AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA,
ADOPTING THE UNIFORM BUILDING CODE, 1988 EDITION,
AMENDING CERTAIN SECTIONS AND APPENDIX CHAPTER 70,
DELETING APPENDIX CHAPTER 12, ADOPTING THE UNIFORM
BUILDING CODE STANDARDS 1988 EDITION; PROVIDING
PENALTIES FOR VIOLATION THEREOF AND AMENDING
ORDINANCE NO. 1908 AND CHAPTER 15.08 OF THE
MUNICIPAL CODE OF THE CITY OF NATIONAL CITY
BE IT ORDAINED by the City Council of the City of National
City as follows:
Section 1. The City Council of the City of National City
hereby adopts the Uniform Building Code, 1988 Edition, and the
Uniform Building Code Standards, 1988 Edition.
Section 2. The City Council of the City of National City
hereby amends certain sections and appendix Chapter 70 and
deletes appendix Chapter 12, of the Uniform Building Code, 1988
Edition and amends Ordinance No. 1908 and Chapter 15.08 of the
National City Municipal Code, to read as follows:

15.08.005 Findings and declaration. The city council
specifically and expressly finds and declares that the nature
and the uniqueness of the climate, terrain, location,
environment, and rate of population growth of the city
necessitates and demands specific changes in, and variations
from the Uniform Building Code, 1988 Edition, which are noted
in and made a part of this chapter.
15.08.010 Code adopted. There is adopted by the city
council, for the purpose of prescribing regulations governing
the erection, construction, enlargement, alteration, repair,
moving, removal, demolition, conversion, occupancy, use,
height, area, fire resistance, and maintenance of all buildings
and/or structures, that certain code known as the Uniform
Building Code except Appendix Chapter 12 and Uniform Building
Code Standards, published by the International Conference of
Building Officials being particularly the 1988 Edition thereof,
save and except such portions as are deleted, added, modified
or amended, of which code one copy has been and is now filed in
the office of the city clerk; and the same is adopted and
incorporated as fully as if set out at length herein, and from
the date on which the ordinance codified in this chapter takes
effect, the provisions thereof shall be controlling within the
limits of the city.

follows:
All Historical structures so designated shall, for the
purpose of enlargement, alterations, repair, moving, removal,
demolition, converging, occupancy, use, and maintenance be made
to comply with Chapter 15.34 Historical Buildings as enumerated
in the National City Municipal Code.

