Regular meeting of the City Council called to order at 7:30 Pa,
by Mayor Fritz, Councilmen present: Adams, Cordingly, Newberry,
Thatcher, Fritz,
Moved by Adams, seconded by Cordingly, that the reading of the
minutes of the regular meeting of November 6, 1946, and the
adjourned meeting of November 12, 1946, be dispensed with,
Carried, all Councilmen present voting aye.

Allowed and warrants ordered drawn for same, Carried, all

MAYOR'FRITZ announced that arguments would not be heard on the
Sales Tax Ordinance and the Parking Meter Ordinance until,
November 27, 1946 at 10:00 A.M, o'clock, as the City has an
agreement with the City of Chula Vista that both Cities will
pass these ordinances at the same time and the City of Chula
Vista ie holding their meeting in the evening of November 26th.

Mayor Fritz further stated that the City needs additional
revenue and the majority of the Council feels that the Ordin-
ances should be'passed,
HERBERT A. BARNES, 1125 °B° Avenue, was present and wanted to
know that bad been done in regard to the shuffleboard courts
during the past two weeks. Administrative Officer Dickson
reported that the Park Dept. is very short handed at present

and do not have time for details other than the lawns and that
he has an appointment with Mr. Barnes Next week and feels quite
sure that something will be worked out;
Be E. ELDRIDGE, 936 "A" Avenue, was present and protested
against the existing conditions in the alley. Mr, Eldridge
stated that boxes from the stores were set in the alley and
scattered, and used water from the restaurant thrown down the
alley and drain into the yards of the homes, Mayor Fritz
referred the matter to Administrative Office Dickson,
COMMUNICATION FROM AMERICAN LEGION POST #255, thanking the
City for the cooperation in making the Armistice parade a
success, was read and ordered filed,
COMMUNICATION FROM W. E. FLACK, Insurance Broker, 615 National
Avenue, expressed his appreciation for the opportunity to bid
on the comprehensive insurance and complimented the Council on
continuing the insuranoe with Mr, Guy, was read and ordered
filed.
REPORT PROM THE PLANNING COMMISSION WAS READ, making the
following recommendations: Joe A, Robnett to operate a used
furniture store and upholstery shop; G, C. Trotochau to erect
a temporary model display building; Marian M. Mueller to operate
a fixit shop; C. E. Eubank* to build a four unit apartment
building; Charles B; Campbell to operate a retail business of
patio furniture and pottery; Lee J, Morgan to build four duplex
houses; Trotochau and Griswold to operate a lumber yard; The
petition of Mattie Cotten Sweet to operate a real estate office
on the front porch of her home at 1139 "A" Avenue was denied,
The Commission recommends the re -zoning of the Sweetwater High
School Grounds from an R-2 to an ab.2 Zone; Moved by Newberry
seconded by Cordingly, that the report be accepted. Carried,
all Councilmen present voting aye;

RESOLUTION N0. 4240 was read, authorizing a zone variance to
Joe A. Robnett to operate a used furniturc store and upholstery
shop in an existing building on the North 3 acres of SW.1/4 of
W.1/2 of 80 Acre Lot 1, Quarter Section 128. Moved by Cordingly
seconded by Adams, that the Resolution be adopted.' Carried, all
Councilmen present voting aye.
RESOLUTION NO. 4241 was read, authorizing a zone variance to
G. C. Trotochau to erect a temporary model display building and
to operate from the building that is now on this property a
retail sales office and yard for the lumber, painting, roofing
etc„ that goes into the construction of said above proposed
building, on Quarter Section 153, L. A. Weisser Sub., Lot 4
Block 1, Moved by Newberry, seconded by Cordingly, that the
Resolution be adopted,' Carried all Councilmen present voting aye.
RESOLUTION NO, 4242 was read, authorizing a zone variance to
Marian M. Mueller to operate a fixit shop on the 3,60' of Lots
25-26-27, Block 2, 20 Acre Lot 1, * Section 133, J. D. O'Connclls
Sub, Moved by Adams, seconded by Cordingly, that the Resolution
be adopted; Carried, all Councilmen present voting eye;
RZ OLUTION NO. 4243 was read, authorizing a zone variance to
Charles E. Eubanks to build a four unit apartment frame and
stucco building on the Wf of Lot 10, E.17' of Lot 9, Block 2,
10 'tore Lot 5, 4 Section 155, Kimball's Sub. Moved by
Newberry, seconded by Cordingly, that the Resolution be adopted,
Carried, all Councilmen present voting aye.
RESOLUTION NO. 4244 was read, authorizing a zone variance to
Charles B. Campbell Jr. to operate a business of retail selling
of lawn and patio furniture and pottery on the N.43' of S115'
of W.155' of 10 Acre Lot 4, * Section 153. Moved by Cordingly
seconded by Adams, that the Resolution be adopted, Carried,all
Councilmen present voting aye.

