Matthews et 7:30 P.M. - o'clock. Councilmen present: Carrigan, Clarke, Curry, Hart, Matthews. Councilmen absent: None. Moved by Carrigan, seconded by Curry, that the reading of the minutes of the regular meeting of October'3, 1950, be dispensed with. Carried, all Councilmen present voting aye. ADMINISTRATIVE OFFICIALS present: Alston, Sullivan, Warner, Vermont, Finnerty, McClure, Mikkelson, Bates, Harbison, Bailey, Bird. BILLS AUDITED by the Finance Committee presented: Moved General Fund Comm. Redevelop. Library Fund Park M & I Fund Plan. Commission Street Fund Accts, Fayable Fund Capital Reserve Fund Payroll Fund TOTAL $13,063.44 839.10 380.39 3,033.59 300.00 53502.99 15,346.48 190.56 17 506.23 556 162.'18 by Curry, seconded by Hart, that the•billa be allowed and warrants ordered drewn for same. Carried, by the follow- ing vote to -wit: Ayes: Carrigan, Clarke, Curry, Hart, Matthews. Nays: None. RESOLUTION NO. 5344 was read, authorizing the payment of $190.56 to the National City Electric Works. for City Hall Remodeling. Moved by Hart, seconded by Curry, that the Resolution be adopted. Carried, all Councilmen present voting aye. HERBERT A. BARNES was present end again brought up the 10/10 198 matter of the Fire Insurance policies and the group insurance for the employees,nnd• asked if the fire insurance had been paid. CITY MANAGER SULLIVAN stated that the bills have been processed but did not know whether or not they had been paid, and that she would be very glad to go over this matter again in detail tomorrow in her office, and answer any questions that Mr. Barnes wishes answered, MAYOR MATTHEWS stated that he thought Mr. Barnes would get better satisfaction if he would take this up with Mrs. Sullivan when she would have access to the information, the Council cannot answer these Questions as a lot of the details are left up to the City Manager. COUNCILMAN CARRIGAN asked Mr. Barnes if he would object to his asking him some ouestions PS he felt that the Council has been very courteous in listening to Mr. Barnes. MR. CARRIGAN asked Mr. Barnes if he had an insurance license and if he could see it. MR. BARNES said he,had a license but did not have it with him. COUNCILMAN CARRIGAN stated that Mr. Barnes had insisted that a man produce his insurance license which is to be hung on his office well, and if Mr. Barnes expected other people to do that he should do the same thing. MR. CARRIGAN asked why Mr. Barnes felt that, he was entitled to have the group insurance. MR. BARNES said thet he felt he was being ostracized. MR. CARRIGAN said that from the questions Mr. Barnes hes answered, apparently it is his intention to take everything wrong regardless of what is said. MR. CARRIGAN asked Mr. Barnes if he had a meeting with the employees and whether or not he explained the group insurance to them. MR. BARNES said that he did not as he did not understand it and still does not. MR. CARRIGAN asked if Mr. Barnes expected anyone to buy insurance 10/10 199 from an insurance man when he did not know whet he was sell- ing. He also asked if his ccmpeny's premiums were higher or lower than the other companies. MR. BARNES said that they were higher. cot:ImIaMM' CARRIGAN stated that he be- lieved Mr. Barnes was President of the Park Social Club and asked if it was a chartered Club and Mr. Barnes said that it was not. MB. CARRICTLN asked if it was a non profit organization, and the number of members. MR. BARNES said that they had three members end did not make eny profit out of it, in feet he had to "nig down in his own pocket". CARRIGAN baked who was the Treasurer of the Club. Mr. Barnes said there was none, that he had nothing to treasure. MR. CARRIGAN asked if he made a charge for his members and when did he quit requesting charges. it was three years ago, he believed. how much money he had collected this MI. Mr. Barnes said that MR. CARRIGAN asked year. MR. BARNES said that he would be glad to answer Mr. Carrigan's questions in his private office. MR. CARRIGAN said that he hed in his hand, a letter dated September 15, V950, and Mr. Barnes had membership $1.00 a year or 10 cents a day. It reed; "Instructions free, membership $1.00 a year, or 10 cents a day," and Mr. Carrigan said he wondered how members of the audience appreciate the fact that you apparently are charg- ing people to play on public Parks. CITY CLERK ALSTON presented'the subdivision Ordinance for the second reading. MAYOR NI TTHEWS said that he would like to discuss the feasibility of adding another amendment to this Ordinance, that he would like to discuss with the Planning Commission whether or not we should ask for side- 10/10 s110 200 walks to be installed in any subdivisions, if not install sidewalks to definitely establish where they should be. CITY MANAGER SULLIVAN stated thst if the Ordinance is not passed tonight there is one other sentence that should go in concerning an easement, which has been discussed with the San Diego Gas and Electric Company. Moved by Clarke, seconded by Hart, that the second reading of the Subdivision Ordinance be laid over until October 17, 1950. Carried, all Councilmen present voting aye. ORDINANCB NO. , en ordinance referred to as the Tree Planting Ordinance, was presented for the second and final reading. Moved by Curry, seconded by Hart, that only the heading be read. Carried, by the following vote to -wit: Ayes: Carrigan, Clarke, Curry, Hart, Matthews. Nays: None. ORDINANCE NO. 801, AN ORDINANCE TO PROVIDE