Councilmen present: Christman, Fritz, Newberry, Thatcher. Council men absent: Cordingly. Administrative officials present: Smith, Ratelle, Gautereaux, Finnerty, Knapp, Bird, Ireland and Lamb. Minutes of the regular meeting of October 5 and October 19, 1943, read and approved. Bills audited by the Finance Committee presented: General Fund $ 1,958.95 Street Imp Fund 98.97 Park M & I Fund 107.69 O.C.D. Fund 80.97 Unapp Tax Fund 61.44 Total $ 2,308.02 Moved by Fritz, seconded by Christman, that the bills be allowed and warrants drawn for same. Carried, all Councilmen present voting aye on roll Call. Councilmen absent: Cordingly. 'City Attorney Ratelle presented for reading an ordinance establishing a curfew law in National City. City Clerk Dale Smith read the ordinance in its entirety. Moved by Newberry, seconded by Christman, that the ordinance entitled " An Ordinance Establishing A Curfew in the City of National City and Prohibiting Children below the -age of 17 years to be upon the streets of the city bet%een certain hours, and prohibiting persons entitled to the care, custody, and -Control of such children from suffering said children to be upon the streets within said hours, and fixing a penalty for violation thereof" be introduced and laid over, under the rules and according to law. Carried, all Councilmen present voting ayeon roll -call. Councilmen absent: Cordingly. /Moved by Newberry, to rescind the ordinance presented for 1st reading at the last meeting regarding pinball machines and invite the Citizens Committee to sit in with the City Attorney in drafting a new ordinance which will meet the approval of a11. Rev. A. Watson Brown in behalf of the Citizens Committee and the Ministerial Assn accepted with appreciation the gesture of Councilmen Newberry and stated that the County Ordinance prohibit&ng pinball and marble machines is acceptable "to them that he suggested that it be substituted for the proposed City r 533 ordinance. Councilman Newberry withdrew his motion. Moved by Newberry, seconded by Fritz, that if the City Attorney has no objection to the County Ordinance, the said County Ordinance be adopted in its entirety. City Attorney Ratelle read eh: ordinance entitled " An ordinance prhhibiting the possession, use or operation of any pinball machine or marble machine or similar contrivance within the City of National City, California, prescribing the penalty for violation thereof and providing for the confiscation of such devices". Motion carried- all Councilmen present voting aye on roll -call. Councilmen absent: Cordingly. 'Rev. A. Watson Brown thanked the City Council in behalf of the Ministerial Assn. /Mr. Charles Hill thanked the City Council for their action in behalf of the Citizens Committee and pledged their support in the enforcement. `City Attorney Ratelle presented the sum of $ 1.00 as settle- ment of the condemnation suit =flit= ofi port3'on7 oft Harbor• Drive which was excluded from the Grant Deed to the United States Government. for the expansion of the Destroyer Base. Moved by Fritz, seconded by Newberry, that RESOLUTION NO. 2528 be adopted, authorizing the Mayor to sign the receipt and full satisfaction of judgement in Case No. 219 SD Civil. Carried, all Councilmen present voting aye on roll -call. Councilmen absent: Cordingly. City Attorney Ratelle stated that in the quiet title suit by Mr. Delbert Guy, a check for $ 50.00 has been deposited with the City Clerk by Mr. Guy and that the proper papers have been drawn for the stipulation if the Council will accept the amount deposited. Moved by Fritz, seconded by Christman, that RESOLUTION NO. 2529 be adopted, authorizing the City Attorney to sign the stipulation. Carried, all Councilmen present voting aye on roll -call. Councilmen absent: Cordingly II/City Attorney Ratelle submitted a resolution of acceptance of the agreement with the County of San Diego for the maintenance of certain City streets with the portion of the County Gas Tax money apportioned by the Board of Supervisors. Moved by Newberry, seconded by“ Fritz, that RESOLUTION NO. 2530 be adopted, accepting the provisions of the cooperative agreement as set forth in the resolution of the Board of Supervisors. Carried, all Councilmen present voting aye on 534 roll -call. Councilmen absent: Cordingly. Aity Attorney Ratelle reported that Edgar Levi will quit claim all land in his name in * Sec. 154, Nat'l Ro.. in exchange for the cancellation of tax liens on other holdings. Mr. Ratelle also reported that foreclosure dales have been started on the Levi property in * Sec. 154, Nat'l Ro. Moved by Fritz, seconded by Newberry, that the City Attorney be authorized to protest the foreclosure sales. Carried, all Councilmen present voting aye. Councilmen absent: Cordingly. Moved by Fritz, seconded by Christman, that RESOLUTION NO. 2531 be adopted, authorizing the City Attorney to -negotiate an option with the County on all tax -deeded properties in Nattongl City. Carried, all Councilmen present voting aye, on roll -call. Connors and Dr. H.S. Welch relative to an aigreement between the City and John F. 