RESOIJJTION NO, 4245 was read, authorizing a zone variance to
Lee J. Morgan to build 4 duplex houses on the SE oorner of 18th
Street and °L" Avenue, Moved by Adams, seconded by Newberry,
that the Resolution be adopted. Carried, all Councilmen
present voting aye.
RESOLUTION NO, 4246 was read, authorizing a zone variance to
Trotochau and Griswold to operate a lumber yard at 2137
National Avenue, Moved by Newberry, seconded by Cordingly,
that the Resolution be adopted, Carried, all Councilmen pre-
sent voting aye,
Moved by Newberry, seconded by Thatcher, that the re -zoning of
the Sweetwater High School Grounds be referred to Attorney
Campbell to prepare an ordinance for same, Carried, all Council-
men present voting aye.
COMMUJNICATION FROM THE PLANNING COMMISSION was read, in regard
to the reorganization of the Planning Commission and making the
following recommendations; Seven voting members appointed at
large by the Council; the City Engineer and City Attorney as
advisory members without power to vote, Moved by Newberry,
seconded by Thatcher, that the recommendation be referred to
Attorney Campbell to prepare an ordinance for same. Carried,
all Councilmen present voting aye.
COMMUNICATION PROM THE PLANNING COMMISSION was read, relative
to the Council granting the appeal of Glenn Q. Reynolds from
the Commission's decision. Moved by Newberry, seconded by
Thatoher, that the Council is in sympathy with the Commission'§
policy and remind theta of the restrictions placed on the zone
variance When the appeal was granted. Carried, all Councilmen
present voting aye.
COMMUNICATION FROM CHIEF OF POLICE BATES was read, requesting
a 60 day sick leave without pay be granted to Henry G. Bolen,
effective October 30, 1946. Moved by Adams, seconded by

RESOLUTION NO. 4248 was read, authorizing the cancellation of
Assm't #3547 on tho 1942 delinquent tax roll as the taxes were
paid before the delinquent date, per request of C. W. Vansant,
City Tax Collector. Moved by Adams, seconded by Cordingly,
that the Resolution be adopted. Carried, all Councilmen present
voting aye,
MAYOR FRITZ requested that the bids on the compressor be opened
at this time; Bid from the Crook Company, $2,373.00, plus tax,
Moved by Cordingly, seconded by Newberry, that the bid be
accepted; Carried, all Councilmen present voting aye,
BIDS FOR THE SERER CONSTRUCTION were opened as follows:
Carrol & Foster, $19,856.00; Dennis Construction Co;, $24,848.00;
L. B, Butterfield, $19;995,00, Engineer Ireland recommended that
the bids be laid over until November 27th meeting,
COMMUNICATION FROM CITY ENGINEER IRELAND was read, in regard
to the establishing of the mean high tide line of San Diego Bay
along our waterfront from Division to 13th Street, Mr. Ireland
states that the California State Lands Commission are now con-
ducting negotiations among the interested parties to establish
this line from 24th Street to Chula Vista. Moved by Adams,

seconded by Newberry, that the matter be laid over until the
next regular meeting. Carried, all Councilmen present voting aye,
RESOLUTION NO. 4249 was read, authorising the following additions
and cancellations to the 1946-1947 tax roll as per the request
of Prank W. Rogers, City Assessor: Improvements on assm't
#569 be reduced from $1,150.00 to $370.00 as the building was
not completed by the deolar^tt&n date; $1000,00 exemption be
granted to Fred Ritchie as the exemption was not claimed else-
where; add Lot 14, Block 6, Wilbur's Sub,, 20 Acre Lot 3,
Section 133, valuation $75:00, to the roll; cancel $500.00
improvements and $50.00 personal property on assmt% #293, as
the building was not built; cancel $750.00 improvements on
assm't #1793,, Lot 22, Block 148, assessed to Lots 20-21, Block
148 City Plat; cancel $175;00 improvements on Lot 23, Block
243 and add to Lot 12,•Block 243, City Plat, assmmt #748,
Moved by Newberry, seconded by Thatcher, that the Resolution be
adopted. Carried, all Councilmen present voting aye,
CITY CLERK ROGERS presented several requests from the County
to participate in the County tax sales and talked that they be
laid over until the next regular meeting,in order to determine
if it is profitable for the City to participate in these sales.
Moved by Cordingly, seconded by Newberry, that the matter be
referred to City Cler, Rogers and City Attorney Campbell.

