. MAYOR MATTHEWS stated that
he would like to have e meeting with the Planning Commission
as there are a number of things that should be discussed,
one is the 15 day waiting period. Mayor Matthews said if it
was possible- for the Planning Commission he would suggest
that the Couneil meet with them Wednesday, October llth.
COUNCILMAN CL!RKE said he would like to know what -the status
of the Planning Engineer would be and who would the Council
be guided by chiefly, the Planning engineer or the Planning
Commission. MAYOR MATTHW'S stated thet he thought it would
be well to have the Planning Engineer meet with the Planning
Commission and Council. CITY MANAGER SULLIVAN said thet the
Planner's principal responsibility is to gather information
end facts and prepare naps and work with the Planning
Commission and to do such other planning requirements the
City Council and the Planning Commission may want, so they

would not be in conflict,
MY -MANAGER SULLIVLN stated that we have two Supplemental
Easement Agreements from the State Livisicn of Highways,
having to do with a change. in their alignment et 24th
Street. The City Engineer and the'City Mt,.neGor have re-
viewed the in comparison with previous agreements signed
and they are sun-lenental agreements, the City Attorney has
also checked the and finds no reason why they should not be
adopted.
REE"LUTIcN Nn. 5342 was read, a nrcvin3 a Supplemental
Easement Agreement between the San Diego end Arizona Eastern
Railway Company, the City of Netional City, end the State
of California by which the railroad grants certain additional
parcels of right of way adjacent to the l8th Street under-
pass. The Mayor and City Clerk are directed to sign the
Agreement on behalf of the City. The City Clerk is direct-
ed to record said Agreement. Moved by Curry, seconded by
Clarke, that the Resolution be adopted. Carried, ell
Councilmen present voting aye.
COUNCILMAN CARRIGAN stated that he noticed recently on
18th Street just off National Avenue where the bus stop hes
been dug out end concrete put in, and asked if the City was
making the repairs or the Trensit Company. CITY MANAGER
SULLIVAN said that the City was doing it, the franchise with
the Bus Company does not include ttie putting in of bus
stops. The City of San Diego has renegotiated a franchise
to include a sharing with the Bus Company, a fifty fifty
cost of putting in concrete beds where it 13 necessary for

bus stops. COUNCILMAN CARRIGAN said he would like to know
if we could not incorporate that 1r an agreement between
this City and the Transit Company. CITY MANAGER SULLIVAN
stated that the City Attorney end she would be glad to
renegotiate if it is the policy of the Council. Moved by
Carrigan, seconded by Clarke, thet the City Manager and
City Attorney be authorized to renegotiate the contract
with the Transit System with the specific mentioned item
of bus stops. Carried, all Councilmen present voting eye.
RESOLUTION NC. 5343 was read., approving a Supplemental
Agreement amending the original agreement dated October 4,
1949, between the San ntego & Arizona Eastern Railway
Company, the City of National City, and the State of
California, in connection with conatruction,of underpasses
et 18th end 24th Streets end Bey Boulevard (Montgomery
Freeway), State Route 2 in National City. The Mayor and
City Clerk are directed to sign same on behalf of the City.
Moved by Clarke, seconded by Hart, that the Resolution be
adopted. Carried, all Councilmen present voting aye.
CITY MANAGER SULLIVAN'atated that the Neon signs are now
nearing completion except for the appropriate slogan
entering the City which the Council indicated to the
Comreny they would like. The Neon Sian Co. and the City
Manager await the instruction of the council es to whet
slogan they would like to have put on the sign. COUNCILMAN
CL RKE said that personally he would like to choose "The
Friendly City", but n good idea was suggested to Mr. Clarke
that it might be well for the newspaper to run some kind of

a contest open to all the citizens of the comity In
choosing a slogan for the City of National City. COUPCIL-
MAN CARRIGAN said he thought it might be a good idea to
run en experiment and see how much interest you could build,
and offer a prize for the beat suggestion. MAYOR MATTHEWS
was in accord with the idea. COUNCILMAN CARRIGAN said that
he would like to suggest that the Council donate one month's
pay for the prize. Moved by Clarke, seconded by Carrigan.
that the prize for the best slogan for Notional City to be
shown on the National City sign et the entrances to the City,
will be one month's pay from the City Council, a total of
$50.00. Carried, all Councilmen Present voting sired
COUNCILMAN CURRY asked how many words should be used. CITY
MANAGER SULLIVAN said that she thought not more than five.
The closing date to be midnight October 28th end that the
details for this coat ist be left up to the Chamber of
Commerce.
CITY MANAGER SULLIVAN stated that we have received a letter
from the sales manager of Saunders and Saunders concerning
en easement for a culvert in Rancho Hills No. 2 addressed
to the City Council. The City Qnglneer hes made a study of
the request and has recommended that it not be granted be-
cause this is an easement which the City obtained from the
original subdivider for a culvert over a lot et the inter-
section of Earle Drive and Herbison Avenue. The city
Engineer recommends that if anything be done that the
easement be increased and not dispensed with, and the City
Engineer has informed Mrs. Sullivan that the contractors
think that they have found some other possible solution,