Section 202(c) of the Uniform Building Code is added to read as
follows:
When necessary to make an inspection to enforce any of the
provisions of this code or reasonable cause to believe that
there exist in any building or upon any premises a condition or
code violation which makes such building or premises unsafe,
dangerous or hazardous, the Building Official, San Diego County
Health Department and/or their authorized representatives may
request entry as specified in Chapter 1.12 of the National City
Municipal Code.
15.08.035 Section 203..deleted..Unsafe Buildings or
Structures. Section 203 of the Uniform Building Code is
deleted.
15.08.040 Section 203..added..Unsafe Buildings or
Structures. Section 203 of the Uniform Building Code is added
to read as follows:
Unsafe Buildings or Structures, Section 203.
(a) All buildings or structures regulated by this code
which constitute a fire hazard, or are otherwise dangerous to
human life are, for the purpose of this section, unsafe. Any
use of buildings or structures constituting a hazard to safety,
health or public welfare by reason of inadequate maintenance,
dilapidation, obsolescence, fire hazard, disaster, damage or
abandonment is, for the purpose of this section, an unsafe
use. Parapet walls, cornices, spires, towers, tanks, statuary
and other appendages or structural members which are supported
by, attached to, or a part of a building and which are in
deteriorated condition or otherwise unable to sustain the
design loads which are specified in this code are hereby
designated as unsafe building appendages.
(b) Abandoned buildings or structures or portions
thereof in incomplete condition inherently constitutes a
hazard, is declared dangerous, unsafe, and declared a public
nuisance by reason of unprotected trenches and excavations,
projecting structural elements, open piping systems, exposed
electrical conductors and/or other conditions characteristic of
construction projects.
(c) For the purpose of this section, the term
"incomplete, building or structure", shall be interpreted to
mean any building or structure described herein.
(d) All such unsafe buildings, structures or appendages
are hereby declared to be public nuisances and shall be abated
by repair, rehabilitation, demolition or removal in accordance
with the procedures set forth in the Dangerous Buildings Code
adopted by this jurisdiction. As an alternative, the building
official, or other employee or official of this jurisdiction as
designated by the governing body, may institute any other
appropriate action to prevent, restrain, correct or abate the
violation.
15.08.045 Section 204(a)(b)..deleted..Board of Appeals.
Section 204 of the Uniform Building Code is deleted.
15.08.050 Section 204(a)..added..Advisory and Appeals
Board. Section 204(a) of the Uniform Building Code is added to
read as follows:
The Advisory and Appeals Board is established by City
Ordinance No. 1324 adopted August 1, 1972. The Board shall
have jurisdiction to review the items as enumerated in Chapter
15.04 of the National City Municipal Code.
15.08.055 Section 205..deleted..Violations. Section 205
of the Uniform Building Code is deleted.
15.08.060 Section 205..added..Violations. Section 205
of the Uniform Building Code is added to read as follows:
Violations of any provisions of this code shall be
punishable as a misdemeanor and shall carry the penalties as
prescribed in Chapter 1.20 of the National City Municipal Code.
15.08.06.5 Section 301(b-1)(b-5)..deleted..Exempted Work.
Section 301(b-1(b-5) of the Uniform Building Code is deleted.
15.08.070 Section 301(b-1(b-S)..added..Exempted Work.
Section 301(b-1(b-S) of the Uniform Building Code is added to
read as follows:
(b-1) One story free standing (detached) accessory
buildings used as tool/storage shed, playhouse, patio covers,
greenhouses, kiosks, and shade structures only, not exceeding
one hundred square feet (100 sq.ft.) of area and providing all
required yard requirements are observed as set forth in the
National City Municipal Code.
(b-5) Retaining walls not exceeding three feet (3'-0") in
height measured from the top of existing ground level to the
top of the wall, except where supporting a surcharge or
impounding Class I, II or III -A liquids.
Retaining walls exceeding eight feet (8'-0") in height or
when a part of a building or structure shall be designed by a
licensed architect or engineer in the State of California.
15.08.075 Section 304(b)(c)(e)2..deleted..Fees. Section
304(b)(c)(e)2 of the Uniform Building Code is deleted.
15.08.080 Section 304(b)(c)(e)2 and Subsections (g)(h)
(i)(j)..added..Fees. Section 304(b)(c)(e)2 and subsections
(g)(h)(i)(j) of the Uniform Building Code is added to read as
follows:
(b) Permit Fees. The fees for each permit shall be as
set forth on the schedule entitled, "Building Permit Fees",
adopted by the city.
The determination of value or valuation under any of the
provisions of this code shall be made by the building
official. The value to be used in computing the building
permit and building plan review fees shall be the total value
of all construction work for which the permit is issued as well
as all finish work, painting, roofing, electrical, plumbing,
heating, air-conditioning, elevators, fire -extinguishing
systems and any other permanent equipment.
(c) Plan Review Fees. When plans and/or other data are
required to be submitted by subsection (b) of Section 302, a
plan permit filing fee per Section 15.08.080 shall be paid at
the time of submitting plans and/or other data.
(e)2. Fee: An investigation fee, in addition to the
permit fee, shall be collected whether or not a permit is then
or subsequently issued. The fee shall be as set forth on the
schedule entitled, "Valuation Multipliers".
The payment of such investigation fee shall not exempt any
person from compliance with all other provisions of this code
nor from any penalty prescribed by law.
(g) Compliance Survey Fee. The fee for conducting a
compliance survey of an existing building and/or structure
shall be paid to the city at the rate of $.05 per square foot
area, with a minimum of fifty ($50) dollars for each unit
located in the building and/or structure.
(h) Energy Plan Check Fee. The fee for required energy
plan check shall be as follows:
RESIDENTIAL:
1. Single family $50.00
2. Multiple family $100.00

