Councilmen present: Adams, Cording- ly, Newberry, Thatcher, Fritz. Moved by Cordingly, seconded by Adams, that the reading of the minutes of November 18, 1947, and the adjourned meeting of Nov- ember 19, 1947, be dispensed with. Carried, all Councilmen 'present voting aye, ADMINISTRATIVE OFFICIALS present: Gautereaux, Smith, Campbell, Dickson, Rogers. BILLS AUDITED by the Finance Committee presented: General Fund $ 2,257.32 Street Imp. RESOLUTION NO. 4536 was read authorizing the following payments from the Capital Outlay Fund: NATIONAL MOTOR SALES, $1,008.99 for one 1947 4-door Special Deluxe Plymouth Sedan, to the Police Department, and $2,413.88 for 1 Model M16, 1j-2j Ton Heavy Duty Federal Motor Truck, to the Fire Department; PEERLESS EQUIP. CO., $3,536.25 for 1 Seaman £M: 72 Pulvi Mixer, to the 111 Street Department. Moved by Adams, seconded by Cordingly, that the Resolution be adopted. Carried, all Councilmen present voting aye. COMMUNICATION FROM THE VETERANS NUMBERING SERVICE was read, re- questing permission to number all the houses in the City and for compensation, donations will be solicted. Moved by Adams, seconded by Thatcher, that permission be granted in conformity with the license ordinance. Carried, all Councilmen present voting aye. APPLICATION OF BERTHA M. BRATT to move a house from 18th and Palm Avenue to the 1700 Block on E. llth Street, was read. Inspector Bird stated that the building could be made to com- ply with the Building Code. Moved by Cordingly, seconded by Adams, that permission to move the building be granted, provided it is made to comply with the Building Code, and is completed within six months from this date. Carried, all Councilmen present voting aye. COMMUNICATION FROM THE STATE CONTROLLER acknowledging the re- ceipt of the protest on the City's portion of liquor license fees, was read and ordered filed. PERMIT FROM THE STATE DEPARTMENT OF PUBLIC HEALTH authorizing the City to use the San Diego Treatment Sewage Plant, was read and ordered filed. PETITION signed by 10 re:sidents in regard to a dog at 2332 E Avenue, was read. Mayor Fritz suggested that the petition be referred to Chief of Police Bates. NOTIFICATION FRO'1 THE ARMY ENGINEE,IiS stating that further inves- 112 tigation was recommended on the National City -Chula Vista pro- posed Yacht Harbor, was read and ordered filed. INSURANCE POLICY for securities and money on the City Treasurer from Flack & Bailey in the amount of $134.50 for three years, was presented, and approved by Attorney Campbell. Moved by Thatcher, seconded by Cordingly, that the policy be accepted. Carried, by the following vote to -wit: Ayes: Adams, Cordingly, Newberry, Thatcher, Fritz. Nays: None. RESOLUTION N0. 4537 was read, authorizing Mayor Gilbert E. Fritz to enter into an agreement with the State Division of Highways for expenditure of the * cent Gas Tax monies for State High- ways for the fiscal year of 1947-1948. Moved by Newberry, seconded by Cordingly, that the Resolution be adopted. Carried, all Councilmen present voting aye. COMMUNICATION FROM THE MARYLAND CASUALTY CO. in regard to the bond of Carroll & Foster on the sewer contract on 6th Street, was presented. Moved by Newberry, seconded by Adams, that the bond be released. Carried, all Councilmen present voting aye. RESOLUTION NO. 4538 was read, rescinding Resolution No. 4524, and accepting a quitclaim deed from Claude B. and Vernie Mar- garet Brown for a sewer pumping plant on the following described property: beginning at the NW corner of Lot 70, Block 5, Par. adena Park Sub., thence N 71° 16' 30" E 60'; thence S 32° 56' E 40'; thence S 71° 16' 30" W 60'; thence N 32° 56' W 40' to point of beginning. Moved by Adams, seconded by Cordingly, that the Resolution be adopted. Carried, all Councilmen present voting aye. 113 MAYOR FRITZ announced that it was 8:00 P. M. and a hearing of protests on the closing of Streets and Alleys in 10 Acre Lots 7 & 8, I Section 154, would