ORDINANCE ADOPTING THE UNIFORM FIRE CODE 1988 EDITION, THE
APPENDIX THERETO, AND THE UNIFORM FIRE CODE STANDARDS,
PRESCRIBING REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE
AND PROPERTY FROM FIRE AND EXPLOSION, AND ESTABLISHING A BUREAU
OF FIRE PREVENTION AND PROVIDING OFFICERS THEREFOR AND DEFINING
THEIR DUTIES AND POWERS, REPEALING ORDINANCE NO. 1917 AND ALL
OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH,
AND AMENDING CHAPTER 15.28 OF THE NATIONAL CITY MUNICIPAL CODE
The City Council of the City of National City does ordain as
follows:
Section 1: The City Council of the City of National City
hereby adopts the Uniform Fire code 1988 Edition, the Appendix
thereto, and the Uniform Fire Code Standards.
Section 2: Ordinance No. 1917 of the City of National City
and all other ordinances and parts of ordinances in conflict with
this ordinance are hereby repealed, and Chapter 15.28 of the
National City Municipal Code is amended to read as follows:

15.28.002. FINDINGS AND DECLARATIONS. The City Council of
the City of National City, does hereby specifically and expressly
find and declare that the nature and uniqueness of the climate,
terrain location, environment and rate of population growth in
the City of National City does necessitate and demand specific
changes in, and variations from the Uniform Fire Code, 1988
Edition, which are noted in and made part of this ordinance.
15.28.010 ADOPTED. There is hereby adopted by the City
Council of the City of National City for the purpose of
prescribing regulations governing conditions hazardous to life
and property from fire or explosion and establishing a bureau of
Fire Prevention and providing a certain code known as the Uniform
Fire Code and the appendix thereto, published by the
International Conference of Building Officials and the Western
Fire Chief's Association, being particularly the 1988 Edition
thereof and the whole thereof, save and except such portions as
are hereinafter deleted, modified or amended, of which code not
less than one (1) copy has been and is now filed in the Office of
the City Clerk of the City of National City and the same is
hereby adopted and incorporated as fully as if set out at length
herein, and from the date on which this ordinance shall take
effect, the provisions thereof shall be controlling within the
limits of the City of National City.
15.28.020 ESTABLISHMENT AND DUTIES OF BUREAU OF
FIRE PREVENTION.
A. The Uniform Fire Code shall be enforced by the Bureau of
Fire Prevention in the Fire Department in the City of National
City which is hereby established and which shall be operated
under the supervision of the Chief of the Fire Department,
B. The Fire Marshal in charge of the Bureau of Fire
Prevention shall be appointed by the Chief of the Fire Department
of the City of National City. His/her appointment shall continue
during good behavior and satisfactory service.
C. The Chief of the Fire Department may detail such members
of the Fire Department as inspectors as shall from time to time
be necessary. The Chief of the Fire Department shall recommend
to the City Manager of the City of National City the employment
of technical inspectors, who, when such authorization is made,
shall be selected through an examination to determine their
fitness for the same position.
15.28.030 DEFINITIONS.
A. Wherever the word "jurisdiction" is used in the Uniform
Fire Code, it shall be held to mean the City of National City.
B. Whenever the words "Chief of the Bureau of Fire
Prevention" are used in the Uniform Fire Code, they shall be held
to mean the Fire Marshal of the City of National City.
C. Where reference to the Uniform Building Code or Building
Code is made it shall mean the currently adopted edition.
15.28.040 ESTABLISHMENT OF LIMITS FOR FLAMMABLE LIQUID
STORAGE. Amended.
Establishment of limits of districts in which storage of Class I,
II and III -A flammable or combustible liquids in above ground
tanks is to be prohibited.
A. The limits referred to in Section 79.501 of the Uniform
Fire Code in which storage of Class I, II and III -A liquids in
above ground tanks is prohibited and hereby established as
follows: Al]. areas within the City limits of National City.
