Councilmen present: Adams, Curry, Matthews, Thatcher, Fritz. Councilmen absent: none Moved by Curry, seconded by Matthews, that the reading of the minutes of the regular meeting of February 1, 1949, be dispensed with. Carried, all Councilmen present voting aye. ADMINISTRATIVE OFFICIALS present: Campbell, Vansant, McClure, Dickson, Bates, Gautereaux. BILLS AUDITED by the Finance Committee presented: General Fund - $3,578.99 Street Fund 718,22 Park M & I Fund 119.21 Light. Dist. #1 32.65 Capital Outlay Fund 447.)+0 1946 Sewer Fund 94.95 Payroll 9.830.66 TOTAL $14,822.0tf Moved by Adams, seconded by Thatcher, that the bills be allowed and warrants ordered drawn for same. Carried, by the following vote towit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz, Nays: none. RESOLUTION NO. 4906 was read, authorizing $447,40 paid from the Capital Outlay Fund as follows: National Lumber Co., $297.07; Mission Pipe & Supply Co., $33.65; Frost Hardwood Lumber Co., $4.68; W. J. Briggs, $112.00; all for the Community Building. Moved by Adams, seconded by Matthews, that the Resolution be adopted. Carried, all Councilmen present voting aye. MAYOR FRITZ announced that it is necessary to fill the vacancy of the office of City Clerk. Administrative Officer Dickson read the following applications: Sumner Norman Stowe, Louis A. Thomas, Alfred E. Tarr, and Irene M. Alston. 190 RESOLUTION NO. 4907 was read, appointing Irene M. Alston, to the position of City Clerk, filling the unexpired term of office of the late Frank W. Rogers. Moved by Thatcher, seconded by Matthews, that the Resolution be adopted. Carried, all Councilmen present voting aye. MAYOR FRITZ turned the matter of the Oath of Office over to City Attorney Campbell. Mr. Campbell introduced County Clerk Tom Sexton who administered the Oath of Office of City Clerk to Irene M. Alston. BERNARD BANKE was present on behalf of Emil Anderson who previously had an application approved to move a building to Lots 21-22, Block 172. In the meantime the deal was not consummated and Lots 1-2, Block 148 were purchased, and Mr. Anderson would like to have a transfer of approval to these lots. Moved by Thatcher, seconded by Matthews, that the transfer of approval be made with the same conditions existing on the other application. Carried, all Councilmen present voting aye. SURETY BOND for City Clerk Irene M. Alston was presented by Delbert P. Guy, insurance broker. Attorney Campbell approved the bond as to form. Moved by Thatcher, seconded by Adams, that the bond be accepted. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: None. COMMUNICATION FROM THE CANCER PREVENTION SOCIETY was read, requesting permission to solicit funds in National City. Moved by Adams, seconded by Thatcher, that the request be granted. Carried, all Councilmen present voting aye. RESOLUTION NO. 1+908 was read, extending sympathy to Mrs. Frank W. Rogers, widow of the late City Clerk Rogers. Moved by Matthews, seconded by Thatcher, that the Resolution be adopted. Carried, all Councilmen present voting aye. 191 \COMMUNICATION FROM THE PLANNING COMMISSION was read, recommending that the Council classify television masts as towers and place them under the Uniform Building Code, Moved by Adams, seconded by Curry, that the matter be referred to Building Inspector Bird and City Attorney Campbell to prepare the proper change in the Build- ing code. N COMMUNICATION FROM Sw ETWATER UNION HIGH SCHOOL was read, request- ing use of the Memorial Bowl June 11+th for graduation, also for rehearsal June 13th, and use of the Community Building June 11+th for the students to change their caps and gowns. Moved by Curry, seconded by Matthews, that the request be granted. Carried, all Councilmen present voting aye, COMMUNICATION FROM PEARL E. REA, 161+5 Highland Avenue, was read, requesting permission to remove a tree from her parkway at 1639 Highland Avenue, Moved by Matthews, seconded by Curry, that the request be granted, provided the work is done at the owner's expense, and under the terms of the ordinance governing such matters. Carried, all Councilmen present voting aye. \CCDWNICATION FROM E. A. HUDSON was read, making application to rent on a month to month basis, approximately 37 x 300 feet of tidelands adjoining the Santa Fe Railway spur track near 19th St. Administrative Officer Dickson recommended the same rental basis that Mr. Hudson has in a lease adjoining the property. V RESOLUTION NO. 1+909 was read, authorizing Mayor Gilbert E. Fritz to enter into a contract with Edgar A. Hudson to lease approxi- mately 37 x300 feet of tidelands adjoining the Santa Fe Railway spur track near 19th St. and adjoining property on which he now holds a lease. Rental to be on a month to month basis at $0.02 per square foot. Moved by Thatcher, seconded by Curry, that the Resolution be adopted. Carried, all Councilmen present