Councilmen present: Cordingly,-Newberry, Thatcher, Fritz. Councilmen absent: Adams. Moved by Newberry, seconded by Cordingly, that the reading of the minutes of the regular meeting of December 16, 1947, be dis- pensed with. Carried, all Councilmen present voting aye. ADMINISTRATIVE OFFICIALS present: Campbell, Dickson, Smith, Gaut- ereaux. BILLS AUDITED by the Finance Committee presented: General Fund Street Imp. First Street, was present in regard to the petition presented by residents on First Street near the area of the 1100 Block, concerning a horse that is stabled in the block and the stable is not kept in a sanitary condition. Moved by Newberry, seconded by Cordingly, that a letter be writ- ten to the Health Department, requesting them to make an inves- tigation and report to the Council in writing. Carried, all Councilmen present voting aye. 136 REPORT FROM ENGINEER IRELAND stating there is 37.13 acres in the W} of 80 Acre Lot 1, * Section 130, which the City has purchased for a proposed golf course, was read and ordered filed. REPORT FROM THE COUNTY HEALTH DEPARTMENT recommending the cons- truction of a sewer system as a health measure, was read and ordered filed. RESOLUTION NO. 4560 was read, accepting the report of the County Health Department which recommended the construction of a sewer system as a health measure in the following locations: between 23rd and 25th Streets from Harrison to Wilson Avenues, contain- ing meat packing plants; between Wilson and National Avenue from 16th to 30th Streets; between National and Highland Avenues from loth to 30th Streets; between Highland and Palm Avenues from North City limits to 30th Street; between Palm Avenue and East City limits from North City limits to 24th Street. Moved by Thatcher, seconded by Newberry, that the Resolution be adopted. Carried, all Councilmen present voting aye. COMMUNICATION FROM THE ELEVENTH NAVAL DISTRICT was read, notify- ing the City that it is authorized to take possession of the 16.3 acres of land on December 31, 1947. Moved by Newberry, seconded by Thatcher, that the City ratify the Attorney's action. Carried, all Councilmen present voting aye. COMMUNICATION FROM 'Tkh EMPLOYEES' ASSOCIATION in regard to a special meeting to be held Friday, January 9th at 1:30 P. M. in the City Hall, on the Retirement and Pension System, was read and ordered filed. REPORT FROM HARRY E. BONNELL, City Auditor, for the fiscal year 137 1946-1947, was presented. Attorney Campbell requested a copy and suggested that the report not be accepted until other copies are received and studied by himself and the Council. APPLICATION for a card room license at 18 West 8th Street, by Carl William Pollock, was presented. Mayor Fritz referred the application to Chief of Police Bates. COMMUNICATION FROM T. G. FORBES, JR. was read, requesting per- mission to remove 4 trees in the parkway at 7th Street and Nat- ional Avenue, described as the E 751 of Lots 20-21-22, Block 8, City Plat. Moved by Newberry, seconded•by Thatcher, that the request be granted, provided the work is done at the expense of the property owner. Carried, all Councilmen present voting aye. COMMUNICATION FROM THE DOMESTIC EMPLOYMENT SERVICE AGENCY, by Gladys Z. Howard, was read, requesting the refund of $10.00 on her business license which she purchased December 31, 1947. Chief of Police Bates approved the request. Attorney Campbell suggested that the request be laid over for investigation. May- or Fritz referred the matter to Attorney Campbell. RESOLUTION NO. 4561 was read, authorizing the payment of $43,277.98 from the 1946 Sewer Fund to Walter H. Barber for partial pay- ment on the sewer contract. Moved by Newberry, seconded by Cord- ingly, that the Resolution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO. 4562 was read, adopting the following wage scale for the proposed sidewalks and curbs on National Avenue from 18th Street to 30th Street: 138 Labor Classification Laborers Operators pneumatic Cement dumper 1 yd. The minimums wage paid to all skilled labor for which rates are not shown above, shall be not less than $1.35 per hour. The minimum wage paid to all intermediate labor, for which rates are not shown above, shall be not less than $1.00 per hour. The minimum wage paid to all unskilled labor for which rates are not shown above, shall be not less than $1.00 per hour. The hourly wage rate prescribed hereinabove is for an eight hour day, forty hour week. It shall be mandatory upon the contractor to whom the contract is awarded, and