'sonnors and H.S. Welch as to the division of this ten feet in exchange for theicosts of the sidewalk and curb. Moved by Christman, seconded by Newberry, that the hearing be laid over until the records can be searched for the agreement. Carried, all Councilmen present v oting aye. Moved by Newberry, seconded by Fritz, that a letter be directed to Mr. H.G.Miller, p4stor,that two or three signs is the usual limit. Carried, all Councilmen present voting aye. Councilmen absent: Cordingly Communication from the San Diego Chamber of Commerce by A.G. Reader, Chairman, Postwar Planning Committee, requesting the name of the head of the postwar planning committee. Moved by Fritz, seconded by Newberry, that the Mayor appoint a postwar committee and that C.B. Ireland be the executive secretary. Carried, all Councilmen present voting aye. Councilmen absent: Cordingly. /Report of the Planning Commission recommending the granting of the petition of Mrs. Margaret Ledfor to operate a public cafe in her residence on lots 39 and 40, block 1, Flemings Sub; said permit to be for the duration of the war and require that she comply with all health board regulations; also recommending that the petition of Mr. Edward Ray Johnson to remodel present buildings and connect same with additional structure and operate as a grocery store on lots 1 to 4, block 1, Smith and Plantes Subd in 10 Acre Lot 2, a Sec. 152, read. Moved by Newberry, seconded by Fritz, that the report be accepted. Carried, all Councilmen present voting ave. Moved by Fritz, seconded by Newberry, that RESOLT]TION'NO. 2532 be adopted, authorizing the Mayor to sign the agreements in behalf of the City of National City. Carried, all Councilmen present voting aye on roll -call. Moved by Christman, seconded by Fritz, that RESOLUTION NO. 2533 be the proper officers to hold the sale. Carried, all Councilmen present voting aye.on roll -call. Councilmen absent: Cordingly. v Alcoholic Beverage License application for an on -sale beer license for the New Plantation Cafe, read. Chief of Police Knapp recommended a denial on the base of the high delinquency rate in that area and the increasing police problem. Mr. Davis protested the license on the request of the Director of the Casa de 8alud particularly in view of the resentment the cafe would cause among the young Mexicans and the possibility of the increase in the vandalism nd deliauency in that part of town. Rev. Royer stated that Mrs. Agee of the Casa de Salud who has worked so long with the young people in that area views with alarm the granting of the beer licesne to this cafe. Mr. Hill, spokesman for the Citizens Committee, stated that the buiness men in that district had requested him to protest the license. Moved by Christman, seconded by, Newberry, that the City protest the issuance of this license and authorize the Chief of Police to appear before the Board of Equalization in behalf of the protestants. Carried, all Councilmen present voting aye. Councilmen absent Cordingly. Recommendation of the Chief of Police that John Edward Owen be re-employed as a Sergeant of the Police and at a salary of $ 215. retroactive to the 1st of November, 1943, read. Moved by Newberry, seconded by Christman, that RESOLUTION NO. 2534 be adopted, employing j John Edward Owen as Sergeant of the Police at $ 200 per month with $ 15 per month additional as a motorcy6ie officer, retroactive to Nov 1, 1943 Carried, all Councilmen present voting aye on roll -call. Councilmen absent: Cordingly. { Annual Report of the Municipal Natatorium read. Moved by Newberry, seconded by Fritz, that this fine report he accepted, Carried, all Councilmen present voting aye. Tattersall. Moved by Christman, seconded by Newberry, that RESOLUTION NO. 2536 be adopted, authorizing the refund of $ 21.84 to Frank M. Tattersall and the cancellation of the erroneous assessment. Carried, all Councilmen present voting aye on roll -call. Councilmen absent: dordingly. `/ Communication from the Commandant, llth Naval District, San Diego regarding the closing of 4th, 5th and 6th Streets in National City in connection with the Destroyer Base, San Diego, California, enclosing five copies of a fora of contract covering payment for the closing and vacating of the streets and two copies of voucher. Moved by Christman, seconded by Fritz and Newberry, that RESOLUTION NO. 2537 be d §dopted, authorizing the Mayor to sign the contracts and voucher. Carried, all Councilmen present voting aye on roll -call. Councilmen absent: Cordingly. Request of the Division of Highways for the dedication as a City Street that portion of West 19th Streets extended upon the tide- lands. Matter referred to the City Attorney. 'Communication from the San Diego Public Safety Committee by Hal H. Hobson, secretary, commending the City Council on their action in ��abolising diagonal parking, read and ordered filed. "Request of the Department of Justice by C.H.Scharnikow, Special Attorney, for the proration of the current taxes on the Bahia Vista Subdivision, being Case No. 297, S.D.Civil. Moved by Newberry, seconded by Fritz, that RESOLUTION NO. 2538 be adopted, authorizing the proper officer to prorate the current taxes on the property covered by Case -No. 297-SD Civil. Carried,all Councilmen present voting aye on roll -call. Moved by Newberry, seconded by Christman, that the policies be accepted and the gemiums paid. Carried, all Councilmen present voting aye. Councilmen absentt Cordingly. 4oved by Newberry, seconded by Christman, thht a letter be directed to the Santa Fe Railway Company regarding the -moving of the depot at the foot of 23rd street and the opening of 23rd street. Councilman Newberry requested that a letter be directed to the Pacific Poa?tland Cement Company regarding the availability of the tide lands for a manufacturing site. Moved by Newberry, seiconded by Christman that the Mayor be authorized to sign such a letter. Carried, all Councilmen present voting aye. Councilmen absent: Cordingly.
