Councilmen present: Christman, Cordingly, Newberry, Thatcher, Fritz. Moved by Cordingly, seconded by Newberry, that the reading of the minutes of the regular meeting of August 7, 1945, be dispensed with. Carried, all Councilmen present voting aye. ADMINISTRATIVE OFFICIALS present: Ratelle, Vansant, Bates, Finnerty, Bird, Gautereaux, Campbell, Ireland, Rogers. BILLS AUDITED by the Finance Committee presented: General Fund $2,235.7S Street Imp." 640.49 Park M & I " 176.41 Unapp. Tax " 17.80 FdA ° 136.01 TOTAL $ 3,206.49 Moved by Christman, Seconded by Newberry, that the bills be allowed and warrants ordered drawn for same. Carried, all Councilmen pres- ent voting aye. C. A. NOBLE was present relative to a zone variance to build a garage with apartment above within five feet of his property line on the alley. Attorney Ratelle ruled that Mr. Noble was within his rights and did not need a zone variance. REPORT OF THE PLANNIUG COY2,:ISSION was read, as follows: recommends special permit to E. J. Uzumecki to erect a garage at grid Street and Highland Avenue; special permit to C. A. Noble to build a one story stucco dwelling facing J Avenue on Lots 11-12, Block 10, Wilbur's Sub., but recommends Mr. Noble's petition be denied to extend the present building to the property line; approves a tentative map of proposed Schutte Sub. lying between 15th and 16th Streets and "I" and Highland Avenues. Moved by Newberry, seconded by Christman, that the report be accepted. Carried, all Councilmen present voting aye. 819 RESOLUTION NO. 2949 was read, authorizing a zone variance to C. A. Noble to erect a one story stucco dwelling facing J Avenue on Lots 11-12, Block 10, Wilbur's Sub. Moved by Christman, seconded by Newberry, that the Resolution be adopted. present voting aye. HEIDEMARE was read which states that the building he proposes to move to his property at 415 National Avenue will be set on rear of lot, on concrete foundation and will not be , used as a public garage. REPORT OF BUILDING COiUIT'TEE was read, stating that the building Mr. Heidemark proposes to move into Fire Zone 1 would be in violat- ion of Sec. 1002B of the Building Code and would not meet the re- quirements of Sec. 1603B of said Code. Moved by Newberry, seconded by Cordingly, that the report be accepted. Carried, all Councilmen present voting aye. PETITION FROM DAVID GOLDFARB was read, protesting the moving of a building to 4th Street and National Avenue by J..R. Heidemark. PETITION SIGNED BY nine business men in the vicinity of 4th Street and National Avenue, protesting the moving of a building to 4th Street and National Avenue by Mr. Heidemark, was read. MR. HEIDEMARS presented a sketch of the proposed building and stated the front will be stucco finish and comparable of the surrounding buildings. MRS. HEIDEMARIC WAS present and protested against discrimination and stated the building is to be used by her son and nephew, veterans of World War II, in their post-war business. 820 RESOLUTION NO. 2951 was read, authorizing permission to J. R. Heidemark to move a corrugated iron building 36'x401 to the rear of his lot at 415 National Avenue, the building co be remodled as per sketch on file with the City with the following conditions: 1. Front elevation shallbe made es per sketch on file, stucco finish. 2. Building shall be located on rear of lot at 415 National Avenue. 3. Fourth Street side of building shall be stucco finish with fire wall extending in height above or even with ridge of said build- ing. 4. Building shall be placed on adequate foundation to allow.:ceiling height as required, and shall conform with local building regu- lations. Moved by Cordingly, seconded by Thatcher, that the Resolution be adopted. Carried, by the following vote: ayes: Cordingly, New- berry, Thatcher, Fritz. Nays: Christman. PETITION FROM MERLE STEADLIAN was read, requesting that changes be made in the grade of C Avenue and 27th Street. Moved by Cordingly, seconded by Thatcher, that the petition be referred to St. Supt. Finnerty and Engineer Ireland for recommendations. Carried, all Councilmen present voting aye. WATER REPORT 3Y COUNTY HEALTH DEPT. on water in swirining pool, Which shows negative, was read and ordered filed. RESOLUTION NO. 2952 was read, accepting $200.00 as opening bid on Lots 1 to 8 incl, and 11 to 20 incl., Block 3, 10 Acre Lot 6, * Section 152, Budd Villa Tract, tax deed property, and authorizing the City Treasurer to advertise and conduct a City tax sale. Moved by Cordingly, seconded by Newberry, that the Resolution be