end since the Engineer hes recommended that the easement
not be granted, Mrs. Sullivan seid she would recomtend that
we reply to the letter asking for a cancellation of the
ee®anent on this lot of 10 feet wide and 35 feet long in
Lot 43 of Rancho Hills No. 2. Moved by Carrigan, seconded
by Clarke, that the request be denied. Carried, all Council-
man present voting aye.
CITY MANAGER SULLIVAN stated that last night et the request
of the Paradise Hills Civic Assn. she met with a committee
of the Assn. in Paradise Hills at which the Asst. Menerer,
Mr. Blum, from San Diego was in attendance. The Assn. had
a number of questions they wanted to esk eech of the
Managers and the result of the discussion was that the
Community group in Paradise Hills decided to ask the City
Council of San Diego for an informal conference in order
that they might find out whether the City Council of San
Diego ere willing to permit en election in the event thet
they had a petition from Peredise Hills to withdraw from
the city of San Diego. CITY MANAGER SULLIVAN said there
are two methods in which Paredise Hills could petition to
annex to Nrtional City, the one would require a City wide
petition of the city of San Diego and would require a City
wide, election, which would be rather difficult for a small
group of people. The other method is under the section of
the Code having to do with en adjacent City whereby the one
that wishes to withdraw from one City and join another may
have en election celled, providing four -fifths of each of
the two Councils ere in agreement. The Paradise Hills
Civic group felt that this Council would be willing to

permit them to come in end they concluded that they should
have eh informal discussion with -the Council of San Diego.
M2S. SULLIVAN stated that, they will probably have the
conference as soon es, Mayor Knox hes returned to the
City. COUNCILMAN CLARKF,,said he would be willing to go
on record,, and would' like to see one hundred percent of

residents of Paradise Hills can resolve their difficulties
with the City of San Diego, and if they did decide to come
in to National City, that the City Council of National City
would welcome them es a new annexation. COUNCILMAN CURRY
saSd he would like to have the Attorney's-opinion as to
se'rvtng that area with water. At the preeent'time they
ere served, by San Diego. would they -carry, their water
rights, or would Sweetwater Water Company or National City.
ATTCRNRY WARNER stated that Mrs. Sullivan has gone over
this matter with the 'Water Company and would be able to
give an answer. CITY MANLORR SULLIVAN stated that the
matter of their rights to the Colorado River Water would
be the same, whether they were in Son Diego or National
City. As to the Otey rights a negotiation would have to
be carried on between the California Water & Telephone
Company and the City of San Diego. They are currently
engaged in a negotiation because of a recent suit about
San Diego serving people outside the cooperate limits,
and the California Water & Telephone Company happen to
serve a small area that subsequently annexed to the City
of San Diego. They are trying to resolve now to get out

of each others territory. The only precedent, Mrs.
Sullivan said that she knew about on the Ctay rights is
thet Coronado withdrew from the city of San Diego end
retained their Otay righte. However, in the Ctay pipe-
line the Colorado River Water is pumping South to Otey
so that Paradise Hills is actually being served Colorado
River Meter. The Committee -lest night asked Mr. Blum
his opinion on their water and he thought it was not
impossible even under their recent court suit for the City
of San Diego to continue to serve them with water 1f there
was no other way in the event that they did withdraw from
the City because of their Otay rights, however, he thought
it was more desirable If they should withdraw from the City
of San Diego that they be served by the California Water &
Telephone Company, es a part of National City, but he did
not think there would be any great legal difficulty involved.

CITY MANAGER SULLIVAN stated that in regard to the Loyalty
Oath Law, that each of the City Council had received e
copy and the City Clerk hes ordered sufficient number of
copies for the employees and such citizens who may become
a part of the Disaster Council and Civilian Defense.
CITY MANAG'R SULLIVAN stated that there have been a number
of requests from the peoale on Mariposa Avenue to become
a pert of National City, end because it is under the same
procedure involved as Paradise Hills, both the City
Attorney and City Manager feel that every precaution

should be taken so that it be done carefully. The Right -
of -Tay Engineer hes obtained the ownerships of record in
the area and is in process of dis:ussing with etch one of
the property owners separately whether they want to with-
drew from San Diego and come into National City. We have
been asked several times for a petition, but the petition
must describe the exact area so they are trying to find
out how far East from Marpioae the people wish to annex
and then that can be put into one petition end presented
to the City Council of National City and the City Council
of San Diego. The other area is one where we have had a
number of property owners who have asked for a petition to
be processed South of 30th Street, and likewise the owner-
ships are being put on a map so that we can determine en
area in order that letters can be sent to make certain
that they want to be annexed.
