Councilmen present: Christman, Cordingly, Fritz, Newberry and Thatcher. Councilmen absent: none. Administrative officials present: Bates, Smith, Ireland, Finnerty, Rogers, Lamb, Ratelle, Gautereaux and Harbison. Minutes of the regular meeting of March 21, 1944, read and approved. B ills audited by the Finance Committee presented: Moved by General Fund $ Street Imp Fund Park M & I Fund O.C.D. Fund Light Dist # 1 F.W.A. Fund_ 2,262.03 186.36 .08 94.83 32.65 7.32 Total $ 2,603.27 Cordingly, seconded by Newberry, that the bills be allowed and warrants drawn for same. Carried, all Councilmen present voting aye on roll -call. Councilmen absent: none. Raymond Hill present and entered a verbal protest on the store building under construction at 3rd and Highland Avenue. Mr. Hill claims the set back for neighborhood business zone is 10 feet and Mr. Graf is building within 2 feet of the property line: Other stores in neighborhood zones are set back 10 feet and protested that if setbacks are not observed and made uniform in the zone, residence property values will tend to decrease. City Engineer Ireland gave his interpretation of the section in the zoning ordinance pertAining to C-2 zones and stated that in his opinion the section does not apply as the site is not entirely surrounded by "R" residence districts and Mr. Graf was given a permit following his decision. City Attorney Ratelle declared that it is a close question and depends upon a factual interpretation and stated that he is of the opinion that Mr. Irelands interpretation is substantially correct. Discussion followed. Councilman Christman stated that he would like to have the City Attorney to look over the site. Councilman Christman so moved and seconded by Fritz, that City Attorney Retells look over the site under question and advise the Council what he thinks would be the outcome in court if the City should file an injunction and Mr. Graf should protest. Carried, all Councilmen present voting aye. Councilmen absent: none. '�" 631 ' Chas. Davies representing the Casa de Salud committee, requesting a definite lease from the City to the Casa as they are on a month to month basis and do not like to go ahead with any improvements under that agree meat. Mr. Davies stated that certain improvements are necessary to make a gymnasium on the second floor and that financial donations have been promised if the City will contribute $ 800 towards the cost. A new floor, plumbing and toilet facilities, remodeling and the building of a boxing ring are among the contemplated inprovements. He also stated that the gymnasium is just as valuable in the training program of pre -induction age boys as the Red Cross Water Safety program and that these recreational programs will help with the control of juveniles. Chief Bates verified this statement. Judge Ira Harbison also on the Casa committee requested the City Council for some definite assurance that the Casa will be allowed to continue.to use the building and that a committee be appointed from the City Council to work with the Casa committee. Moved'by Newberry, seconded by Christman, that inasmuch as we have no immediate use for the building, the City Attorney be instructed to prepare a two year lease and that a committee be appointed to work with theiCasa committee. Carried, all Councilmen present voting aye. Councilmen absent: none. Mayor Thatcher appointed the following committee: Chuncilman Newberry, chairman, Coumneilman Christman, Councilman Cordingly, Chief of Police Bates and City Attorney Ratelle. ✓D.J.Bates present regarding his petition for a permit to move his four car garage into National City which was referred to the Building Committee at the last meeting. The denial of the Building Committee read. Councilman Christman stated that the denial was on the basis that there is not enough ceiling height. Mr. Bates stated that he intends to correct that by raising the building. Mr. Christman stated t31 view of the new plan that the petition be referred back to the Building Committee. Moved by Newberry, seconded by Cordingly, that the petition be referred back to the Building Committee.for recondderation and that the City Council be bound by their decision. Carried, all Councilmen present voting aye. Councilmen absent: none. ✓Councilman Newberry requested a letter from the City Council to the draft board of City Attorney Ratelle requesting his deferrment as he is engaged on certain important matters for the City. Moved by Newberry, seconded by Cordingly, that the Mayor sign a letter from the City requesting his deferment. Carried, all nonneilien present voting ave. 632 Councilman absent: none. 'Moved by Cordingly, seconded by Fritz, that the following delinquent taxes be accepted without the seven percent interest and the cancellation fee: San Diego Wholesale Credit Men's Association the 1942 taxes on the W 51.05 feet of lots_16 and 17, block 2 of National Heights Subdivision, a Sec. 133, Nat'l Ro $ 39.5 J.H.Diaz the 1941 and 1942 taxes on lots 8, 9, 10 and the S 751 of lot 11, block 113, City Plat $ 40.43 Carried, all Councilmen present voting aye. Councilmen absent: none. 'A/Request of Chief Bates for the appointment of Forrest Lynn McDill as a probationary police officer as of Janurary 15, 1944 as Officer MaDill has worked since the date mentioned but has never been officially appointed on the regular force as a probationary officer. Moved by Newberry, seconded by Christmgn, that RESOLUTION NO. 2604 be adopted, appointing Officer MoD ll as a probationary officer as of January 15, 1944. Carried, all Councilman present voting aye on roll -call. Councilman absent: none. c:Request of Chief Bates for the appointment of Clyde Wilburn Yandell to the regular police force as of Match 15, 1944 at the monthly salary of $ 17O.as he has'cpmpleted his probationary period. Moved by Newberry, seconded by Cordingly, that RESOLUTION N0. 