B. The limits referred to in Section 79.1401 of the Uniform
Fire Code in which new bulk plants for flammable or combustible
liquids are prohibited, are hereby established as follows: All
areas within the City limits of National City except for MM,
Manufacturing Medium, MH, manufacturing Heavy, MT, Manufacturing
Tidelands as established by the National City Land Use Code.
15.28.050 ESTABLISHMENT OF LIMITS FOR BULK STORAGE OF LPG.
Amended.
Establishment of limits in which bulk storage of liquified
petroleum gases is to be restricted.
The limits referred to in Section 82.104 of the Uniform Fire
Code, in which bulk storage of liquified petroleum gases is to be
restricted, are hereby established as follows: All areas within
the City limits of National City, except MM, Manufacturing
Medium, MH, Manufacturing Heavy, MT, Manufacturing Tidelands as
established by the National City Land Use Code.
15. 8.060 ESTABLISHMENT OF LIMITS FOR STORAGE OF EXPLOSIVES
AND BLASTING AGENTS. Amended.
The limits referred to in Section 77.106(b) of the Uniform
Fire Code, in which storage of explosives and blasting agents is
prohibited are hereby established as follows: All areas within
the City limits of National City.
AMENDMENTS MADE TO THE UNIFORM FIRE CODE:
15. 8.070 Section 14.104. Amended. FIRE ALARM SYSTEMS.
Delete Item number 1 of "EXCEPTIONS" of subsection (c) and
add new paragraph (f) to read as follows:
(f) "Approval. All fire alarm system components and
equipment installed under these provisions shall be State
Fire Marshal approved."
15.28.080 Section 79.605lb). Added. UNDERGROUND TANK TESTING.
Add paragraph 2 to subsection (b) as follows: "Underground
tanks shall be tested for tightness in accordance with San
Diego County Department of Health Services, Hazardous
Materials Management Division and those regulations adopted
by the State of California."

15.28.090 Section 11.112. Added. OUTDOOR BURNING.
Add subsection (c) to read as follows: "All outdoor burning
and incinerator burning shall be done in compliance with the
Rules and Regulations of the San Diego County Air Pollution
Control District."
15.28.100 Section 2.105. Amended. AUTHORITY OF FIRE PERSONNEL
TO EXERCISE POWERS OF A POLICE OFFICER.
Change "powers of a police officer" to "powers of a peace
officer."
15.28.110 Section 2.107. Amended. RIGHT OF ENTRY.
Change to read "...shall fail, neglect or refuse after
proper request is made..."
15.28.120 Section 2.201(a). Amended. INSPECTION AND UNSAFE
BUILDINGS.
Change "The Fire Prevention Bureau" to "The Fire Prevention
Bureau and other Fire Department personnel shall inspect."
15.28.130 Section 4.108. Amended. PERMITS REQUIRED.
Add numbers (h.4) Hydrants and (t.4) Trade Shows:
(h.4) Hydrants. To use a fire hydrant for other than its
intended purpose, a permit is required. Sec. 10.203.
(t.4) Trade Shows. To hold a trade show, exhibit, fair,
concert, convention or vehicle show, a permit is required.
Sec. 25.119.
15.28.135 Section 4.102. Amended. COMMODITIES.
Add subsection (d) to read as follows: (d) "The Chief may
impose a fee for recovery expenses incurred as result of
activities undertaken pursuant to enforcing the fire
prevention provisions of this Code."
15.28.140 Section 10.207. Amended. FIRE DEPARTMENT ACCESS.
(a) No changes.
(b) Where Required. Fire apparatus access roads shall be
required for every building hereafter constructed when any
portion of an exterior wall of the first story is located
more than 150 feet from Fire Department vehicle access as
measured in an unobstructed manner.
(c) through (j) No changes.
(k) Obstructions. The required width of access roadways
shall not be obstructed in any manner, including parking of
vehicles. Where no space is provided for parking along
access roadways, they shall be kept clear as follows:
1. Owners and/or property representatives shall be required
to identify and mark fire lanes to the satisfaction and
approval of the Fire Department. This requirement shall be
marked on the approved plans and complied with in the field.