adopted. Carried, All Councilmen present voting aye. RESOLUTION NO. 2953 was read, setting $125.00 per lot as the opening bid on Lots 8-9-10, Block 1, Home Crest Villas, for the Cityts part- icipation in the County Tax Sale. Moved by Cordingly, seconded by Newberry, that the Resolution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO. 2954 was read, authorizing a refund of $.78 to A. C. Stewart for personal property tax which he paid twice in 1944. Moved by Newberry, seconded by Cordingly, that the Resolution be adopted. Carried, all Councilmen present voting aye. 821 RESOLUTION NO. 2955 was read, authorizing a refund of $4.09 to Myrtle Singletary for dual payment of personal property tax. - Moved by Cordingly, seconded by Thatcher, that the Resolution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NO. 2956 was read, accepting check No. 33452 for $175.00, dividend No. 65 for period ending July 31, 1945, 25 shares at $7.00 per share, to be deposited in the Library Fund to purchase books. Moved by Christman, seconded by Cordingly, that the Resolution be adopted. Carried, all Councilmen present voting aye. COMMUNICATION FROM J. W. WILSON, Jehovah's Witness, was read, requesting the use of the band stand in the City Park for a four week period. Moved by Newberry, seconded by Cordingly, that the request be denied. Carried, all Councilmen present voting aye. APPLICATION FROM 0. C. LUDWIG was read, requesting the use of the band stand in the City Park for one Sunday. Moved Christman, seconded by Cordingly, that the request be granted and Mr. Ludwig make application to Mr. Gautereaux to ascertain when the band stand will be available. Carried, all CounoL1men present voting aye. COMMUNICATION? FROM 0. C. LUDWIG relative to tax sale No. 3751, was read. Mayor Fritz referred the matter to Councilman Newberry and Engineer Ireland to make a survey in that district. COMMUNICATION FROM CITY TREASURER was read, relative to the budget and referred to the budget committee. RESOLUTION NO. 2957 was read, authorizing a refund to W. G. Kraft of $.47 for dual payment of personal property tax. Moved by Dord- ingly, seconded by Newberry, that the Resolution be adopted. Carried, all Councilmen present voting aye. ORDINANCE NO. 711 was presented for the second reading. Moved by Christman, seconded by Thatcher, that only the heading of the Ord- inance be read. Carried, all Councilmentresent voting aye. INANCE INTO. 711, AN ORDINANCE OF TEE CITY OF NATIONAL CITY, AMENDING ORDINANCE NO. 622 "AN ORDINANCE PROVIDING FOR THE CREATIOIT IN NATION= AL CITY OF SEVEN (7) ZONES CONSISTING OF VARIOUS ZONES OR DISTRICTS AND PRESCRIBING THE CLASSES OF BUILDINGS, STRUCTURES, IMPROVEMENTS IN SAID SEVERAL ZONES; AND THE USE THEREOF; THE HEIGHTS OF BUILDINGS, AND THE AREA OF LOTS COVERED BY BUILDINGS; ESTABLISHING SET -BACK IN FRONT ADTD SIDE YARDS; DEFINING THE TERMS USED HEREIN, PRESCRIBING THE PENALTY FOR THE VIOLATION OF THE PROVISIOITS HEREOF AND REPEALING CERTAIN ORDINANCES OF SAID CITY" BY ADDING A SECTION THERETO. loved by Newberry, seconded by Cordingly, that the Ordinance be adopted. Carried, all Councilmen present voting aye. COMMUNICATION FROM H. A. BARNES was read. Mayor Fritz referred the matter to the Park Committee. COMMUNICATION FROM E. J. EOUD, PRES. SAN DIEGO COUNTY DIVISION LEAGUE OF CALIFORNIA CITIES, was read, announcing a one day regional meeting August 24, 1945, starting at 10:AM in the San Room of the San Diego Hotel. COLflTONICATION FROII SAN DIEGO COUNTY WATER AUTHORITY WAS read, stat- ing that National City's portion of the taxation is $2,746.20 which may be shown on the County tax statements or paid fron the General Fund. Moved by Christman, seconded by Newberry, that the City Clerk make a request to have the charges on the County tax statements. Carried, all Councilmen present voting aye. RESOLUTION NO. 2958 was read, authorizing the following additions and deductions to the 1945-1946 tax roll: additions: land, f$105,325.00; improvements, $101,710.00; personal property, $$10,605.00; total $217,640.00. Deductions: land, $,850.00; improvements, $$2,360.00; personal property, $170.00; total $3,380.00.Moved by Cordingly,-sec- onded by Thatcher, that the Resolution be adopted. Carried, all Councilmen present voting aye. RESOLUTION NC. 2959 was read, accepting a check from the Federal ' Works Agency for $3,460.58 on requisition No. 15. Moved by Chris- 823 tman, seconded by Newberry, that the Resolution be adopted. Carried, all Councilmen present voting aye. PARK SUPT. GAUTEREAUX reported