FOR THE PLANTING, PROTECTION, PRESERVATION, REGULATION AND CONTROL OF SHADE AND ORNAMENTAL TREES, SHRUBS, AND FLOWERS UPON THE STREETS, SIDEWALKS, ALLEYS, AND PUBLIC PLACES WITHIN THE CITY OF NATIONAL CITY AND FOR SUCH PURPOSES TO PROVIDE FOR THE DIRECTION AND JURISDICTION AND CONTROL OVER THE PLANTING, MAINTENANCE AND CARE OF SAID TREES, SHRUBS AND FLOWERS, AND TO PROVIDE PENALTIES FOR THE VIOLATION THEREOF. Moved by Hart, seconded by Clarke, that the Ordinance be adopted. Carried, ell Councilmen present voting aye. REQUEST from S. Z. Greenberg to move a building, was present- ed. The building is located at 1802 National Avenue and is to be moved to Lots 13, 14 and 15, Block 17. BUILDING INSPECTOR BIRD approved the application with a 90 day time 10/10 201 limit end in conformity with the Code. CITY MANAGER SULLIVAN stated that Mr. Greenberg called the office late this afternoon, end M. Bird was out on e field inspection so she could not discuss ;he matter with him, but Mr. Greenberg indicated that he expected to have the foundation in end the building moved February let, but he wanted to be sure that he was allowed the necessary time. The property on which Mr. Greenberg's building is now has been sold to McCune Motors end their arrangement for re -location would not make it possible for Mr. Greenberg to move within the 90 days. MRS. SULLIVAN said it was her recommendation that Mr. Greenberg be allowed six months. Moved by Curry, seconded by Hart, thet the request be granted with six months time limit. Carried, ell Councilmen present voting eye. PETITION OF W. C. MOESER, requesting a building set -back variance end permission to build two duplexes in en R-1-A Zone, was presented. The Planning Commission held a hear- ing on the Petition September 12, 1950 and there were no protests. The Planning Commission recommends that the petition be granted with a 26.53' dedication for one-half street and a 10' building set -back. COUNCILMAN CARRIGAN said he thought we were getting quite a few requests for a 10 foot set -back. COUNCILMAN HART said he has seen the property and the set -beck would not interfere with anyone's view. MAYOR MP_TTHEWS asked City Engineer McClure that if Eleventh Street was continued would this interfere with the continuation. CITY SNGINEM MCCLUTlE said that it would not. COUNCILMAN HART said that he thought thet the members of the 10/10 • 202 Council should see the property involved in any requests for zone variances before the Petition is presented to the Council, in that way they would be familiar with it and not have to hold up the granting or rejection of the Petitions. Moved by Clarke, seconded by Hart, that the Petition of W. C. Moeser be laid over until next week. Carried, all Councilmen present voting eye. PETITION OF CLARENCE MORRIS for a store building and cabinet shop in the R-1-A and R-4 zones adjoining the C-3-A zone et the Southwest corner of 10th Street and Highland Avenue was presented. CITY MANAGER SULLIVAN stated that Mr. Morris wants to build on a piece of property which is split as to zones. A portion of the property which he wished to use for business is already in the business zone and the additional property that he owns is outside the business zone. It was the recommendation of the Planning Commission that the petition be granted. RESOLUTION NO. 5345 was reed, granting a special zone variance permit to Clarence E. Morris, for the purpose of a store building and cabinet shop in the R-d-A and R-4 Zones adjoining the C-3-A Zone at the Southwest.corner of 10th Street end Highland Avenue. Moved by Curry, seconded by Hart, that the Resolution'be adopted. Carried, all Councilmen present voting eye. REPORT FROM THE PLANNING COMMISSION was reed. At the regular meeting of the Planning Commission held October 9, 1950, a hearing was held on Petition No. 373 by Paul A. Foroueran, requesting a permit to sell property to the 10/10 11 r 203 congregation of the National City Church of the Nazarene, for use as a permanent building site for parsonage facilities and church. Property located at the Northwest corner of 4th Street and Norton Avenue, in en R-1 Zone. A petition signed by 18 persons in the neighborhood of the proposed church, protesting Petition No. 373, was presented, and some of the neighbors were present. The Planning Commission recommends that Petition No. 373 be denied on the basis of the protests by the neighbors. A hearing was also held on Petition -No. 374 of Gertrude Drost, re- questing a permit to build an additional building on property et 1606 Grove Street, requiring a lot size variance. The Planning Commission recommends that this petition be granted. REVEREND MOFFITT was present end stated there was a little discrepancy in the overall picture when stated it is for a personage and church. Rev. Moffitt said that it is not a church building at all, it ie a residence type building and they asked for a variance for meeting in this building until such time asithey ere able to purchase e piece of property for a church. COUNCILMAN HART suggested that Rev. Moffitt talk to the people who signed the petition and perhaps he could clerify the matter. Molted by Clarke, seconded by Hart, that the report of the Planning Commission be laid over until October 31, 1960. Carried, ell Council- men present voting eye. CITY CLERK ALSTON presented the Annual Statistical Report for the fiscal year 1949-1950. Moved by Hart, seconded by Clarke, that the report be accepted.