be heard at this time. No written protests were presented. Attorney Campbell suggested that the hearing be continued until the next regular meeting. Moved by Thatcher, seconded by Cordingly, that the hearing be continued until the next regular meeting. Carried, all Councilmen pre- sent voting aye, NOTICE OF JUDGMENT No. 121165, City of National City vs: Tavares Construction Co. in the amount of $829.48, was presented. Moved by Thatcher, seconded by Adams, that the judgment be paid. Carried, by the following vote to -wit: Ayes: Adams, Cording- ly, Newberry, Thatcher, Fritz. Nays: None. COMMUNICATION FROI'1 TFIE SAN DIEGO ELECTRIC RY. CO. was read, re- questing the City to pass an ordinance prohibiting smoking on the buses in National City. Moved by Newberry, seconded by Adams, that the communication be tabled. Carried, all Council- men present voting aye. COMMUNICATION FROM VETERANS OF FOREIGN WARS, Thomas H. Cosby, Jr. Post No. 4630, was read, requesting a refund of $5.00 for use of the Community Building September 27, 1947. Moved by Newberry, seconded by Adams, that the refund be made. Carried, by the following vote to -wit: Ayes: Adams, Cordingly, New- berry, Thatcher, Fritz. Nays: None. COMMUNICATION FROM ENGIN:ER IRELAND was read, requesting that car allowance for the months of October and November in the amount of $20.00 be allowed Ass't Eng. Wayne Smith and $10.00 to Engineer Ireland. Mr. Ireland further requested the Council 114 to consider the purchase of a pick up truck for the transport- ation of the Engineers equipment. Moved by Adams, seconded by Newberry, that the request for the two car allowances be gran- ted. Carried, by the following vote to -wit: Ayes: Adams, Cordingly, Newberry, Thatcher, Fritz, Nays: None. MAYOR FRITZ suggested that the City purchase a pick-up truck but not give exclusive use of the. truck to the Engineers. Attorney Campbell ruled that the City must advertise for bids unless the truck is not used for Street or Sewer purposes. Moved by Adams, seconded by Newberry, that the City purchase a + ton pick-up truck for utility use, primarily the Engineers, and excluding Street and Sewer purposes, Carried, all Council- men present voting aye. RESOLUTION NO. 4539 was read, increasing the salary of Tomas.- W. Baker, Police Department, to $245,00, effective December 15, 1947, as per recommendation Chief of Police Bates, as Officer - Baker has completed his second year of -service at that time. Moved by Newberry, seconded by Cordingly, that the Resolution be adopted. Carried, all Councilmen present voting aye. COMMUNICATION FROM CHIEF OF POLICE BATES was read, stating that The Federal Communications Commission has issued orders that the Police Radio Station KQBF will have to change the radio frequency from 33,100 KC to a band in the 152 to 160 M.C. class before July 1, 1950. Chief Bates further stated'that tests have been made and plans drawn, whereby•a change can be made with the present equipment for an approximate cost of $1,500.00, Administrative Officer Dickson recommended that $1,500.00 be transferred from the unbudgeted reserve to the Police Expense 115 account for that purpose. Moved by Cordingly, seconded by New- berry, that the transfer be made. Carried, by the following vote to -wit: Ayes: Adams, Cordingly, Newberry, Thatcher, Fritz. Nays: None. COMMUNICATION FROM CHIEF OF POLICE BATES was read, stating that the lease agreement with Joe Navaro in Sweetwater Valley for the pistol range will expite January 3, 1948, suggested that the City property in + Sections 105 & 130 is the most desirable. Mayor Fritz suggested that the land be surveyed for a golf course and allow the Police Department to move in the pistol range. Moved by Newberry, seconded by Thatcher, that the matter be laid over until the next meeting, Carried, all Councilmen present voting aye. RESOLUTION NO. 4540 was read authorizing the City Engineer to prepare plans and specifications for the formation of a sewer district. Moved by Newberry, seconded by Thatcher, that the Resolution be adopted, Carried, all Councilmen present voting aye. COMMUNICATION FROM THE CALIFORNIA WATER & TELEPHONE CO. was read, relative to the City purchasing water from the City of San Diego. RESOLUTION N0. 