Councilmen present: Adams, Curry, Matthews, Thatcher, Fritz. Councilmen absent: None. ADMINISTRATIVE OFFICIALS present: Dickson, Vansant, Gautereaux, Campbell, Bonnell, Rogers. J. R. HARVEY, 1705 Grove Street, was present and asked how much money the Council could spend without going to the vote of the people. The question was referred to Attorney Campbell by Mayor Fritz. Attorney Campbell stated there are no limitations. COMMUNICATION FROM MRS. J. D. ROBERTS was read, requesting that a traffic signal be installed at 21st Street and National Avenue. Moved by Matthews, seconded by Curry, that 21st Street be in- cluded in the State's survey for traffic signals, also that action on the survey be made as soon as possible. Carried, all Councilmen present voting aye. REPORT FROM THE LAND TITLE INSURANCE CO, on Lots 13-14, Block 26, City Plat, except the Nly 51 of W 121 of Lot 13, and except the W 121 of Lot 14, was read and ordered filede REPORT FROM THE COUNTY HEALTH DEPARTMENT on mosquito control, was read and ordered filed. MOVED BY ADAMS, seconded.by MATTHEWS, that crosswalks at 21st Street and National Avenue be painted• Carried, all Councilmen present voting aye. 65 was read COMMUNICATION FROM MRS. LEONA A. JAMISON, 2328 Highland Avenue/ requesting refund on her business license in the amount of $9.00. The refund was approved by License Collector Bates. Moved by Matthews, seconded by Curry, that the refund be made. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: None. COMMUNICATION FROM MRS. INEZ ELAINE BRAGDON, 2467 Deauville Place, was read, requesting that a portion of a "turn -a -round" be closed. Administrative Officer Dickson reported that the property has never been deeded to the City for street purposes and that the City has no need for it. RESOLUTION NO. 4786 was read, authorizing Mrs. Inez Elaine Brag - don to close her portion of a "turn -a -round" on the following described property: that portion of the Ef of 20 Acre Lot 1, $ Section 132; beginning at the NE corner of said Lot 1; thence along the East line of said Lot 1, S 19° E 40.00 feet to the South line of 8th Street; thence along the South line of 8th Street, South 71° W 170.00 feet; thence South 19 East 185.86 feet; thence South 26° West 84.85 feet to the true point of be- ginning; thence South 19° E 4.14 feet; thence South 71° W 40.00 feet to the Westerly terminus of a tangent 11.26 foot radius curve concave Northwesterly; thence Ely and North Ely along said curve through a central angle of 77o 17' a distance of 15.19 feet to a point of reverse curvature with a 40 foot radius curve whose center bears North 83° 43' East; thence Nly and North Ely along said curve to an intersection thereof Frith a line which bears North 26° 001 East from the true point of beginning; thence South 26° 00' West to the true point of beginning. Moved by Matthews, seconded by Thatcher, that the Resolution be adopted. 66 Carried, all Councilmen present voting aye. COMMUNICATION FROM SISTER ALICE ANN 0. S. B., 618 C Avenue, was read, requesting the Police Department to organize and operate a Junior Patrol for Saint Mary's School, which is temporarily located at 8th Street and D Avenue. Mayor Fritz suggested that the request be referred to the Chief of Police. Moved by Adams, seconded by Thatcher, that the matter be referred to Chief Bates. Carried, all Councilmen present voting aye. COMMUNICATION FROM CITY TREASURER VANSANT was read, setting forth reasons why the bulk of the City's money should remain in the U. S. National Bank of San Diego. At the conclusion of the five page letter, Mr. Vansant stated that if there are members of the Council who still feel that the change should be made, that he would like to meet with them for further discussion. Councilman Matthews remarked that it was a very good letter. Councilman Adams remarked that if the funds were moved, they would doubtless wind up in the Bank of America. Moved by Adams, seconded by Thatcher, that the previous motion requesting the City Treasurer to move the City Funds to National City banks be rescinded. Carried, by the following vote to -wit: Ayes: Adams, Curry, Thatcher, Fritz. Nays: Matthews. COMMUNICATION FROM DOROTHY J. JENSEN was read, which stated that she deposited with the City in 1945, $600.00 for the installation of a sewer lateral, and was now requesting the City to refund her money. ADMINISTRATIVE OFFICER DICKSON reported that in November, 1945, Mrs, Jensen received $79.38 for her portion of the Johnson connection, and that she will receive the refunds as the people make the connections, as per the contract she signed 67 with the City. MAYOR FRITZ suggested that