ROLL CALL Council / Board members present: Cano, Mendivil, Morrison, Rios, Sotelo-Solis. Administrative Officials present: Dalla, Deese, Duong, Manganiello, Parra, Raulston, Roberts, Rodriguez, Silva, Stevenson, Vergara, Williams, Ybarra. Others present: City Treasurer Mitch Beauchamp. PLEDGE OF ALLEGIANCE TO THE FLAG BY MAYOR RON MORRISON PUBLIC COMMENTS Sunshine Horton, El Cajon, said she was tired of hearing of all the violence in the world and shared several quotations from Mother Teresa on the topic of love. CITY COUNCIL AWARDS AND RECOGNITIONS COUNCIL MEETING PRESENTATIONS / AWARDS & RECOGNITIONS 2015 (102-10-10) 1. Women in Transportation Society (WTS) San Diego Chapter 2015 Innovative Transportation Solutions Award: Alternative Modes and Active Transportation National City Community Corridors Project — Jennifer Koopman, Kimley-Horn and Associates. (Engineering/Public Works) TESTIMONY: Jennifer Koopman from WTS presented the award, congratulated the City and noted that only one such award is given each year and that National City was actually nominated for two projects which is testimony to the great work the City is doing. Interviews and Appointments: Various Boards and Commissions. (City Clerk) Julio Munoz was interviewed for the Community and Police Relations Commission. ACTION: Ballots were distributed to Council Members to fill the expiring term on the Civil Service Commission. City Clerk Dalla tallied the results and reported that Rafael Courtney received four votes (Cano, Mendivil, Rios and Sotelo-Solis) and John Bailey received one (Morrison). Rafael Courtney was considered duly re- appointed to a full term on the Civil Service Commission. Mayor Morrison nominated John Bailey and Julio Munoz for appointment to the Community and Police Relations Commission. A request was made to take each appointment separately. Motion by Morrison, seconded by Cano, to appoint John Bailey to the Community and Police Relations Commission. Carried by the following vote, to -wit: Ayes: Cano, Mendivil, Morrison. Carried by unanimous vote. Motion by Morrison, seconded by Sotelo-Solis, to re -appoint Katherine Wesner to the Parks, Recreation and Senior Citizens Advisory Board. Carried by unanimous vote. Motion by Morrison, seconded by Sotelo-Solis, to re -appoint Cheryl Colmenero and Gonzalo Quintero to the Traffic Safety Committee. Carried by unanimous vote. Motion by Morrison, seconded by Sotelo-Solis, to re -appoint Gloria Bird to the Library Board of Trustees. Carried by unanimous vote. CONSENT CALENDAR ADOPTION OF CONSENT CALENDAR. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, 1) ACCEPTING THE IMPROVEMENTS COMPLETED FOR THE SWEETWATER BIKEWAY PLAZA BONITA SEGMENT LOCATED ON THE WESTERLY SIDE OF PLAZA BONITA ROAD WITHIN THE CITY OF NATIONAL CITY; AND 2) AUTHORIZING THE MAYOR TO EXECUTE A MEMORANDUM OF UNDERSTANDING BETWEEN SAN DIEGO ASSOCIATION OF GOVERNMENTS (SANDAG) AND THE CITY OF NATIONAL CITY REGARDING MAINTENANCE OF THE SWEETWATER BIKEWAY PLAZA BONITA SEGMENT WITHIN THE CITY OF NATIONAL CITY. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A SUBORDINATION AGREEMENT WITH T&T COMMUNITY PROPERTIES, LLC, A CALIFORNIA LIMITED LIABILITY COMPANY, SUBORDINATING THE DEED OF TRUST THAT SECURES A HOME INVESTMENT PARTNERSHIP PROGRAM LOAN FOR $717,500 ON EIGHT RESTRICTED RENTAL UNITS LOCATED AT 138 NORTON AVENUE IN NATIONAL CITY FOR THE PURPOSE OF REFINANCING EXISTING DEBT. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY: 1) ACCEPTING THE WORK OF CLAUSS CONSTRUCTION FOR THE 2020 AND 2100 HOOVER AVENUE REMEDIATION AND SITE DEMOLITION PROJECT, SPECIFICATION NO. 13-01, 2) AUTHORIZING AN INCREASE OF $19,044.04 IN THE CONTRACT AMOUNT FOR CONSTRUCTION CHANGE ORDERS; 3) APPROVING THE FINAL CONTRACT AMOUNT OF $1,937,305.30, 4) AUTHORIZING THE RELEASE OF RETENTION IN THE AMOUNT OF $66,238.71, AND 5) AUTHORIZING THE MAYOR TO SIGN THE NOTICE OF COMPLETION FOR THE PROJECT. NEW BUSINESS CONDITIONAL USE PERMITS 2015 (403-30-1) 17. Notice of Decision — Planning Commission approval of a Conditional Use Permit for a Wireless Communications Facility to be located at 116 National City Blvd. (Applicant: PlanCom, Inc. for Verizon Wireless) (Case File 2015-15 CUP) (Planning) RECOMMENDATION: Staff concurs with the decision of the Planning Commission and recommends that the Notice of Decision be filed. TESTIMONY: None. ACTION: Motion by Cano, seconded by Mendivil, to set for a Public Hearing. Carried by unanimous vote. TEMPORARY USE PERMITS 2015 (203-1-31) 18. Temporary Use Permit — Pilipino History Day sponsored by National City Historical Society at Heritage Square, 900 Block of "A" Avenue on October 24, 2015 from 11 a.m. to 6 p.m. with a request of waiver of fees. (Neighborhood Services) RECOMMENDATION: Approve the Application for a Temporary Use Permit subject to compliance with all conditions of approval with no waiver of fees. TESTIMONY: Janice Martinelli, National City, responded to questions. ACTION: Motion by Sotelo-Solis, seconded by Mendivil, to approve staff recommendation. Carried by unanimous vote. Book 97 / Page 168 10-06-2015 COMMUNITY DEVELOPMENT COMMISSION — HOUSING AUTHORITY OF THE CITY OF NATIONAL CITY NEW BUSINESS — HOUSING AUTHORITY HOUSING AUTHORITY 2015 (404-1-4) 19. Presentation requesting further direction from the Community Development Commission -Housing Authority of the City of National City's Board of Commissioners on entering into an Exclusive Negotiating Agreement with La Maestra Community Health Centers for the development of a Housing Authority -owned 1.47 acre property located between Eta Street and Bucky Lane on Highland Avenue in National City. (Housing, Grants, & Asset Management) (Copy on file in the Office of the City Clerk) RECOMMENDATION: Provide direction on the disposition and development of the Housing Authority -owned property located between Eta Street and Bucky Lance on Highland Avenue also known as the Purple Cow. TESTIMONY: Dan Munoz, the applicant, spoke in support and responded to questions. ACTION: Motion by Rios, seconded by Cano, to move ahead and bring back an Exclusive Negotiating Agreement (ENA) for Commission review. Carried by unanimous vote. Page 169 10-06-2015 MAYOR AND CITY COUNCIL City Treasurer Mitch Beauchamp reported on the recent Economic Development Summit (EDC) he attended and expressed concerns about the future impact to the City of sea level rise. Member Mendivil said that quality of life is a big issue for him and he believes that business have a responsibility to enhance the appearance of their businesses. Member Sotelo-Solis was pleased to see the OpenGov application and suggested working with students to create a YouTube video to assist people using the new sand bagger machine and provide emergency information. Member Rios praised the promotion ceremony at the Police Department, encouraged efforts to work more to encourage and retain Board and Commission members and improve the appointment process, said she hoped to receive information on what the Council can consider when reviewing cell tower applications and presented the "Beacon Spot Light Award for Best Practices" that was awarded to the City by the League of California Cities and an Appreciation Certificate from the Relay For Life Committee. Vice Mayor Cano thanked the committee that put on the recent Employee Picnic for doing an excellent job. Mayor Morrison presented a check to the City Manager from the Regional Solid Waste Association in the amount of $22,650 to be deposited into the Trash Enterprise fund. Members retired into Closed Session at 9:42 p.m. The meeting reconvened at 10:22 p.m. Members present: Cano, Mendivil, Morrison, Rios, Sotelo-Solis. CLOSED SESSION REPORT City Attorney Claudia Silva stated there was nothing to report from the Closed Session.