2. The entrance to all required Fire Department access
roads shall be posted with approved signs. A maximum
distance of 100 feet shall be required in the spacing of
signs along the length of the Fire Department access road.
The placing of signs shall be subject to the approval of the
Fire Department.

3. When applicable, all curbing which outlines the access
roads shall be painted red. White lettering reading "NO
PARKING - FIRE LANE" shall be a minimum of 4 inches tall and
shall be placed every 30 feet or portion thereof, on top of
designated curbing or striping. Additional striping for
Fire Department access roads may be required under special
conditions (i.e. areas in front of garages and parking
spaces). The minimum width of this red striping shall be 8
inches with white lettering.
4. Fire Department access areas for appliances, such as
hydrants, standpipe inlets, sprinkler valves, etc. shall
only require marking per Item number 3. Fire hydrants shall
be maintained yellow in color.
(1) Signs - is deleted.
(m) Buildings Over 35 Feet High - is added. Required
access roadways shall be kept a minimum of 26 feet in width
in the immediate vicinity of any building over 35 feet in
height above natural grade. Required access roadways shall
be located within a minimum 15 feet and a maximum of 25 feet
from the building, and shall be positioned parallel to one
entire side of the building.
15.28.150 Section 10.208. Amended. PREMISES IDENTIFICATION.
"Approved numbers or addresses shall be placed on all new
and existing buildings adjacent to the principle entrance.
Where the numbers posted at the entrance are not easily
visible from the street, additional numbers shall be posted
on the building or at a point that is plainly visible and
legible from the street on which is addressed. If
necessary, directional signs shall be posted showing proper
access to a given address, from the point where the Fire
Department access roadway leaves the dedicated street, to
the entrance of each addressed building. All such numbers
shall be placed on a contrasting background."
15.28.160 Section 10.301(d). Amended. FIRE HYDRANT MARKERS.
(d) Fire Hydrant Markers. When required by the Chief,
hydrant locations shall be identified by the installation of
reflective blue -colored markers affixed to the roadway
surface adjacent to the hydrant. The use of reflective blue -
colored markers for any other purpose shall be prohibited.
15.28.165 Section 10.306. Amended. AUTOMATIC FIRE
EXTINGUISHING SYSTEMS.
(a) No Changes.
(b) Add items (5) and (6):
(5) Throughout all buildings four (4) stories or more in
height except in R-1 occupancies, see subsection (h).
(6) Throughout all buildings which have a required fire
flow in excess of 2500 gallons per minute (GPM).
(c) through (h) No Changes.

(d) is added to read as follows: Conflicts with the Uniform
Building Code. Where the provisions of this chapter
conflict with the currently adopted Uniform Building Code,
the more stringent provisions shall apply, this is to say,
the provisions offering the greatest fire and life safety
protection shall apply.
Where automatic sprinkler systems are provided throughout
buildings, required fire flows may be reduced by as much as
75%. All such reductions should be predicated on recognized
standards and recommendations of the public fire protection
grading and rating agencies providing that service.
All required fire flows are to be available at a minimum 20
pounds per square inch (PSI) residual operating pressure.
15.28.170 Section 10.309. Amended. SPRINKLER SYSTEM ALARMS.
Add paragraph 3 to read as follows: "When deemed necessary
by the Chief, sprinkler systems serving less than 100 heads
with a special hazard, shall be supervised by an approved
central, proprietary or remote station service or local
alarm which will give an audible signal at a constantly
attended location."
15.28.175 Section 10.313(d). Amended. PORTABLE FIRE
EXTINGUISHERS.
(d) Portable Extinguishers. In addition to the fixed
system, a dry chemical (sodium bicarbonate or potassium
bicarbonate base) portable fire extinguisher which has a
rating of not less than 40-B shall be installed near the
food processing equipment. For additional portable fire
extinguishers, see UFC Std. #10-1.
