HomeMy WebLinkAboutCC ORD 1988-1957 Submission of question to voters (Special)ORDINANCE NO. 1957 IN THE MA'1.ri. it OF CALLING AN ELECTION IN THE CITY OF NATIONAL CITY FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF THE CITY A PROPOSITION CONCERNING THE ABANDONMENT AND DISCONTINUANCE OF "Q" AVENUE PARK, FIXING THE DATE OF THE ELECTION, THE MANNER OF HOLDING THE ELECTION, THE PROCEDURE FOR VOTING FOR AND AGAINST THE PROPOSITION, AND ORDERING IT CONSOLIDATtli WITH THE STATEWIDE GENERAL ELECTION THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DOES ORDAIN AS FOLLOWS: WHEREAS, the City Council of the City of National City held a hearing on August 11, 1988 to consider all protests concerning the abandonment and discontinuance of "Q" Avenue Park; and WHEREAS, at said hearing, the City Council determined that the public interest or convenience requires the discontinuance of "Q" Avenue Park, to overrule all protests, to abandon and discontinue "Q" Avenue Park, and to sell the land on which it is located as surplus, for the proceeds of such sale to be devoted to park purposes. NOW, THEREFORE, IT IS ORDERED, as follows: 1. An election is called and ordered and shall be held in the City of National City on Tuesday, November 8, 1988. At that election, there shall be submitted to the qualified voters of the city the question of the abandonment and discontinuance of "Q" Avenue Park, the sale of the land on which it is located as surplus, and for the proceeds of such sale to be devoted to park purposes, as set forth in the following proposition: CITY OF NATIONAL CITY ABANDONMENT AND DISCONTINUANCE OF "Q" AVENUE PARK: Shall an ordinance be adopted providing for the abandonment and discontinuance of "Q" Avenue Park, for the sale of the land on which it is located as surplus, and for the proceeds of such sale to be devoted to park purposes? YES NO 2. The City Council submits to the qualified voters at the election this ordinance and the proposition set forth in section 1. 3. If the proposition receives approval by the applicable vote majority required, the proposition is adopted and there shall be adopted an ordinance providing for the abandonment and discontinuance of "Q" Avenue Park, and for the sale of the land on which it is located as surplus. 4. The election shall be held and conducted, the votes canvassed, the returns thereof made, and result determined as provided in this ordinance and in all particulars not prescribed by this ordinance the election shall be conducted as other city elections. 5. The election hereby called is ordered consolidated with the statewide general election to be held in the City on Tuesday, November 8, 1988. The election precincts, polling places and voting booths shall be the same and there shall be only one set of election officers in each of the precincts. The elections shall be held in all respects as if there were only one election. Only one form of ballot shall be used. 6. All persons qualified to vote at the general municipal election shall be qualified to vote upon the proposition submitted at the election hereby called. 7. Ballots for the election shall be provided in the form and in the number provided by law. On the ballot, in addition to any other printed matter required by law, opposite the statement of the measure to be voted upon and to its right, the words "YES" and "NO" shall be printed on separate lines, with voting squares. If a voter stamps a cross (+) in the voting square after the printed word "YES", his or her vote shall be counted in favor of the measure. If he or she stamps a cross (+) in the voting square after the printed word"NO", his or her vote shall be counted against the measure. Absentee ballots may be marked with pen and ink or pencil. 8. The hours of opening and closing the polls shall be the same as provided for the statewide general election. 9. The Registrar of Voters of the County of San Diego, with the cooperation and assistance of the City Clerk of National City, is directed to obtain supplies necessary for the proper conduct of the election and to have prepared and mailed a sample ballot and precinct polling place card to each voter within the city, in the time and manner provided by law. 10. The Registrar of Voters of the County of San Diego, with the cooperation and assistance of the City Clerk of National City, shall fix and determine a reasonable date prior to the election after which written arguments for or against the measure may be submitted to the City Clerk, and shall cause any arguments for or against the measure to be printed and enclosed with the sample ballot under Elections Code sections 5010-5015. 11. The City Clerk shall publish or post a synopsis of the measure to be voted on in 3 public places in the city pursuant to Elections Code section 22835. 12.
