National City, California, March 5, 1946.
Regular meeting of the City Council called to order at 7:30 P. M.
by Mayor Fritz. Councilmen present: Cordingly, Newberry, That-
cher, Fritz. Councilmen absent: Christman.
Mayor Fritz announced that the votes will be canvassed at this
time for the Special Bond Election held February 26, 1946.

Mayor Fritz called for any contest of the election. There being
none, the totals remained.
RESOLUTION NO. 4023 was read, declaring the result of a special
election of the City of National City, California, held on Feb-
ruary 26, 1946. Moved by Thatcher, seconded by Newberry, that
the Resolution be adopted. Carried, all Councilmen present vot-
ing aye.
CERTIFICATE OF ELECTION: I, FRANK W. ROGERS, City Clerk of the
City of National City, California do hereby certify that the
following statements are true and correct:
1. A special Election was held in the City of National City,
California, on the 26th day of February 1946, pursuant to Ord-
inance Number 715, duly passed and adopted by the City Council
of said City by warrant of a two-thirds (2/3) vote on the 22nd
day of January 1946, entitled:
"An Ordinance of the City Council of the City of
National City, California, ordering, calling, providing
for and giving notice of a special election to be held
in the City of National City on the 26th day of February
1946, for the purpose of submitting to the qualified
voters of said City a proposition to incur bonded indebt-
edness by said City for a certain municipal improvement."
2. The whole number of votes cast at said election was 1212 on
the proposition which reads as follows:

"Shall the City of National City incur a bonded in-
debtedness in the principal sum of 375,000.00 for
the purpose of the acquisition and construction by
said City of a certain municipal improvement, to wit:
The acquisition and construction of a trunk sewer
system in said City including the acquisition of
all equipment, easements and other property necessary
or convenient therefor?"
3. That all of said votes were valid and legal votes, of
which there were cast in favor of the proposition submitted at
said election 1104 votes; and against the proposition sub-
mitted at such election 108 votes.
That the votes cast in favor of the proposition constituted
more than two-thirds (2/3) of the votes of all voters voting
at such special election.
That 77 votes were cast in favor of the proposition submitted at
said election; and 16 votes against the proposition submitted at
such election in consolidated voting Precinct "A".
That 161 votes were cast in favor of the proposition submitted at
said election; and 29 votes against the proposition submitted at
such election in consolidated voting Precinct "S".
That 166 votes were cast in favor of the proposition submitted at
said election; and 14 votes against the proposition submitted at
such election in consolidated voting Precint "C".
That 216 votes were cast in favor of the proposition submitted at
said election; and 11 votes against the proposition submitted at
such election in consolidated voting Precinct "D".
That 90 votes were cast in favor of the proposition submitted at
said election; and 13 votes against the proposition submitted at
such election in consolidated voting Precinct "E".
That 223 votes were cast in favor of the proposition submitted at
said election; and 11 votes against the proposition submitted at
such election in consolidated voting Precinct "F".
That 170 votes were cast in favor of the proposition submitted at

said election; and 14 votes against the proposition submitted at
such election in consolidated voting Precinct "G".
The whole number of votes cast by absentee ballot at eeid election
was 1.
That 1 votes were cast in favor of the proposition submitted at
said election, by absentee ballot; and no votes against the
proposition submitted at such election, by absentee ballot.

minutes of the regular meeting of Feb.::19, 1946, be dispensed with.

Moved by Cordingly, seconded by Newberry, that the bills be allowed
and warrants ordered drawn for same. Carried, all Councilmen pres-
ent voting aye.
REPORT FROM THE CIVIL SERVICE COMMISSION was read, announcing the
results of the examinations for Street equipment operator, Street
maintenance man, and Park gardener and recreation Ass't.
RESOLTUTION NO. 4024 was read, authorizing the appointment of R.
L. McGarrah, Street maintenance man, at $160.00 per month, effect-
ive March 16, 1946; Oscar Agnew, Park Gardeneer and recreation
assistant, at $160.00 per month, effective March 16, 1946. Moved
by Newberry, seconded seconded by Cordingly, that the Resolution be
adopted. Carried, all Councilmen present voting aye.

COMMTNICATION FROM CARL R. BOHLING was read, requesting permission
to erect a sign on City property at 15th & National avenue. Moved
by Newberry, seconded by Cordingly, that the request be denied.
Carried, all Councilmen present voting aye.
coIffIUNICATION FROM BEN H. DIFFENBAUGH was read, requesting that his
-resignation from the Fire Dept. be effective March 1, 1946, and
be glaced on the reserve list.
RESOLUTION NO. 4025 was read, accepting the resignation of Ben
H. Diffenbaugh, engineer of the Fire Dept., effective March 1, 1946,
and placing him on the reserve list. Moved by Cordingly, seconded
by Newberry, that the Resolution be adopted. Carried, all Council-
men present voting aye.
COMMUNICATION FROM VERNER E. HAWKINS was read, requesting that
portion of Palm Avenue adjacent to Lot 74, Block 5, Paradena Park
be closed. Mayor Fritz referred the request to Attorney Campbell
to check the legality and the City Engineer to check the cost of
closing, so that funds may be deposited.
COMMUNICATION FROM COORDINATING COUNCIL was read, relative to the
City purchasing the Federal Recreation Building. Councilman New-
berry suggested that the City Clerk inform the Coordinating Coun-
cil that the City is taking steps to purchase the building.
APPLICATION OF JAMES E. KNOX AND VIRGIL PHIPPS for on sale general
was read. Mayor Fritz referred the request to Chief of Police Bates.
RESOLUTION NO. 4026 was read, authorizing the payment of $75.00
for special services rendered by Attorney Campbell for the period
, of January 1, 1946 to February 28, 1946. Moved by Newberry, sec-
onded by Cordingly, that the Resolution be adopted. Carried, all
Councilmen present voting aye.
RESOLUTION NO. 4027 was read, authorizing a refund of $10.00 to
Paul E. Leininger, 4370 Felton Street, San Diego, for a zone
variance which was not used. Moved by Cordingly, seconded by

