ROLL CALL Council / Board members present: Cano, Morrison, Natividad, Rios, Sotelo-Solis. Administrative Officials present: Cissel, Dalla, Deese, Duong, Manganiello, Parra, Raulston, Roberts, Rodriguez, Silva, Smith, Stevenson, Vergara, Williams. Others present: Student Representatives Nallely Aceves and Kane Gillego. PLEDGE OF ALLEGIANCE TO THE FLAG BY MAYOR RON MORRISON PUBLIC ORAL COMMUNICATIONS George Contreras, National City, requested resolution of outstanding issues regarding his grant of an easement for sidewalk at 3005 F Avenue. Guille Coronado, National City, extended an invitation to the Mayor and Council to attend the MANA's San Diego Dia de la Mujer event at Sweetwater High School. William Sendt, National City, publicly acknowledged the efforts of Armando Vergara and his Neighborhood Services staff for their motor home parking enforcement efforts. CITY COUNCIL PRESENTATION COUNCIL MEETING PRESENTATIONS 2013 (102-10-8) 1. Volunteer Recognition Award — Eva Caligagan. (Community Services) la. Mayor Morrison acknowledged the City Manager's appointment of Manuel Rodriguez as the new Police Chief and offered congratulations to Chief Rodriguez. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE ACCEPTANCE OF THE FY 2012 OPERATION STONEGARDEN GRANT IN THE AMOUNT OF $37,086 AND AUTHORIZING THE CHIEF OF POLICE TO EXECUTE AMENDMENT NO. 2 TO THE AGREEMENT FOR THE AWARD OF THE GRANT FUNDS, AND APPROPRIATING FUNDS IN THE AMOUNT OF THE GRANT FOR THE REIMBURSEMENT OF OVERTIME, FRINGE BENEFITS AND MILEAGE FOR PROGRAMMATIC OPERATIONS. TEMPORARY USE PERMIT — National City Cinco De Mayo Mariachi Festival and Competition at Pepper Park on April 27, 2013 at Pepper Park with request for waiver of fees. (Neighborhood Services) TESTIMONY: Jacqueline Reynoso, National City Chamber of Commerce, spoke in support and responded to questions. ACTION: Motion by Rios, seconded by Natividad, to approve the Temporary Use Permit with all fees except application fee waived. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING THE SALARY SCHEDULE FOR THE PART-TIME AND SEASONAL EMPLOYEE GROUP TO INCLUDE THE CREATION OF A SALARY RANGE FOR THE PART- TIME PROPERTY AND EVIDENCE SPECIALIST I CLASSIFICATION. (Human Resources) RECOMMENDATION: Adopt the Resolution. TESTIMONY: None. ACTION: Motion by Sotelo-Solis, seconded by Rios, to adopt the Resolution. Carried by unanimous vote. CONTRACT (C89-12) TOWING SERVICES POLICY ADMIN (806-1-1) 12. Resolution No. 2013-51. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO AMEND THE CITY'S CURRENT CONTRACT WITH MOYNAHAN'S TOWING AND A TO Z ENTERPRISES DBA ROAD ONE TOWING, TO INCREASE FEES PER SECTION 3.5 RE -OPENER CLAUSE - FEE SCHEDULE. THE RECOMMENDATION IS TO RAISE A BASIC TOW TO $190, A MEDIUM TOW TO $210 AND STORAGE FEE TO $48 PER DAY. THE TOW CONTRACTORS ALSO AGREE TO DECREASE THE VICTIM AND WITNESS INVESTIGATIVE TOW FEES TO $75. (Police) RECOMMENDATION: Adopt the Resolution. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING BUDGET ADJUSTMENTS BY APPROVING INCREASES OF THE LIABILITY INSURANCE FUND REVENUE BUDGET AND LIABILITY CLAIM COST APPROPRIATION AND ESTABLISHMENT OF A GENERAL FUND POST REVENUE BUDGET AND APPROPRIATION FOR POLICE DEPARTMENT POST TRAINING, TRAVEL & SUBSISTENCE AND RATIFYING INCREASES OF THE GENERAL FUND DONATION REVENUE BUDGET AND INDEPENDENCE DAY FIREWORKS APPROPRIATION IN RELATION TO A DONATION ACCEPTED FROM THE SYCUAN BAND OF THE KUMEYAAY NATION. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY IN SUPPORT OF ASSEMBLY BILL 981 — BLOOM (AB 981) RELATED TO THE USE OF REDEVELOMENT BOND PROCEEDS. (City Manager) RECOMMENDATION: Adopt the Resolution. TESTIMONY: None. ACTION: Motion by Natividad, seconded by Rios, to adopt the Resolution. Carried by unanimous vote. NEW BUSINESS CONDITIONAL USE PERMITS 2013 (403-28-1) 15. Notice of Decision — Planning Commission approval of a Conditional Use Permit for a martial arts school at 340 West 26th Street, Suite G & H. (Applicant: Leticia Ribeiro Dos Santos) (Case File No. 2013-05 CUP) (Planning) RECOMMENDATION: Staff concurs with the decision of the Planning Commission and recommends that the Notice of Decision be filed. TESTIMONY: None. ACTION: Motion by Sotelo-Solis, seconded by Rios, to file. Carried by unanimous vote. DISCLOSURE: Council Member Rios disclosed that she was in attendance at the Planning Commission meeting when the item was considered. CONDITIONAL USE PERMITS 2013 (403-28-1) 16. Notice of Decision — Planning Commission approval of a Conditional Use Permit to add two gasoline pumps at an existing