Regular meeting of the City Council was called to order by Mayor
Gilbert E. Fritz at 7:30 P. M. o'clock. Councilmen present:
Curry, Matthews, Thatcher, Fritz. Councilmen absent: Adams.
Moved by Thatcher, seconded by Curry, that the reading of the
minutes of the regular meeting of October 5, 1948, be dispensed
with. Carried, all Councilmen present voting aye.

Moved by Thatcher, seconded by Matthews, that the bills be allowed
and warrants ordered drawn for same. Carried, by the following
vote to -wit: Ayes: Curry, Matthews, Thatcher, Fritz. Nays:
None.
RESOLUTION NO. 4811 was read, authorizing the following payments
from the Capital Outlay Fund for the Community Building: Lemon
Grove Sheet Metal Works, $429.96; National Lumber Company, $85.41.
Moved by Matthews, seconded by Curry, that the Resolution be
adopted. Carried, all Councilmen present voting aye,
MR. S.Z. GREENBERG was present, stating that he was the owner of
Lots 1 to 7 and Lots 16 to 22 in Block 17 of National City, and

that he wished to petition the Council to close the alley as
the alley serves no other purpose and could be used to better
advantage if the alley was closed. Moved by Curry, seconded by
Thatcher, that Mr. Greenberg's request be referred to the Plan-
ning Commission for recommendation. Carried, all Councilmen
present voting aye.
C. R. HANAN, 1533 E. 18th Street, was present and presented a
petition signed by property owners, requesting the Council to
remove, or to have removed, an unsightly building located on the
NE corner of 18th Street and Palm Avenue. Moved by Matthews,
seconded by Curry, that the matter be referred to Chief Bird to
check as a fire and health hazard. Carried, all Councilmen
present voting aye.
PETITION FROM RESIDENTS IN HILLS OF PARADISE requesting that a
zone variance granted to Mr. Diehl, 2121 E. llth Street, be
rescinded. Mr. Mark L. Cripe, Mr. Tom Leonard, and Abbie
Carrington were present and questioned the legality of the
Council granting a zone variance to Mr. Diehl. Moved by Matthews,
seconded by Thatcher, that the matter be referred to Attorney
Campbell to check on the Council's right to have granted the
zone variance, and to Chief Bird to check for a fire hazard.
Carried, all Councilmen present voting aye.
APPLICATION BY RAYMOND ACOSTA to move a building from 2224 Bay
Blvd. to the SE corner of lath & Wilson, was read. Moved by
Curry, seconded by Matthews, that the request be granted, pro-
vided the building conforms with the building code and is completed
within six months from this date. Carried, by the following
votes to -wit: Ayes: Curry, Matthews, Thatcher, Fritz. Nays:
None.

MAYOR FRITZ recommended that the bids be referred to the City
Engineer. Moved by Curry, seconded by Thatcher, that the bids
be referred to City Engineer Ireland. Carried, all Councilmen
present voting aye.
COMMUNICATION FROM NATIONAL CITY REALTY BOARD was read, requesting
a change in license fees. Moved by Matthews, seconded by Curry,
that the matter of license fees be given some thought until
after the first of the year, keeping in mind the improvements
possible. Carried, all Councilmen present voting aye.
COMMUNICATION FROM NATIONAL CITY TENNIS CLUB, was read, expressing
their appreciation for the use of court equipment and lighting
facilities. Mayor Fritz ordered the communication filed.
COMMUNICATION FROM CIVIL SERVICE COMMISSION, vas read, regarding
their recommendation on proposed ordinance to lower compulsory
retirement age to 65 years. It is the opinion of the Civil

