ROLL CALL Council / Board members present: Cano, Morrison, Natividad, Rios, Sotelo-Solis. Motion by Rios, seconded by Sotelo-Solis, to pull Item No. 5, and to approve the remainder of the Consent Calendar. Carried by unanimous vote. APPROVAL OF MINUTES 4. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE INSTALLATION OF RED CURB "NO PARKING" ON THE 3000 BLOCK OF E. 6TH STREET. (TSC 2012-25) (Engineering) **Continued from Council Meeting of January 15, 2013** TESTIMONY: Eric Quinonez, National City, spoke in opposition. ACTION: Motion by Sotelo-Solis, seconded by Natividad, to adopt the Resolution. Carried by unanimous vote. CONTRACT (C2006-63) 6. Resolution No. 2013-23. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING THE SEVENTH AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF NATIONAL CITY AND DOKKEN ENGINEERING IN THE AMOUNT OF $135,000 TO PROVIDE ENGINEERING AND CONSTRUCTION SUPPORT SERVICES FOR THE PLAZA BOULEVARD WIDENING PROJECT. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DECLARING A RECENTLY VACATED PORTION OF G AVENUE RIGHT-OF-WAY, SOUTH OF EAST 24TH STREET AS SURPLUS PROPERTY AND DIRECTING STAFF TO PROCEED UNDER COUNCIL POLICY #901 FOR THE EVENTUAL SALE OF THE PROPERTY. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE NATIONAL SCHOOL DISTRICT FOR PARTIAL FUNDING OF THE SCHOOL RESOURCE OFFICER PROGRAM. THE CITY OF NATIONAL CITY WILL BE REIMBURSED $61,917.00 BY THE NATIONAL SCHOOL DISTRICT FOR FISCAL YEAR 2012-2013 SCHOOL RESOURCE OFFICER POLICE SERVICES. (Police) ACTION: Adopted. See above. CONTRACT (C2004-42) 9. Resolution No. 2013-26. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE SWEETWATER UNION HIGH SCHOOL DISTRICT FOR PARTIAL FUNDING OF THE SCHOOL RESOURCE OFFICER PROGRAM. THE CITY OF NATIONAL CITY WILL BE REIMBURSED $80,000.00 BY THE SWEETWATER UNION HIGH SCHOOL DISTRICT FOR FISCAL YEAR 2012-2013 SCHOOL RESOURCE OFFICER POLICE SERVICES. (Police) ACTION: Adopted. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY RATIFYING THE ACCEPTANCE OF AN AUGMENTATION TO THE CALIFORNIA LIBRARY LITERACY SERVICES (CLLS) GRANT FY 2012-13 IN THE AMOUNT OF $3,537.00, INCREASING THE TOTAL AMOUNT OF THE GRANT FROM $43,410.00 TO $46,947.00. Warrant Register #30 for the period of 01/16/13 through 01/22/13 in the amount of $1,018,620.34. (Finance) ACTION: Ratified. See above. NEW BUSINESS TEMPORARY USE PERMITS 2013 (203-1-29) 14. Temporary Use Permit — Liberty Tax Service requesting advertising displays at 605 Highland Avenue and 1615 E. Plaza Boulevard from February 6, 2013 thru April 15, 2013 with no waiver of fees. (Neighborhood Services) **Continued from Council Meeting of February 5, 2013** RECOMMENDATION: Approve the Application for a Temporary Use Permit with no waiver of fees and subject to compliance with all conditions of approval. TESTIMONY: None. ACTION: Motion by Natividad, seconded by Sotelo-Solis, to approve the Temporary Use Permit with modifications at 605 Highland to include reducing the signs permitted from 8 to 4, reducing flags from 5 to 2 and 4 x 5 signs from 2 to 1 and at 1615 E. Plaza to reduce 'A' frames to 2, signs to 5, waiver boards to 2, flags to 4 and 4 x 5 signs to 2. Carried by unanimous vote. CONDITIONAL USE PERMITS 2013 (403-28-1) 15. Notice of Decision — Planning Commission approval of a Conditional Use Permit for a charter school in Westfield Plaza Bonita Shopping Center located at 3030 Plaza Bonita Road, Suite 1000. (Applicant: Student Success Programs Incorporated) (Case File 2012-25 CUP) (Planning) RECOMMENDATION: Staff concurs with the decision of the Planning Commission and recommends that the Notice of Decision be filed. TESTIMONY: Lynne Alipio, Tim Tuter and Wade Aschbrenner from Altos Institute and Sherry Jones from Westfield Plaza Bonita responded to questions. CONDITIONAL USE PERMITS 2013 (403-28-1) 16. Notice of Decision — Planning Commission approval of a Conditional Use Permit for the expansion of an existing church, including the construction of a new school, with a request for a reduction in off-street parking at 616 E. 8th Street. (Applicant: International Bible Baptist Church) (Case File 2012-24 CUP) (Planning) RECOMMENDATION: Staff concurs with the decision of the Planning Commission and recommends that the Notice of Decision be filed. TESTIMONY: None. ACTION: Motion by Sotelo-Solis, seconded by Rios, to approve staff recommendation. Carried by unanimous vote. FINANCIAL MANAGEMENT 2012 — 2013 (204-1-28) 17. City of National City Comprehensive Annual Financial Report for the Fiscal Year Ended June 30, 2012. (Finance) RECOMMENDATION: Accept and file. TESTIMONY: Jennifer Farr, appeared on behalf of the Auditor and reviewed the report. ACTION: Accepted and filed. BUDGET FY 2012 — 2013 (206-1-28) 18. Mid -Year Fiscal Year 2012-13 Budget Update. (Finance) RECOMMENDATION: Accept the staff report as presented. Adopt the recommendations in the staff report. TESTIMONY: None. ACTION: Motion by Sotelo-Solis, seconded by Natividad, to approve staff recommendation. Carried by unanimous vote. BUDGET FY 2013 — 2014 (206-1-29) 19. Scheduling of City Council workshops related to the discussion and preparation of the City of National City's Strategic Plan and Annual Budget for Fiscal Year 2013-2014. (Finance) RECOMMENDATION: Accept staffs recommended budget workshop of April 9 and 30, 2013; or, in the alternative, provide direction on alternative dates. TESTIMONY: None. COMMUNITY DEVELOPMENT COMMISSION — HOUSING AUTHORITY OF THE CITY OF NATIONAL CITY NO AGENDA ITEMS STAFF REPORTS CLOSED SESSION REPORT (509-1-4) 21. Closed Session Report. (City Attorney) City Attorney Claudia Silva stated there was nothing to report from the Closed Session. (See attached Exhibit'L') MAYOR AND CITY COUNCIL City Treasurer Beauchamp expressed his concern about placing a charter school at Plaza Bonita. Vice Mayor Natividad requested updates on the negotiations with the YMCA and a list of City programs affected by loss of CDBG funding. Council Member Sotelo-Solis commended to Code Enforcement staff for the job they did during Valentine's Day and thanked everyone that participated in the City Hall visit by the elementary students. Council Member Rios reported that she attended the SANDAG retreat and reported on an idea to be considered by the Bay Shore Bikeway Committee dealing with the potential for a suspended bike bridge or tube on the Coronado Bridge. ADJOURNMENT Motion by Sotelo-Solis, seconded by Rios, to adjourn the meeting to the next Regular Meeting of the City Council and Community Development Commission — Housing Authority of the City of National City to be held Tuesday, March 5, 2013 at 6:00 p.m. at the Council Chambers, National City, California.