voting aye. 192 ✓APPLICATIONS for off sale beer and wire beverage license, were read as follows: Gilbert F. 3warez, 150 Coolidge Avenue; John R. Wilson, 137 W 8th Street. The applications were approved by Chief of Police Bates. Mayor Fritz ordered the applications filed. RESOLUTION NO. 4910 was read, accepting a grant deed from Herbert L. & Frances L. Blue, for street purposes only on the following described property: W. 30' of N} of WI of W# of EI, 80 Acre Lot 2, Quarter Section 130, as recommended by Administrative Officer Dickson, and to be recorded by the City Clerk. Moved by Curry, seconded by Matthews, that the Resolution be adopted. Carried, all Councilmen present voting aye. PETITION signed by eight residents was read, protesting the smoke created by the Hoffman Laundry. Mayor Fritz suggested that the protest be referred to the Chief of Police. COUNCILMAN CURRY stated that the condition could be controlled and there wouldn't be any smoke. Moved by Curry, seconded by Thatcher, that the matter be referred to Chief of Police Bates. Carried, all Council- men present voting aye. `APPLICATION to move a building to the EI of NI of WI, Ex. S. 120' of 20 Acre Lot 2, Quarter Section 134 by W. G. Kraft, was read. Moved by Adams. seconded by Curry, that the application be approved subject to the requirements of the Uniform Building Code and Building Inspector James A. Bird, and the building to be completed within six months from this date. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews: Thatcher, Frit;. Nays: none. COMMUNICATION FROM E. F. CORCARAN, Acting Secretary of the Sciots, was read, requesting permission to have a parade in National City March 26th at 1:00 P4M. Moved by Matthews, seconded by Thatcher, that the request be granted provided they work under the supervision = 7; of St. Supt. Finnerty and Chief of Police Bates. Carried, all Councilmen present voting aye. ✓COMMUNICATION FROM THE FIRST ORTHODOX PRESBYTERIAN CHURCH was read, requesting permission to place a street sign at 24th Street and Highland and National Avenues, Administrative Officer Dickson stated that a sign could not be placed at 24th Street and National Avenue as National Avenue is a State Highway. Mayor Fritz suggested that they be questioned how long they will hold the services in the Olivewood Club House, Moved by Matthews, seconded by Adams, that the request be referred to St. Supt. Finnerty with power to act. Carried, all Councilmen present voting aye. COMMUNICATION FROM THE SAN DIEGO GAS & ELECTRIC CO. was read, which enclosed a check in the amount of $7,475.74 and statement cover- ing the Franchise Tax for the year 1948. Moved by Adams, seconded by Matthews, that the check be accepted. Carried by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: none. ADMINISTRATIVE OFFICER DICKSON stated that a number of communica- tions came in Saturday which was a holiday and they did not appear on the agenda but felt they should be given consideration at the meeting, to which the Council agreed, APPLICATION FROM HAROLD F. GORHAM was read, requesting a refund of $5.00 on his business license, which has been approved by License Collector Bates, Moved by Curry: seconded by Matthews, that the refund be approved. Carried by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher. Fritz. Nays- None, J APPLICATION FROM JOHN P. MENDEZ, owner of E1 Burralito Calif, 1805 McKinley Avenue, was read, requesting a refund of $3.00 on a bus- iness license for a peanut vending machine which had been removed by the owner of the machine because the license was too high. 194 A recommendation was not made by License Collector Bates. Attorney Campbell ruled that the vending machine was not the property of the owner of the Cafe, therefore a refund could not be made to him. Mayor Fritz ordered the communication filed. COMMUNICATION FROM A. A. BRAUDWAY was read, requesting the refund of $300.00 which he deposited with City Treasurer Vansant on December 7, 1948, at the request of the Bank of America, to insure a sewer connection at 230 Laurel Avenue. Now that the sewer line has been completed in that area, the Bank has informed Mr. Braudway that he may request the refund of the deposit. The refund was recommended by City Treasurer Vansant. Moved by Matthews, seconded by Adams, that City Treasurer Vansant make the refund. Carried, by the following vote to -wit: Ayes; Adams, Curry, Matthews, Thatcher Fritz. Nays: none. PRELIMINARY REPORT FROM CITY ENGINEER McCLURE was read, relative to the widening of Highland Avenue, which covers the widening of the pavement to a width of 65 feet, moving the curb from its pres- ent location to the edge of the existing sidewalk, removing trees from the existing parkway, moving meters to e new location, drain- age improvements. and en armor coat on the existing pavement from 8th Street to 33th S;.'eet, at an