gas station located at 10 Osborn Street. (Applicant: Adeeb Eddy Brikho) (Case File 2013-06 CUP) (Planning) RECOMMENDATION: Staff concurs with the decision of the Planning Commission and recommends that the Notice of Decision be filed. COMMUNITY DEVELOPMENT ADMIN 2011-2014 (406-2-16) 17. Report on the San Diego Regional Enterprise Zone 2012 Voucher Activity Report. (Housing and Grants) RECOMMENDATION: Accept and file. TESTIMONY: None. ACTION: Accepted and filed. There was no vote. COUNCIL POLICY MANUAL (102-13-1) 18. City Council Review of Proposed Updates to the City Council Policy Manual (Chapter 100 Policies). (City Manager/City Attorney) RECOMMENDATION: Review policy revisions as submitted. After Council review, a supporting Resolution will be brought forward to Council at a subsequent Council meeting for final approval. TESTIMONY: None. ACTION: The consensus was to have staff look at possible formats and dates and return with a recommendation. There was no vote. POLITICAL SUPPORT ADMIN — INITIATIVES (102-4-1) 19. DISCUSSION: Draft resolution supporting a reasonable and humane approach to reforming the currently broken immigration system. (City Manager and City Attorney) RECOMMENDATION: Provide direction to staff. TESTIMONY: Pedro Rios, American Friends Service Committee, spoke in support. Julie Schauble, National City, spoke in support. ACTION: Motion by Natividad, seconded by Rios, to form an Ad - Hoc Committee to include two Councilmembers, the City Manager and Police Chief to come back with a recommendation. Carried by unanimous vote. Motion by Sotelo-Solis, seconded by Rios, to confirm the Mayor's appointment of Vice Mayor Natividad and Member Sotelo-Solis to the Committee. Carried by unanimous vote. Book 95 / Page 59 04-02-2013 COMMUNITY DEVELOPMENT COMMISSION — HOUSING AUTHORITY OF THE CITY OF NATIONAL CITY PUBLIC HEARING HOUSING AUTHORITY 2013 (404-1-2) CITY WIDE HOUSING ADMIN (303-4-1) 20. PUBLIC HEARING: Community Development Commission — Housing Authority of the City of National City approving the Public Housing Agency Plan (PHA) for Fiscal Year 2013, and the Section 8 Administrative Plan for Fiscal Year 2013; and authorizing the submittal of the PHA Plan and the Administrative Plan to the U.S. Department of Housing and Urban Development. (CDC - Housing Authority of the City of National City) RECOMMENDATION: Conduct the Public Hearing. TESTIMONY: None. ACTION: Motion by Sotelo-Solis, seconded by Rios, to close the Public Hearing. RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION — HOUSING AUTHORITY OF THE CITY OF NATIONAL CITY APPROVING THE REVISIONS TO THE SECTION 8 ADMINISTRATIVE PLAN, AND AUTHORIZING SUBMITTAL OF THE PLAN TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. (CDC - Housing Authority of the City of National City) RECOMMENDATION: Adopt the Resolution. TESTIMONY: None. ACTION: Motion by Natividad, seconded by Sotelo-Solis, to adopt the Resolution. (City Clerk) CLOSED SESSION REPORT (509-1-4) City Attorney Claudia Silva stated there was nothing to report on Item No. 1 from the Closed Session and that Item No. 2 was held over. (See attached Exhibit `L') MAYOR AND CITY COUNCIL City Clerk Dalla asked the Mayor and City Council to give consideration to an appropriate way to acknowledge the service of citizens who have served on Boards and Commissions. Vice Mayor Natividad requested that Neighborhood Services pursue enforcement of illegal tarps; requested an update on the status of auto sales on the public streets and a copy of the City of San Diego's ordinance on motor homes. Council Member Sotelo-Solis suggested the possibility of recognizing Board & Commission volunteers in conjunction with a Chamber of Commerce event. Council Member Rios praised New Police Chief Rodriguez's article in the Star News and interview on KUSI; reminded everyone about the Job Fair scheduled April 3rd; complimented staff on providing all agenda materials to the public on the City web page and stressed the importance of recognizing City volunteers who serve on Boards & Commissions. Council Member Cano expressed appreciation to Neighborhood Services for the work they are doing and questioned why the large event conducted by St. Anthony' s Church on March 29th was not required to have permits. Book 95 / Page 61 04-02-2013 MAYOR AND CITY COUNCIL (cont.) Mayor Morrison informed everyone that Sweetwater Authority now allows customers to pay their bill online and a possible opening on the Coastal Commission will require a recommendation by the City Selection Committee which he currently chairs.
