ROLL CALL Council / Board members present: Cano, Morrison, Natividad, Rios, Sotelo-Solis. Administrative Officials present: Dalla, Deese, Duong, Parra, Raulston, Rodriguez, Silva, Stevenson, Vergara, Ybarra, Williams. Others present: Student Representative Kane Gillego. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING THE REALLOCATION OF $70,000 IN COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS TO THE FY 2013-2014 CDBG PROJECT TITLED GEORGE H. WATERS NUTRITION CENTER PROGRAM TO COMPLETE THE INSTALLATION OF A WALK-IN REFRIGERATOR UNIT AND REPAIRS TO THE HEATING, VENTILATION, AND AIR CONDITIONING SYSTEM. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING A QUALITY ASSURANCE PROGRAM (QAP) THAT PROVIDES SAMPLING AND TESTING PROCEDURES TO ENSURE THAT MATERIALS INCORPORATED INTO CONSTRUCTION PROJECTS ARE IN CONFORMANCE WITH THE CONTRACT SPECIFICATIONS AND CALTRANS REQUIREMENTS FOR FEDERAL -AID PROJECTS. (Engineering) ACTION: Adopted. See above. WARRANT REGISTER JULY 2013 — JUNE 2014 (202-1-28) 9. Warrant Register #25 for the period of 12/11/13 through 12/17/13 in the amount of $1,620,610.73. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING A CONDITIONAL USE PERMIT FOR ALCOHOL SALES AT REDBIRD MARKET LOCATED AT 2035 HIGHLAND AVENUE. (Applicant: Laith Arabo) (Case File 2013-18 CUP) (Planning) RECOMMENDATION: Adopt the Resolution. TESTIMONY: None. ACTION: Motion by Sotelo-Solis, seconded by Morrison, to adopt the Resolution. Motion by Natividad, seconded by Cano, to amend the motion to change the conditions of approval to permit the sale of beer and wine from 8 am to 10 pm Sunday through Friday and from 8 pm to 11 pm on Saturday. Amendment carried by the following vote, to - wit: Ayes: Cano, Morrison, Natividad. Nays: Rios, Sotelo-Solis. Absent: None. Abstain: None. The original motion by Sotelo-Solis, seconded by Morrison, to adopt the Resolution including appropriate new language incorporating the amendment failed by the following vote, to -wit: Ayes: Morrison, Cano. Nays: Natividad, Rios, Sotelo-Solis. Absent: None. Abstain: None. At the conclusion of the vote, it was determined that a voting error occurred. Mayor Morrison directed that the board be cleared and members re -vote. The original motion carried by the following vote, to -wit: Ayes: Cano, Morrison, Natividad. Nays: Rios, Sotelo-Solis. Absent: None. Abstain: None. FINANCIAL MANAGEMENT 2013 — 2014 (204-1-29) 13. Resolution No. 2014-15. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE APPROPRIATION AND CORRESPONDING REVENUE INCREASE OF $1,000,000 FOR THE PURPOSE OF ENVIRONMENTAL REMEDIATION WORK ON THE WESTSIDE IN -FILL TRANSIT ORIENTED DEVELOPMENT PROJECT SITE. (Engineering) RECOMMENDATION: Adopt the Resolution. TESTIMONY: None. ACTION: Motion by Natividad, seconded by Sotelo-Solis, to adopt the Resolution. Carried by unanimous vote. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, 1) AWARDING A CONTRACT IN THE NOT TO EXCEED AMOUNT OF $858,609.00 TO CLAUSS CONSTRUCTION FOR THE 2020 AND 2100 HOOVER AVENUE REMEDIATION AND SITE DEMOLITION PROJECT. SPECIFICATION NO. 13-01; 2) AUTHORIZING A 25% CONTINGENCY IN THE AMOUNT $214,652.25 FOR ANY UNFORESEEN CHANGES; AND 3) AUTHORIZING THE MAYOR TO EXECUTE THE CONTRACT. NEW BUSINESS CONDITIONAL USE PERMITS 2014 (403-29-1) 15. Notice of Decision — Planning Commission approval of a Conditional Use Permit for the sale of beer and wine for off -site consumption at an existing market (El Super Market) located at 1811 "L" Avenue. (Applicant: Rodel Chalabi) (Case File 2013-27 CUP) (Planning) RECOMMENDATION: Staff concurs with the decision of the Planning Commission and recommends that the Notice of Decision be filed. TESTIMONY: None. ACTION: Motion by Rios, seconded by Sotelo-Solis, to set for Public Hearing on March 4th. Carried by unanimous vote. CONDITIONAL USE PERMITS 2014 (403-29-1) 16. Notice of Decision — Planning Commission approval of a Conditional Use Permit for a Wireless Communications Facility located at 2415 East 18th Street. (Applicant: Verizon Wireless) (Case File 2013-26 CUP) Planning) RECOMMENDATION: Staff concurs with the decision of the Planning Commission and recommends that the Notice of Decision be filed. Response to the December 3, 2013 direction by the City Council to bring forward recommendations related to the facilitation of a City Council Retreat, including possible dates and format. (Administrative Services) RECOMMENDATION: Provide direction to Staff. TESTIMONY: None. ACTION: Motion by Rios, seconded by Natividad, to move forward with Gary Winter and staff to come back with snapshot of events and possible meeting dates from now through summer. ACTION: Motion by Sotelo-Solis, seconded by Rios, to accept and file. Carried by the following vote, to -wit: Ayes: Morrison, Cano, Rios, Sotelo-Solis. Nays: None. Absent: Natividad. Abstain: None. (Finance) MAYOR AND CITY COUNCIL CITY COUNCIL ADMIN (102-16-1) 21. Discussion of a Safe Ongoing Prescription Drug Drop Off site which would allow residents to dispose of household prescription medications at a location for quick and convenient use. Vice Mayor Natividad invited everyone to attend the Affordable Care Act Town Hall Meeting to be held at MLK on February 22, 2014. Council Member Rios reminded everyone that Sweetwater High is having their Annual Career Fair on February 28th and requested staff provide any materials that would be helpful for the event. Mayor Morrison gave an update on the Annual SANDAG Retreat; provided a $1,000 check to the City Manager from the Regional Solid Waste Association to be used for environmental education; reported on his participation on the recruitment committee for the Executive Director of the National Congress of Cities and urged everyone to visit the newly remodeled Big Ben Market. CLOSED SESSION REPORT City Attorney Claudia Silva stated there was nothing to report from the Closed Session for the City Council, Successor Agency or Parking Authority. (See attached Exhibit `L') ADJOURNMENT Motion by Sotelo-Solis, seconded by Rios, to adiourn the meeting to the next Regular Meeting of the City Council and Community Development Commission — Housinq Authority of the City of National City to be held Tuesday, February 18, 2014 at 6:00 p.m. at the Council Chambers, National City, California.