upon any subcontractor under him, to pay not less than the said specified rates to all laborers, workmen and mechanics employed by them in the execution of the contract. Effective October 1, 1947, employees shall'be entitled to one working day of sick leave with pay for each calendar month of service. Employees entering on duty or terminating their services during a calendar month shall be credited with a full month if they have worked 16 days or more during that month. After 12 calendar months of service and at the beginning of each 139 12 month period thereafter, each employee will be credited with 12 working days of sick leave which may be used at any time dur- ing the ensuing 12 months. If any employee does not take the full amount of sick leave allowed in any 12 months period, the amount not taken may be accumulated to a total of not more than 30 working days. Sick leave which has been accumulated by emp- loyees prior to October 1, 194? shall be retained but in no case shall any sick leave accumulation exceed the 30 working days max• imum at any time. 2. Sick leave is hereby defined to mean the absence from duty of any employee because of illness, exposure to contagious disease, attendance upon a member of his or her immediate family seriously ill and requiring the care of such employee, or death in the immediate family. 3. Immediate family is defined to mean husband, wife, grand- mother, grandfather, mother, father, sister, brother, son, daug- hter, or providing he or she lives in same household, mother-in- law, father-in-law, sister-in-law, brother-in-law, daughter-in- law, or son-in-law. 4. Computation of sick leave shall not include regular days off or holidays provided these are not in conflict with the es- tablished work schedule within each department. 5. No person shall be entitled to sick leave with pay while absent from duty on account of any of the following causes: (a) Disability arising from any sickness or injury purposely self inflicted or caused by any wIXTh1 misconduct; (b) Sickness or disability sustained while on leave of absence, other than his or her regular vacation. 11+0 6. If absence from duty by reason of sickness extends be- yond a period of 3 working days, the salary or wages as provid- ed above shall be paid only upon filing with the Civil Service Clerk, and a copy thereof with the head of the employee's de- partment, a certificate of disability by a regular licensed and practising physician whose certificate will be honored by the County Health Officer. 7. Absence for a part of a day that is chargeable to sick leave in accordance with these provisions shall be charged pro- portionately in an amount not smaller than one-half of a day. 8. An employee who is laid off from his position for re- asons that are not discreditable to him, may, if reappointed with- in 12 months, have available for his necessary use any unused sick leave existing at the time of his lay-off. 9. Sick leave rules apply to employees who are off work because of accidents or sickness not incurred in line of duty. But, employees who are absent from work because of injuries in- curred in line of duty are not classified as being on sick leave. An employee absent from work for reasons that will entitle the employee to compensation under State Compensation Law shall re- ceive for the duration of such compensation, not to exceed 90 days, only that portion of his regular salary that will together with compensation equal his salary, At the discretion of the City Council the 90 day period may be extended. 10. Reports of absences of employees must be made to the Clerk of the Civil Service Commission at the same time the de- partment head files his payroll report with the City Clerk twice each month. The department head who fails to report the absence 141 of an employee from duty and thus enables the employee to receive pay in excess of the amount to which he is legally entitled shall be held liable to the City for the amount illegally paid. Moved by Newberry, seconded by Thatcher, that the Resolution be adopted. Carried, all Councilmen present voting aye. MAYOR FRITZ announced that it was 8:00 P. Administrative Off- icer Dickson stated that he had been unable to obtain that in- formation. Moved by Newberry, seconded by Cordingly, that the bid of the MacMillan Distributing Corp. be accepted, and that Mayor Fritz be authorized to sign the contract. Carried, by the following vote to -wit: Ayes: Cordingly, Newberry, Thatcher, Fritz. Nays: None. MAYOR FRITZ announced that the hearing of protests on the clos- ing of Streets and Alleys in Blocks 1-2-3-4 of 10 Acre Lot 7; and Blocks 2-3 of 10 Acre Lot 8; all in * Section 154, would be heard at this time. There were no protests. RESOLUTION NO. 4564 was read, to vacate and close public streets and alleys in the City of National City. Moved by Newberry, seconded by Cordingly, that the Resolution be adopted. Carried, all Councilmen present voting aye. 142 COMMUNICATION FROM CITY ENGINEER IRELAND was read, requesting that a $10.00 car allowance be given Wayne Smith for the month of December and a $5.00 car allowance to C. B. Ireland for the month of December. Moved by Cordingly, seconded by Newberry, that the request be granted. Carried, by the following vote to - wit: Ayes: Cordingly, Newberry, Thatcher, Fritz. Nays: None. COMMUNICATION FROM PARK SUPT. GAUTEREAUX was read, suggesting that a new classification under Civil Service be set up in the Park Department known as Park Recreation Director. This rec- ommendation was made due to the fact that two examinations have been held for Ass't Park Supt. and no one qualified that had sufficient experience. RESOLUTION NO. 4565 was read, setting up a new classification under Civil Service in the Park Department known as Park Rec- reation Director. Salary scale to be: $225.00$235.00-$250.00. Moved by Newberry, seconded by Thatcher, that the Resolution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO. 4566 was read, authorizing the promotion of Wes- ley Malcolm to second class fireman, effective December 29, 1947, salary $227.50 per month, as recommended by Fire Chief Bird. Moved by Cordingly, seconded by Newberry, that the Resolution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO. 4567 was read, authorizing the appointment of Gorey M. Burnette, as Jr. Park Gardener, effective January 6, 1948, salary $180.00. Moved by Cordingly, seconded by Newberry, that the Resolution be adopted. Carried, all Councilmen present voting aye. 11+3 ORDINANCE NO. an ordinance amending Ordinance No. 732 was presented for the second and final reading. Moved by Thatcher, seconded by Newberry, that only the heading be read, Carried, by the following vote to -wit: Ayes: Cordingly, Newberry, Theta.- cher, Fritz. Nays: None. ORDINANCE NO. 745 was read, AN ORDINANCE AMENDING ORDINANCE NO. 732 OF THE ORDINANCES OF THE CITY OF NATIONAL CITY BY ADDING THERETO SECTION 5*. Moved by Newberry, seconded by Cordingly, that the Ordinance be adopted. Carried, all Councilmen present voting aye. REPORT FROM ASS'T ENGINEER SMITH, giving the estimated costs for the completion of the trunk sewer system, was read and or- dered filed. RESOLUTION NO. 4568 was read, authorizing a transfer of $100,000.00 from the Capital Outlay Fund to the 1946 Sewer Fund, which con- stitutes a loan and must be repaid when the Sewer Fund is re- plenished. Moved by Thatcher, seconded by Newberry, that the Resolution be adopted. Carried, all Councilmen present voting aye. MAYOR FRITZ suggested that the City sell another block of sewer bonds in the approximate amount of $200,000.00, and requested Attorney Campbell to follow through. APPLICATION TO PURCHASE TAX DEEDED PROPERTY at public auction on the following described property, was read: Lots 1-10, 17-22, Block 38; Lots 3-10. Block 23; Lots 1-10, Block 43; Lots 1-10, 13-225 Block 44; Lots 1-10, 13-22, Block 45; Lots 3-4-5, Block 145; all in City Plat; Lot 76, Block 5, Paradena Park. Said opening bid was $1,678.27. Moved by Newberry, sec- onded by Cordingly, that the bid be rejected. Carried, all 144 Councilmen present voting aye. ADMINISTRATIVE OFFICER DICKSON reported that the Federal Gov- ernment will be satisfied with an insurance of $13,000-00 on the Community Building, and requested authorization to purchase this policy and have the beneficiary of the existing policy changed to the City only. Moved by Thatcher, seconded by Cord- ingly, that Mr. Dickson be authorized to follow through on his request. Carried, by the following vote to -wit: Ayes: Cord - Newberry, Thatcher, Frita. ADMINISTRATIVE OFFICER DICKSON reported that sometime ago Berge - Roberts made application for the extension of their awning over the sidewalk, and that the Ordinance had been amended to enable the Council to grant certain concessions such as this. RESOLUTION NO. 4569 was read, granting Berge -Roberts authori- zation to extend their awnings over the sidewalks. Said work to be done under the supervision of Building Inspector Bird. Moved by Newberry, seconded