the matter be referred to the Attorney. ATTORNEY CAMPBELL stated that it was an agreement and the City shouldn't set a precedent by breaking such agreements, when Councilman Adams suggested that the City pay Mrs. Jensen the balance of the money. MAYOR FRITZ suggested that the Engineer make a study of the situation. Moved by Adams, seconded by Curry, that the Engineer make a report on the matter at the next meeting. Carried, all Councilmen present voting aye. CITY CLERK ROGERS presented Ordinance No. _ for the closing of a portion of 25th Street for the second and final reading. Moved by Thatcher, seconded by Matthews, that only the heading be read. Carried by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: None. ORDINANCE NO. 749 AN ORDINANCE OF INTENTION TO VACATE AND CLOSE A PORTION OF A PUBLIC STREET, TO -WIT: 25th STREET IN THE CITY OF NATIONAL CITY, CALIFORNIA. Moved by Adams, seconded by Thatcher, that the Ordinance be adopted. Carried, all Council- men present voting aye. CITY CLERK ROGERS brought up the question of changing paydays to sometime after the first of the month on account of State reports that require exact accounting of time in some of the departments. RESOLUTION NO. 4787 was read, authorizing the changing of pay periods to the 5th and 20th of each month, effective November 5th. Moved by Adams, seconded by Matthews, that the Resolution be adopted. Carried, all Councilmen present voting aye. PLANS AND SPECIFICATIONS for the lateral sewers were submitted by 68 Engineer Ireland. Councilmen Matthews, Curry and Adams questioned the use of concrete sewer pipe. Attorney Campbell reported that the phrase "or clay pipe" could be inserted in the specifications. Moved by Matthews, seconded by Curry, that the phrase "or clay pipe" be inserted in the specifications before they are advertised for bids. Carried, all Councilmen present voting aye. RESOLUTION NO. 4788 was read, accepting the plans and specifica- tions for the construction of lateral sewers, and adopting the following prevailing wage scale: LABOR CLASSIFICATION MINIMUM RATE PER HOUR Laborers general or construction including guard and/or watchman $1 4875 Asphalt raker and ironer 1 6875 Cribbers or shorers . - 1 8375 Cement Finisher 2 ���5 Sewer Pipe Layer (excluding caulker) 1 7875 Sewer Pipe Layer (using caulking tools) . . . 1.6625 Operators of Power Equipment Air or Electric tools 1.6875 Apprentice Engineer, Including Fireman, Oiler and Greaser 1 6625 Concrete Mixer Operator --skip type 1 9125 Motor Patrol Operator 2 1625 Tractor Operator --bulldozer, tamper, etc. . 2.0375 Trenching Machine 2 1125 Truck Drivers --less than 4 yards 1 5625 Universal Equipment --shovel, dragline, clamshell, or crane - 2 2375 Foreman $1.00 per day extra Overtime, one and one-ha}f the above rates, except Sundays and Holidays, which is double the above rates. The minimum wage paid to all skilled labor, for which rates are not shown above shall be not less than $2.00 per hour. The minimum wage paid to all intermediate labor, for which rates are not shown above, shall be not less than $1.65 per hour. The minimum wage paid to all unskilled labor, for which rates are not shown above, shall be not less than $1.4875 per hour. The hourly rate prescribed hereinabove is for an eight hour day forty hour week. It shall be mandatory upon the contractor to whom the contract is awarded and upon any sub -contractor under him, to pay not less than the said specified rates to all laborers, workmen and mechanics employed by them in the execution of the contract. Said specifications to be amended to read, "or clay pipe". Moved by Adams, seconded by Matthews, that the Resolution be adopted. Carried, all Councilmen present voting aye. 69 Moved by Adams, seconded by Curry, that the Engineer be•authorized to advertise for bids on the construction of lateral sewers. Said bids to be opened October 19th. Carried, all Councilmen present voting aye. ATTORNEY CAMPBELL presented an ordinance of annexation for the first reading. Moved by Thatcher, seconded by Matthews, that only the heading be read. Carried, by the following vote to- wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: None. ORDINANCE NO. — AN ORDINANCE ANNEXING CERTAIN DESCRIBED PROPERTY TO THE CITY OF NATIONAL CITY, A MUNICIPAL CORPORATION. Moved by Thatcher, seconded by Adams, that the Ordinance be laid over until the next meeting for the second and final reading. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: None. ATTORNEY CAMPBELL presented an ordinance for decreasing the speed limit in certain sections, for the first reading. Moved by Adams, seconded by Thatcher, that only the heading be read. