I,950 AN ORDINANCE REZONING CERTAIN PARCELS OF REAL PROPERTY PURSUANT TO THE LAND USE CODE OF THE CITY OF NATIONAL CITY, IN THE CALTRANS (I-5) RIGHT-OF-WAY, ON THE NORTH SIDE OF CIVIC CENTER RIVE AND WEST OF THE MTDB TROLLEY (GP-3-87 AND ZC-3-87) WHEREAS, pursuant to the terms and provisions of the Government Code of the State of California, proceedings were duly initiated for the rezoning of the parcels of real property, hereinafter described, and for the amendment of the General Plan of the City of National City; and WHEREAS, pursuant to legal notice, hearings were held by the Planning Commission of National City and also by the City Council of National City, and all persons interested were given the opportunity to appear and be heard before said Planning Commission and City Council; and WHEREAS, the Planning Commission of National City has regularly and duly certified to the City Council its report and recommendation regarding such rezoning and such amendment; and WHEREAS, the City Council found that on the basis of the Initial Study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment and adopted a proposed Negative Declaration which addresses both said General Plan amendment and rezoning; and WHEREAS, the City Council finds the rezoning consistent with and necessary to implement the General Plan; NOW, THEREFORE, the City Council of the City of National City, California does ordain as follows: Section 1. All protests, if any, against said rezoning and said amendment to the General Plan, and each of them be and hereby are denied and overruled. Section 2. That all the real property described below is hereby rezoned as follows: From OS (Open Space) to ML-PD (Light Manufacturing -Planned Development) for approximately 0.5 acres of property located in the Caltrans (I-5) right-of-way, on the north side of Civic Center Drive, west of the MTDB trolley, and for adjacent street right-of-way, as more fully described in the legal description attached and made a part hereof as Exhibit "A", Case File No. ZC-3-87; and Section 3. That a Notice of Determination shall be filed indicating that the rezoning will not have a significant effect on the environment. PASSED AND ADOPTED this 28th day of June , 1988 . Legal Description of Property: Those portions of Lots 13 through 19 in Block 205, of Map of National City, the City of National City, County of San Diego, State of California, according to Map Number 348, filed in the Office of said County Recorder of San Diego County, October 2, 1882 TOGETHER with that portion of Taft Avenue (formerly 6th Ave.) and 12th Street as shown on said Map Number 348, described as follows: Beginning at the Southeasterly corner of Director's Deed to Dwight and Annis Wineteer recorded May 4, 1966, F/P 75334 in the Office of the County Recorder of San Diego County; thence (1) along the Easterly line of said Director's Deed and it's Northerly prolongation N.08°24'24"E., 351.70 feet to the Northerly prolongation of the Westerly line of Block 180 according to said Map Number 348; thence (2) along last said Northerly prolongation and last said Westerly line, S.17°45'40"E., 315.66 feet to the Southwest corner of said Block 180; thence (3) leaving said Southwest corner along the Westerly prolongation of the Southerly line of block 180, and the Southerly line of Block 205 S.72°14'25"W., 155.10 feet to the Point of Beginning. The bearings and distances used in the above descriptions are on the California System, Zone 6. And also: The northerly half of Civic Center Drive (formerly 13th Street) adjacent to the Southerly line of said Block 205 and its Easterly and Westerly prolongations. Said northerly half of Civic Center Drive is to be bounded to the west by the Southwesterly prolongation of the Easterly line of aforesaid Director's Deed to Dwight and Annis Wineteer and bounded to the East by the Southerly extension of the west line of said Block 180.