15.28.180 Section 10.314. Added. PRE -FIRE AND EMERGENCY
PLANNING.
Owners, operators, tenants, administrators and managers of:
educational and institutional occupancies; hotel and
apartment occupancies containing 15 or more units and all
high-rise buildings, shall when required by the Fire Chief
or his designated representative, establish pre -fire and
emergency procedures and plans which shall include but not
be limited to the following:
1. Designation of a responsible person as Safety Director
who shall work with the Fire Chief in the establishment,
implementation and maintenance of pre -fire emergency plans.
0 Preparation of pre -fire and emergency plans which shall
be designed and implemented in accordance with the approval
of the Fire Department.
15.28.185 Section 11.105. Amended. TYPES AND CONSTRUCTIONS OF
INCINERATORS.
(a) Every incinerator used shall comply with the provisions
of this section.
(b) Commercial or industrial incinerators, when permitted
shall be constructed in accordance with the provisions of
the Building and Mechanical Codes and shall be located a
minimum of 20 feet from any buildings and/or property line
and shall not obstructed any required path of exit travel.
(c) Every incinerator shall be equipped and maintained with
a spark arrestor constructed constructed of iron, heavy wire
mesh or other noncombustible material, with openings not
larger than 1/2 inch.
(d) Every incinerator shall be constructed and maintained
in accordance with the requirements of any air pollution
district having jurisdiction.
15.28.190 Section 11.106. Amended. RESIDENTIAL INCINERATORS.
Residential incinerators are strictly prohibited.
15.28.200 Section 11.107. Amended. INCINERATORS.
Incinerators in a trailer camp, mobile home park or
permanent camping park are strictly prohibited.
15.28.210 Section 11.110. Deleted. RESTRICTED USE OF
INCINERATORS.
15.28.220 Section 11.111. Amended. CHIMNEY SPARK ARRESTORS.
Each chimney used in conjunction with any fireplace or any
heating appliance in which solid or liquid fuel is used upon
any cabin house, hotel, building or structure shall be
maintained with a spark arrestor as required for
incinerators.
15.28.230 Section 11.112. Amended. HOURS OF BURNING.
Delete "EXCEPTIONS."
15.28.240 Section 11.11S. Amended. ATTENDANT FOR FIRE.
Accept in an approved incinerator, open burning shall be
strictly prohibited.
15.28.250 Section 11.204. Amended. FLAMMABLE DECORATIVE
MATERIALS.
(a) Existing language is hereby labeled (a).
(b) Cut Trees.
1. No person shall flameproof or apply fire resistive
treatment to any cut tree required to be flameproofed by
this section unless such person has been issued a permit.
2. The Chief may give an examination to determine that the
applicant possesses the necessary qualifications required to
perform a satisfactory job of flameproofing or providing
fire resistive treatments.
3. In the flameproofing or fire resistive treatment of any
cut tree, only such chemicals or compounds or methods of
treatment as are approved by the Chief shall be used.
4. Following the flameproofing of fire resistive treatment
of any cut tree, there shall be firmly affixed thereto, on
the base of the tree, a tag or label, which shall contain
the following information:
1. Name of the person performing the treatment.
Firm of business name and address.
iii. Name or description of chemical or compound used
for treatment.
iv. Date of application.
v. Each tag or label shall be serially numbered and
a record kept thereof.
S. Each person, firm or corporation giving flameproofing or
fire resistive treatment shall maintain a written list of
all such work performed giving the serial number of the tag
or label attached to the tree, and the name and address of
the person, firm or corporation for whom the work was
performed and the date of treatment and location where the
tree is to be placed.
EXCEPTION: Cut trees three (3) feet or less in height when
approved by the Chief.

15.28.260 Section 11.210. Added. VEHICLES LEAKING FUEL.
When any vehicle is leaking fuel and it is impracticable to
stop such leaking, and such leaking creates a fire hazard as
defined in this Code, the Chief may order the removal of the
vehicle from a highway or from public or private property
and take action to mitigate the hazard at the owner's
expense.