4541 was read, accepting that proposal by the California Water & Telephone Co, dated November 21, 1947, and appointing the said Company the agent of the City, Moved by Newberry, seconded by Thatcher, that the Resolution be adopted. Carried, all Councilmen present voting aye. CITY CLERK ROGERS requested transfers from the Unbudgeted Reserve to the following budgets to cover overdrafts: Advertising & Promotion Refunds & Rebates League of Calif. Cities $400.00 830.00 900.00 116 Moved by Newberry, seconded by Cordingly, that the transfers be made. Carried, by the following vote to -wit: Ayes: Adams, Cordingly, Newberry, Thatcher, Fritz. Nays: None. RESOLUTION NO. 4542 was read, authorizing City Assessor Rogers to make the following deductions from the 1947.1948 tax roll: Assessment No. 2754 deduct $125.00 valuation for personal prop- erty not owned by assessee on March 3, 1947, amount of tax $2.06; Assessment No. 3523, deduct $500.00 valuation for land, now owned by the City, amount of tax $8,25; Assessment No. 1280, deduct $7.10 valuation from improvements not constructed as of March 3, 1947, amount of taxes $11,71; Assessment No. 351, de- duct $600.00 valuation on improvements not constructed as of March 3, 1947, amount of taxes $9.90; Assessment No. 425, deduct $1,790.00 valuation for improvements, duplicated in assessment No. 356, amount of taxes, $29.53; Assessment No. 1463, deduct $470.00 valuation for improvements not constructed as of March 3, 1947, amount of tax $7.75. Moved by Adams, seconded by Newberry, that the Resolution be adopted, Carried, all Council- men present voting aye, ORDINANCE NO. , an ordinance amending Ordinance No. 656 of the Building Code was presented for the second and final reading, Moved by Newberry, seconded by Adams, that only the heading be read. Carried, by the following vote to -wit: Ayes: Adams, Cordingly, Newberry, Thatcher, Fritz. Nays: None. ORDINANCE NO. 741, AN ORDINANCE OF THE CITY OF NATIONAL CITY AMENDING ORDINANCE NO. 656 OF THE CITY OF NATIONAL CITY, BY 1 117 ADDING THERETO SECTION 4501-A. Moved by Adams, seconded by Newberry, that the Ordinance be adopted. Carried, all Council- men present voting aye. ORDINANCE NO. an ordinance regulating parking zones was presented for the second and final reading. Moved by Adams, sec- onded by Newberry, that only the heading be read. Carried, by the following vote to -wit: Ayes: Adams, Cordingly, Newberry, Thatcher, Fritz. Nays: None. ORDINANCE NO. 742, AN ORDINANCE PROVIDING FOR THE REGULATING OF PARKING ON THE STREETS OF THE CITY OF NATIONAL CITY, CALIF- ORNIA. Moved by Adams, seconded by Cordingly, that the Ordinance be adopted. Carried, all Councilmen present voting aye. ORDINANCE NO. providing for the sale or destruction of un- claimed property in possession of the Police Department, was presented for the second and final reading. Moved by Adams, seconded by Newberry, that only the heading be read. Carried, by the following vote to -wit: Ayes: Adams, Cordingly, New- berry, Thatcher, Fritz. Nays: None, ORDINANCE NO. 743, AN ORDINANCE OF THE CITY OF NATIONAL CITY PROVIDING FOR THE CARE, RESTITUTION, SALE OR DESTRUCTION OF UNCLAIMED PROPERTY IN THE POSSESSION OF THE POLICE DEPARTMENT OF THE CITY OF NATIONAL CITY. Moved by Newberry, seconded by Adams, that the Ordinance be adopted. Carried, all Councilmen present voting aye. ADMINISTRATIVE OFFICER DICKSON reported that he had received a quotation from the Attorney for the Margaret Currier Est. and offered the property in Block 307, City Plat for twice the val• uation or $3,000.00. Mr. Dickson did not recommend the purchase. 