PUBLIC COMMENT Mayor Sotelo-Solis summarized the process for acceptance of live public comment allowing three (3) minutes per comment and introduced City Clerk Molina. Councilmember Morrison left the dais at 7:23 p.m. and returned at 7:25 .m. 2 .2 Presentation - Artist Francisco Morales ARTS Executive Director James Halliday introduced Francisco Morales who detailed the artist rendering and new interior design of Council Chamber, 6. REGIONAL BOARDSANDCOMMITTEE REPORTS (Limited to Five (5) Minutes each) Part of San Diego Commissioner Sandy Naranjo provided an updated report. 7. CONSENT CALENDAR Mayor S t l -Solis requested to pull Item 7.9 and Vice -Mayor Bush requested to pull Item 7.11. W.rgb!k.Comment received and read into the record b Cit Clerk Molina: Ted Godshalk (Item 7.5), and Ronald Attiq (Item 7,9) ACTION: Motion by Councilmember Rios, seconded by Councilmember Morrison, to approve the Consent Calendar Items 7.1 through 7.19, with item 7.9 pulled for discussion by Mayor S t l -Solis and Item 7.11 pulled for discussion by Vice - Mayor Bush. Motion passed by 5-0 vote. 7.1 Approval of Reading by Title Only and Waiver of Reading in Full of Ordinance on this Agenda ,2 Approval of City Council Meeting Minutes .3 Adopted Resolution 1 . 2022-120 Authorizing the Mayor to Approve the Agreement with Chandler Asset Management, Inc. for Investment Management and Investment Advisory Services. 7.4 Adopted Resolution No. 2022-121 Cal o y to SB 1383 Grant — Funds Appropriation 7.5 Adopted Resolution No. 2 22- 22 Acceptance of Ocean Protection Council Proposition 1 Grant, Authorizing City Manager to Execute Grant Agreement, and Establish Grant Fund Appropriation. 7.6 Adopted Resolution No. 2022-123 Devaney Pate Morris Cameron, LLP 1st Amendment to the Agreement 7.7 Pedestrian Safety Enhancements Project PS No. Z44 Adopted Resolution No. 2022-124 entitled, Resolution lution f the City Council of the City of National City, California, authorizing the Mayor 3 to 1 Execute the State -Aid Master Agreement; and 2 Execute Program Supplement Agreement PS No. Z44 with the State of California Department ent of Transportation (Caltrans) for the Pedestrian Safety Enhancements Project to allow for reimbursement of up to $60,000 in Eligible Project Expenditures through the Highway Safety Improvement Program (HSIP); and 3 authorizing the establishment of an Engineering Grants Fund Appropriation of $60,000 and Corresponding Revenue Budget.'} 7.8 Rescinding and Replacing City Council Resolution No. 2022-78, and revising S I Road Maintenance and Rehabilitation account Projects and Appropriations. Adopted Resolution No. 2022-125 entitled, "Resolution olution of the City Council of the City of National City, California, Rescinding and Replacing Resolution No. 2022-78, adopted on May 17, 2022, to include the schedule and estimated useful life of each of the projects previously approved by said resolution and as required by Caltrans." 7.9 7.10 7,1 7.12 item pulled for discussion. ITEMS PULLED FROM CONSENT CALENDAR 7,9 Notice of Decision — Planning Commission Approval of a Conditional Use Permit for the Operation of a Tobacco Specialty Business located at 120 National City Blvd. (Case File No,: 2022-14 CUP) ACTION: Motion by Mayor S t l-Solis, seconded by Councilmember Rios, to continue this item to future public hearing. Motion passed by 5-0 vote. 7.11 Adopted Resolution No. 2022-127 F 2 21 UASI Grant ACTION: Motion by Vice -Mayor Bush, seconded by Councilmember Rodriguez to approvestaffsrecommendation with an amendment that staff present the item to the Community Police & Relations Commission prior to returning tthe City Cnil for the Commission to review items related to weapons, surveillance technologies and military grade equipment. STAFF REPORTS 8.1 Public Meeting Protocols — In -Person and Teleconference Meetings City Manager Brad Raulston presented the item. One written comment received from Ted Godshalk. ACTION: Motion by Vice -Mayor Bush, seconded by Councilmember Rios for staff to return at the August 16, 2022, City Council meeting with protocol for a hybrid meeting model for virtual meeting participation by C un ilm mb rs. Substitute Motion by Mayor r S t l-Solis, seconded by Councilmember Morrison for Council meetings to occur solely in - person or via Zoom with no hybrid model and the continued reading of AB361. 5 Ayes: S t l -Solis Nays: Bush, Morrison, Rios, Rodriguez Motion failed by 1-4 vote Vote on original motion. Motion passed by 5-0 vote. .2 Accept the Certification of Sufficiency of Initiative Petition Entitled, "National City Special Parcel Tax for Streets and Parks." Motion by Mayor S t l -Solis, seconded by Councilmember Rios to approve Option No. 3 of the staff report request staff to return with a report pursuant to Elections Code Section 9212 on options 1-8 in no more than 30 days. Substitution Motion by Councilmember Rodriguez, seconded by Vice -Mayor Bush to approve Option No, 2 of the staff report and submit the Initiative Measure, without alteration, to the voters, Ayes: Bush, Rodriguez Nays: S t lo-Solis, Morrison, Rios Motion failed. Staff to return within 30 days at a Special Meeting to provide Elections Code Section 9212 report addressing items 1-8 as listed below: (1) Its fiscal impact. 6 (2) Its effect on the internal consistency of the city's general and specific plans, including the housing element, the consistency between planning and zoning, and the limitations on city actions under Section 65008 of the Government Code and chapters 4.2 (commencing with Section 65913) and 4.3 (commencing with Section 65915) of Division 1 of Title 7 of the Government Code, (3) Its effect on the use of land, the impact on the availability and location of housing, and the ability of the city to meet its regional housing needs. Its impact on funding for infrastructure f all types, including, but not limited to, transportation, schools, parks, and open space. The report may also discuss whether the measure would be likely to result in increased infrastructure costs or savings, including the costs of infrastructure maintenance, to current residents and businesses. (5) Its impact on the community's ability to attract and retain business and employment. (6) Its impact on the uses of vacant parcels f land. (7) Its impact on agricultural lands, open space, traffic congestion, existing business districts, and developed areas designated for revitalization. City of National City in the amount of 60,000, Motion carried unanimously.
