National City, California, September 2, 1947,
Regular meeting of the City Council was called to order by
Mayor Fritz at 7:30 P. M, Councilmen present: Adams, Cord-
ingly, Thatcher, Fritz. Councilmen absent: Newberry,
Moved by Adams, seconded by Cordingly, that the reading of the
minutes of the regular meeting of August 19, 1947, be dispens-
ed with. Carried, all Councilmen present voting aye,

allowed and warrants ordered drawn for same, Carried, by the

L, J, SHAPARD, 3125 East 20th Street, was present in regard
to the condition of 20th Street between Granger and Rachel
Avenues, Mayor Fritz informed Mr. Shepard the procedure for

oiling streets, Administrative Officer Dickson was instructed
to send Mr, Shapard the estimate coat in a letter,
APPLICATION OF DANNIE E, LINTON, 2840 National Avenue, for
off sale beer and wine license was read. Moved by Cordingly,
seconded by Adams, that the request be referred to Chief of
Police Bates, Carried, all Councilmen present voting aye.

COMMUNICATION PROM THE CITY 0' LAS VEGAS, NEVADA, relative to
sewage disposal plants, was read and ordered filed,
COMMUNICATION 710M A, L, JOHNST)N, NATIONAL REa'INERY, was read,
requesting the City to oil 20th Street from Bay Blvd, to
Cleveland Avenue, 'layne Smith, AssIt Engineer, was present
and presented a map designating the proposed streets of major
importance, which covered 49 miles but which will have to be
reduced to 36 miles, Mayor Fritz referred the map back to the
Engineers to complete.

ADMINISTRATIVE OFFICER DICKSON reported that Mr, Primmer of
the San Diego Seat Advertising Co, has accepted the contract
as revised by the City,
COMMUNICATION :MOM DON CRIPPEN, Don's Mobile Service, was road,
requesting the refund of $2,80 on his business license as he
has sold his business, Chief Bates approved the request, City
Clerk Rogers informed the Council that they might not have
authority to make refunds on basic licenses, and suggested the
attorney look into the matter, Moved by Newberry, seconded
by Cordingly, that Attorney Campbell give a ruling on the
legality of this type of refunds, Carried, all Councilmen
present voting aye,
CIMMUNICATION ?ROM JAMES ALLEN, janitor was read, stating that
he was tendering his resignation, effective September 18th,

and requesting that he be placed on the reserve list, Moved
by Newberry, seconded by Cordingly, that the resignation be
accepted and his name be placed on the reserve list, Carried,
all Councilmen present voting aye,
APPLICATIDN OF ARTURO NARTINEZ to move a building from 1784
Kearney Avenue, San Diego, to Lots 11-12, Block 147, City Plat,
was read, Moved by Cordingly, seconded by Newberry, that the
request be granted provided the building is brnught to the
requirements of the building oode and completed within six
months from this date, Carried, all Councilmen present voting

MAYOR FRITZ announced that it was 8:00 P, M, o'clock and the
bids would be opened at this time, Bid from the San Diego Gas
& Electric Co, on Lighting District #1 was $783,60, Moved by
Newberry, seconded by Cordingly, that the bid be accepted,
Carried, by the following vote to -wit: Ayes: Adams, Cordingly
Thatcher, Fritz. Nays: none, Bid from Brown -Bevis Equip-
ment Company on a model 44C Barber•Grcene Standard Ditcher was
$11,335,00 f,o,b, plus sales tax, delivery approximately 90
days after receipt of order, Moved by Newberry, scoondcd by
Thatcher, that the bid be accepted, provided delivery can be
made within six months from date, Carried, by the following
vote to -wit: Ayes: Adams, Cordingly, Thatcher, Newberry,
Fritz, Nays: none, Bid from the American Pipe and Construct.

MAYOR 'RITZ announced that it was time for a hearing on the
closing of the alley in Irving Place, There were no protests,
RESOLUTION N0, 4466 was read, closing the following described
alley:

COMMU ICATION !R)]•t THE LANDS DIVISION, DEPARTIMIT J? JUSTICE,
was read, requesting the City to extend the negotiation time
of the tideland settlement fifteen days, Administrative Officer
Dickson gave a resume of the progress of the settlement, and
suggested that the City set up a rental and eviction date for
actual possession of the land, Moved by Adana, seconded by
Newberry, that the 15 days extension be.granted thus making
the final negotiation date September 17, 1947. Carried, all
Councilmen present voting aye,
COMMUNICATION 2ROM THE U. S, NAVY PURCHASING J22ICE was rend,
requesting an amendment to the Naval Surly Depot -San Diego
Contract N244e-39385 for sewer service with the City, :Soved
by Adams, seconded by Cordingly, that Mayor Gilbert E, 2ritz be
authorized to sign the amendment on behalf of the City, Carried,
all Councilmen present voting aye,
RESOLUTION NO, 4467 was read, accepting a grant deed for street
purposes only from Frank A, Richards, Jr, on the following

his employment with the City, was read and ordered filed,

mail notices to the property owners in the proposed asSesement
district for improvements on National Avenue from the southerly
line of 18th Street to the northerly line of 30th Street. Moved
by Adams, seconded by Newberry, that the fesoiution be adopted,

be sent to Arthur C. Eddy for the work he has done for the City,

ATTORNEY CAMPBELL reported on quiet title action #137171, Movod
by Cordingly, seconded by Newberry, that Attorney Campbell be
authorized to sign the disclaimer. Carried, all Councilmen

ADMINISTRATIVE 572ICLR DICKSON reported on the City property
recently acquired from S, Z. Greenberg and suggested that the

ADMINISTRATIVE OFFICER DICMSON requested authorization to negoti-
ate with the California Water & Telephone Co, to purchase
property for park purposes, Moved by Adams, seconded by Thatcher,
that Mr, Dickson be authorised to negotiate for thc property,
Carried, all Councilmen present votin; aye.
CITY CLERt ROG31S requested permission to attend the League of
California Cities convention in San Francisco this month, Moved
by Cordingly, seconded by Thatcher, that City Clerk Rogers and
Park Supt, Gautcreaux be authorized to attend the League conven-
tion, Carried, all Councilmen present voting aye,
RESOLUTION NO, 4470 was read, authorizing the appointment of
Charles Neumann as Custodian of the City Hall and Community
Building, salary 4180,00 per month 'and $2,50 per night for
attendance of the Community Building when occupied, effective
• August 29, 19470 Moved by Thatcher, seconded by Cordingly, that

LDMINISTRATIVE 07FICER DICKSON reported on the contacts made
with the property owners in regard to the proposed opening of
J Avenue between 3rd and 4th_ Streets. ar_d widening of 3rd Street,
and stated that from verbal discussions the property owners
as a majority do not want an assessment district,
LDMINISTRLTIVI i3 ICER DICKSON reported that all of the neoessary
easements for the sewer have been obtained with the exception
of five and that possibly one or two will have to go to condem-
nation,
ADMINTISTR.'ATIVE O"PIC]Tt DICKSON submitted a bid from the National
Motor Sales for 2 oars for the Police Department in the amount
of $1,662,67, net erith the trade in of the two police cars,