118 ADMINISTRATIVE OFFICER DICKSON reported that the gasoline con- tracts expire in January and requested authorization to adver- tise for bids, and that the lowest bidder of a standard quality gasoline, be accepted. Moved by Thatcher, seconded by Newberry, that -the request be granted. Carried, all Councilmen present voting aye. ADMINISTRATIVE OFFICER DICKSON reported that the City should have street signs. Mayor Fritz suggested a low mounted vertical reflection type sign. Moved by Newberry, seconded by Adams, that a committee be appointed and make a report. Carrie4, all Councilmen present voting aye. ADMINISTRATIVE 0r'r'iCER DICKSON suggested that an informal meet- ing be held with the Council of Chula Vista in regard to the Cities acquiescence to water rates. It was agreed that Mr. Dick- son arrange a time that will be agreeable to all concerned and Mr, Burkholder. COUNCILMAN NEWBERRY stated that when he was absent November 4th a communication from the Division of Highways in regard to the establishment of a freeway on that portion of State Highway Route W1-SD-2 between the Mexican Border and 8th Street, was ordered filed, Mr. Newberry stated that the City should have access to the water front. Moved by Newberry, seconded by Adams, that the Highway Department be contacted and obtain a map on" the proposed freeway. Carried, all Councilmen present voting ayp. MAYOR FRITZ stated that the owner of the 37f acres in * Section 130, adjoining City property, had contacted him and asked the City to make an offer. Councilman Newberry reported 'that some people want the property adjoining the City property for a golf 119 course. Councilman Thatcher suggested that the City get a quo- tation. Administrative Officer Dickson suggested that $30,000.00 be offered for the 37* acres. That the property North of Div- isioni Street was $1,000.00 per acre. Councilman Adams stated that he thought the people should be consulted first before $30,000.00 was spent for a golf course which would be a drug on the market in a depression. Councilman Thatcher reported that in the past depression the golf courses paid for themselves. Councilman Adams stated that he is not a property owner, and fundamentally is not in sympathy with taxpayers. However, he would be in favor of spending a half million dollars for apart- ment houses. That would draw people to National City. Council- man Newberry stated that the golf course would draw people to National City too as the greater San Diego area is short about five courses. Moved by Thatcher, seconded by Newberry, that an offer of $30,000.00 be made for the 37f acres. Carried, by the following vote to -wit: Ayes: Cordingly, Newberry, Thatcher, Fritz. Nays: Adams. MAYOR FRITZ asked why the two hour parking signs had not been installed. Administrative Officer Dickson reported that the signs had not been ordered. ATTORNEY CAMPBELL requested that the minutes of September 2, 1947, be amended to include Resolution No. 4469-A. Moved by Adams, seconded by Newberry, that the minutes be amended. Carried, all Councilmen present voting aye. ATTORNEY CAMPBELL presented an ordinance providing for the des- truction of duplicate papers and records over five years old of the City Court, for the first reading. Moved by Newberry, 120 seconded by Thatcher, that only the heading be read. Carried, by the following vote to -wit: Ayes: Adams, Cordingly, Newberry, Thatcher, Fritz. Nays: None. ORDINANCE NO. AN ORDINANCE OF THE CITY OF, NATIONAL CITY PROVIDING FOR THE DESTRUCTION OF DUPLICATE PAPERS AND RECORDS OVER FIVE YEARS OLD OF THE CITY COURT OF NATIONAL CITY. Moved by Newberry, seconded by Thatcher, that the Ordinance be laid over until the next meeting for the second and final reading. Carried, by the following vote to -wit: Ayes: Adams, Cordingly, Newberry, Thatcher, Fritz. Nays: None. ATTORNEY CANPBELL presented a proposed ordinance, amending the Business Licetibe Ordinance for study. Moved by Newberry, seconded by Adams, that the meeting be elosed.
