ROLL CALL Council / Board members present: Cano, Morrison, Natividad, Rios, Sotelo-Solis. Administrative Officials present: Cissel, Dalla, Deese, Duong, Manganiello, Parra, Raulston, Roberts, Rodriguez, Silva, Smith, Stevenson, Vergara, Williams, Ybarra. Others present: City Treasurer Mitch Beauchamp and Student Representative Kane Gillego. PLEDGE OF ALLEGIANCE TO THE FLAG BY MAYOR RON MORRISON OFF AGENDA ITEM SUBJECT: Request from California Assemblywoman Lorena Gonzalez, together with Facebook, Inc., to use the Martin Luther King Jr. Community Center (North Room) for a Facebook Small Business Owners Training Seminar on Friday, November 8, 2013, from 7:00 am to 10:00 am for approximately 150 attendees. Applicant is not requesting a fee waiver. RECOMMENDATION: Add the item. ACTION: Motion by Sotelo-Solis, seconded by Cano, to bring the item onto the Agenda as Item No. 22a. Carried by unanimous vote. PUBLIC ORAL COMMUNICATIONS Brian Clapper, National City Lions Club, informed the Council about a program undertaken by the Chula Vista Elks Lodge to distribute dictionaries to all third graders in National City. Mr. Clapper invited the City Council to attend the next give -a -way events and suggested the possibility of a Proclamation by the City. Temporary Use Permit — Sweetwater High School's Homecoming on November 1, 2013 from 2:30 p.m. to 9:30 p.m. at 2900 Highland Avenue. This is a City co -sponsored event per Council Policy No. 804. (Neighborhood Services) ACTION: Motion by Rios, seconded by Natividad, to approve the Application for a Temporary Use Permit. Carried by unanimous vote. WARRANT REGISTER JULY 2013 — JUNE 2014 (202-1-28) 21. Warrant Register #12 for the period of 9/11/13 through 9/17/13 in the amount of $1,490,504.13. (Finance) ACTION: Motion by Rios, seconded by Cano, to ratify Warrant Register #12. Carried by unanimous vote. WARRANT REGISTER JULY 2013 — JUNE 2014 (202-1-28) 22. Warrant Register #13 for the period of 9/18/13 through 9/24/13 in the amount of $996,567.99. (Finance) ACTION: Ratified. See above. ACTION: Motion by Rios, seconded by Cano, to approve the Facility Use Application with all recommendations of staff. Carried by unanimous vote. PUBLIC HEARING MUNICIPAL CODE 2013 (506-2-28) 23. Public Hearing to Consider an Ordinance Amending Appendix 'A' of the Westside Specific Plan to add "Self -Storage Facility with Accessory Truck Rental" as a Conditionally -Allowed Use in the Limited Commercial (CL) Zone. (Applicant: U-Haul) (Case File: 2013-20 SPA) (Planning) RECOMMENDATION: Staff concurs with the Planning Commission's recommendation to adopt the Amendment to Appendix 'A' of the Westside Specific Plan. TESTIMONY: Parul Butala, Ron Pederson and Carlos Vizcarra appeared on behalf of the applicant, made a presentation and responded to questions. Carolina Martinez, representing the Environmental Health Coalition, suggested modifications regarding parking and hours of operation. Margarita Garcia, National City, expressed concern about the hours of operation. ACTION: Motion by Sotelo-Solis, seconded by Rios, to close the Public Hearing. Carried by unanimous vote. Motion by Sotelo-Solis to continue the item to the next meeting. Motion died for lack of a second. Motion by Rios, seconded by Cano, to bring back an Ordinance. Carried by the following vote, to -wit: Ayes: Cano, Morrison, Natividad, Rios. Nays: Sotelo-Solis. Absent: None. Abstain: None. Temporary Use Permit - Fall Festival hosted by the South Bay Community Church at 2400 Euclid Avenue on October 31, 2013 from 5 p.m. to 9 p.m. with no waiver of fees. (Neighborhood Services) RECOMMENDATION: Approve the Application for a Temporary Use Permit subject to compliance with all conditions of approval. TESTIMONY: None. ACTION: Motion by Rios, seconded by Natividad, to approve staff recommendation. Carried by unanimous vote. COMMUNITY DEVELOPMENT COMMISSION — HOUSING AUTHORITY OF THE CITY OF NATIONAL CITY NO AGENDA ITEMS STAFF REPORTS BD OF PORT COMMISSION REPORTS & HEARINGS ADMIN (701-3-1) 25. Update on San Diego Unified Port District. (Brad Raulston, Executive Director) Executive Director Raulston reported on recent events and actions by the Port that relate to National City including the unanticipated reallocation of $4.8 million of Port CIP funds to San Diego and Chula Vista; the apparent redirection by the Port away from National City's strategic plan goals for DB Capital site and the newly established Port initiatives for "Integrated Planning" and "Short-term CIP goals". 25a. Student Representative Kane Gillego updated the City Council on recent and upcoming events at Sweetwater High School. A recess was called at 8:33 p.m. The meeting reconvened at 8:41 p.m. All members were present. 25b. City Attorney Claudia Silva reported on new legislation (AB 1090) that will allow the FPPC to enforce and provide advice on conflict of interest matters. The new legislation goes into effect on January 1, 2014. Book 95 / Page 188 10-15-2013 MAYOR AND CITY COUNCIL CITY COUNCIL ADMIN (102-16-1) 26. Follow-up — State of the City Address. (Council Initiated) ACTION: There were questions to staff and extensive discussion. No action was taken. City Treasurer Beauchamp discussed the local and national consequences of the current federal government budget crisis, expressed concern about the use of outside legal counsel, the importance of the City tree crew and the new administration in our Sister City of Tecate, Mexico. Vice Mayor Natividad requested updates on food trucks and car sales on the street. Council Member Sotelo-Solis spoke about the Sweetwater High School field dedication and the upcoming Halloween Tower of Terror event, commented on the importance of working together on the food truck issue and advised that she would be participating in the 19th Annual MANA de San Diego Gala event on October 17th Council Member Rios acknowledged Vice Mayor Natividad for the award he received from the SAMAHAN Clinic, reported on two Police Department events she participated in and said she appreciated the discussion that took place regarding the State of the City event. Mayor Morrison commented on the upcoming Tower of Terror event at the fire station and Day of the Dead at La Vista Cemetery, the Sweetwater High field dedication and victory and November 1st Homecoming. Mayor Morrison highlighted the planned State of the City address on October 17th and invited everyone to attend. CLOSED SESSION REPORT City Attorney Claudia Silva stated there was nothing to report from the Closed Session.
