ROLL CALL Council / Board members present: Cano, Mendivil, Morrison, Rios, Sotelo-Solis. Administrative Officials present: Dalla, Deese, Denham, Duong, Manganiello, Morris -Jones, Parra, Raulston, Roberts, Rodriguez, Stevenson, Vergara, Williams, Ybarra. Others present: City Treasurer Mitch Beauchamp and Student Representative Erika Gastelum. PLEDGE OF ALLEGIANCE TO THE FLAG BY MAYOR RON MORRISON PUBLIC COMMENTS Samiya Kaddory, owner of California Produce, complimented the City for the many positive changes that have occurred during the 28 years they have been in business and offered her appreciation and thanks to the City Council, Police, Fire, and other City Departments for their service. Brian Clapper, Tracey Bristow and Charmaine Lawson, National City, represented Palmer Way preschool extended an invitation to the City and community to participate in a nacho sale fundraiser on February 17th in partnership with Wrigley's Supermarket to raise funds for a preschool field trip. Sunshine Horton, National City, wanted to remind everyone to give more of themselves for others and spread cheer amidst all of the negativity and violence going on. Bert Andrade, National City, shared the news of a close friend who passed away and shared history of their service during the Korean War. TESTIMONY: Sandy Naranjo, National City, policy advocate for the Environmental Health Coalition (EHC) spoke in opposition. ACTION: Motion by Cano, seconded by Morrison, to file the Notice of Decision. Carried by unanimous vote. FINANCE DEPT ADMIN (1104-1-13) 27. Request for Direction regarding City Council priorities for the City of National City's Fiscal Year 2019 Budget. (Finance) TESTIMONY: Coyote Moon, National City, urged a study of the financial benefits of allowing cannabis business in the City. Sandy Naranja National City, policy advocate for the Environmental Health Coalition (EHC), spoke of the need to collaborate with residents on issues of public health, amortization of businesses, open space and affordable housing. ACTION: Members Rios, Sotelo-Solis and Mendivil supported the identified Staff and City Council priorities and highlighted numerous individual areas of concern and emphasis. Mayor Morrison said what was presented was a good starting point but the number one priority should be Fiscal Sustainability. There was no vote taken. CITY MANAGER / REPORTS ADMIN (1104-1-12) 28. Staff Report and Request for Direction on Scope of a Proposed Special Meeting of the City Council on March 26, 2018 at 4:00 p.m. on Housing. (City Manager) Book 100 / Page 16 02-06-2018 NEW BUSINESS (cont.) CITY MANAGER / REPORTS ADMIN (1104-1-12) 28. Staff Report and Request for Direction (continued) RECOMMENDATION: Set the date of the Proposed Special Meeting. Staff is seeking direction to refine the scope of the workshop so the workload is manageable and outcomes are useful to National City. TESTIMONY: Jose Rodriguez, Organizer for the San Diego Organizing Project and National City resident, identified some State-wide housing solutions and highlighted various housing needs and strategies ACTION: Motion by Sotelo-Solis, seconded by Cano, for staff to bring back information on rent stabilization, inclusionary zoning and accessory dwelling units, both pros and cons, provide a definition of affordable housing, and have formal presentations by the San Diego Housing Commission and the Center for Policy Initiatives. Member Cano withdrew his second. Member Rios seconded the motion. Motion failed by the following vote, to -wit. Ayes: Rios, Sotelo-Solis. Nays: Cano, Mendivil, Morrison. Absent: None. Abstain: None. Motion by Morrison, seconded by Mendivil, to have staff come back with a report also bring the San Diego Housing Commission for a formal presentation and leave it open for advocacy groups to make their input as part of the meeting. REPORTS STAFF REPORTS CITY MANAGER / REPORTS ADMIN (1104-1-12) POLICE DEPT ADMIN (302-4-1) 29. Police Executive Research Forum -"The Police Response to Homelessness". (City Manager/Police) REPORT: City Manager Leslie Deese and Police Chief Manuel Rodriguez reported on some of the key take aways from the National Conference Forum on homelessness which they attended: • 25% of the nation's homeless are in California. • Any city with a riverbed has homeless encampments. • Homelessness is not just a police problem, it needs a multi -disciplinary or outreach team approach. • Since every homeless