ROLL CALL Council / Board members present: Cano, Mendivil, Morrison, Rios, Sotelo-Solis. Administrative Officials present: Dalla, Deese, Duong, Manganiello, Morris -Jones, Parra, Raulston, Roberts, Rodriguez, Stevenson, Vergara, Williams. Others present: City Treasurer Mitch Beauchamp. PLEDGE OF ALLEGIANCE TO THE FLAG BY MAYOR RON MORRISON PUBLIC COMMENTS Jose Estrada, former Student City Council Representative, expressed thanks and appreciation to the City Council and staff for the opportunity to serve and for continuing the Student Council Representative Program and to AT&T for funding and the Mayor for helping to arrange for the laptop he received at the conclusion of his service. CITY COUNCIL CONSENT CALENDAR ADOPTION OF CONSENT CALENDAR. Item No. 2 (NCMC), Item No. 3 (Minutes), Item No. 4 (Resolution No. 2018-1), Item Nos. 5 through 7 (Warrant Registers), Item No. 8 (Temporary Use Permit). (City Clerk) ACTION: Approved. See above. ENCROACHMENT AGREEMENT ADMIN 2016 — 2020 (903-14-10) 4. Resolution No. 2018-1. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING AND AUTHORIZING THE MAYOR TO SIGN AN ENCROACHMENT PERMIT AGREEMENT WITH KD 31ST, LLC, TO CONSTRUCT FIVE BIO-FILTRATION PLANTERS WITHIN PUBLIC RIGHT-OF-WAY FOR THE FUTURE MARINERS LANDING APARTMENT BUILDING LOCATED ON EAST 31ST STREET (APN 562-252-09 THRU 562-252-12). Temporary Use Permit Circus Vargas event sponsored by Circus Vargas from February 8, 2018 to February 19, 2018 at the Westfield Plaza Bonita Mall with no waiver of fees. (Neighborhood Services) ACTION: Approved. See above. NON CONSENT RESOLUTIONS CONTRACT (C2018-1) CITY - OWNED LAND / SALE - LEASE (1001-1-1) 9. Resolution No. 2018-2. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY MANAGER TO EXECUTE A REAL PROPERTY PURCHASE AND SALE AGREEMENT AND JOINT ESCROW INSTRUCTIONS FOR THE SALE OF PROPERTY LOCATED AT 130 EAST 8TH STREET IN NATIONAL CITY TO PROTEA NATIONAL CITY, LLC. (Housing & Economic Development) RECOMMENDATION: Adopt the Resolution. TESTIMONY: Andrew Malik, the applicant, was present and spoke in favor. ACTION: Motion by Sotelo-Solis, seconded by Cano, to adopt the Resolution. Carried by unanimous vote. CITY ATTORNEY REPORTS (509-1-3) 10. Resolution No. 2018-3. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AND AUTHORIZING THE ISSUANCE OF A WRITTEN REPORT PERTAINING TO A MORATORIUM ORDINANCE PROHIBITING THE ISSUANCE OF MASSAGE TECHNICIAN PERMITS OR LICENSES FOR A PERIOD OF 10 MONTHS AND 15 DAYS, AND PROHIBITING NEW MASSAGE ESTABLISHMENTS FROM LOCATING WITHIN NATIONAL CITY FOR A PERIOD OF 10 MONTHS AND 15 DAYS. (City Attorney) RECOMMENDATION: Adopt the Resolution and provide issuance of report. TESTIMONY: None. ACTION: Motion by Sotelo-Solis, seconded by Mendivil, to adopt the Resolution. Carried by unanimous vote. COUNCIL POLICY ADMIN (102-13-1) 11. Resolution No. 2018-4. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING CITY COUNCIL POLICY # 802, "CITY SUPPORT FOR SPECIAL EVENTS, ACTIVITIES, PROGRAMS AND SERVICES," 1) ADDING THE REQUIREMENT THAT DOCUMENTATION BE PROVIDED FOR ALLOWABLE INCURRED EXPENSES RELATED TO A SPECIAL EVENT, PROGRAM, SERVICE, OR ACTIVITY RECEIVING FUNDING SUPPORT FROM THE CITY; 2) ADDING CLARIFYING LANGUAGE REGARDING DEPOSITS REMITTED IN RELATION TO Book 100 / Page 5 01-16-2018 NON CONSENT RESOLUTIONS (cont.) SPECIAL EVENTS OF A COMMERCIAL NATURE; 3) ADDING THREE ORGANIZATIONS TO NATIONAL CITY CO -SPONSORED EVENTS; 4) REMOVING NATIONAL CITY PUBLIC SAFETY FAIR FROM SPONSORED EVENTS; AND 5) CORRECTING TYPOGRAPHICAL ERRORS. (Finance) RECOMMENDATION: Adopt the Resolution. TESTIMONY: None. ACTION: Motion by Mendivil, seconded by Sotelo-Solis, to adopt the Resolution. Carried by unanimous vote. NEW BUSINESS FINANCE DEPT ADMIN (1104-1-13) 12. Scheduling of City Council workshops related to the discussion and preparation of the City of National City's annual budget for Fiscal Year 2019. (Finance) RECOMMENDATION: Approve staff's recommended Budget Workshop and adoption dates. TESTIMONY: None. ACTION: Motion by Rios, seconded by Sotelo-Solis, to approve Staff Recommendation. Carried by unanimous vote. C. REPORTS STAFF REPORTS — None. MAYOR AND CITY COUNCIL City Treasurer Mitch Beauchamp offered cautionary comments about the City's pension liability and reported that palm trees in the City are being attacked by an invasive beetle. Member Mendivil expressed pleasure about the effort and outcome for City Council Policy 802 which was adopted earlier in the meeting; expressed concerns about homelessness and the challenge it poses for the City and suggested the City consider the possibility of providing restroom facilities for the homeless. Member Sotelo-Solis expressed appreciation to staff members who were out working during the recent storms commended National City Port Commissioner Dukie Valderrama for his service as Port Chairman and stated her intent to request a workshop on Affordable Housing. ACTION: Motion by Sotelo-Solis, seconded by Mendivil, to have Staff return with dates/options for workshop on affordable housing/housing needs. Carried by unanimous vote. Book 100 / Page 6 01-16-2018 MAYOR AND CITY COUNCIL (cont.) Member Rios reported on the delivery dates for the new green waste containers, applauded the upcoming workshop on Affordable Housing and echoed the positive comments and recognition of Port Commissioner Dukie Valderrama. Member Cano applauded all the many projects and improvements underway throughout the City and inquired about the water leak repair work done by Sweetwater Authority. Mayor Morrison commented on the many events that took place during the holidays, complimented City Public Works staff for their efforts during the recent major storms and spoke of the tragic death of a longshoreman from National City and the public outpouring of support for him. CLOSED SESSION REPORT City Attorney Angil Morris -Jones reported that; in the matter of Mendoza vs the City of National City, staff received direction and authority by unanimous vote. (See attached Exhibit 'L') .
