RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING REDUCTION THE PROPERTY TAX RATE FOR BONDED INDEBTEDNESS FOR FISCAL YEAR 2014 FROM 1.32 CENTS PER $100 OF ASSESSED VALUATION TO 1.19 CENTS. (Finance) ACTION: Adopted. See above. Vice Mayor Natividad returned to the Council Chamber at 5:33 pm. PUBLIC HEARING SEWER CAPACITY / FEES ADMIN (906-1-4) 16. A Public Hearing to consider the report required by California Health and Safety Code Section 5473, Et Seq. pertaining to collection of sewer charges on the tax roll, directing the City Clerk to file said report with the San Diego County Auditor, and directing the Public Works Director to certify with the San Diego County Auditor the "Sewer Service Charge Fund." Sewer service fees will not increase for FY 13-14. (Public Works) RECOMMENDATION: Hold the Public Hearing. TESTIMONY: None. (City Attorney) Book 95 / Page 142 08-06-2013 NON CONSENT RESOLUTIONS SEWER CAPACITY / FEES ADMIN (906-1-4) 18. Resolution No. 2013-118. RESOLUTION ADOPTING THE REPORT REQUIRED BY CALIFORNIA HEALTH AND SAFETY CODE SECTION 5473, ET SEQ. PERTAINING TO COLLECTION OF SEWER CHARGES ON THE TAX ROLL, DIRECTING THE CITY CLERK TO FILE SAID REPORT WITH THE SAN DIEGO COUNTY AUDITOR, AND DIRECTING THE PUBLIC WORKS DIRECTOR TO CERTIFY WITH THE SAN DIEGO COUNTY AUDITOR THE "SEWER SERVICE CHARGE FUND". RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY 1) APPROVING AMENDMENT NO. 2 TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE SAN DIEGO UNIFIED PORT DISTRICT AND THE CITY OF NATIONAL CITY WHEREIN THE DISTRICT REALLOCATED FUNDS FROM THE PORT PARK PROJECT TO THE AQUATIC CENTER, 2) AUTHORIZE THE MAYOR TO EXECUTE AMENDMENT NO. 2, AND 3) AUTHORIZE THE APPROPRIATION OF $3,080,000. (Funded by General Fund to be reimbursed by the San Diego Unified Port District) (Engineering) RECOMMENDATION: Adopt the Resolution. TESTIMONY: None. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AMENDMENT NO. 2 TO THE AQUATIC CENTER LEASE AGREEMENT BETWEEN THE SAN DIEGO UNIFIED PORT DISTRICT AND THE CITY OF NATIONAL CITY. Notice of Decision — Planning Commission approval of a Conditional Use Permit and Planned Development Permit for a new drive-in and drive - through Sonic restaurant within an existing shopping center, with an exception for less than required parking, located at 3007 Highland Avenue. (Applicant: SPG Management, LLC.) (Case File 2013-14 CUP, PD) (Planning Division) RECOMMENDATION: Staff concurs with the decision of the Planning Commission and recommends that the Notice of Decision be filed. TESTIMONY: None. ACTION: Motion by Sotelo-Solis, seconded by Rios, to approve staff recommendation. Carried by unanimous vote. MARTIN LUTHER KING JR. COMMUNITY CENTER (1101-5-1) 22. Request to use Martin Luther King Jr. Community Center (North Room) by National School District for a professional development session for approximately 100 teachers on Tuesday, August 13, 2013, from 7:00 am to 4:00 pm. Applicant is not requesting a waiver of fees. (Public Works) RECOMMENDATION: The requested use is in accordance with Council Policy 803. Staff recommends approving the Facility Use Application and payment of all fees. TESTIMONY: None. ACTION: Motion by Rios, seconded by Sotelo-Solis, to approve staff recommendation. Carried by unanimous vote. TEMPORARY USE PERMIT (203-1-29) 23. TEMPORARY USE PERMIT — Pumpkin Station hosted by Pinery Christmas Trees, Inc. at Westfield Plaza Bonita Mall from September 27, 2013 thru October 31, 2013 with no waiver of fees. (Neighborhood Service) RECOMMENDATION: Approve the application for a Temporary Use Permit subject to compliance with all conditions of approval with no waiver of fees. TESTIMONY: None. Request City Council approve the appointments of City Manager and Executive Director as Member and Alternate to the San Diego Regional Military Working Group facilitated by the San Diego Association of Governments (SANDAG). (City Manager) RECOMMENDATION: Appoint City Manager, Leslie Deese and Executive Director, Brad Raulston to participate as members of the San Diego Regional Military Working Group facilitated by San Diego Association of Governments (SANDAG). COMMUNITY DEVELOPMENT COMMISSION — HOUSING AUTHORITY OF THE CITY OF NATIONAL CITY NO AGENDA ITEMS STAFF REPORTS None. MAYOR AND CITY COUNCIL Member Sotelo-Solis acknowledged another successful Auto Heritage event at Kimball Park last weekend and reported that she will be making a presentation on her recent trip to Israel hosted by the Jewish Community Relations Council. Member Rios acknowledged former Library Board Member Brian Clapper and re- stated her hope that the City can find a way to recognize the efforts and services of our volunteers. Mayor Morrison reported that the City's National Night Out event was taking place at Las Palmas Park and encouraged everyone to participate immediately after the meeting adjourns. CLOSED SESSION REPORT City Attorney Claudia Silva stated there was nothing to report from the Closed Sessions of the City Council / Community Development Commission — Housing Authority held at 4:00 pm.