estLmated cost of $162,360.00. Councilman Matthews questioned whether it would be possible to in- stall the sewer laterals on Highland Lvenue before the armor coat is laid, Administrative Office- Dickson reported that it is necessary to submit a "fudge* to the Division of State Highways and they in turn must have approval from Cacramento before Gas Tax monies can he used. CGITNCILMAN ADAMS inquired why the City would have 'o ?ay for the moving of water meters„ Attorney Campbell stacec_ that the Water Company has a corstitutional franchise. Engineer McClure made an oral report on the streets that Gas Tax 195 1 money can be used for their maintenance. Administrative Officer Dickson reported that a signal at 18th St. & National Avenue has been delayed by the State until a budget has been submitted, and suggested that Engineer McClure be authorized to prepare such a budget. Mr. Dickson further stated that 60% of Gas Tax allotments can only be used for construction of Streets of major importance and 40% for the construction and maintenance of all streets. Mayer Fritz suggested that Charles J. Dorfman, Contractor, com- plete the Highland Avenue sewer first, in order that all the pro- perty owners along Highland Ave. can connect to the sewer before the widening program is started. Moved by Adams, seconded by Matthews, that St. Supt. Finnerty and Engineer McClure draw plans for the Highland Avenue program. Carried, all Councilmen present voting aye. COMMUNICATION FROM ENGINEER MCCLURE was read, recommending that $4,291.14 be paid to Walter H. Barber, Contractor, for the trunk line sewer contract, and that a balance of $200.00 be withheld until the work is completed on the pumping plants. Administrative Officer Dickson reported that Mr. Barber had been delayed on account of equipment the City was unable to obtain, and confirmed the Engineer's recommendation. Moved by Thatcher, seconded by Matthews, that $4,291.14 be paid on the trunk line sewer contract to Walter H. Barber. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: None. COMMUNICATION FROM L. E. C. SMITH was read, stating that he is constructing an ice cream store at 8th Street and "D" Avenue, and he proposes to replace the old curb and walk with a new one, giving normal curb height at the corner, also he would like to change the radius of the return to 14 feet. COMMUNICATION FROM ENGINEER McClure was read, recommending the approval of Mr. Smith's request. Moved by Adams, seconded by Matthews, that the request be approved 196 according to plans and specifications. Carried, all Councilmen present voting aye. PETITION signed by a large number of residents was presented, requesting that the 18th Street and McKinley Avenue bus route be returned to its original route. Moved by Adams, seconded by Curry, that the petition be transferred to the San Diego Transit Co. Carried, all Councilmen present voting aye. COMMUNICATION FROM SAN DIEGO LIQUID GAS & APPLIANCE CO. was read, stating that they would National City, which is iness license ordinance per year for a license. Councilman Adams suggested that truck license be obtained for $25.00, and suggested that trailer court managers confer with City Attorney Campbell on the matter. ADMINISTRATIVE OFFICER DICKSON reported on the acquisition of easements for sewer laterals. Attorney Campbell reported that he has prepared agreements for the people to sign. Leroy Harkey reported there are three possible condemnations. Moved by Adams seconded by Matthews, that Mayor Fritz be authorized to sign the agreements. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: none. ADMINISTRATIVE OFFICER DICKSON suggested authorization for the Mayor to sign agreements with property owners to replace pro- perty that has been damaged or destroyed by the sewer line. Moved by Thatcher, seconded by Adams, that Mayor Fritz be authorized to sign agreements to replace property damaged by the sewer line. 197 Carried, by the following vote to -wit: Ayes; Adams, Curry, Matthews, Thatcher, Firtz. Nays: none. ADMINISTRATIVE OFFICER DICKSON reported on a meeting of Department Heads:to discuss problems arising from the sewer project and it was suggested that an advisory board be established by the City Council for future subdivisions. Mr. Dickson suggested that a Committee of five members be appointed, consisting of two Council- men, Building Inspector! St. Supt., and Engineer, be appointed and they will make recommendations to the City Council. Council- man Matthews thought the Planning Commission should make the recommendations. Councilman Cur_y concurred with Administrative Officer Dickson's recommendation, Moved by Curry, seconded by Adams, that the Committee be appointed. Carried, all Councilmen present voting aye. ADMINISTRATIVE OFFICER DICKSON reported that Joanne Esser, tempor- ary clerk, was living with the Rogers family at the