15.28.270 Section 11.302. Amended. COST RECOVERY FOR FALSE
ALARMS.
Add new subsection (e): (e) Cost Recovery for False
Alarms. The Chief shall adopt and assess such alarms
received due to the action of any mechanical or electrical
alarm device, when the frequency of such false activations
is beyond five (5) a month and prior notification by the
Fire Department has been issued.
15.28.280 Section 11.404. Amended. UNVENTED FUEL BURNING
APPLIANCES.
Add new subsection (e): (e) Unvented Fuel Burning
Appliances. Unvented fuel burning appliances shall not be
installed, used, maintained or permitted to exist in any
occupancy.
15.28.290 Section 11.412. Amended. VACANT BUILDINGS.
Existing language is hereby labeled (a).
(b) Right to Secure. In the event the owner shall fail,
neglect or refuse to remedy any condition which renders a
structure unsecured, the Chief may order the owner of such
structure prosecuted as a violator of the provisions of
these Sections and/or may proceed to cause the
accomplishment of the necessary remedial work or
demolition. A record of the cost of all such work performed
shall be transmitted to the City Council, who shall cause
the same to be paid and levied as a special assessment
against the property.
15.28.300 Section 12.104. Amended. DOORS.
Change "building official" to "enforcing authority" in part
(b) EXCEPTIONS, last sentence.
15.28.305 Section 25.119. Added. REQUIREMENTS FOR EXHIBITS,
FAIRS, TRADE SHOWS, VEHICLE DISPLAYS INSIDE BUILDINGS, HAUNTED
HOUSES AND SIMILAR TEMPORARY INSTALLATIONS.
(a) Permits. A permit shall be required to operate an
exhibit, fair, trade show, vehicle display inside a
building, a haunted house or similar temporary installation.
(b) Aisles. Aisles of a minimum of ten (10) feet in width
must be maintained at all times. The line of travel to an
exit door by an aisle shall not be more than 150 feet.
(c) Exits. Exhibits, fairs, trade shows, vehicle displays,
haunted houses and other similar temporary installations
shall not be placed in lobbies, foyers or the required width
of an exit way.
(d) Vehicle Displays. The display in any public building,
other than those constructed and classified by the Uniform
Building Code for such use of automobiles, motorcycles,
scooters or other fuel operated vehicles shall meet the
following requirements:
1. The battery shall be disconnected and the battery cable
placed or tied in a position to prevent accidental battery
contact.
2. Fuel tanks shall be equipped with a key locking cap or
other device (duct tape) approved by the Fire Marshal. Fill
caps that are inaccessible may be approved without a key or
other locking devices by the Fire Marshal.
3. For vehicle shows inside buildings, the following shall
be required:
(a) Vehicle gas tanks shall not contain more
than one (1) gallon of fuel.
(b) Vehicles shall be pushed into display area
and pushed out of display area upon termination
of exhibit unless otherwise approved by the Fire
Marshal.
(e) Haunted Houses and Similar Temporary Installations.
1. General. Haunted houses or other similar installations
such as fun houses, etc., set for temporary use not to
exceed 90 days inside a structure not designed for this
specific use, shall comply with the requirements of this
section and all other applicable provisions of this code.
2. Requirements. Haunted houses and similar temporary
installations shall comply with the following:
(a) In any facility using the maze concept,
there may be no dead-end corridors and there
must be an obvious exit out of the maze for
approximately every SO feet of linear travel.
All stairways must be illuminated at a level of
at least one footcandle.
(b) A group shall consist of not more than 20
persons. Each group of children age 12 and
under must be accompanied or supervised by a
staff person who is 18 years of age or older.
This staff person must have in his/her
possession an operable flashlight and should be
completely familiar with the facility.
(c) There shall be no smoking allowed at any
time by anyone inside the building.
(d) All electrical installations must meet the
Electrical Code.
(e) The Fire Department must be contacted prior
to the placing of the facility in operation for
an inspection and planning of evacuation
procedures. Sketch shall be provided to the
Fire Department to accommodate these procedures.