4. Additions over 300 sq.ft. $50.00
COMMERCIAL AND INDUSTRIAL: $150.00
(i) Permit Filing Fee. A permit filing fee of fifteen
($15) dollars shall be paid for each project submitted to the
city for review.
EXCEPTIONS: The United States, the State of California,
the County of San Diego, the City of National City, and other
public agencies shall not be required to pay any fees for
filing an application for a building permit pursuant to this
code.
(j) Re -inspection Fee. Whenever it shall be necessary
to make an extra inspection to any project due to incorrect
address or any reason enumerated in Section 305(g) a re -
inspection fee per schedule entitled, "Valuation Multipliers"
shall be paid to the city.
15.08.085 Section 30.5(f)..added..0ther Inspections.
Section 305(f)2 of the Uniform Building Code is added to read
as follows:
(f)2. Compliance Survey Inspection. Upon receipt of a
written request for a compliance survey from the owner and
after the fee specified in Section 304(g) has been paid, the
Director of Building and Safety may inspect an existing
building or structure to ascertain its compliance with the
provisions of this code and other applicable laws and
ordinances, and report his findings in writing to such owner.
15.08.090 Section 305(g)..amended..Re-inspections.
Section 305.(g) of the Uniform Building Code is amended by
revising paragraph four of subsection (g) to read as follows:
(g) To obtain a re -inspection, the permittee shall file
an application therefor in writing upon a form provided for
that purpose, and pay the re -inspection fee per schedule
entitled, "Building Multipliers."
In instances where re -inspection fees have been assessed,
no additional inspection of work will be performed until the
fees have been paid.
15.08.095 Chapter 3..deleted..Table 3-A Building Permit

Building Code is deleted.
15.08.100 Chapter 3..added..Building Permit Fees.
Chapter 3, Building Permit Fees of the Uniform Building Code is
added to read as follows:

15.08.105 Section .513..deleted..Premises Identification.
Section 513, Premises Identification of the Uniform Building
Code is deleted.
15.08.110 Section 513..added..Premises Identification.

Code is added to read as follows:
Every principal building or structure located within the
incorporated limits of the City of National City shall be
identified by a designated street number as issued by the
Director of Building and Safety. Approved numbers, or
addresses, shall be placed on all new and existing buildings
adjacent to the principal entrance where the numbers posted at
the entrance shall be posted on the building or at a point that
is plainly visible and legible from the street which is
addressed. If necessary, directional signs shall be posted
showing proper access to a given address, from the point where
the Fire Department access roadway leaves the dedicated street,
to the entrance of each addressed building. All such numbers
shall be placed on a contrasting background.
15.08.115 Section 3204(e)3..added..Special Purpose Roofs
Section 3204(e)3 Special Purpose Roofs of the Uniform Building
Code is amended by adding paragraph 3 to read as follows:
Section 3204(e)3. All wood shakes and/or shingle, new and
re -roofing, installed in the city limits shall conform to the
following:
1. Group R Occupancies, Division 3, wood shakes and/or
shingles shall be Class C fire retardant.
2. Group R Occupancies, Division 1, wood shakes and/or
shingles shall be Class C fire retardant.
2. Group M, Division 1, wood shakes and/or shingles
shall be Class C fire retardant.
4. Group B, Division 1 and 2, wood shakes and/or
shingles shall be Class C fire retardant.
5. When the area of repairs and/or re -roofing exceeds
twenty-five percent of the total roof area for the occupancies
listed above, fire retardant shakes and/or shingles shall be
installed.
15.08.120 Section 3802(a) General..amended..Automatic
Fire Extinguishing Systems. Section 3802(a) General of the
Uniform Building Code is amended by adding paragraph (a) to
read as follows:
In every building regardless of occupancy group or type of
construction, when such building is more than 40 feet or 4
stories in height, all automatic fire extinguishing systems
shall be installed in accordance with the requirements of this
chapter.
15.08.125 Section 5601(e)..added..General..Kiosks.
Section 5601(e) General of the Uniform Building Code is amended
by adding paragraph (e) to read as follows:
Kiosks. Kiosks and/or similar structures within the mall
(temporary or permanent) shall be constructed to the following:
1. Be constructed of non-combustible materials or fire
retardant treated wood.
9. Provided with an automatic sprinkler system if
roofed over in such manner as to obstruct the sprinkler heads
from the main building sprinkler system.
3. Separated from each other a minimum of 20 feet.
4. Area not to exceed 300 square feet.
15.08.130 Appendix Chapter 12 Division I and II..deleted
..Re2uirements for Group 3 and 4 Occupancies. Appendix Chapter
12 Division I and II of the Uniform Building Code is deleted.
15.08.135 Appendix Chapter 3212(E)..amended..Shinles
and Shakes. Appendix Chapter 3212(g) of the Uniform Building
Code is amended by adding paragraph (g) to read as follows:
(g) Wood shingles and/or shakes installed during repairs
and/or re -roofing projects shall conform with the regulations
set forth in Section 3204(e)2 of this code.
15.08.140 Appendix Chapter 70..amended..Excavation and
GradinE. Appendix Chapter 70 Excavation and Grading of the
Uniform Building Code is amended to read as follows:
The term "Building Official" as used therein is amended to
read, "City Engineer of National City."