by Cordingly, that the Resolution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO. 4570 was read, rescinding Resolution No. 4559, and providing for an election to be held January 20, 1948, be- tween the hours of 8:00 A. M. and 4:30 P. M., whereby the City Employees shall elect as to whether or not they shall be in- cluded in the California State Employees Retirement System. Moved by Newberry, seconded by Cordingly, that the Resolution be adopted. Carried, all Councilmen present voting aye. ADMINISTRATIVE OFFICER DICKSON reported that Mayor Koester of Chula Vista has invited the Council, Attorney and himself to 145 luncheon at Grihalvas January 8th at 12:00 noon, to discuss the water rates. Mayor Fritz stated that he was sorry that one Councilman was not present to hear what he was to say. When the last water meeting was called in National City, that one other Councilman and himself were the only members of the local Council present, and that it was one of the most important meetings the City has ever had. Mayor Fritz further stated that he hoped there would be a better attendance at the Thursday meeting, as the Cities are trying to negotiate a water contract, and it is very important. ADMINISTRATIVE OFFICER DICKSON reported that at the last meeting of the Council, the salary of the City Treasurer was reduced. RESOLUTION NO. 4571 was read, rescinding Resolutions 4553 and 4554. Moved by Newberry, seconded by Thatcher, that the Resolu- tion be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO. 45 was read, setting the salary of the Chief Clerk of the Street Department as $75.00 per month; and the salary of the Ass't Purchasing Agent as $50.00 per month, ret- roactive to December 16, 1947. Moved by Thatcher, seconded by Newberry, that the Resolution be adopted. Carried, all Council. men present voting aye. ADMINISTRATIVE OFFICER DICKSON reported that he has received notice that a petition is before the County Planning Commission to change the zone across Division Street from City property to a warehouse zone. Said hearing to be held January 9, 1948, at the Civic Center. RESOLUTION NO. 4573 was.read, protesting to the County Planning v+6 Commission for an► changes in zoning on property lying adjacent to Division Street. Moved by Newberry, seconded by Cordingly, that the Resolution be adopted. Carried, all Councilmen present voting aye. ATTORNEY CAMPBELL suggested that Administrative Officer Dickson attend the meeting of the County Planning Commission January 9th. ADMINISTRATIVE OFFICER DICKSON stated that he has a verbal re- quest from Charles Anderson for the City to reconsider a tax sale on Blocks 152-105-106, City Plat. It was the concensus of the Council not to sell any of the property that might be needed for fill purposes. CHAS. M. DAVIS was present and stated that if the City would sell the property, he could fill it from his scrap yard. Administrative Officer Dickson inquired what type of fill he intended to use, and Mr. Davis stated that it was heavy metal particles, small pieces of glass and dirt. Mayor Fritz stated that he didn't feel that the City should sell portions of property they are holding for fill purposes. Councilman Newberry stated that he thought the property should be held for City development and not for special sales. hi. Davis stated that if the City should consider the sale of Block 152, he would guarantee the immediate fill of the property. Administrative Officer Dickson stated that the City should be able to obtain assistance from the State and County on the de- velopment of that area. Councilman Thatcher suggested that the•City study the drainage set-up, and thought the request should be tabled. ATTORNEY CAMPBELL reported on the improvement bond held by Mary 147 Dawson on City Property, and stated that foreclosure wouldn't hurt the title as the bond is over four years old. RESOLUTION NO. 4574 was read, a resolution of intention for the construction of sidewalks and curbs on National Avenue from 18th to 30th Streets, and setting the time of hearing protests. Feb- ruary 3, 1948, at 8:00 P. M. Moved by Newberry, seconded by Thatcher, that the Resolution be adopted. Carried, all Council- men present voting aye. COUNCILMAN NEWBERRY stated that the crosswalks need re -painting, and suggested that the crosswalks near the schools be taken care of immediately. ATTORNEY CAMPBELL brought up the question of painting the curb in front of the Justice Court. ' Moved by Cordingly, seconded by Newberry, that the meeting be closed.
