City Council expressed their opposition to the proposed mole pier inasmuch as the channel between the bulkhead line erE the south mole and the and of the pro posed ne),, mole was not sufficient to permit ingress and egress, thereby rendering inactive 1035 feet of water frontage. City proposed that 400 feet be cut off the end of the proposed mole pier. Moved by Christman, seconded by Cordingly, that the City Council grant a lease to the A.T.ac.S.F.Ry 423 Company according to the description of parcels no. 1 and no. 2, Atchison, Topeka and Santa Fe Ry Company frawing no. 88-23173 and eccordine to description of parcel no. 3 modified to terminate at Santa Be Engineers station 43 plus 50 and that said lease shall provide that the right of public use of said parcels for travel he reserved, said traveled way to be at least ten feet from the center line of track; also that said lease permit that area outside of lines parallel to and 25 feet on each side of described center lines bf said parcels no. 1, 2 and 3 may be sub -leased by approval of the City of National City or used by said City for public benefit and that any revenue derived from said sub -lease or leases shall be paid to the City of National City; also that the Mayor be autborizied to sign a letter to the United State: Enginners Office appro;ine, of the application by the A.T.&.S.F.Ry Co for mole pier es per application no. 47 providine the fill ends at Santa Fe Enr,ineers station 42 plus 50. City Attorney _Burch reported that in the natter of the quiet title proceeding with B.B.Margolis, the City has consenterT to the County sale 424 and therefore he ✓✓oul_i recommend that the City Attorney be given the authooity to consent to settle. ;moved by Newberry, seconded by Christma: that the City Attorney be authorized to give a consent to settle the quiet title suit with ?.B.tlargolis.