situation is different, it is important to have representatives from Police, Public Works, Code, Mental Health and Social Services. • It must be a regional approach. • The County is responsible for Mental Health and Social Services and must be part of the equation. Police Executive Research Forum (continued) • Not enough case managers, mental health and social workers to handle the case load. • Can't rely on Police alone. • There must be a balance between enforcement and compassion. Taking people who live on the street to jail simply won't solve the problem. You are not going to arrest your way out of homelessness. • Community Partnerships are essential. • There must be political will and support to tackle the problem to be successful. MAYOR AND CITY COUNCIL Member Mendivil related his experience dealing with a homeless situation at a local business and said it was important that the City prioritize situations for enforcement. Member Sotelo-Solis commented on the Regional Outreach Task Force on Homelessness and encouraged attendance at the upcoming budget sessions. Member Rios shared her perspective on the importance of tackling the homeless issue, acknowledged a local businessman who complimented the professionalism of City Building Official Luis Sainz and reported on her selection as Vice Chair of the Metropolitan Transit System (MTS) Board and provided an update on MTS activities. Member Cano gave kudos to various departments for their work on graffiti, parking enforcement, motorhome abatement and traffic enforcement and congratulated Robert Garcia, outgoing Chairperson of the Planning Commission, and incoming Chair Ditas Yamane. Member Cano referenced a previous City Council meeting and read the following statement into the record: "I would like to redress the matter regarding Mundo Gardens requesting continue to use City owned land I might have had limited information about this matter during the time that we were considering the situation. But after listening to my staff report the last meetings where they inform us that years they were aware of this illegal use, apparently had done nothing to stop it and thereby allowing our City to be exposed to possible liability. Therefore, I am believe that we have done disservice to our City. Although the intent of this garden may have been in good faith, I'm asking the City Attorney to investigate the level and the levels of responsibility, accountability, of those that ignore the matter and for not making the necessary corrections as soon as they were aware of the violations. I want to make that on record, because like I said, I was targeted and a lot of people said, `Jerry, you don't know where this park is at'? And to this day I want clarification, does this park belong to us or they're using our land? So whoever knew about it, I want some accountability from Book 100 / Page 18 02-06-2018 MAYOR AND CITY COUNCIL (cont.) our City Attorney. You're new to us but you're gonna find out a lot of good stuff and I need a report back on this matter. Thank you." Member Cano inquired of the City Attorney if it was necessary for him to make his request in the form of a motion. City Attorney Morris -Jones responded that it was sufficient for him to request a report. Mayor Morrison indicated that he had two items he would like to have included on future agendas. Motion by Morrison to propose that a Contractor Responsibility Ordinance be put on the next agenda. Upon further clarification and discussion, the motion was clarified to be: A proposed Contractor Responsibility Ordinance would be provided to staff for review and report to be placed on the agenda when determined to be appropriate. The motion, as clarified, was seconded by Mendivil. Motion carried by the following vote, to -wit. Ayes: Cano, Mendivil, Morrison, Rios. Nays: Sotelo- Solis. Absent: None. Abstain: None. Motion by Morrison, seconded by Cano, to have staff review and bring back an updated Historic Housing Survey on a future agenda. Carried by unanimous vote. City Clerk Michael Dalla expressed his concerns over the Council digressing when it comes to properly making and discussing motions, which are often confusing, lengthy and hard to understand, as well as maintaining proper order and decorum. Mr. Dalla reminded the Council on the importance of following Rosenberg's Rules of Order, which was previously adopted by the Council. CLOSED SESSION REPORT There was nothing to report.