Newberry, that the Resolution be adopted. Carried, all Councilmen
present voting aye.
COMMUNICATION FROM W. J. STEWART relative to dogs roaming the
• streets, was read and ordered filed.
RESOLUTION NO. 4028 was read; accepting the Hartford Fire Ins.
Compnay comprehensive policy on the 1946 Ford Sedan, factory No.
992-739154, for $11.00 per year. Moved by Newberry, seconded by
Cordingly, that the Resolution be adopted. Carried, all Council-
men present voting aye.
NOTICE FROM DIVISION OF HIGHWAYS of rider to be attached to en-
• croachment permit No. 118,308 to National Motor Sales, was read
and ordered filed.
COMMUNICATION FROM KENNETH L. BLANCHARD POST 255, AMERICAN LEGION,
was read, read relative to information on organizational signs.
Mayor Fritz suggested that the City Clerk inform the Legion of the
pending sign ordinance amendment.
RESOLUTION NO. 4029 was read, authorizing a refund of $17.50 of
the business license issued to Robert A. & Lola M. Doyle, 2464
G Street, San Diego 2 California, to cperate a service station
at 2540 National Avenue but was unable to obtain a lease. Moved
by Cordingly, seconded by Thatcher, that the Resolution be adopted.
Carried, all Councilman present voting aye.
RESOLUTION NO. 4030 was read, accepting County warrant #113839 in
the amount of $46.82 on County Tax Sale #3793 against Lots 16-17,
Block 77, City Plat. Moved by Cordingly, seconded by Newberry,
that the Resolution be adopted. Carried, all Councilmen present
voting aye.
NOTICE FROM THE RAILROAD COMMISSION of the order of dismissal of the
application of Alton H. Putnam dba California Southern Bus Co., was
read and ordered filed.

CHIEF OF POLICE BATES recommended the denial of the application
of Simon M. Gonzalez to operate two pool tables and two card
tables in the Amigos Cafe building. Moved by Newberry, seconded
by Thatcher, that the request be denied. Carried, all Council-
men present voting aye.
RESOLUTION NO. 4031 was read, consolidating the precincts and
appointing the election officials, and setting the salaries, for
the Municipal Election April 9, 1946. Moved by Thatcher, seconded
by Cordingly, that the Resolution be adopted. Carried, all Coun-
cilmen present voting aye.
RESOLUTION N0. 4032 was read, instructing the City Clerk to ad-
vertise for bids for one 4 yard dump truck, Federal 3/or 4::ton
model 29MA. Specifications on file in the City Clerk's office.
Moved by Newberry, seconded by Cordingly, that the Resolution be
adopted. Carried, all Councilmen present voting aye.
ST. SUPt.FINNERTY was present relative to a site for trash dis-
posal. Mayor Fritz referred the matter to St. Supt. Finnerty
and Councilman Cordingly, to locate a site for same, and the
City dlerk to inform the Commandant of the llth Naval District
to discontinue bringing trash to National City.
Moved by Cordingly, seconded by Newberry, that Attorney Campbell
and City Engineer work on the sewer bonds. Carried, all Council-
men present voting aye.
RESOLUTION N0. 4033 was read, setting the salaries for election
officials and polling places at the Special Bond Election held
February 26, 1946. Moved by Thatcher, seconded by Cordingly,
that the Resolution be adopted. Carried, all Councilmen present
voting aye.
RESOLUTION NO. 4034 was read, authorizing the extension of the
Lighting District from 5th Street and National Avenue to First, -.
Street and from Main Street at First to Division Street. Moved

by Thatcher, seconded by Newberry, that the Resolution be adopted.
Carried, all Councilmen present voting aye.
RESOLUTION NO. 4035 was read, setting up a Lighting District from
loth Street on National Avenue to 13th Street. Moved by Newberry,
l seconded by Cordingly, that the Resolution be adopted. Carried,
all Councilmen present voting aye.
ATTORNEY CAMPBELL presented Quiet Title Suit by the Investment
Securities Corp. against Lots 17-18-19, Block 3, Austin Heights.
Mr. Campbell stated there is $453.63 in taxes against the lots,
a
plus street bonds that average about $1,000.00 per lot, and he
would like permission to take a settlement of $300.00 for the taxesi
to which the Council agreed.
ATTORNEY CAMPBELL brought the issuance of sewer bonds and requested
the Council to make a study of same. Mr. Campbell also suggested
that the City Clerk obtain information from the League on the pro-
cedure to make application for State funds which have been recent-
ly appropriated.
Mayor Fritz introduced Mr. Wm. R. Stevens, Ass't Engineer for the
City.
Moved by Thatcher, seconded by Newberry, that the meeting be closed.
Carried, all Councilmen present voting aye.

ATTORNEY CAMPBELL requested an amendment to the minutesof March 5,
1946, to include Resolution No. 40352j authorizing the City Clerk
to Mail Cards to each property owner in the proposed lighting dis-

tract from 5th Street on National Avenue to First Street and from
First Street on Main Street to Divison Street. Moved by Thatcher,
seconded by Cordingly, that the Resolution be adopted. Carried,
all Councilmen present voting aye.