Service Commission that the retirement ordinance should not be
changed or amended at this time. Mayor Fritz ordered the
communication filed.
COMMUNICATION FROM CIVIL SERVICE COMMISSION, was read, recommend-
ing addition of Street Painter to the National City Civil Service
Position Classification Plan. Moved by Matthews, seconded by
Thatcher, that the recommendation be accepted. Carried, all
Councilmen present voting aye.
COMMUNICATION FROM RECREATION DIRECTOR JAMES B. CASEY, was read,
requesting authority to conduct a concession booth in the Park
during the Halloween celebration on the evening of October 30th,
1948. The Central and Highland Parent Teacher's Associations
have agreed to purchase, prepare and dispense the food and
beverages, the profits going to the Recreation Department fund.
Moved by Curry, seconded by Matthews, that the request be granted
with the City assuming the cost of the merchandise, turning over
to the Recreation Department any profits received. Carried, all
Councilmen present voting aye.
RESOLUTION NO. 4812 was read, accepting a deed for street purposes
from the National School District; the Nly 301, the 3 301 and the
Wly 301 of the following described real property: The Ely Half
of Stay Quarter of Forty Acre Lot Two in Quarter Section One
Hundred Thirty-two of Rancho de la Nacion; signed by Ira F.
Harbison, President; and City Clerk Rogers to have same recorded.
Moved by Thatcher, seconded by Matthews, that the Resolution be
adopted. Carried, all Councilmen present voting aye.
RESOLUTION NO. 4813 was read, accepting the deed from the County
of San Diego for tax deeded property; described as the W 301 of

E} of W (Exc N 40') and (Exc $40') of 40 Acre Lot 2 in Quarter
Section 131 of Rancho de la Nacion; and instructing City Clerk
Rogers to have same recorded. Moved by Matthews, seconded by
Curry, that the Resolution be adopted. Carried, all Councilmen
present voting aye.
RESOLUTION NO. 4814 was read, accepting the deed from the County
of San Diego for tax deeded property; described as the N 3/4 of
W} of 80 Acre Lot 2 in Quarter Section 128 of the Rancho de la
Nacion; and instructing City Clerk Rogers to have same recorded.
Moved by Matthews, seconded by Curry, that the Resolution be
adopted. Carried, all Councilmen present voting aye.
COMMUNICATION FROM CITY TREASURER was read, requesting authority
to engage the services of a clerk at $150400 per month, from
November 1, 1948 to December 10, 1948, to assist in handling
the first installment of 1948 taxes. Moved by Thatcher,
by Matthews, that the request be granted.

COMMUNICATION FROM CITY ENGINEER IRELAND, was read, requesting
that the Council study his recommendations for the "proposed
Drainage Channel" from 18th Street to 24th Street. Moved by
Curry, seconded by Matthews, that the Engineer's recommendation
be accepted and the plan be numbered and filed. Carried, all
Councilmen present voting aye.
COMMUNICATION FROM STATE LANDS COMMISSION, was read, regarding
joint lease for South Bay Tidelands. Administrative Officer
Dickson stated that since this letter was written National City
and Chula Vista have signed their joint leases, and that if the
City of Coronado so desires they can become a member.

ADMINISTRATIVE OFFICER DICKSON stated that he would like author-
ization to advertise for bids to purchase a trailer which is
needed to carry two piecea of equipment, namely, a Trenching
Machine and a Roller. Moved by Curry, seconded by Matthews, that
ADMINISTRATIVE OFFICER DICKSON be authorized to advertise for
bids for the purchase of a trailer. Carried, all Councilmen
present voting aye.
ADMINISTRATIVE OFFICER DICKSON reported that negotiations have
been started to obtain 24th Street between Cleveland and Harrison
Avenues.
ADMINISTRATIVE OFFICER DICKSON stated that the Council had re-
quested him to make a report on sewer laterals installed by
private parties, but as yet this report is not completed, however
he expects to have the report completed by the next meeting.
ADMINISTRATIVE OFFICER DICKSON asked that this meeting be adjourned
until 7:00 P. M. next Tuesday, October 26, 1948.
CITY CLERK ROGERS stated he would like the Council to grant him
authority to keep the temporary clerk in his department until
the end of October, 1948. He stated that due to the heavy work
load he will be forced to keep the clerk until the end of the
month. Moved by Matthews, seconded by Curry, that the request
be granted. Carried, all Councilmen present voting aye.
RESOLUTION NO. 4815 was read, transferring the sum of $1500.00
from the General Fund to the Library Fund as a loan, to be re-
paid when tax money has accumulated in the Library fund sufficient
to cover same. Moved by Thatcher, seconded by Matthews, that the
Resolution be adopted. Carried, all Councilmen present voting
aye.