RESOLUTION NO, 4250 was read, confirming the appointment of
Louie H, Nlwbrough at $1.75 per hour and $0.05 mileage to
obtain sewer easements. Moved by Newberry, seconded by Cordingly
that the Resolution be adopted. Carried,all Councilmen Present
voting aye.

COMMUNICATION FROM H. W. SMITH was read, requesting a refund
of $7.00 on his business license as he sold his place of
business. Chief Bates recommended the refund. Moved by
Adams, seconded by Newberry, that Mr. Smith be refunded the
$7.00. Carried, all Councilmen present voting aye.
NOTICE OF HEARING between the California Water & Telephone Co;
and the Crest Public Utility Co. set for Dec. 3rd, was discussed;
Mayor Fritz requested Administrative Officer Dickson to contact
the Water Co. and ascertain what part they wish the City to take.
ADMINISTRATIVE OFFICER DICKSON Reported on the sewer line
leading from the pumping station to the San Diego Diaposal
Plant, stating that apparently it is a steel pipe line and is
breaking in various planes. Mr. Dickson requested permission
to advertise for bids for 16" C.I. Pipe. Moved by Newberry,
seconded by Thatcher, that the request be granted. Carried,
all Councilmen present voting aye.
ADMINISTRATIVE OFFICER DICKSON stated that the City needs
another diaphragm pump for the sewer department, and requests
authority to purchase same for $366,57,
RESOLUTION NO. 4251 was read, authorizing the Purchasing Agent
to purohase a diaphragm pump for $366,57, Moved by Cordingly,
seconded by Newberry, that the Resolution be adopted. Carried,
all Councilmen present voting aye.
ADMINISTRATIVE OFFICER DICKSON reported that Park Supt.
Gautereaux has recommended that the National City Shuffleboard
Club be permitted to hold their annual Thanksgiving dinner in the
Community Building November 24th without charge as this organ-
ization is a part of the City's recreational program. Moved
by Adams, Seconded by Newberry, that the request be granted.

ADMINISTRATIVE OFFICER DICKSON requested permission to contact
the California Water & Telephone Co, and have them bill the
Paradise Valley Sanitarium for the rental of the two fire plugs
on their grounds; Moved by Cordingly, seconded by Newberry,
that the request be granted, Carried, all Councilmen present
voting aye,
ANMINISTRATIVE OFFICER DICKSON requested permission to advertise
for bide to sell the following City property: 1 compressor,
1 grader, 1 caterpiller, as they are no longer needed by the
City, Moved by Cordingly, seconded by Newberry, that the
request be granted; Carried, all Councilmen present voting aye;
COUNCILMAN ADA S stated that a large number of men present are
business men and thought the Council should extend them time to
discuss the proposed sales tax and parking meters. Mayor Fritz
stated that the time had been set for 10:00 A.M. Wednesday,
November 27th and that anybody could be present to express their
views, however it was up to the rest of the Council. Councilman
Newberry stated that if Chula Vista didn't pass their Ordinances
the time would be wasted;
M.C, PATTERSON, 2927 E 16th Stteet, was present and asked the
Council to explain what has been done with the tax monies to
have the City $42,000.00 in debt and why the mis-management,
ATTORNEY CAMPBELL reported that about 30 easements are proving
difficult to obtain and requested authorization to write letters
requesting voluntary casements or the City will have to take
action, Moved by Newberry, seconded by Cordingly, that the
fastest steps possible be taken. Carried, all Councilmen present
voting aye.
ADMINISTRATIVE OFFICER DICKSON submitted a new proposed rental
schedule for the Community Building. Mayor Fritz suggested
that the Council make a study of the schedule before the next
meeting;

Council :was going -to answer -Mr-. Patterson's questions. Mayor
Fritz replied that the books are open to the public and
anybody could examine them. Councilman Thatcher stated that
they are public books. Councilman Adams stated that the Mayor
was not speaking for him.