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: None. ORDINANCE NO. — AN ORDINANCE DECREASING THE PRIMA FACIA LIMIT OF 55 MILES PER HOUR TO 35 MILES PER HOUR ON 18th STREET FROM RACHEL TO GROVE STREETS, NATIONAL CITY, CALIFORNIA. Moved by Matthews, seconded by Curry, that the Ordinance be laid over until the next meeting for the second and final reading. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: None. 70 ATTORNEY CAMPBELL presented an ordinance amending Ordinance No. 562, for the first reading. Moved by Thatcher. seconded by Adams, that only the heading be read. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: None. ORDINANCE NO. _ AN ORDINANCE AMENDING ORDINANCE NO. 562 OF THE CITY -OF -NATIONAL CITY, CALIFORNIA, ENTITLED "AN ORDINANCE LIMITING THE TIME FOR PARKING ON 8th STREET BETWEEN "A" AVENUE AND HIGHLAND AVENUE IN SAID CITY, AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF." Moved by Matthews, seconded by Curry, that the Ordinance be laid over until the next meeting for the second and final reading. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: None. ATTORNEY CAMPBELL reported there was nothing in Ordinance #532 which governed the planting of trees and shrubs in parkways and therefore presented a new ordinance for the first reading. Moved by Adams, seconded by Curry, that only the heading be read. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: None. ORDINANCE NO. _ AN ORDINANCE PROHIBITING THE PLANTING OF TREES OR SHRUBS IN CERTAIN PLACES IN THE CITY OF NATIONAL CITY, CALIFORNIA. Moved by Adams, seconded by Thatcher, that the Ordinance be laid over until the next meeting for the second and final reading. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: None. RESOLUTION NO. 4789 was read, that pursuant to Ordinance No. 742, fifteen minute parking zones are established as follows: for a length of 38 feet in front of the property at 718 E 8th 71 Street and a length of 40 feet in front of the Post Office on "A" Avenue. The Street Superintendent is directed to paint said curbing a green color in compliance with Ordinance No. 742. Moved by Adams, seconded by Thatcher, that the Resolution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO. 4790 was read, that pursuant to Ordinance No. 681, 8th and 18th Streets are hereby designated as through Streets, and all traffic entering on said streets except High- land Avenue, National Avenue and Bay Boulevard, shall stop before entering 8th and 18th Streets. A7.1 north and south bound traffic on Roosevelt Avenue shall stop before entering 4th Street. The Street Superintendent is hereby directed to erect boulevard stop signs in accordance with law on 8th and 18th Streets, ex- cept Highland Avenue, National Avenue, and Bay Boulevard, and on Roosevelt Avenue at the intersection of 4th Street. Moved by Thatcher, seconded by Matthews, that the Resolution be adopted. Carried, all Councilmen present voting aye. MOVED BY CURRY, seconded by THATCHER, that the Street Department construct the "island" at 24th Street and L Avenue. Carried, all Councilmen present voting aye. ATTORNEY CAMPBELL reported on the "Avon Products Co." business license. Mr. Campbell stated that the products are sold by local residents who are City tax payers and should be issued a business license on gross income instead of a peddlers license. Moved by Adams, Seconded by Curry, that the interpretation be accepted. Carried, all Councilmen present voting aye. ADMINISTRATIVE OFFICER DICKSON reported that he has quotations on two trucks, one for the Park and one for the Sewer Dept; also 72 an appraisal on the equipment now in use. 1 -- 1948 Ford 6--} ton truck and 1 -- 1948 Ford 6-3/4 ton truck, net $2,668.44 including the trade in allowance. 1 -- 1948 Dodge j- ton pickup and 1 -- 1948 Dodge 3/4 ton pickup, net $2,598.66 including the trade in allowance. Moved by Matthews, seconded by Curry, that the City purchase the two Dodge trucks in the amount of $2,598.66 which includes the trade in allowance. Carried, by the following vote to -wit: Ayes: Adams, Curry, Matthews, Thatcher, Fritz. Nays: None. ADMINISTRATIVE OFFICER DICKSON requested permission to take three days .vacation September 16-17-18. Moved by Adams, seconded by Curry, that the request be granted. Carried, all Councilmen present voting aye. BETTY EDELEN, 1531 National Avenue, was present and requested that something be done in order for the audience to hear what transpired at the Council meetings. Moved a by Matthews, that/public address system be by Adams, seconded installed in the City Council Chamber. Carried, all Councilmen present voting aye.