2605 be adopted, appointing Officer Mandell to the regular police force as of March 15, 1944 at the monthly salary of $ 170. Carried, all Councilmen present voting aye on roll -call. Councilmen absent; none. 4equest of E.E.Wiley, 1045 East 21st Street, City, for a license to operate a shoe repair shop at his home. Chief Bates reported that he bad denied him a license. Moved by Cordingly, seconded by Newberry, that the request be referred to the Planning Commission as it involves the matter of zones. Carried, all Councilmen present voting aye. Councilmen absent: none. 1KResolution of the War Recreation Committee of the City of National City, deeming it necessary to curtail operating costs of the building and reducing the number of personnel employed, also the reductions in hours per day worked by same employees due to the lack of Federal funds for the present operation and if and when additional funds are received this Committee will immediately do its best to set up a capable personnel for the operation of the Federal Recreation Building, read. Communication from the War Recreation Council requesting the City 633 to defray the Janitors salary for two months and submitting a check from the War Recreation Council in the amount of • 813.75 to help defray the personnel salaries and program expenses as approved by the War Recreation Committee, and agreeing that if and when Federal Funds under the Lanham Act are received, all money contributed or loaned by the City of National City and the War Redreation Council will be refunbd. Moved by Christman, Seconded by Cordingly, that RESOLUTION NO. 2606 b e adopted, pledging the City to assume the janitors salary for two months and accepting the check from the War Recreation Council in behalf of the Federal Building program. Carried, all Councilmen present voting aye on roll -call. Councilmen absent: none. `%Surety bond for deputy City treasurer and tax collector Elizabeth L. Tracy, approved as to form by the City Attorney, presented. Moved by Fritz, seconded by Christman, the bond be accepted and filed. Carried, ell Councilmen present voting aye. Councilmen absent: none. 0lanket fire insurance policies submitted by Agents- Scheuerman & Co., Dale Mann, Fred Miller, W.E.Flack and Walter H. Beideman, approved as to form by the City Attorney, presented. Moved by Christman, seconded by Fritz, that the policies be accepted and filed. Carried, all Councilman present voting aye. Councilmen absent: none. County of San Diego application to purchase tax deeded real property at public auction and request that auction be held on lots 13 to 19 inc., p^ and lot 21, block 109, City Plat... by Duilio Martinelli at $ 12 per lot, vet' submitted. Moved by Newberry, seconded by Cordingly, that RESOLUTION NO. 2607 be adopted, protesting the sale as this property is in the 100 foot drainage channel planned by the City for the area south of 18th street and west of National Avenue. Carried, all Councilmen present voting aye on roll call. Councilmen absent: none. Moved by Newberry, seconded by Christman, that the following transfer of funds be authorized: From the Unapp tax Fund to the General Fund $ 4,680.26 From the Unapp tax fund to the Library Fund 795.60 From the Unapp tax fund to the paxk M & I Fund 842.40 From the Unapp tax fund to the Sink Fund # 4 374.40 From the Unapp tax fund to the Sink Fund # 6 468.00 From the Unapp tax fund to the Sink Fund # 7 140.40 Carried, all Councilman present voting aye. Councilmen absent: none. /City Attorney Ratelle reqd a letter from the Attorney Generals office of the State of California, giving their interpretation of the 634 question as to what constitutes the 75% of the tidelands to be leased. . v6ity Attorney patelle recommended the cancellation of portion of 4 the taxes on the Schaeffer Plant as requested by Lands Division, Dept of 0 1 p.2b Justice. Moved by Newberry, seconded by Christman, that RESOLUTION NO. `/(2608 be adopted, authorizing the cancellation as requested. Carried, a 11 Councilmen present voting aye on roll -call. Councilmen absent: none. ✓city Attorney Retells reported that there is no actual decision on the ability of a city to levy a franchise tax on the operation of a bus comppny and several decisions in Court have goOe against cities. C.B.Ireland, City Engineer reported receiving a letter from the Federal Housing Authority regarding the connections with the sewer by private parties and that a contract as to be submitted. Councilman Fritz reported that Mr. Larson of the Paradise Valley Sanitarium has received approval of federal Hinds for the expansion of the hospital. This will increase the flow of sewage into the City lines about 20%, and they request permission to pump this additional sewage. City Engineer Ireland stated that the hospital is pumping septic sewage into the City lines causing destruction of lines and manholes. He stated �kr that when the laity first gave the Paradise Valley Sanitarium and Hospital permission to connect with the City system, no septic sewage was to be pumped. The County Health department has checked this condition and verified his statement. Mr. Ireland stated that he is opposed to the increase unless they stop pumping the septic sewage into the lines. Moved by Newberry, seconded by Fritz, that RESOLUTION NO. 2609 be adopted, ✓ authorizing the increase in sewage flow into the city lines providing they adhere to the provision that no septic sewage be pumped. Carried, all Councilman present voting aye on roll -call. Councilmen absent: none. '"Park Sup+t Gautereaux submitted for consideration the new schedule for admissions to the pool to comply with the federal regulations. Matter referred to the Park Committee. Park Sup't Gautereaux stated that the test sets for the pool were stolen and that new sets will have to be purchased but no% provisions were made for it in the budget. Moved by Fritz, seconded by Newberry, that Mr. Gautereaux be authorized to purchase a new set of testing equipment to cost $ 64.05. Carried, all Councilmen present voting aye. Councilmen absent none. Being no futher business, it was moved by Fritz, seconded by Cording 6S5 that the meeting adjourn. Carried, all Councilmen present voting aye. Councilmen absent: none.
