National City, California, August 23, 1949
Adjourned meeting of August 16, 1949, of the City Council was
called to order by Mayor Gilbert E. Fritz at 7:30 P,M.,o'clook.
Counoilmen present: Curry, Matthews, Thatcher, Fritz. Coun-
cilmen absent: Adams.
ADMINISTRATIVE OFFICIALS present: Alston. Dickson, McClure.
RESOLUTION NO, 5039 was read, authorizing the payment of Five
Hundred Dollars ($500.00) to the Chamber of Commerce to be
used for.the Sports Jubilee. Moved by Thatcher, seconded by
Matthews, that the Resolution be adopted. Carried, all Coun-
cilmen present voting aye.
COMMUNICATION FROM CITY ENGINEER McCLURE was read, stating
that the State Highway has required that the 10 inch sewer
line across the site of the proposed Freeway at 23rd and Bay
Blvd. be incased in concrete. The contractors price is $600:00;,
Engineer McClure stated that he discussed this matter with Mr.
R. L. Beuthel of the State Highway Department, contending that
the incasement was unnecessary and that if the State Highway
required it, they should pay for the extra work. Mr, Beuthel
made no commitment but did agree that he would attempt to ob-
tain reimbursement for the city, Mr. McClure requested that
he be authorized to forward a copy of the contractors letter
quoting the contract price, together with a request for reim-
bursement. Moved by Matthews. seconded by Carr', that City
Engineer McClure's request be granted. Carried, all Council-
men present voting aye.
RESOLUTION NO. 5040 was read, accepting the contractors price

of $600,00 for the incasing in concrete of the 10 inch sewer
line across the site of the proposed Freeway at 23rd and Bay
Blvd., as recommended by CITY ENGINEER MoCLURE, Moved by
Matthews, seconded by Thatcher, that the Resolution be adopted.
Carried, all Councilmen present voting aye,
COMMUNICATION FROM CITY ENGINEER MoCLURE was read, which stated
that the National City Sewer Committee recommends that the
City Council consider the adoption of the following policy on
sewer extensions in new subdivisions: (1) That the City de-
sign and construct either by its own forces, or by contract,
all sewer lines required in new subdivisions, (2) That the
City Engineer shall estimate the costs of these installations
and that the subdivider shall deposit with the City Treasurer
an amount equal to the engineer's estimate of cost, or $170.00
per lot whichever Se the larger, (3) That regardless of
leaser costs the minimum amount to be paid by the subdivider
shall be $170.00 per lot. (4) That if the cost of construction
of the sewers exceeds $170.00 per lot, the full amount of cost
shall be borne by the subdivider. (5) When a sewer installs*
tion borders a new subdivision the subdivider shall pay not
less than 1;170.00 per lot, and shall pay one-half the excess
cost if the amount exceeds $170.00 per lot. (6) The cash
deposit for the construction of the sewer lines will be paid
prior to the final adoption of the subdivider's map by the
City Council, f7) In the event that the cost of the sewer
exceeds $170.00 per lot, but is less than the engineers esti-
mate, the subdivider shall be refunded the difference between
the actual cost of the sewer and the amount deposited. (8)
In the event that the cost of the sewer exceeds the engineers
estimate, the subdivider shall pay the excess over the estimate

before any connections shall be permitted, Moved by Thatcher,
seconded by Matthews, that the Council adopt the above policy
until the dew subdivision ordinance is drawn up. Carried,
all Councilmen present voting aye.
MAYOR FRITZ bought up the question of property owners split-
ting their property and questioned whether or not a piece of
property split more than twice in one year should be subdivided.
CITY ENGINEER McCLURE stated that the City of San Diego issues
a zone variance before a building permit is given in order
that it will not interfere with any future streets. MR. Me
CLURE stated he will make a further study of San Diego's
policy in this regard and submit his findings to the Council.
COMMUNICATION FROM SAN DIEGO METROPOLITAN MASS CHEST X'-RAY
SURVEY was read. &letter of invitation for participation
was sent on July 18, 1949, asking that a representative be
elected to the Board of Directors of this organization, They
ask that the Budget Committee be granted an opnortunity to
appear before the City Council for the purpose of informing
the Council of the details of the program and asking support
and assistance in this project. MAYOR FRITZ requested that a
letter be stint ingiting them to appear before the Council on
September 6, 1949. at 7:30 P.M.
APPLICATION FOR ALCOHOLIC BEVERAGE LICENSE for off sale beer
and wine by Piggly Wiggly of San Diego, Inc., 130 E. 8th Street.
was read. Application was approved by Chief of Police Bates.
Mayor Fritz ordered the application filed.
NOTICE OF AP'LICATION OF THE SAN DIEGO GAS & ELECTRIC COMPANY
to the Public Utilities Commission to increase the rates was