time of the death of City Clerk Frank W. Rogers, and she was absent from work for two days, She would have been entitled to sick leave with pay, if she were under Civil Service. Moved by Adams,, seconded by Matthews, that Mrs. Esser be allowed pay for the two days absent, and that the unclassified employees be allowed the same sick leave privileges as those under Civil Service. Carried, by • the following vote to -wit: Ayes: Adams, Curry, Matthews, Thathher Fritz, Nays: none. ATTORNEY CAMPBELL reported that a quiet title suit had been filed against Lot 16, Block 147, City Plat, and he would like a recom- mendation on the sale of the property„ Moved by Matthews, seconded by CIrry, that the City Clerk report the value of the lot and the taxes and bonds against it. Carried, all Councilmen present vot- ing aye. 198 ATTORNEY CANPBELL reported that he had been informed by the Chief of Police that there were a number of applications for business licenses to operate "Bridgo" in National City and he inquired as to the policy of the City Council. Moved by Adams, seconded by Matthews, that all applications for bridgo be denied on the grounds that it is illegal. Carried, all Councilmen present voting aye. EDGAR HERVEY was present and stated that he has a business license, which he presented. License Collector Bates was present and examined the said "license" and stated that it was a receipt for money paid on an application for a license. Mr. Hervey contended that the receipt was a license and that he would open his rester rant and operate the "bridgo" game. Moved by Adams, seconded by Matthews, that refunds be made to all applicants who have deposited money an an application for a business license to operate a bridgo game. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: none. MAYOR FRITZ bought up the question of sewer charges. Councilman Matthews suggested $150.00. Engineer McClure estimated that it would take 4+,952 connections to make up the estimated cost over a possible 15 y apx period. Councilman Thatcher didn't feel that $170.00 was too high, as a cesspool and septic tank would cost at least that much. Mayor Fritz thought that it was a fair figure. BARNARD BANKS was present and inquired whether amortization had been considered and Mayor Fritz stated that it had. Moved by Thatcher, seconded by Adams, that the connection charge be $170.00 and Attorney Campbell prepare the ordinance. Carried, all Council- men present voting aye. MAYOR Z' ITZ questioned whether all sewer connections would be $170,00 or leave the old ones at $300.00. Administrative Officer Dickson suggested that the difference should be refunded, Moved 199 by Matthews, seconded by Adams, that all sewer connection fees be $170.00, and any deposits be refunded. Carried, by the following tote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz, Nays: none: MAYOR FRITZ SUGGESTED that City Clerk Irene M. Alston be appointed Assistant Purchasing Agent at a salary of $100.00 per month, in order that a reduction in salary would not result in her advance- ment to City Clerk. RESOLUTION NO. 1+911 was read, appointing Irene M. Alston Assistant Purchasing Agent, salary $100,00 per month, effective February 15, 1949. Moved by Matthews, seconded by Thatcher, that the Resolution be adopted. Carried, all Councilmen present voting aye. COUNCILMAN ADAMS reported that the City Attorney ruled it was illegal to send flowers to the injured Fireman, and suggested that some type of scroll be given to Fireman Robert 0. Bates and Engineer Leland D. Bacon, who was instrumental in saving Fireman Bates' life, and received burns by so doing Administrative Officer Dickson suggested some form of citation, Moved by Adams, seconded by Thatcher= that citations be given of Fireman Robert 0, Bates and Ergineer Leland D. Ba'cr_. Carried, all Councilmen present voting aye. COUNCILMAN CURLY inquired about the ordinances being brought up to data: and the codifying• of same. Administrative Officer Dickson reported that the codifying had been completed and the Ordinances are ready for the printer for additional copies. CITY CLERK IRENE M. ALSTON expressed her appreciation for her appointment to City Clerk and stated that she would do her utmost to keen the faith and trust committed to her charge, 200 CITY CLERK IRENE M. ALSTON STATFiD tnere is still a vacancy of a Deputy Clerk in her office and re;iested permission to appoint a clerk from the eligibility list certified by the Civil Service Commission from the examination that will be held February 19th. RESOLUTION NO. 4912 was ready authorizing the City Clerk to appoint a probationary Deputy Clark, s:arti_•ig salary to be $168.00 per month. Said Deputy Clerk to be certified by the Civil Service Commission. Moved by Matthews, seconded by Thatcher, that the Resolution be adopted„ Carried, all Councilmen present voting aye.