(f) Total number of occupants in the facility
at any time shall be limited to the number
allowed by the total exits from the building.
(g) There shall be no open flame devices or
temporary heaters used in the building.

15.28.301 Section 32.110. Amended. STANDBY PERSONNEL.
Shall read as follows: "Qualified persons shall meet the
requirements in Section 25.117."
15.28.315 Section 45.207. Deleted. LIMITED SPRAYING AREAS.
This section is deleted in its entirety.
1.5.28.320 Section 61.106(c). Amended. PORTABLE UNVENTED OIL -
BURNING HEATING APPLIANCES.
(c) Where Permitted. Portable unvented oil -burning heating
appliances shall not be installed, used, maintained or
permitted to exist in any occupancy.
15.28.330 Section 79.115(f). Amended. ABANDONMENT AND STATUS
OF TANKS.
Paragraph 1 shall read as follows: "Any underground tank
which has been out of service for a period of one (1) year
shall be removed from the ground in a manner approved by the
Chief and the site restored in an acceptable manner. In
circumstances where tank removal will cause structural
damage to surrounding buildings and the Chief gives
approval, the tank may be filled in place in accordance with
Nationally Recognized Standards."
15.28.340 Section 79.201(E-2). Amended. STORAGE CABINETS.
2. Quantities. The quantity of Class I or Class II liquids
shall not exceed 60 gallons and the total quantities of all
liquids in a storage cabinet shall not exceed 120 gallons.
EXCEPTION: Quantities shall not exceed those amounts listed
in Table 9-A of the Uniform Building Code.
15.28.350 Section 79.702. Amended. CORROSION PROTECTION.
Delete the words "coated or" in the first sentence.

15.28.360 Section 80.101. Amended. HAZARDOUS MATERIALS.
Add item number 3 to EXCEPTION in first paragraph to read:
(3) A maximum quantity of 200 pounds of solid or 20 gallons
of liquid Class 3 oxidizers may be permitted in I, M and R
occupancies, when such materials are necessary for
maintenance purposes or operation of equipment. The
oxidizers shall be stored in approved containers and in a
manner approved by the Chief.

15.28.370 Section 80.301(o-2). Amended. HAZARDOUS MATERIALS
STORAGE CABINETS.
(o) 2. "Construction. Cabinets may be constructed of wood
or metal. Cabinets shall be listed or constructed in
accordance with the following:"
A. No Changes.
B. Wooden Cabinets. Wooden cabinets, including
the doors, shall be of not less than one (1)
inch Exterior Grade plywood, or equivalent,
which is compatible with the material being
stored. Doors shall be well fitted, self -
closing and equipped with a latch. The bottom
of the cabinet designed for he containment of
liquid shall be liquid tight to a height of at
least two (2) inches. Cabinets shall be painted
with an intumescent -type paint.
15.28.375 Section 80.301(y-1). Amended. GENERAL REQUIREMENTS.
(y) 1. Change "section 10.107" to read "section 10.207" for
Fire Access Roadways.
15.28.380 Section 80.306-A. Amended. HAZARDOUS MATERIALS
LIQUIDS AND OXIDIZERS.
Footnotes to Table 80.306-A shall read as follows. Footnote
3 is added:
Footnote: 1. No exempt amounts of Class 4 oxidizers are
permitted in Group R occupancies or offices or retail sales
portions of Group B occupancies.
Footnote: 2. No exempt amounts of Class 4 oxidizers are
permitted in Group A, E, I or M occupancies or in classrooms
of Group B occupancies unless storage is within a hazardous
materials storage cabinet containing no other storage.
Footnote: 3. A maximum quantity of 200 pounds of solid or
20 gallons of liquid Class 3 oxidizers may be permitted in
I, M and R occupancies, when such materials are necessary
for maintenance purposes or operation of equipment. The
oxidizers shall be stored in approved containers and in a
manner approved by the Chief.