read.' A hearing by the Publio Utilities Commission has been
set for Wednesday, September 14, 1949, at 10:00 A.M. in the
Council Chamber in San Diego. Mayor Fritz requested that
this matter be laid over until the next meeting, September 6,
1949,
RESOLUTION NO. 5041 was read, authorizing the payment of
.21,980.20sto the Metropolitan Water District of Southern
California, which represents fifty percent of the taxes levied
by the Water District. Moved by Thatcher, seconded by Matthews,
that the Resolution be adopted. Carried, all Councilmen pres-
ent voting aye.
CITY CLERK ALSTON presented an ordinance which regulates the
use of a sewer system in the City of National City, for the
first reading, The Ordinance was read in full. Moved by
Matthews, seconded by Thatcher, that the ordinance be laid
over until the next meeting for the second and final readings
Carried,.by the following vote to -wit: Ayes: Curry, Matthews,
Thatcher, Fritz. Nays: None.
ORDINANCE NO. 765, allowing the property owner to install soil
pipe upon his own property was presented for the second and
final reading. The Ordinance was read in full. Moved by
Matthews, seconded by Curry, that the Ordinance be adopted.
Carried, all Councilmen present voting aye.
RESOLUTION NO, 042 was read, setting the following tax rate
for the fiscal year 1949-1950:

Moved by Thatcher, seconded by Curry, that the Resolution be
adopted♦ Carried, all Councilmen present voting aye,.
ADMINISTRATIVE OFFICER DICKSON requested authorization to
purchase a compressor in the amount of $367.97 and a paint
pot in the amount of S124.61 for the street painting machine,
Moved by Thatcher, seconded by Curry. that Administrative
Officer Dickson be authorized to make these.purcha.ses,. Carried.
by the following vote to -wit; Ayes: Curry, Matthews, Thatcher,
Fritz. Nays: None,
CITX ENGINEER McCLt?RE stated that the Pacific Telephone and
Telegraph Company wish to run an underground conduit across
the Freeway and they would like permission to trim about four
trees in order to get their aerial cable installed,, Moved
by Thatcher, seconded by Matthewe, that their request be
granted. Carried, all Councilmen present voting aye.
ADMINISTRATIVE OFFICER DICKSON stated that the only two Utility
campmates who do not pay the City any franchise tax are the
Water Company aad the Telephone Company, and he would like
the Council to instruct the City Attorney to check into this
matter and ascertain if there is not some way the City could
collect a franchise tax from the these companies-. Moved
by Thatcher, seconded by Matthews, that the City Attorney be
instructed to investigate the poseiblities of such a tax.

MAYOR FRITZ stated that it has been the ouetom to Close the
City Hall on the morning of the Sports Jubilee, and asked
what the, desire of the Council was in this regard. Moved by
Matthews, seconded by Curry, that,the City Hall be closed
Saturday morning, August 27, 1949, for the Sports Jubilee.'
Carried, all Councilmen present voting aye.
COUNCILMAN CURRY asked if the City had a Smog Ordinanoe.
ADMINISTRATIVE OFFICER DICKSON said there was none, and stated
that a great deal of the smoke came from the Navy'e Fire -
School
fighting/at the foot of 7th Street. COUNCILMAN CURRY said
there is a lot of smoke in the neighborhood of National Avenue
and 22nd,Street and also in other parts of the City. Moved
by Curry, seconded by Matthews, that ATTORNEY CAMPBELL be
authorized to draw up an ordinance regulating smog. Carried,
all Councilmen present voting aye.
COUNCILMAN CURRY asked if the City should not consider some
development on the water front. He paid there are a number
of people who own small boats that would like to come in to
National City, provided there is some sort of pier. Moved
by Curry, seconded by Matthews, that CITY ENGINEER MoCLURE
and ADMINISTRATIVE OFFICER DICKSON be authorized to make a
survey and a map of the land the City haeavailable, how
practical it would be to dredge; the coat of a wooden pier
and how much patronage would be derived from this type of a
project; also make,a study of Paradise Creek for such possi-
bilities. Carried, all Counoilmen present voting aye.
Moved by Thatcher, seconded by Matthews, that the meeting be
closed. Carried, all Councilmen present voting aye.