that an error had been made on their requisition and thought an adjustment will be made by the Federal Works Agency. Otherwise the US0 will be able to operate to about Sept. 15th instead of Sept. 31st. FIRE CHIEF BIRD reported that the Office of Civilian Defense is calling in their equipment. ENGINEER IRELAND reported that the re -surfacing of 8th Street will cost over a $1,000.00 and therefore will have to advertise for bids which will add another twenty five percent to the cost of the work. RESOLUTION NC. 2960 was read, authorizing the City Clerk to adver- tise for bids for re -surfacing 8th Street from K Avenue to the east City limits. Moved by Newberry, seconded by Cordingly, that the Resolution be adopted. Carried, all Councilmen present voting aye. COMMUNICATION FROM LARDS DIVISION, DEPARTbIENT OF JUSTICE, re: 248- SDCivil, petition for cancellation of taxes covering Parcels 4,6, 9,10 and 11, was presented by Attorney Ratelle and requested that it be filed. ENGINEER IRELAND reported there are sanitation and sewerage systems amendments in Assembly Bill No. 302. Mayor Fritz referred the matter to Attorney Ratelle. COUNCILMAN THATCHER presented the proposed Civil Service Ordinance for first reading. Moved by Thatcher, seconded by Cordingly, that the heading only be read of the Civil Service Ordinance. Carried, all Councilmen pres- ent voting aye. Mayor Fritz asked Councilman Thatcher if he had contacted Judge Harbison relative to be included in Civil Service. Councilman 824 Thatcher stated that he had been unable to contact him. It was agreed by the majority that the Attorney, Judge and Engineer will be left out of Civil Service for the present time. CRDINANCE NO.---- AN ORDINIANCE OF THE CITY OF NATIONAL CITY CREATING AND ESTABLISHING A CIVIL SERVICE SYSTEM FOR SAID CITY. Moved by Thatcher, seconded by Cordingly, that the Ordinance be laid over until the next regular meeting for the final reading. Carried by the following vote to -wit: Ayes: Cordingly, Newberry, Thatcher. Nays: Christman, Fritz. Mayor Fritz qualified his vote, stating, "that it should be put to the vote of the people." COUNCILMEN NEWBERRY reported on his meeting with the Army Engineer's Office in Los Angeles. The Engineers stated that they have no program on their records relative to dredging in the South Bay District. MAYOR FRITZ suggested that letters of appreciation be sent to the Air Raid Wardens who participated in fire fightinglAuggust 6, 1945, at 23rd-Street and Cleveland Avenue. Moved by Thatcher, seconded by Christman, that the City Clerk write these letters. Carried, all Councilmen present voting aye. MAYOR FRITZ spoke of the inadequate water pressure during the rec- ent fire and the condition of the unfiltered water for human con- sumption. Moved by Newberry, seconded by Cordingly, that action referred be started and/it to Attorney Ratelle and Engineer Ireland. Carried, all Councilmen present voting aye. a or zi RESOLUTION NO. 2961 was read,�t e an Diego & Arizona Ry Co. to construct, operate and maintain an industry spur track in National City, to be located as follows: Commencing at a point S 18° 11'E 40' and S 71° 49' W 40.5' from the most Southerly corner of Block 282 in the City of National City, County of San Diego, State of California, which point is the true point of beginning of the follow- ing certer line of spur track N 2°56' W 18feet; thence on a curve concave to t left with radius of 458.6 feet, tangent to the /dfscribed course, a distance of 58 feet; thence N 11°26' W 115 feet to end of spur track. 825. Moved by Christman, seconded by Newberry, that the Resolution be adopted. Carried, all Councilmen present voting aye. ATTORNEY RATELLE ruled that in view of the fact that Ruth Isaacs, Busy Bee Grill, did not file a report of her sales within fifteen days after the sale of her business, the Council would not be in ID a position to make a refund on her license. ATTORNEY RATELTF reported that Mr. Cobb of San Diego Electric Ry Co. will return to San Diego tomorrow and the franchise will be taken care of shortly thereafter. RESOLUTION NO. 2962 was read, authorizing the City Clerk to make a settlement with Ed Porter on the quiet title suit against Lots 13 to 19 inclusive, Block 21, City Plat, for •$100.00 to cancel the taxes on the City tax rolls and the City to remove the excess dirt without charge. Moved by Cordingly, seconded by Newberry, that the Resolution be adopted. Carried, all Councilmen present voting aye. Moved by Cordingly, seconded by Thatcher, that the meeting adjourn.