ADMINISTRATIVE OFFICER DICKSON asked that the Council grant per-
mission to set up a Miscellaneous Fund of $1,000, as there is
no particular fund for the expenditure of costs involved in
Street assessment work. Moved by Thatcher, seconded by Matthews,
that the request be granted and that $1,000.00 be transferred
from the unbudgeted reserve to this fund. Carried, all Council-
men present voting aye.
ATTORNEY CAMPBELL stated that the City Engineer is charged with
making up the National Avenue sidewalk and curb assessment
district roll, but that he felt sure the Engineer did not have
time to do so; he suggested that Mr. Murray Loop be contacted
for this purpose and further suggested that City Clerk Rogers
with consent of the City Engineer contact Mr. Loop and see if he
would make up this roll and what the charge would be. Moved by
Matthews, seconded by Curry, that City Clerk Rogers contact Mr.
Loop with the concurrence of the City Engineer and make a report
at the next Council meeting, Carried, all Councilmen present
voting aye.
ATTORNEY CAMPBELL presented a bill in the amount of $17.50 from
the Union Title Insurance and Trust Company for a title search
on the Oliver property. He asked if this bill has not already
been paid that Council grant permission to pay same. Moved by
Curry, seconded by Matthews, that the City Clerk theck to see
if the bill has been paid, if not to pay same. Carried, all
Councilmen present voting aye.
FILING OF FALSE CRIM REPORTS ORDINANCE NO. was presented
for the first reading. Moved by Matthews, seconded by Curry,
that only the heading be read. Carried, by the following vote
to -wit: Ayes: Curry, Matthews, Thatcher, Fritz. Nays: None.

ORDINANCE N0. , AN ORDINANCE OF THE CITY OF NATIONAL CITY,
CALIFORNIA, PROHIBITING FILING OF FALSE CRIME REPORTS WITH THE
POLICE DEPARTMENT OF THE CITY OF NATIONAL CITY, CALIFORNIA.
Moved by Matthews, seconded by Thatcher, that the Ordinance be
laid over until the next meeting for the second and final reading.
Carried, by the following vote to -wit: Ayes: Curry, Matthews,
Thatcher, Fritz. Nays: None.
ORDINANCE NO. AN ORDINANCE OF THE CITY OF NATIONAL CITY,
CALIFORNIA, PROHIBITING Thh, POSSESSION, USE, SAT. OR CONSUMPTION
OF ALCOHOLIC BEVERAGES IN THE CITY PARK IN NATIONAL CITY, was
presented for the first'-f€'ading. Moved by Curry, seconded by
Matthews, that the Ordinance be laid over until the next meeting
for the second and final reading. Carried, by the following
vote to -wit: Ayes: Curry, Matthews, Thatcher, Fritz. Nays:
None.
ATTORNEY CAMPBELL asked that the placing of shrubs 10 feet from
any curb be referred to Administrative Officer Dickson.
ATTORNEY CAMPBELL stated that he is going ahead with the quiet
title suit on the flat lands lying general between National Ave.
and Bay Blvd; 18th and 30th Streets, and unless instructed
otherwise he will continue with the suit. Mayor Fritz suggested
that the Council reiterate its position in this matter since the
Planning Commission unanimously went on record as urging the City
to carry on at once with the onset title action. COUNCILMAN
CURRY asked about how long it would take to quiet title and
ATTORNEY CAMPBELL said it would be about four months.
MAYOR FRITZ requested an opinion from the City Attorney regarding
the expenditure of Capital Outlay funds for sewers. Attorney

Campbell stated that he had checked with the League of California
Cities' Attorney and Mt. Louis Burke and that they concurred with
his opinion that any money spent for a sewer system out of the
Capital Outlay Fund was a legal expenditure.
COUNCILMAN MATTHEWS stated that the recent rain had washed out a
lot of soft dirt in various sections of the City where the sewer
is being laid and he wondered whether the contractor would take
care of this matter. He stated that in the rear of the Baptist
Church at 26th & Highland there was quite a pool of water.
Administrative Officer Dickson said that both he and Engineer
Ireland had just checked that place today and that this same
condition has been there each year and was not due to the con-
struction of the sewer line. Administrative Officer Dickson
said that the contractor had informed him that he would take care
of the places that had been "washed out".
COUNCILMAN MATTHEWS asked whether or not the City owned the Casa
de Salud Building. He said that it needed painting very badly
and wondered if the City could do something about it. Mayor
Fritz said that the building was leased by the Community Chest
and that the City paid all the utilities and that the Community
Chest had agreed to maintain the building and make any repairs
and alterations.
MAYOR FRITZ adjourned the meeting until October 26, 1948, at 7:00
P. M. o'clock.