15.28.385 Section 80.313. Amended. BREATHING APPARATUS.
(c) Where radioactive materials are stored, a minimum of
two self contained breathing apparatus shall be provided,
when required by the Chief. The breathing apparatus shall
be suitable for use with the material stored and shall be
located near the immediate area of storage in a location
that provides safety to those expected to don the
apparatus. A safe area is one which is not likely to be
immediately affected by the release of the hazardous
material in the area of concern.
(d) Radioactive material shall be secured against
unauthorized removal from places of storage and shall be
provided with reasonable protection against loss, leakage or
dispersion by the effects of fire or by water, hose streams
or other means used to fight fire.

15.28.390 Section 81.112. Added. STORAGE OF EMPTY WOODEN OR
PLASTIC PALLETS.
(a) Outdoor Storage. Pallets shall be stored outside of a
building or in a detached building whenever possible.
Pallets shall not be stacked closed that five (5) feet from
the building.
(b) Indoor Storage. Pallets when stored indoors shall be
protected with sprinklers in accordance with NFPA Std. 231,
Table 4-4.1.2 unless both of the following conditions are
met:
1. Pallets are stored no higher than six feet.
2. Each pallet pile of no more than four (4)
stacks shall be separated from other pallet
piles by at least eight (8) feet of clear space
or 25 feet of commodity.
15.28.395 A22endix I-A(1.b). Amended. LIFE SAFETY FOR EXISTING
BUILDINGS.
Add "EXCEPTION" to end paragraph: "EXCEPTION: All smoke
detectors shall be installed immediately upon notification
accordance with Appendix I -A (6)."
15.28.400 A22endix I-A(5). Amended. STANDPIPES.
5. Standpipes. Any building four (4) stories or more in
height shall be provided with an approved Class I or III
standpipe system.
15.28.410 APPEALS.
Section 2.303 of the Uniform Fire code is hereby amended as
follows: The Board of Appeals shall determine the suitability of
alternate materials and methods of construction, provide
reasonable interpretations of the provisions of the code and
shall recommend to the City Council such new legislation as is
consistent therewith.
The decisions of the Fire Chief and/or Fire Marshal in
interpreting the provisions of this code, the refusal to issue
any permit required by the code and any action in issuing
correction notices or notice to abate a public nuisance of fire
hazard may be appealed to the Board of Appeals.
15.28.420 NEW MATERIALS, PROCESSES OR OCCUPANCIES WHICH MAY
REQUIRE PERMITS.
The City Manager, the Chief of the Fire Department and the
Fire Marshal shall act as a committee to determine and specify,
after giving effected persons an opportunity to be heard, any new
materials, processes or occupancies which shall require permits
in addition to those now enumerated in said code. The Fire
Marshal shall post such list in a conspicuous place in his/her
office and distribute copies thereof to interested parties.
15.28.430 PENALTIES.
Any person who shall violate any of the provisions of the
Uniform Fire Code hereby adopted or fail to comply therewith or
who shall violate or fail to comply with any order made
thereunder, or who shall build in violation of any detailed
statement of specifications or plans submitted and approved
thereunder, and from which no appeal has been taken, or who shall
fail to comply with such an order as affirmed or modified by the
City Council or by a court of competent jurisdiction is guilty of
a misdemeanor.

15.28.440 REPEAL OF CONFLICTING ORDINANCES.
All former ordinances or parts thereof conflicting or
inconsistent with the provisions of this ordinance or of the Code
or Standards hereby adopted are hereby repealed.
15.28.450 VALIDITY.
The City Council of the City of National City hereby
declares that should any section, paragraph, sentence or work of
this ordinance or of the Code or Standards hereby adopted be
declared for any reason to be invalid, it is the intent of the
City Council of the City of National City that it would have
passed all other portions of this ordinance independent of the
elimination here from of any such portion as may be declared
invalid.
15.28.460 DATE OF EFFECT.
This ordinance shall take effect and be in force from and
after its approval as required by law.
